SAN JUAN COUNTY COMMISSION MEETING MINUTES APRIL 24, 1995 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the April 17, 1995 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Radio Policies A motion was made by Commissioner Bill Redd and seconded by Commissioner Maryboy to approve the following: San Juan County Non- Government Radio Policy, Radio Frequency Policy and Radio Acquisition and Disposal Policy. UNANIMOUS. SAN JUAN COUNTY RADIO ACQUISITION AND DISPOSAL POLICY Those County Departments receiving approval from the Board of County Commissioners for the purchase of radios, pagers or other communication equipment shall provide to the County Communications Department itūs requirements and specifications for such purchases. The County Communications Department shall provide pricing comparisons for such purchases as required by the County Purchasing and Procurement Policy and shall assure that the County has programming and other radio capabilities for such purchases. The County Communication Department shall then provide to the Board of County Commission all requests for radios, pagers, and other communication equipment for final approval. The County Communications Department shall inventory all new equipment, assure that all frequency authorizations are in placed, and install, if necessary such equipment. All radios, pagers, and other communication equipment determined to be surplus, either by age, condition, or service, shall be transferred to the County Communication Department. This department shall make recommendation to the final disposition of such equipment, assuring that if any are placed into a surplus equipment sale or of any other type of disposal, that all frequencies licensed to the county or other agencies which have authorized the use of their frequencies by the county have been removed. This policy is approved by the Board of County Commissioners, San Juan County, this 24th day of April, and is effective upon its approval. This frequency is authorized by the County only under the following situations: The authorized radio frequency shall be placed only in mobile radios that are placed in actual wreckers or private emergency service providerūs vehicle or equipment as authorized by San Juan County. No authorization is allowed for placements in base station type radios or other vehicles. Communication shall be limited to radio traffic to and from the San Juan County Sheriffūs Office and mobile emergency personnel dealing with the specific call out of the services. If the wrecker or other private emergency service provider at the scene has need of additional assistance, these may be requested through the San Juan County Sheriffūs Office. The request shall be forwarded to the wreckerūs or private providerūs place of business. No communication on any San Juan County frequency is authorized for any type of private business or personal communication. It is the responsibility of the wrecker service or private provider to provide their own radio equipment, installation, programming, etc. The County is in no way responsible for any costs related to any frequency or radio changes. The wrecker service or private provider shall be required to sign this policy confirming that they agree to the terms and conditions of this policy prior to the assignment of the frequency. If the wrecker service loses state certification, the service shall immediately cease from use of the radio frequency and remove said frequency from any and all radios. When a public provider has completed a work contract or assignment, the provider shall immediately cease from use of the radio frequency and remove said frequency from any and all radios. This authorization is given with the understanding that the Federal Communication Commission has issued and authorized the frequencies for local governmental use only within the operating authorities of county law enforcement, fire services, emergency medical services, public works, and other emergency response operations and that the license prohibits any type of private or business use and that this authorization and policy prohibits any such use. It is the opinion of the response agencies within San Juan County, that radio communication outlined within this policy and authorization, may be essential to the emergency responses of the County Departments and would be allowed under the FCC license. This policy acknowledges that the County can be fined by the FCC and may be required to forfeit the license if found to be in violation of the terms and conditions of the license. Additionally, it is acknowledged that there are private business providers of radio frequencies, communications systems and cellular telephone systems available for private and business uses. It is also acknowledged that this authorization will be terminated at any time for failure of a wrecker service or private provider to abide by this policy. If a wrecker service or private provider is found to be in violation of this policy, a certified letter shall be sent to the service terminating the authorization and requiring the service to cease usage of the frequency and to remove the frequency from any and all radios. This policy is approved by the Board of County Commissioners, San Juan County, this 24th day of April 1995 and is effective upon its approval. These licenses allow the County to operate on these frequencies for the purposes of local government within the operating authorities provides for county law enforcement, fire and other emergency services, emergency medical services, public works and other county government purposes. These licenses require the purpose and use of the radio frequencies and provide valuable and necessary communication in the provision of emergency services to the residents of San Juan County. It is beneficial for the county to at times authorize other governmental agencies use of these frequencies in order to provide coordination and other essential services. These other users may include city agencies, other county agencies, and state and federal agencies. This policy authorizes only the following to issue written authorization to these other agencies to use the Countyūs radio frequencies: Sheriff's Office General Frequency and Associated Frequencies shall be authorized by the Sheriff. Emergency Services General Frequency and Associated Frequencies shall be authorized by the Director of Emergency Services Road Department General Frequency and Associated Frequencies shall be authorized by the Road Department Engineer. Other County Radio Frequencies shall be authorized by the Communication Department Head. If necessary, these authorized personnel shall coordinate the authorization of any and all frequencies that may have some effect on each of the individual departments. It is the intent of this policy that the frequencies licensed to San Juan County shall not be placed in any private or business owned radios and no County employee shall give such authorization without the consent and approval of the Board of County Commissioners. It is also the intent of this policy that letters will be sent to businesses associated with the sale and programming of such radios giving notice of this policy. Deputy Clerk San Juan County Commission San Juan County Clerk Seat Belt Policy Commissioner Redd made a motion to approve the following: San Juan County Seat Belt Policy, Safety Policy Statement and Auto Insurance Deductible. Commissioner Mark Maryboy seconded. UNANIMOUS. SEAT BELT POLICY All San Juan County employees and their passengers are required to wear seat belt restraints while driving or riding in any vehicle (private, rental or county vehicle) being used for county business, in or out of the State. All occupants of the vehicle shall wear seat belt restraints. Any supervisor who becomes aware of a violation of this policy within his or her jurisdiction shall issue a letter of warning (written warning) to the employee. A copy of this letter shall be signed by the employee and placed in the employee's personnel file. Subsequent violations shall be treated in accordance with disciplinary procedure, which could include suspension without pay and finally dismissal for continued and repeated violations. Research has proven that occupants of vehicles who are wearing seat belt restraints are less likely to be injured when involved in vehicular accidents. The County strongly encourages the use of seat belt restraints in all non-employee situations as a protection to the employees and the employee's family. /s/Ty Lewis April 24, 1995 SAFETY POLICY STATEMENT It shall be the policy of San Juan County to provide county employees with a work place free of recognized hazards which may cause injury, illness, or death. All employees are equally responsible for following this policy and for working in a safe, proper manner to protect themselves and others, including equipment, vehicles, building, and supplies. All employees, at all levels, are required to make safety a vital part of every work effort, no matter how small. Employees are encouraged to report any hazard or unsafe situation to their supervisor. /s/Ty Lewis April 24, 1995 AUTO INSURANCE DEDUCTIBLE Effective May 1, 1995, the auto insurance deductible will be raised from $500.00 to $1,000.00. If a County department has an accident in which a county vehicle is damaged it will be the responsibility of the department to pay for the deductible from their budget and not from the County's Tort and Liability Fund. /s/Ty Lewis April 24, 1995 Excess Material Disposal Policy A motion to approve the Disposal of Excess Material Excavated by County Road Crews Policy was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS as follows: MEMORANDUM To: San Juan County Road Foreman and Cities of Monticello and Blanding FROM: San Juan County Commission SUBJECT: Disposal of Excess Material Excavated by County Road Crews DATE: April 24, 1995 Several times over the past couple of years the County's policy with regard to disposal of fill and excess material has come into question. The County Commission has considered the issue in a regular meeting. The following is a brief statement of the County's policy with regard to how these materials are handled. The County wishes to establish a uniform policy throughout the county and to reiterate with the County Road Employees how the matter should be handled and to give direction and input from the cities when fill material is available to the cities or to the general public. The County wishes to avoid liability where county equipment may be used to deliver materials to private citizens, including the cities. The County does not wish to incur additional expense by making available to private citizens or the cities fill materials where the county may have to excavate in the future to obtain additional fill material for their own projects. Therefore, the County makes the following statement of policy with regard to these issues: Where the County has excess fill material or excavated material from county work, for which the county does not have a higher use, (this higher use shall be defined as a use which will serve all county residents by virtue of the fact that the county requires fill material in other projects or for other purposes) the County shall make those materials available to private citizens or the cities. Where excavation work is being conducted within a City, the City may request fill material for City or private purposes, provided the City and private citizen indemnify the County for damages to vehicles, property or persons occasioned by virtue of the loading or delivery of said material. The City shall provide a priority list to County Road Foreman of persons to receive the materials. Where excess materials are available, a county employee using county equipment, shall load the material on a private vehicle at the cite of the excavation. The County shall have no further responsibility in the matter and shall not be engaged by use of county equipment other than the loader used to load it at the excavation site. This policy shall be in effect only under circumstances where undue delays or dangerous conditions are not caused by private vehicles entering the job site. In event such concerns exist the City shall be notified and delays shall be charged at ordinary construction rates. COUNTY COMMISSION /s/Ty Lewis May Tax Sale County Clerk Gail Northern reported to the Commission that there are thirteen properties not yet redeemed. Commissioner Bill Redd made a motion that the properties for the tax sale be sold at market value. Commissioner Mark Maryboy seconded. UNANIMOUS. Beer License/Fry Canyon County Clerk Gail Northern presented a beer license for Fry Canyon Store for approval. They have met all the requirements. A motion to approve the Beer License was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Bluff Service Area County Assessor Bruce Bunker requested follow up on the tax exempt status of the Bluff Service Area. The Bluff Service was formed by the County and therefore should be tax exempt. After a discussion with Assessor Bunker and County Attorney Craig Halls it is their recommendation that the taxes due would be placed at zero therefore no taxes would be due on the property in question owned by the Service Area. Commissioner Redd made a motion to approve the recommendations of County Assessor Bruce Bunker and County Attorney Craig Halls. Commissioner Mark Maryboy seconded. UNANIMOUS. County Fair/Beautification Project Glenice Mantz, Fair Board Chairman, presented a beautification plan for the County Fairgrounds. The Fair Board is proposing a grant through the Utah Statehood Centennial Commission to build planter boxes and benches to be placed in the fairground area. Mrs. Mantz is requesting that San Juan County match the grant. Commissioner Bill Redd made a motion that San Juan County would match over a two year period whatever the Utah Statehood Centennial Commission would grant. Commissioner Mark Maryboy seconded. UNANIMOUS. AT&T Property Tax Appeal County Attorney Craig Halls has received a letter from Bill Peters concerning the AT&T property tax appeals. The Tax Commission revalued the AT&T property to a lesser value with a refund due them for 1990. The Supreme Court upheld the Tax Commission. For the year 1990 the amount of taxes due is just over $10,000. The Commission asked that County Attorney write a letter stating that the County is willing to negotiate 1991-94. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Mr. Bailey has a report of a broken windshield by one of the County trucks hauling gravel. Sheriff Department Vehicle Sheriff Lacy had an accident on April 21, 1995 in a snow storm. The vehicle appears to be totaled. The insurance adjuster will be here tomorrow. Bluff Library A letter was received from Rosalie Goldman stating that the Bluff Library has been dissolved and has vacated the premises effective April 16, 1995. Administrative Assistant Rick Bailey will write a letter to the Bluff Service Area asking them if they would like to take over the building. Sign Application Two sign applications were received from The Dinosaur Museum to place signs at the Dinosaur Museum. A motion was made by Commissioner Bill Redd to approve the permit. Commissioner Mark Maryboy seconded. UNANIMOUS. Building Permits Two building permits were submitted. One for Joe Barton to place a modular home at #1 Verdure Lane So. Highway 191 and one for Shelby Seely for storage units in Blanding. A motion was made by Commissioner Bill Redd to approve the permits and seconded by Commissioner Mark Maryboy. UNANIMOUS. TV Expansion Mr. Bailey reported that the cost figures are about together on the expansion of the TV site. Emery County's portion will by $18,000 to go toward the grant. Travel Request Two out of state travel requests were submitted for Communications Specialists Bill Bayles and Steve Bradford to attend a National Translator Association Seminar in Denver, CO. May 10-13, 1995. A motion to approve the request was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Maintenance Bid Dell Hunter, Grounds and Maintenance Supervisor, requested to purchase a grinder to sand off edges on sidewalks in front of county buildings. A bid was received for Hilti for a 7" grinder and diamond cup wheel for $538.65 and from Alternative Supply for a Black & Decker 7" grinder and diamond cup wheel for $402.45. Mr. Hunter requested to purchase the better quality grinder from Hilti. Commissioner Bill Redd made a motion to approve the Hilti grinder. Commissioner Mark Maryboy seconded. UNANIMOUS. Road Dept Oil Bids A bid was received from Koch Materials Company, Grand Junction, CO for 500 ton mulch mixing @$150 per ton; 1000 ton chip seal @$150 per ton; and 100 ton of prim oil @ $170 per ton. A bid was also received from Petro Source Refining Partners, Salt Lake City, for 100 ton prime oil @$206.15 per ton; 1000 tons chip seal at $184.15 per ton; 500 ton cold mix oil @$184.15 per ton. Commissioner Bill Redd made a motion to approve the low bids from Koch Materials. Commissioner Mark Maryboy seconded. UNANIMOUS. Concrete Cattleguard Bids Three bids were received for 10ft, 12ft, 14ft cattleguard beams. They are as follows: Hollingsworth Construction, Monticello, for a total of $10,500; Mike Crittenden, Monticello for a total of $6,000; and from Fuller Construction,LaSal, Utah for a total of $6220.65. Commissioner Bill Redd made a motion to accept the bid from Fuller Construction as they were the only one with the proper license. Commissioner Mark Maryboy seconded. UNANIMOUS. Meetings Mr. Willis of the State Tax Commission would like to meet with the Commission on May 22, 1995 at 2:00 P.M. The Safety Committee will meet with Geotech and DOE on May 15, 1995 at 2:00 P.M. Mr. Bailey will be in Salt Lake on April 26-27, 1995 with Steve Cheney of Natural Bridges to present an application to the Public Service Commission for funding of a telephone system at Natural Bridges. Mr. Bailey will be testifying at that Commission on their behalf. Historical Preservation Commission/Constitution Corinne Roring and Toni Turk representing the San Juan Historical Preservation Commission presented it's constitution and by laws for approval. The Commission asked County Attorney Craig Halls to review. After review by the County Attorney Commissioner Bill Redd made a motion to approve the Historical Preservation Commission Constitution. Commissioner Mark Maryboy seconded. UNANIMOUS. Bridger Jack Mesa Rick Lamb, Bridger Jack Mesa, presented the final subdivision plat. Before the Commission would sign the plat he needed the signatures of the County Engineer and the Health department. An agreement between Northwest Pipeline, Mid America Pipeline and Bridger Jack Mesa concerning easements which need to be signed. The Commission gave their approval pending signatures on easement agreement and health department signature. It was noted that the number of feet for utilities easement on the plat was 10 feet and the County subdivision ordinance is 15 feet. Commissioner Bill Redd made a motion for a variance from 15 to 10 feet in this subdivision. Commissioner Mark Maryboy seconded. UNANIMOUS. Navajo Nation Public Safety Commissioner Mark Maryboy expressed his concern with public safety and cross deputization and highway control to Tom Yazzie of the Navajo Nation Public Safety. Commissioner Maryboy would like more officers assigned to the Utah side of the Reservation. Mr. Yazzie stated that in the near future there should be two police officers assigned to the Chapters. 911 Service Administrative Rick Bailey reported to Mr. Yazzie of the Navajo Nation Public Safety that San Juan County received a grant to upgrade the 911 service. The system has been bought and paid for. Mr. Bailey stated that there is no 911 service on the Utah side of the Reservation because no agreement has been accomplished with the Navajo Nation. Mr. Yazzie will look into the reasons why the Nation has not agreed to test the system. Violent Crime Task Force Meeting There will be a public meeting held on May 9, 1995 at Monument Valley High School at 10:00 A.M. and at Whitehorse High School at 2:00 P.M. to announce and seek community input into the formation of the Utah Navajo Reservation Violent Crimes Task Force. PERSONNEL-PLANNER EDWARD SCHERICK'S REPORT Unemployment Benefits San Juan County is pursuing legal action against Job Service Unemployment Benefits in connection with a former county employee. Sick Leave Policy Personnel Director Scherick discussed the County Sick Leave policy with the commissioners. He will make changes in draft form which will be given to department heads for comment. Changes to the policy will then be made. Maintenance/Blanding Library Mr. Scherick reported that Gary Martineau, Blanding Library Maintenance, has resigned and the County would like to advertise for part-time, less than 20 hours per week at Grade 4 Step 1. The Commission gave their approval. Part Time Librarian/Blanding Barbara Roberts, Blanding Librarian, has made a request to hire an addeitional part-time librarian. It was the decision of the Commission that the current library staff should be sufficient to manage the operations of the Blanding Library. Weed Department The Weed Department has requested to hire Adam Bronson as temporary full-time at Grade 4 Step 2 at $6.12 per hour effective 4/24/95; Brian Goodwine as temporary full-time at Grade 4 Step 2 at $6.12 effective 4/24/95; and Jimmie Myrick as temporary full-time at Grade 4 Step 2 at $6.12 per hour effective 4/24/95. A motion was made by Commissioner Bill Redd to approve the requests to hire and seconded by Commissioner Mark Maryboy. UNANIMOUS. Utah State University Study Planner Scherick reported that Don Snyder, USU, has completed some draft information on maps and text and would have it mailed to the County by Thursday, April 27, 1995. USU has asked for a two month extension on the project. Commissioner Redd would like to see the economic base study for San Juan County before approving the extension. County Planning Commission Planner Scherick would like to organize a County Planning Commission with representatives from LaSal Recreation, Navajo Commission, Bluff, City of Monticello, City of Blanding, and Mexican Hat for suggestions that may be incorporated into the County Master Plan. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT Mr. Tapaha reported that Red Mesa and Mexican Water Chapter requested that a cattleguard needs to be repaired on State Road #191. The Commission suggested that he contact the State Road Department. The road between Red Mesa and Montezuma Creek has been resurveyed for realignment. Red Mesa Chapter approved the right-of-ways. Commissioner Lewis stated that the BIA and the archeological clearance need to be completed before any further work can be done. Mr. Tapaha reported that he had attended the Native American Scholarship Committee meeting in which 45-50 applications were issued. COMMISSIONER BILL REDD'S REPORT Commissioner Redd attended a Trust Land Board meeting on April 20, 1995 in Salt Lake discussing wilderness. Commissioner Redd will be a guest of Utah Local Government Trust attending a meeting in Florida on April 27-29, 1995. He attended a meeting at the Edge of the Cedars discussing Recapture on Tuesday, May 18, 1995. COMMISSIONER MARK MARYBOY'S REPORT On Thursday, April 27, 1995, Commissioner Maryboy will be meeting with the U.S. Attorney. Commissioner Maryboy will be in Gallop, NM speaking at the Navajo School Board Association meeting on Monday, May 1, 1995. Ralph Foreman of Senator Hatch's office is planning on scheduling a meeting with Indian Health Service on May 5, 1995 in Washington DC and will be notified today or tomorrow concerning the details. He stated that he would be traveling on County expenses if this meeting takes place. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the Interagency breakfast on April 18, 1995 discussing park expansion. The next breakfast will be held on May 24, 1995. He attended an AOG meeting in Price on Thursday, April 20, 1995 approving two revolving loans. They also discussed CDBG. The AOG meetings will be changed to the fourth Thursday of each month. There will be a San Juan Forum meeting in Farmington, NM on Friday, April 28, 1995. The Commission asked that Planner Scherick attend.
