SAN JUAN COUNTY COMMISSION MEETING MINUTES FEBRUARY 13, 1995 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the February 6, 1995 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Paul Redd-Melvin Dalton/San Juan Stockmen Association Paul Redd and Melvin Dalton representing San Juan Stockmen's Association discussed with the Commission the possibility of changing the County fencing law. A letter from the San Juan Stockmen's Association was presented requesting that the Commissioners consider changing the ordinance requiring that stockmen construct and maintain the fences which keep livestock off private and leased lands. The stockmen recommend that the responsibility be given to the private land owners and lease holders. A list of 30 names and addresses accompanied the letter. No decision was made at this time. Sheriff's Department/Payroll Changes Sheriff Mike Lacy and Lt. Bill Christensen proposed hiring Erik Grover as a dispatcher at Grade 9 Step 1 at $1271 per month to replace Randall Bolos. Commissioner Bill Redd made a motion to approve the hiring. Commissioner Mark Maryboy seconded. UNANIMOUS. A request to change Mike Bradford from temporary to permanent at Grade 9 Step 2 at $1283 per month effective February 15, 1995. Commissioner Bill Redd made a motion to approve the status change. Commissioner Mark Maryboy seconded. UNANIMOUS. Mike Pederson/Appeal San Juan County is appealing the award of unemployment benefits to Mike Pederson, formerly of San Juan County Sheriffs Department, through Job Service. A hearing will be held in Provo on February 22, 1995 at 1:15 P.M. Out-of-State Travel Requests Out of state travel request was presented for Lt. William Monte Dalton to attend the 22nd annual Western States Livestock Investigators Theft Seminar in Reno, Nevada on March 7-11, 1995. A request to attend a Professional Training Seminar in Grand Junction Colorado on March 16, 1995 for Susan Taylor, Economic Development and Lillian Taylor, Personnel was presented. Peggy Humphreys, San Juan County Economic Development, presented a request to attend a seminar in Burbank, California on March 3-7, 1995, to promote the film industry in SE Utah. Commissioner Bill Redd made a motion to approve the out-of-state travel requests. Commissioner Mark Maryboy seconded. UNANIMOUS. Road Dept/Jason Shumway Personnel Director Edward Scherick presented a payroll change effective February 1, 1995 for Jason Shumway from Grade 7 Step 24 at $1486 per month to Grade 9 Step 21 at $1550 per month to be Patch Crew Foreman and cross over to light equipment operator when not acting as patch crew foreman. Commissioner Bill Redd made a motion to approve the payroll change. Commissioner Mark Maryboy seconded. UNANIMOUS. Road Dept/Radio Procurement Bid Last week a bid for a radio was approved. However, the Road department recommended that they purchase the radio that cost $15 more because of quality. The Commission gave their approval to purchase the more expensive radio. Extension Secretary/Cynthia Marie Allen Personnel Director Edward Scherick presented the name of Cynthia Marie Allen to be hired as the Extension Secretary at Grade 4 Step 1 at $1050 per month effective February 27, 1995. Commissioner Bill Redd made a motion to approve the hiring. Commissioner Mark Maryboy seconded. UNANIMOUS. Building Permits Two building permits were presented as follows: Stephen Schultz of LaSal for an addition to be used as a dwelling and Mark Meloy of Kenilworth, Utah to build a residence 1/3 mile west of Bluff. Mr. Bailey suggested that approval be contingent on the fact that it is out of the Bluff Service District. Commissioner Bill Redd made a motion to approve the permits. Commissioner Mark Maryboy seconded. UNANIMOUS. PERSONNEL/PLANNER EDWARD SCHERICK'S REPORT Planner Edward Scherick requested permission to attend a GIS Training in Salt Lake on March 13-17, 1995. Commissioner Bill Redd made a motion to approve the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Mr. Scherick discussed with the Commission the proposed agenda for the Wilderness hearing to be held on February 16, 1995 at San Juan High School. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd attended a Legislative Rural Caucus on February 8, 1995. On February 9th he attend the UAC Legislative committee meeting and the 2000 Wilderness discussion workshop. On February 10th he attended the GIS information workshop and the UAC Legislative briefing. He also attended the UAC Legislative dinner with Senators and Representatives. That afternoon he attended the Blue Ribbon County Commission session looking at federal Legislation On Thursday, February 16, 1995, he will be attending the Wilderness Hearing in Blanding at San Juan High School. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT The RC&D meeting has been changed to February 23, 1995 in Green River. Mr. Bailey reported that the County was notified by the State that the Mineral Management Service which collects mineral lease payments from different entities has collected 4.8 million more in royalties from one mining company for the last period. Consequently that company was given a credit. That 4.8 million will be withheld from that portion that comes back to the State which will effect the Community Impact Board. The Interagency Breakfast will be held on February 21, 1995 at 8:00 A.M. at Hoagies. BLM State Director State Director of the BLM, Matt Millenbach, will be in San Juan County on February 23rd or 24th to meet with the Commission. The Commission would like to meet with him on the morning of February 24, 1995. Solid Waste Mr. Bailey reported that the County has received a letter from the Grand County Special Service District that deals with solid waste. They are asking for a proposal by the end of the month indicating whether or not we would accept the solid waste from their community. Mr. Bailey will respond. Severance Tax Bill Administrative Assistant Rick Bailey reported that a presentation was made in the Legislature on the Severance Bill in the Unitah Basin. It will take a certain amount of the severance tax that the State collects not to exceed two million dollars and return that to Unitah County and the Ute Tribe to be split evenly. San Juan County has been excluded from that bill. Commissioner Bill Redd suggested that the County should petition to be included in the severance bill. Commissioner Mark Maryboy also agrees that San Juan County should be included. Administrative Assistant Rick Bailey will write a letter to the Governor stating that San Juan County supports the bill but feels that it should be broadened to include the Utah side of the Navajo Reservation. Interim Study for Division of San Juan County Administrative Assistant Rick Bailey presented his ideas which are just a beginning of a draft proposal which he prepared on an Interim Study for County Division of San Juan County. It includes discussions on the formation of a Blue Ribbon Study Committee and sub committees, funding proposals, time frame and a copy of the State code on creating new counties. There may be other things which will need to be included as time goes on. Bluff Community Center The County has written a letter to the Bluff Service Area stating that the County would like a walk through on the Community Building. The Bluff Service Area has set up a meeting for February 17th at 2:00 P.M. for the walk through. Montezuma Creek Fire Dept Mr. Bailey reported that there was a break in at the Montezuma Creek fire dept. A door was knocked in, a generator was stolen off of the fire truck and other damage was done to the building. A report will be submitted to the County insurance carrier. Cedar Point Schoolhouse Dell Hunter, Maintenance and Grounds Supervisor, reported that the Cedar Point School belongs to the School District and the other building used as a fire station belongs to the County. A letter will be written to Mrs. Breedlove indicating that the schoolhouse belongs to the school district so she will have to contact them concerning the things involved with that building. The fire building belongs to the County. The County is aware of the problems with it and will be working on those problems. Wanda Franklin/Road Dept Road Department Office Manager, Wanda Franklin, discussed with the Commission some problems the road department is having in connection with receiving payment from the BIA- Shiprock Agency. The contract has been extended and will reflect that some of last years payments have not been received. The Road Department has made a decision to close the road to Geyser Pass on the LaSal Mountain due to damage from logging trucks. It will be closed until the weather warrants it being opened again. Microfilm Grant Mr. Bailey reported that the County has received an invitation from the State Archives to apply for grant money that is available to microfilm the County records. Volvo Dump Trucks The two Volvo Dump trucks are still available. The two cities declined the offer to purchase them from the County. Great Basin Truck will take them for $18,000 on a trade-in. Mr. Bailey would like to place them at State Surplus at $25,000. The new trucks that were ordered are ready for pick up. Uranium Tailings Energy Fuels, Blanding, has gone back to Washington DC to continue promoting the tailings haul to the Blanding facility. Senator Hatch's office has called to ask the Commission if the Commission has a level of comfort with the DOE's proposal to remediate on site and would they be willing to ask Hatch's office to go to a higher level with the decision. The Commissioners feel that with whatever decision was made the DOE still needs to mitigate that decision with the County. Gail Northern/Independent Auditors County Clerk, Gail Northern reported that the independent auditors, Karrin, Hendrix & Associates are adding $2,000 to our audit contract because of the additional work involved with reports which need to be added to the audit. After a discussion with Karrin, Hendrix & Associates they have agreed to do the work for $1,000. Commissioner Bill Redd made a motion to accept the $1,000 additional fee. Commissioner Mark Maryboy seconded. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Mark Maryboy reported that the Utah Navajo Commission met last week and supported the grant for the trash bins. Mr. Maryboy was in Washington, DC attending the National Indian Education Council discussing the BIA streamline and block grant proposal. The National Association of Counties will be meeting in Washington DC in March. A resolution will be drafted supporting the block grant which Commissioner Redd will present to the committee while in Washington, DC. Commissioner Maryboy reported that the Utah Navajo Commission will take action on the resolution concerning the Wilderness issue when they receive a response from the Chapters. He also stated that the Navajos do not like the wording "Special Use Permit" in the Wilderness Bill Commissioner Maryboy asked Administrative assistant Rick Bailey to send a copy of the Interim Study for County Division of San Juan County to Navajo Nation President Hale and indicate to him what is going on and that the County would like to work with them. He would also like copies sent to Speaker of the Council, Kelsey Begay and to the Utah Navajo Commission, Clarence Rockwell, Executive Director. Commissioner Maryboy reported that there is a bill being prepared by Representative Keele Johnson concerning Tribal Housing. It appears that only select Chapters will be included. Commissioner Mark Maryboy would like a letter written to Representative Keele Johnson requesting that all Utah Chapter residents be included in that bill. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis attended a Rural Caucus Legislative meeting last week in which bills concerning rural counties were discussed. On Friday, February 10, 1995 Commissioner Lewis attended a GIS Legislative Briefing and met with Blue Ribbon Committee looking at Federal laws. Commissioner Lewis will be attending a UAC Insurance Mutual meeting on Thursday, February 16, 1995 and also the Wilderness Hearing in the evening on February 16, 1995 at San Juan High School. The County has written a letter to Navajo Nation President Albert Hale concerning cross deputization in receiving help from the Navajo police for the Montezuma Creek and Oljato areas. The County is requesting a meeting with him to discuss these issues.
