SAN JUAN COUNTY COMMISSION MEETING MINUTES NOVEMBER 21, 1994 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the November 14, 1994 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Gail Northern/County Clerk County Clerk Gail Northern reported to the Commission that San Juan Health Care Services has requested a recount of the election concerning the 1% Sales Tax issue. The recount will take place on Tuesday morning, November 22, 1994 at 8:00 A.M. On Monday afternoon, November 28, 1994, the Commission would like to meet with the department heads to discuss their budget requests. ADMINISTRATIVE ASSISTANT RICK BAILEY'S DOE There will be a DOE meeting on November 29, 1994 at 6:30 P.M. at Monticello High School to evaluate and discuss information concerning the Monticello mill tailings. On December 13, 1994 at 6:30 P.M. at San Juan High School a meeting will be held to develop recommendations for the DOE concerning the tailings. The State Radiation Control Board will be in Monticello on December l, 1994 from 12:00 P.M. - 1:00 P.M. at the Monticello pavilion. They will also be in Moab on December 2, 1994 from 9:00 A.M. to 12:00 P.M. at Star Hall for their monthly board meeting. Governor Leavitt has convened an executive task force on health care. They will be in Moab on December 2, 1994 to hear public comment on some of the things they are opposing. Solid Waste The County is required to set up an escrow account to receive funds from the CIB for the solid waste landfill. Mr. Bailey has sent requests to the two local banks. First Security will charge an initial fee of $750 plus an annual administration fee of $750 totaling $1500. First Western Bank, Monticello, will charge an initial fee of $1000 with no administration fee. Commissioner Bill Redd made a motion to accept First Western Bank as the escrow account holder if the State pool is not less Commissioner Mark Maryboy seconded. UNANIMOUS. Mr. Bailey also stated that the County is required by the bond attorney to have an ordinance in which the County should set fees. The County would rather set the fees which would be determined on an annual basis. Centennial History The County has received a letter from Robert McPherson on writing the County history. He is requesting a partial payment of $9000 with the remaining $1000 to be held out for pictures and maps. Commissioner Bill Redd requested that a note be placed with the check stating that this is payment in full for all participants involved in the San Juan County Centennial history. Mr. Bailey mentioned that the Commission will need to decide if the County would like to publish the booklets locally for sale. USU/CIB Allocation Fund-Dan R. Nelson Mr. Dan Nelson of USU presented the proposal for the CIB Targeted Allocation Fund for USU and CEU to develop a partnership for expanded higher educational opportunities in San Juan County. They are requesting a one year instructor, twelve computers, office equipment and supplies, and an electronic delivery program and some indirect costs. CEU will furnish the office space. The proposal will provide the same level of education USU has in Moab and Price with seven bachelor programs and the potential for five masters programs. Commissioner Bill Redd made a motion to support the proposal based on the fact that half of the indirect cost receives hardware preference. Commissioner Mark Maryboy will support Commissioner Redd's motion with the provision that USU work with Commissioner Maryboy on issues helping Native Americans. Mr. Maryboy stated that San Juan County has the highest rate of high school drop outs in the state, less than 1% graduating from CEU are graduating with an Associates degree, the highest unemployment rate in the state and many are on welfare. UNANIMOUS. County Vehicles Administrative Assistant Rick Bailey discussed with the Commission the two blazers used by the State Tax Commission last summer. Mr. Bailey suggested that the County sell these and purchase some new vehicles. Commissioner Lewis suggested that it might be possible for the Assessor to use one of those vehicles instead of his personal vehicle. It was requested that Max Ksiaziewicz, North Road Shop Foreman, look at these vehicles to see if they are worth keeping. Word Perfect Training Mr. Bailey requested permission to attend a Word Perfect workshop in Salt Lake on Jan 11, 1995 at a cost of $120. Commissioner Mark Maryboy made a motion to accept the request. Chairman Ty Lewis seconded. UNANIMOUS. Building Permits/Buckley Jensen Buckley Jensen presented a request for the future to place a very large sign with a light at each of the approaching highways into Monticello advertising the retirement area near the golf course. The Commission stated that it would call for a variance which would be advertised for public hearing and comments. Straw Built Home Mr. Buckley Jensen presented a request for a building permit for a straw built home to be located on Highway 191 South, northwest of Vermillion Hills Building Center. Mr. Jensen agrees that the building permit on the straw house will be held in Assessor Bruce Bunkers office until Mr. Jensen signs a document prepared by the County Attorney absolving San Juan County of any liability in this matter and that through Mr. Bunkers research it meets the standard structural safety requirements. Commissioner Mark Maryboy seconded. UNANIMOUS. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT Mr. Tapaha reported on the Tribe and County elections. He stated that the elections went well except where both elections were combined in one place. He will be completing the election report and will submit it to the Commission He will be working with the Chapters helping them with their funding cycle and identifying projects. Public Hearing/Bond - Landfill Construction Commissioner Bill Redd made a motion to convene into a public hearing: Proposal to Bond for $711,000/25 years/2.5% from Community Impact Board for the landfill construction. There were no comments from the public. Commissioner Bill Redd made a motion to close the public hearing. Commissioner Mark Maryboy seconded. UNANIMOUS. San Juan Service Area #1/Craig Simpson San Juan Service Area #1 purchased property on January 9, 1994 from Perkins and Shumway Parcel #RPC40210253003A. Bluff Water & Sewer has Parcel #RPC00290200160A purchased in August 1993. Mr. Simpson is requesting that these two parcels be tax exempt and that the taxes be removed. County Assessor Bruce Bunker stated that the Bluff Water & Sewer Users Association should have a letter of incorporation that gives tax exempt status from the IRS and State Tax Commission. The Bluff Water & Sewer Users Association has not been declared tax exempt. Commissioner Bill Redd made a motion that upon certification of tax exemption that the Bluff Water & Sewer Users Association be exempt and that the property be exempt from time of property purchase. Commissioner Mark Maryboy seconded. UNANIMOUS. Utah Navajo Trust Fund Administrative Assistant Rick Bailey presented a letter from Utah Navajo Trust Fund requesting a tax abatement for all future property taxes and consideration of tax relief for the following parcels numbers B0000019002BA & B0000029001AA. These were recorded July 19, 1993. Commissioner Bill Redd made a motion that they will be taxed from January 1 - July 19, 1993 and will be forgiven taxes for the remainder of that year and all of 1994. Bids/Senior Citizens Building and Grounds Supervisor Dell Hunter submitted two bids for general carpentry from Seely's Contracting and Masonry for work on an hourly basis at $17.95 and from Sondregger Inc. for $26.00 per hour. Commissioner Bill Redd made a motion to accept the bid from Seely's Contracting and Masonry for $17.95 per hour. Commissioner Mark Maryboy seconded. UNANIMOUS. COMMISSIONER BILL REDD'S REPORT Commissioner Redd attended the Southeastern Utah Health District meeting in Green River on November 15, 1994 On November 17, 1994 he met with the Utah State Planning committee and with the Attorney Generals office. On November 22, 1994 at 1:00 P.M. he will attend an RS2477 strategy meeting in St. George with the Governors Office and UAC. PERSONNEL/PLANNER EDWARD SCHERICK'S REPORT Personnel Director Edward Scherick requested approval to advertise for a driver for Meals on Wheels, Grade 1 Step 1 $925 per month to replace Carol Sallee who was approved as the new cook at the jail. Approved. He also requested approval to hire a Road Supervisor for the Sheriffs Department. The Commission would like to see a job description before approving the request. Request to Hire Personnel Director Edward Scherick requested to hire Sherry Shupe as temporary dispatcher at Grade 9 Step 1 $1258 per month to fill the position vacated by Dispatcher Kayla Draper while on Leave of Absence until November 1, 1995. Sherry Shupe has signed an agreement stating that she understands that this is a temporary position. Commissioner Bill Redd made a motion to approve the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Personnel Director Edward Scherick requested to hire Cynthia Bancroft as the Extension Office Clerk at Grade 4 Step 1 $1048 per month. Commissioner Bill Redd made a motion to approve the hiring. Commissioner Mark Maryboy seconded. UNANIMOUS. Payroll Change Personnel Director Edward Scherick requested that Douglas E. Pehrson, Department Head, San Juan County Road Department be upgraded from Grade 25 Step 27 $3212 per month to Grade 27 Step 28 $3519 per month retroactive to September 1, 1994 and David A. Bronson, Supervisor Survey Department be upgraded from Grade 16 Step 27 $2193 per month to Grade 21 Step 15 $2403 per month effective November 1, 1994. The Commission tabled these actions until they look at the grade and step chart. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy reported that a cleanup day was held in the Aneth area last week picking up trash from there to the Colorado border. On November 14, 1994 he attended the National Indian Education Council meeting in Denver, Colorado. They discussed Project 2000 which routes money through the states for Indian education programs. Last week he met with the Land Administration working on a Memorandum Agreement on road maintenance on County B roads. They would like to set it up like the BLM agreement. Commissioner Maryboy went with Senator Hatch in Pinon, Arizona on November 19, 1994 to discuss the Native American Religious Freedom Act. The Tribe presented Senator Hatch with a belt buckle and bolo tie Mr. Maryboy stated that a culvert on the Burke road between Hatch Trading and Cahone Mesa is washed out. He will be going to Salt Lake City on November 22, 1994 to attend the Utah Navajo Trust Fund meeting. He will be in Window Rock on Wednesday, November 23, 1994, to attend a Federal Finance Committee meeting. Also on Wednesday, he will meet with Moab BLM District Manager Kate Kitchell and the Tribe regarding rafters on the San Juan River. CHAIRMAN TY LEWIS' REPORT Chairman Lewis attended the AOG Executive Council meeting in Price on November 17, 1994 with the Private Industry Council which oversees job type training programs awarded by the State. The AOG agreed to have PIC attend their board meetings to better coordinate these programs. He will have a 9:00 A.M conference telephone call on November 23, 1994 with Sheldon Kinsel of Congressman Orton's office concerning the wilderness bill.
