SAN JUAN COUNTY COMMISSION MEETING MINUTES OCTOBER 24, 1994 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk Excused: Ty Lewis, Chairman A motion to approve the minutes of the October 11, 1994 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. There will be no Commission meeting held on October 31, 1994 due to it being the fifth Monday. Joyce Martin/ Blanding Library Joyce Martin, President/Library Board, reported to the Commission that Bonnie Black, Blanding Librarian has resigned effective October 25, 1994. Joyce Martin requested that the assistant librarian, Barbara Roberts, be paid librarian wages until a new librarian is selected. Commissioner Bill Redd made a motion to appoint Barbara Roberts as temporary librarian with entry at Grade 4 Step 1, not to exceed 120 days. Commissioner Mark Maryboy seconded. UNANIMOUS. Personnel Director Edward Scherick will post the librarian vacancy announcement in-house before going to the public. Applications will be received until November 4, 1994. Aging Director/Frank Morrell Aging Director Frank Morrell discussed with the Commission the commodities contract & program for San Juan County. Mr. Morrell recommended that the commodities be assigned to Blue Mountain Dine' providing the State would accept Blue Mountain Dine' as the agent. Commissioner Bill Redd made a motion to accept the proposal as long as Blue Mountain Dine' is willing to help the people who are unable to get to Blue Mountain Dine' to pick up their commodities. Commissioner Mark Maryboy seconded. UNANIMOUS. Fire Warden/Frank Morrell Mr. Morrell reported that a flexible porta-tank had been lost at the Haller Fire. He has contacted the other agencies involved and has been unable to locate it. He presented bids from L.N. Curtis for a 1500 gallon tank for $860 and from Ross Equipment for $875. The State will pay half of the purchase price as the County has over- spent their fire budget. Commissioner Bill Redd made a motion to accept the low bid from L.N. Curtis. Commissioner Mark Maryboy seconded. UNANIMOUS. Jerald Mikesell/San Juan School District-ADA San Juan School District Superintendent Jerald Mikesell acting in behalf of the Interagency Council would like the Commission to appoint an advisory committee to review and make judgements on ADA needs on a county- wide basis. This committee would meet together as needed. The Commission tabled the idea until they could talk with County Attorney Craig Halls concerning county liability. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Administrative Assistant Rick Bailey reported that a public hearing for a variance was held on October 17, 1994 for Marlene A. Huckabay and Steve Bathemess to move a modular home on to their property in Spanish Valley. Commissioner Bill Redd made a motion to accept the variance. Commissioner Mark Maryboy seconded. UNANIMOUS. Mr. Bailey received a fax copy of a targeted allocation fund application from USU Cooperative Extension Service Expanded Food & Nutrition Program asking that the County approve it. This program is designed to reach limited resource audiences especially youth and families with young children. The decision was tabled. Mr. Bailey will meet with Julie Orr of Indian Health Service in Shiprock to work on the proposed ordinance for the County landfill. They will also discuss the draft contract from Indian Health Service that provides the County funding for the landfill. CIB/Bond In connection with the funding from the CIB for the landfill a public hearing will be held in November to meet the requirements for the bond. Dump Trucks The state contract on the beds for the dump trucks is wrapping up. The trucks should arrive approximately January l, 1995 and the beds will then be placed on them. The County expects delivery the end of January. Miles Moretti/Division of Wildlife Mr. Moretti discussed with the Commission some DWR concerns. There were approximately half the amount of the hunting permits issued than were previously issued. The Ute Tribal members have fee lands that are treated as reservation lands. The permits for these lands are issued out of Towoac, Colorado for reservation land only. They have had a few problems with hunters crossing over on to public lands thinking they were still on the fee lands. There will be a public meeting on November 15, 1994 at 7:00 P.M. at the Moab Civic Center for public input regarding the solutions. After all of the public meetings are held throughout the state a council will make recommendations for next years hunting season. COMMISSIONER BILL REDD'S REPORT On October 13, 1994 Commissioner Redd attended the Canyon Country Partnership meeting in Moab discussing the impact of 250 joggers on Grand, Emery, and San Juan County and the kind of TV advertisement that would bring. Mr. Redd attended the State Tax Commission hearing on the airplane value apportionment on October 14, 1994. Commissioner Redd, Administrative Assistant Rick Bailey, and Planner Edward Scherick attended a planning seminar in Cedar City presented by the State Office of Planning and Budget. On October 19, 1994 Commissioner Redd met with all the Salt Lake TV stations discussing ways to improve and upgrade the TV reception in San Juan County. He met with the Four Corners Heritage Council on October 21, 1994. Schedule On October 25, 1994 he will meet with Commissioners from Arizona to look at the San Juan County road agreement with the Tribe as apparently San Juan County has a different agreement with the Tribe and the BIA. Commissioner Redd will help interview for the North Road Foreman position on October 26, 1994. On October 27-28, 1994 there is a Rural Economic Development meeting in Price. COMMISSIONER MARK MARYBOY'S REPORT On October 17-18, 1994, Commissioner Maryboy attended a meeting in St. Paul, MN with other Presidential Appointees regarding educational issues on the reservations. The Tribal Council was in session on October 20-21, 1994 discussing legal issues facing the Utah Navajos. The council delegates from Aneth made a motion to see if a full time attorney could be assigned to the Utah Navajos. That issue was tabled by the council until further studies could be made. Mr. Maryboy met with Julie Orr, Indian Health Service concerning the emergency plan for the County. The Aneth Chapter is working on a $2.5 million dollar proposal for a grant to extend water for cooking and drinking purposes from Hatch to McCracken Mesa. A special council session will be held on October 25-26, 1994. The Tribal transportation department will make a recommendation that all major archeology sites be capped with mitigation and studies to be waived. Commissioner Maryboy stated that Herbert Claw is no longer in the position as Public Safety Executive Director. Commissioner Maryboy also stated that he has received several complaints about traffic checks conducted in the southern part of the County. Commissioner Maryboy would like the Sheriffs office to come to the commission with an explanation. The TV channel #8 at Montezuma Creek has been out for two weeks. The Utah Chapters would like to have a meeting with the Commissioners concerning the FY95 budget preparation to discuss revenue and expenditures and also possible projects coming from the reservation. Ochoa/Government Class Mrs. Ochoa's government class from Blanding attended Commission meeting. After hearing the reports the students asked the Commissioners questions concerning their position as Commissioners. PERSONNEL/PLANNER EDWARD SCHERICK'S REPORT Personnel Personnel Director Edward Scherick presented a request to hire Lillian Taylor as Personnel Clerk at Grade 4 Step 11 at 1148 per month effective October 31, 1994. Commissioner Bill Redd made a motion to approve the hiring of Lillian Taylor. Commissioner Mark Maryboy seconded. UNANIMOUS. Mr. Scherick requested permission for two people to attend a workshop in Salt Lake City discussing the legal aspects of personnel management. Commissioner Bill Redd made a motion to approve the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Sheriffs Dept Dispatcher Tom Moore has been accepted in the POST program. A motion to approve a salary change from Grade 9 Step 1 at $1258 per month to Grade 12 Step 1 at $1434 per month was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Personnel Director Edward Scherick presented a request from Dispatcher Kayla Draper asking for a one year leave of absence due to an illness in her family. Also Mr. Scherick stated that the dispatch position that would be temporarily vacant could be filled by the next person on the Sheriff's Dept. roster. This person is already employed by San Juan County in the Jail kitchen as a cook. This employee would be temporarily transferred to the dispatch position leaving a temporary vacancy in the Jail kitchen. Commissioner Bill Redd made a motion to approve the leave of absence. Commissioner Mark Maryboy seconded the motion with the condition that the Sheriffs office prepare a letter stating the conditions in connection with the temporary positions. UNANIMOUS. Personnel Director Scherick then requested to hire a temporary cook at the Jail kitchen. Commissioner Bill Redd made a motion to advertise for a temporary cook. Commissioner Maryboy seconded. UNANIMOUS. Library Vacancy/Blanding Personnel Director Edward Scherick will advertise for a permanent librarian for the Blanding library at Grade 4 Step 1 to replace Bonnie Black who has resigned effective October 25, 1994. Commissioner Bill Redd made a motion to accept the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Extension Secretary/Vacancy Mr. Scherick requested to advertise in-house for an Extension Secretary at Grade 4 Step 1 at $1048 per month to replace Lillian Taylor who has accepted another position. Commissioner Bill Redd made a motion to accept the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Fire Warden Personnel Director Edward Scherick presented a request from Fire Warden Frank Morrell to extend Assistant Fire Warden Ronnie Sorrell's seasonal position until March 31, 1995. It was requested that they continue his employment as a temporary mechanic at Grade 13 Step 1 through March 31, 1995 and then move him back to Assistant Fire Warden after that date. The Commission decided not to extend Mr. Sorrell's seasonal employment. Commissioner Redd then made a motion to advertise for a temporary mechanic. Commissioner Mark Maryboy seconded. UNANIMOUS. Planning Matt Millenbach the new BLM State Director would like to meet with the Commissioners in early December or January. Mr. Scherick attended a planning seminar in Cedar City on October 17-18, 1994. Mr. Scherick has requested reimbursement of $5200 to the County from the planning budget escrow account with the State. Planner Scherick has written a letter to Garth Skousen, Mental Health, requesting that they meet with the County concerning their office space and their intent on moving to another location. "Quiet Title"/Roads Planner Scherick has written a letter to the Department of Interior and has sent copies to the BLM, Forest Service, and National Parks Service stating that the County is claiming all the roads in San Juan County.
