SAN JUAN COUNTY COMMISSION MEETING MINUTES JUNE 5, 1995 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Gail Northern, Clerk A motion to approve the minutes of the May 22, 1995 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Ms. Shirley Donald/Road Improvement Request Ms. Shirley Donald, representing families and students from Mexican Hat Elementary School and Monument Valley High School, requested help from the County Road Department for road improvements on the bus routes to these two schools. The Commission will talk to Road Superintendent, Doug Pehrson and South Road Foreman, Lynn Laws to see what the county is doing in that area and what can be done in the future to alleviate the problems. Senior Citizens/Contracted Meals Aging Director, Frank Morrell, recommended that the contracted meals for senior citizens be increased by $.25 each (from $3.25 to $3.50). Mr. Morrell indicated this would increase the total new contract for 1995- 96 by approximately $5,000. A motion to approve the increase in contracted senior citizen meals from $3.25 each to $3.50 each providing the increase is covered within the Aging budget was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Beer License County Clerk, Gail Northern presented a beer license for Charlotte Johnson, J Bar and Steak House. A motion to approve the beer license for J Bar and Steak House was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Park Service Agreement San Juan County Sheriff, Mike Lacy presented the Park Service Agreement for Commission signature. A motion to approve the signing of the Park Service Agreement was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Dinosaur Museum Stephen and Sylvia Czerkas, representing the Dinosaur Museum, invited the Commission to view the progress of the museum. They hope to be open by the end of June. Mr. and Mrs. Czerkas requested financial help from the County toward new doors and upgrading of the restroom facilities at the museum. These repairs have cost approximately $10,000. The Commission suggested that they present their request to the San Juan County Economic Development Board. Administrative Assistant, Rick Bailey will write Mr. & Mrs. Czerkas a letter regarding their request for financial help with Museum repairs. Procurements Dell Hunter, Maintenance Supervisor, presented bids for booster heaters for the Public Safety building from Diversey for $999.00 and Jim Wight for $1200.00. A motion to approve the low bid from Diversey for a booster heater Model C- 12 for $999.00 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Gail Northern, Clerk/Auditor, presented bids for a Microtek 11 SP Scanner from Micro Systems for $519.95 and PC Connection for $569.00 to be purchased by the Title V program. A motion to approve the low bid from Micro Systems for a Microtek Scanner for $519.95 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Out of State Travel A motion to approve out of state travel for Commissioner Redd to attend the Western States Coalition, Western States Summit IV, July 12-15 in Albuquerque, New Mexico was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A motion to approve out of state travel for Commissioner Maryboy to attend the NACO convention, July 21-25 in Atlanta, Georgia was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Solid Waste Revenue Bonds/Resolution A motion to approve the following Solid Waste Revenue Bonds Resolution 1995-5 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. RESOLUTION NO. 1995-5 A RESOLUTION authorizing the issuance and confirming the sale of $711,750 Solid Waste Revenue Bonds, Series 1995, of San Juan County, Utah, for the purpose of defraying a portion of the cost of constructing a new certified landfill and establishing a county-wide solid waste collection system and related improvements; authorizing the publication of a Notice of Bonds to be issued; prescribing the form of bonds, the terms and condition of issuance and retirement and the security therefor; providing for the collection, handling and disposition of the revenues to be derived from the County's solid waste collection and disposal system; authorizing the taking of all other actions necessary to the consummation of the transactions contemplated by this Bond Resolution; and related matters. PERSONNEL/PLANNER EDWARD SCHERICK'S REPORT Assistant Librarian/Blanding Library Blanding Library Assistant, Lana Latham requested retirement benefits as she has been working 20 hours per week. It was explained by Personnel Director, Edward Scherick that the part time Assistant Librarian position is intended to be less than 20 hours per week with no retirement benefits. A motion to compensate Ms. Latham with retirement benefits for the weeks previously worked at 20 hours with the understanding that the position allows a maximum of 19 hours with no benefits was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Unemployment Benefits Personnel Director, Edward Scherick discussed with the Commission Unemployment Benefits for former San Juan County Sheriff's Department employee, Mike Pederson. A motion to approve the continued investigation to determine the County's legal position was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Employee Resignations Personnel Director, Edward Scherick informed the Commission of the resignation of Weed Department employee, Jim Myrick as of June 1, 1995. Weed Supervisor, Max Black has indicated that Mr. Myrick shall not be replaced. Mr. Scherick also informed the Commission of the resignation of 4-H Aide, Layne Livingston as of May 31, 1995. A motion to fill the 4-H Aide vacancy with Ms. Kelly Tracy from the current list of applicants at Grade 1 Step 1 effective May 31, 1995 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Supervisor Training Personnel Director, Edward Scherick discussed the need for supervisor training with the Commission. Mr. Scherick would like to schedule training to be conducted by Pryor Resources, Inc. for Monday, June 26, 1995 for all elected officials, department heads and supervisors. The cost to the County will be $2,600 for a maximum of 35 employees. A motion to approve the Supervisor Training conducted by Pryor Resources, Inc. was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. San Juan County Planning Board Appointments Planner, Edward Scherick has received nominations for appointment to the San Juan County Planning Board. The nominations are: Bill Pierce, LaSal; Gary Wilson, Grand County Water Conservancy District; Trent Schafer, Monticello City; Edward Tapaha, Utah Navajo Commission; Steve Simpson, San Juan Special Service Area #1; and Bret Hosler and Wayne Palmer, Blanding City. A motion to appoint Bill Pierce, Gary Wilson, Trent Schafer, Edward Tapaha, Steve Simpson and Wayne Palmer to the San Juan County Planning Board was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. San Juan County Economic Base Study/Dr. Don Snyder Planner, Edward Scherick reported to the Commission that Dr. Don Snyder will be in San Juan County next week to discuss the Economic Base Study. He further indicated that the study including analysis should be completed prior to July 12, 1995. Geographic Information System Planner, Edward Scherick reported that there will be a GIS meeting in Price tomorrow, June 6th at 1:00 with Dr. Ridd. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT San Juan Special Service Area #1 Administrative Assistant, Rick Bailey presented a letter from Special Service Area #1 that they requested be read into the minutes. 5/27/95 San Juan County Commission Monticello, Utah 84535 San Juan County Commissioners: The Bluff Service Area board (San Juan Service Area #1), Bluff's primary municipal government entity, fully supports the nomination of Bluff's Historic District. We applaud the local and regional volunteers and Mr. Roger Roper in their efforts to formally recognize and preserve Bluff's historic significance. Jim Sayers, Chair Bluff Service Area Susan Taylor/Fencing Ordinance Administrative Assistant, Rick Bailey informed the Commission of a letter received from Susan Taylor regarding her position with respect to the San Juan County Fencing Ordinance. Ms. Taylor opposes any change in the current ordinance which would place the responsibility for fencing upon the neighbors of those owning livestock. BIA Division of Roads Administrative Assistant, Rick Bailey informed the Commission of the BIA Division of Roads Amendment #5 to the Aneth to Ismay Grant which closes out the grant and unobligates $25,413.07, which is the balance of unused funds. Worker's Compensation Rates Administrative Assistant, Rick Bailey informed the Commission of the .7% increase in Worker's Compensation rates this year. Mr. Bailey reports that this increase is considerably lower than in years past. Cedar Mesa Site Administrative Assistant, Rick Bailey reported that an agreement has been reached for the telecommunications site at Cedar Mesa for sale and purchase from Citizens for $3,500. Mr. Bailey informed the Commission that the BLM has already reviewed the agreement and he will now give it to County Attorney, Craig Halls for review. A motion to approve Administrative Assistant, Rick Bailey to sign the agreement upon the approval by County Attorney, Craig Halls was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Montezuma Creek Dump Administrative Assistant, Rick Bailey reported that the Health Department has contacted him about some problems with the Montezuma Creek dump. It was the decision of the Commission to talk to South Road Foreman, Lynn Laws about building a ramp for ease of unloading until the transfer station is in place. Fire Department Truck Purchase A motion to approve the purchase of 2 one ton trucks for the Montezuma Creek fire department which had been previously approved with changes from crew cabs to standard size cabs and standard transmissions to automatic transmissions with an increase in price of approximately $900 per vehicle was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Treasurer/Year End Balance Administrative Assistant, Rick Bailey informed the Commission that San Juan County Treasurer, Paul Barr has indicated that the General Ledger is short to the Bank by $1,652.81 at year end 1994. The Independent Auditors recommended during their audit of the 1994 San Juan County financial records that this amount be written off to balance the General Ledger with the Bank. A motion to contact previous County Treasurer, Marian Bayles to justify this discrepancy as it occurred during her term in office was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. County Attorney, Craig Halls will contact Ms. Bayles. COMMISSIONER BILL REDD'S REPORT Meetings Last Week Tuesday, May 30 Commissioner Redd and Commissioner Lewis went on a Wilderness ground proofing tour. Wednesday, May 31 Commissioner Redd met with Senator Bennett to discuss Wilderness. At that time, Commissioner Redd also thanked the Senator for his efforts on behalf of the Montezuma Creek Clinic. Thursday, June 1 Commissioner Redd was in Salt Lake City at a CIB meeting. Meetings This Week This week Commissioner Redd has an Executive Personnel Hearing with the Southeastern Utah Health District. Thursday Commissioner Redd has a State Planning meeting. Friday Commissioner Redd will attend a Wilderness meeting in Richfield. COMMISSIONER MARK MARYBOY'S REPORT Meetings Last Week Commissioner Mark Maryboy met in Salt Lake City last week with U.S. Attorney General, Janet Reno and Scott Matheson, Jr. regarding the proposal to set up a court system on the Utah side of the Reservation. Commissioner Maryboy was in Window Rock the rest of the week discussing roads and program funding. Meetings This Week This week Commissioner Maryboy will be in Salt Lake City, Tuesday, with the Civil Rights Commission. Commissioner Maryboy will be in Albuquerque, New Mexico, Wednesday, Thursday and Friday. June 23rd Commissioner Maryboy will be in Washington, D.C. to meet with Indian Health Services, Senator Hatch, Senator Bennett and the President of the Navajo Nation. COMMISSIONER TY LEWIS' REPORT UAC Board of Directors Meeting Commissioner Ty Lewis reported that the UAC Board of Directors meeting has been changed to June 28, 1995. Wilderness Commissioner Lewis and Commissioner Redd went on a Wilderness ground proofing tour Tuesday, May 30th. Forest Road Agreement A motion to approve the updated schedule on the Forest Road Agreement was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Meetings Commissioner Lewis informed the Commission that a regional hearing on mandates for local officials will be held at the Blanding City Council Chambers on June 13, 1995 from 7:00 to 9:00 P.M. Executive Session At 3:00 a motion to convene into Executive Session regarding a Personnel Hearing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. At 3:35 a motion to end Executive Session and convene into open Commission Meeting was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS.
