SAN JUAN COUNTY COMMISSION MEETING MINUTES SEPTEMBER 26, 1994 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk Excused: Bill Redd, Commissioner A motion to approve the minutes of the September 19, 1994 meeting as amended was made by Commissioner Maryboy and seconded by Chairman Ty Lewis. UNANIMOUS. Lt. Bill Christensen/Sheriffs Office Lt. Christensen discussed with the Commission Sergeant and Corporal position descriptions for the Sheriffs department including shift coverage and how they relate to one another. In twelve out of eighty-four shifts the Corporal is on duty when the Sergeant is on duty. A lieutenant and sergeant are on day duty together. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT There will be a Canyon Country Partnership meeting on September 27, 1994 at the BLM District office in Moab. On October 17, 1994, there will be a state-wide planning seminar in Cedar City. Planning Planner Scherick and Commissioner Bill Redd attended a planning workshop in Castle Dale on September 20, 1994. The Sonoran Institute presented ideas on understanding the relationship between where counties are and where they want to go. It was stated that it is important to have hometown heros, a quality of life lobby, responsible developers, smart communities and new economic realities. Mr. Scherick attended the Canyon Country Partnership subcommittee meeting on September 21, 1994 in Price discussing the Energy Corridor proposal by Dr. Merrill Ridd. Planner Scherick was asked by Commissioner Redd to present the idea that after discussing with other counties and UAC that it might be to the County's best interest to file a "Quiet Title" claim on ALL roads in San Juan County. This would in effect place the burden of proof on the Federal Agencies to prove that the County did not have the title to the roads in question and the widths designated by state laws. Commissioner Mark Maryboy made a motion to proceed with Commissioner Redd's recommendation to file "Quiet Title" on all roads in San Juan County. Chairman Ty Lewis seconded. UNANIMOUS. Personnel The North Road Foreman position has been advertised and will close on October 10, 1994. The Personnel/Planning Clerk position will close on October 7, 1994. Interviews for the Blanding Senior Citizen Director will be on September 28, 1994. Rick Lamb/Subdivision plat Mr. Lamb presented one modification to the Bridger Jack Subdivision plat to equalize lot size. The covenants state that buyers will have to fence cows out if they want them out. Also that the County is not responsible for any roads in the subdivision. Commissioner Mark Maryboy made a motion to approve the Bridger Jack Subdivision plat with changes and covenants attached. Chairman Ty Lewis seconded. UNANIMOUS. James W. Hurst/Spanish Trail Estates Mr. Hurst presented his Spanish Trail Estates subdivision plat for approval. Commissioner Mark Maryboy made a motion to approve the subdivision. Chairman Ty Lewis seconded. UNANIMOUS. Aging Director Frank Morrell/ Senior Employment Program Aging Director Frank Morrell discussed with the Commission the Title V Senior Employment Program and the unused slots that are available. It was decided that the banked slots could be assigned to Soapy's Gallery until they run out at the end of the contract. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT Mr. Tapaha reported that he has a copy of the proof of the election ballot. He is working on the interpretation of tax issues and propositions that appear on the ballot. He attended the San Juan Health Care Service District meeting. Indian Health Service made a three year contract with San Juan Health Care district who submitted the low bid for services at Montezuma Creek. Also discussed was the future of Monument Valley Hospital. Mr. Tapaha attended the Utah Navajo Trust Board meeting discussing chapter allocation, scholarship applications and the decrease in royalty on oil wells. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Administrative Assistant Rick Bailey proposed trying an Action Item List in Commission meeting to help keep track of actions to be taken. These would be written down on this form and attached to the minutes and reviewed each week to see if action have been taken. The grader that Mr. Bailey reported on last week is not a county grader. On October 10, 1994 there will be a meeting concerning a road to the proposed marina site and to tie back in at Oljato. Propane Heater/Cal Black Airport Mr. Bailey discussed with the Commission a propane heater to be placed at the Cal Black Airport to replace an electric heater. A quote was received from Petrolane for $890. Commissioner Mark Maryboy made a motion to approve the purchase of the heater. Chairman Ty Lewis seconded. UNANIMOUS. Sign Permit Mr. Bailey submitted for signature a request by Twin Rocks Trading Post to move existing signs to different locations. Commissioner Mark Maryboy made a motion to approve the permit. Chairman Lewis seconded. UNANIMOUS. Mexican Hat Service District/Transfer Station Mexican Hat Service District has been asked to look at a proposed site for their solid waste transfer station. The County has received a letter stating that the community preference site for the new transfer station be at the existing dump. The County is still waiting to hear from Bluff with their suggestions. State Bookmobile Mr. Bailey has contacted the State Bookmobile concerning the rumor that it might close. Federal funding for library programs will be reduced after 1995 with concerns not only for the bookmobile but also other state programs. Dump Trucks The County has ordered four dump trucks that will be coming with a cab and chassis. The Commission agreed to buy the beds for the trucks from the state bid sheet. Meetings Rick Bailey will meet with Brian Bremner in Panguitch on Wednesday, September 28, 1994 reviewing their current landfill and to go over planning and design documents for San Juan County's landfill. He will attend the RC&D meeting in Green River on September 29, 1994. On Monday, October 3, 1994, he will be attending the Governors Conference on Emergency Management in Park City. Building Permit A permit for LaSal Livestock, LaSal, to move an existing home onto a new basement was presented. Another permit for LaSal Livestock, LaSal, to move an existing cabin on to a new foundation was presented. Commissioner Mark Maryboy made a motion to approve the permits. Chairman Ty Lewis seconded. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Last week Mr. Maryboy met with the County Economic Development Board. Commissioner Maryboy would like to recommend Chavez Nez of Aneth to be appointed to the board. The Commission requested that Mr. Nez write a letter asking for appointment to the board. Commissioner Maryboy met with Senator Hatch in Salt Lake City concerning the Native American Religious Freedom Act. Mr. Maryboy went to Washington DC last week to attend the National Advisory on Education Council. While there he met with Senator Hatch and Congressman Orton and discussed with them Indian Health Care and having the Indian Health Service assume responsibility for Native American health care in San Juan County. Meetings Mr. Maryboy will be in Window Rock on September 27, 1994. On September 29-30, 1994 in Gunnison, Utah there will be a meeting with a new organization called Utah Tribal Leaders.
