SAN JUAN COUNTY COMMISSION MEETING MINUTES DECEMBER 19, 1994 The regular meeting of the San Juan County Commission was held at 10:00 A.M in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the December 12, 1994 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Road Department Wanda Franklin, Road Department Office Manager, submitted three bids for the purchase of a distance measuring device which was approved in road meeting. They are as follows: 1) Safety Supply & Signs for $560; 2) Newman Signs for $600; 3) AMS for $436. Commissioner Bill Redd made a motion to approve the bid from AMS for $436. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid Awards The Road Department presented the following 1995 bids for approval. Filters from Caun-Co of Cortez; corrugated steel pipe from Amcor of Bountiful; tires from Parkway Grand-U passenger, Parkway Grand-G truck, Redburn Tire of Cortez for retread; batteries from Caun-Co of Cortez; oil, grease and antifreeze from Woody's, Wickenburg, AZ. These individual bids are on file. Commissioner Bill Redd made a motion to approve the bids. Commissioner Mark Maryboy seconded. UNANIMOUS. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT Process Facilitator Edward Tapaha reported that the Navajo Mountain Chapter has asked for funds equal to $35,000 allocated by San Juan County for road maintenance. He reported that requests have been sent to Navajo County, Arizona for $10,000; Coconino County, Arizona for $15,000; and Glen Canyon National Recreation Area for $10,000. The money will be used to purchase road equipment. Mr. Tapaha reported that the Navajo Mountain Chapter Christmas dinner will be at noon on Saturday, December 24, 1994. The Commissioners are invited to attend. San Juan Health Care Services Mr. Tapaha reported that Kerry Smallcanyon of the Navajo Mountain Chapter is interested in serving on the San Juan Health Care Services Board. After a discussion it was decided that a letter would be written to him expressing appreciation but that a requirement to serve would be that the person be a resident of San Juan County, Utah and it is the Commissioners understanding that he lives in Arizona. Mr. Tapaha also reported that his own term on the San Juan Health Care Services Board expires this month and he will not be returning to that board. Within the last two years the Utah Navajo Board of Trustees have completed an assessment of the Montezuma Creek Clinic facility to identify what is needed. Mr. Tapaha reported on the Utah Navajo Trust proposal to purchase a fiber optic computer system for $350,000. Many people feel that this money should actually be used for medical equipment which is needed most. Health care or quality health care is the top concern for Utah Navajos. Mr. Tapaha presented a letter from the United States Department of Interior National Parks Service addressed to Willie Greyeyes concerning a draft Programmatic Agreement among Glen Canyon National Recreation Area, the National Park Service, Rocky Mountain Regional Office, the Advisory Council on Historic Preservation and the Utah State Historic Preservation Office regarding implementation of Rainbow Bridge National Monument's General Management Plan. The draft will have a 30-day review period after which time a meeting will be held on January 19, 1995 at 10:00 A.M. in the conference room of Glen Canyon National Recreation Area headquarters building to discuss any changes or comments. Navajo Mountain Chapter The construction of the senior citizen center at Navajo Mountain will begin in early 1995. Projected cost will be $40,000 with the County paying half. Meetings Mr. Tapaha will attend a San Juan School District meeting today at 11:00 A.M. This afternoon he will attend the Native American Scholarship Review Committee meeting. The Red Mesa Chapter Christmas dinner will be held on Friday, December 23, 1994. County Assessor Bruce Bunker/Tax Issue Assessor Bruce Bunker presented a tax statement from Cory Perkins concerning Parcel #RPB362202724A11A. The property was privately owned until 4/9/90 and then was purchased by Blanding City. The building was left on the wrong parcel. The building was taxed as him owning it for the years 91,92, 93. He has paid the taxes for those three years but is requesting a refund of $1203.94 for those years that the building should not have been taxed. No action was taken at this time. Recorder Louise Jones/Capital Purchase Request County Recorder Louise Jones presented a request to purchase a computer for recordation. Bids were received from Gateway 2000 for $1879 and from Mid West Micro for $1643. Commissioner Bill Redd made a motion to approve the purchase from Mid West Micro for $1643. Chairman Ty Lewis seconded. UNANIMOUS. 1995 Beer Licenses The 1995 Beer Licenses were presented for renewal as follows: K&C Trading Post, Halls Crossing Store, Halls Crossing Marina, San Juan Inn, San Juan Trading Post, Shirt Tail C-Store, Dairy Cafe, Mexican Hat Lodge, Valle's, Hatch Trading Post, Montezuma Lounge, Mexican Hat Texaco,and LaSal Store. LaSal Store to be approved when a copy of the bond and server training certification is received. Commissioner Bill Redd made a motion to approve the licenses. Commissioner Mark Maryboy seconded. UNANIMOUS. Building Permits Two building permits were presented. A permit to Vaughn Hadenfeldt, Glenwood Springs, Co for an addition in Bluff at 1st West 2nd North upon site of a business known as Far Out Expeditions. A permit to Coralee Massey for a mobile home on Browns Canyon Road, Blanding. Commissioner Bill Redd made a motion to approve the permits. Commissioner Mark Maryboy seconded. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Cal Black Airport/Fuel Truck Lease Administrative Assistant Rick Bailey presented a Master Equipment Lease/Purchasing Refunding Agreement between San Juan County & First Security Bank for the fuel truck at Cal Black airport dated December 19, 1994. Commissioner Bill Redd made a motion to approve the lease. Commissioner Mark Maryboy seconded. UNANIMOUS. An out-of-state travel request was submitted for Commissioner Bill Redd and Commissioner Mark Maryboy to attend a NACO meeting in Washington DC on March 3-7, 1995. Commissioner Bill Redd mad a motion to approve the requests. Commissioner Mark Maryboy seconded. UNANIMOUS. Emergency Services Bid Mr. Bailey presented two bids for a break apart litter for emergency services. A bid from California Mountain for $500 and one from Pine Pig Rescue for $425. The money to purchase the litter is coming from search and rescue received from a private billing. Commissioner Bill Redd made a motion to approve the bid from Pine Pig Rescue. Commissioner Mark Maryboy seconded. UNANIMOUS. Spanish Valley/Highway Property The Commission discussed selling 5.77 acres of land owned by San Juan County in Spanish Valley. The San Juan County Commission will hold an open bid on Monday, January 9, 1995 at 2:00 P.M. in the County Commission Chamber with minimum bid to be set prior to the hearing. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Meals on Wheels Aging Director Frank Morrell has interviewed for the Meals on Wheels position. He is recommending approval to hire Dale Wegner at Grade 1 Step 1 at $5.33 per hour. Commissioner Bill Redd motioned to hire Dale Wegner. Commissioner Mark Maryboy seconded. UNANIMOUS. Sheriffs Dept/Payroll Change Corrections Officer Thomas Moore has completed POST. The Sheriffs Department is recommending a payroll change from Grade 12 Step 1 at $1434 per month to Grade 15 Step 1 at $1624 per month. Commissioner Bill Redd motioned to approve the payroll change. Commissioner Ty Lewis seconded. UNANIMOUS. Michael Pederson has resigned from the Sheriffs Office effective December 22, 1994. On April 20, 1994 Mr. Pederson signed an agreement with San Juan County that states in part..."should I voluntarily fail to remain in their employ, I will pay as liquidated damages to San Juan County an amount equal to $1549, which amount having been expended for my training, salary and benefits during the training period is just and owing to San Juan County." Since completing training he has been with the County seven months. He owes the County for 5 months @ $129.09 per month totaling $645.45 reimbursement for training. Commissioner Bill Redd made a motion to deduct the lump sum of $645.45 from his final paycheck. Commissioner Mark Maryboy seconded. UNANIMOUS. Stinger Road Spikes The Sheriffs department submitted a bid from Stinger Spike System, Inc. for two sets of Stinger Road Spikes at $449 per pair. Commissioner Bill Redd made a motion to approve the purchase. Chairman Ty Lewis seconded. UNANIMOUS. Patch Crew Leader/Advertisement Personnel Director requested permission to advertise for a Patch Crew Leader within the Road Department. Commissioner Bill Redd made a motion to approve the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Personnel Policy/Correction Personnel Director Edward Scherick requested a personnel policy change on page 11 para 2 as follows: "Exception: When the need has been determined and approved by the Board of Commissioners, the Department Head may use an encumbered position to fill a vacancy that had an additional level of responsibility. With this approval a recruitment action can be taken solely within the department." Commissioner Bill Redd made a motion to accept the change in policy. Commissioner Mary Maryboy seconded. UNANIMOUS. Carma Ingram/Global Positioning System Carma Ingram, Global Positioning Systems, works with GPS & GIS systems. This company can provide aerial photography, ground control points, grid surveys, data collection, data input, hardware and software packages, training, engineering support, grant writing assistance, digitizing services, etc. She is willing to come to Monticello and discuss some ideas with the Commissioners. It was decided to invite her here sometime in January 1995. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd attended a Library Board meeting. He attended a Site Specific Advisory Board meeting in Blanding concerning the uranium cleanup. He will meet with RC&D in Price on December 21, 1994. On Thursday, December 22, 1994, he will meet with Senator Bennett's office concerning roads. That evening he will attend the Utah Local Government Trust Board meeting. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy met with the Dine` committee concerning the fiber optics proposal. The committee decided not to support the proposal. Commissioner Maryboy stated that last year the Navajo Nation Council put a moratorium on all gas operations in the Aneth & Red Mesa area because of lack of protection with oil spills. He will meet this afternoon with the Mobil Oil Company and the Navajo Nation to go over the moratorium and possibly extend it for another 90 days. He met with President Elect, Albert Hale of the Navajo Nation and gave him a list of things to work on that would require a cooperative effort of the County and Navajo Nation. The Navajo Nation Inauguration will be held on January 10, 1995. On January 11, 1995, Albert Hale, Navajo Nation President will meet with Senator Hatch's staff and Indian Health Service. Last week, Commissioner Maryboy spent the evenings delivering food, toys, and clothes donated to needy families by the wives of the Utah Jazz Basketball team. This week he will be involved with the Aneth Chapter hauling coal from Peabody International to the communities of Montezuma Creek, Aneth, Cahone Mesa and McCracken Mesa. COMMISSIONER TY LEWIS' REPORT Chairman Lewis attend a Organic Workshop on December 13, 1994 in Provo. Chairman Lewis will attend a Western Region meeting on January 5-6, 1995. Commissioner Lewis will be attending a new commissioners workshop to be held in Ogden, Utah on January 12-13, 1995. Commission meeting will be held on Tuesday, December 27, 1994 due to the Christmas holiday. The new elected officials will be sworn in to office on Tuesday, January 3, 1995 at 12:00 P.M.
