SAN JUAN COUNTY COMMISSION MEETING MINUTES DECEMBER 11, 1995 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the December 4, 1995 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Mental Health Dan Rogers, Acting Director of San Juan Counseling Center, presented a proposal to retain Mark Lyman, San Juan Counseling, on a six month contract after his retirement from San Juan Counseling Center which will be effective December 15, 1995. Commissioner Redd made a motion to approve the proposal to retain Mr. Lyman on a six month contract. Commissioner Mark Maryboy seconded. UNANIMOUS. Mr. Rogers also reported that Mr. Lyman's position has been advertised. He requested that a letter be sent from the Commission to Bill Gertz, State Mental Health, requesting that the position interviews be held in this County and that the appropriate people be involved in the interview process. Road Department Bids The following bids were received for the Road Department for 1996: Filters: One bid was received for filters from Caun-Co, Cortez, Colorado. Commissioner Bill Redd made a motion to approve the bid. Commissioner Mark Maryboy seconded. UNANIMOUS. Tires: One bid was received for tires, recapping and tubes from Grand Tire Company, Moab. A motion was made by Commissioner Bill Redd to accept the bid and seconded by Commissioner Mark Maryboy. UNANIMOUS. Culverts: Three bids were received for culverts from Amcor, Wheeling, and Contech. Commissioner Bill Redd made a motion to approve the bid from Amcor. Commissioner Mark Maryboy seconded. UNANIMOUS. Oil, Grease & Antifreeze: Two bids were received for oil, grease and antifreeze from Woody's Petroleum and Black Oil. Commissioner Bill Redd made a motion to approve the bid from Woody's Petroleum. Commissioner Mark Maryboy seconded. UNANIMOUS. Batteries: Three bids were received for batteries from Caun-Co, Intermountain, and Grand Tire. Commissioner Bill Redd made a motion to approve the bid from Grand Tire. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid price lists are on file in the Commission files. BIA CONTRACT County Attorney Craig Halls has reviewed the BIA Road Maintenance Contract for the Shiprock Agency. Commissioner Bill Redd made a motion to sign the contract based on the editing and approval by the County Attorney. Commissioner Ty Lewis seconded. UNANIMOUS. Mexican Hat Transfer Station Mark Sword, San Juan Special Service District #1, reported his concerns with the dump closing and the opening of the transfer station for the Mexican Hat area. Administrative Assistant Rick Bailey explained the transfer station set-up and how it should work. Canyon Country Partnership Karron Jorgen, Acting Coordinator Canyon Country Partnership introduced herself to the Commission and explained her role as the coordinator of the partnership in which she hopes to involve San Juan County more. Sheriff Department Sheriff Mike Lacy and Lt. Bill Christensen reported to the Commission that the airplane will be ready for use by December 15, 1995 and requested permission to look for aircraft radios. The Commission gave their approval. POST/Lori Brandt A payroll change for Lori Brandt, Corrections Officer, who has completed POST was presented. It was requested to change her from Grade 12 Step 1 @ $1271 per month to Grade 15 Step 1 @ $1640 per month. Commissioner Bill Redd made a motion to approve the payroll change and seconded by Commissioner Mark Maryboy. UNANIMOUS. Building Permit A building permit was presented for Gene and LouJean Cressler, Blanding to build a new home. The permit was denied because it does not meet the zoning requirements. A variance hearing will be held on December 26, 1995 at 1:00 P.M. in the Commission room. Spanish Valley Subdivision Moratorium Administrative Assistant Rick Bailey discussed some problems with subdivision wells, septic systems and impact. Commissioner Bill Redd made a motion to place a moratorium on subdivisions in Spanish Valley until such time the County has a well/septic density study completed that is acceptable to the area or an applicable impact fee or combination of both that would make it economical for sewer and water utilities to be extended by way of the service districts. Commissioner Ty Lewis seconded. UNANIMOUS. Out-of-State Travel An out-of-state travel request was presented for Dayne Shumway, Landfill Manager, to attend a Landfill Manager training in Phoenix in January. A motion was made by Commissioner Bill Redd to approve the request and seconded by Commissioner Mark Maryboy. UNANIMOUS. An out-of-state travel request was presented for Rick Bailey, Administrative Assistant, to attend a Bureau of Reclamation meeting on San Juan River - Dam Safety to be held in Grand Junction on December 11-13, 1995. Commissioner Bill Redd made a motion to approve the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Bluff Planning Susan Taylor, San Juan County Economic Development, Theresa Breznau, Chairperson Bluff Planning and Liza Doran, Bluff presented the proposal to be presented to the Local Ecomonic Development Incentive to help with the Bluff Master Plan and Zoning to the Commission for their approval. Commissioner Bill Redd made a motion to support Bluff in their planning effort. Commissioner Mark Maryboy seconded. UNANIMOUS. 1996 Budget Approval A motion to approve across the board county employee salary adjustment of 3% allowing department heads discretion over 2% based on corrective actions was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Chief Deputy Auditor John Fellmeth presented the adjustments for the 1996 budget. A motion to approve the following resolution for the 1996 budget was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. (See attached budget.) PERSONNEL-PLANNER EDWARD SCHERICK'S REPORT Landfill Manager Personnel Director Edward Scherick introduced the new Landfill Manager, Dayne Shumway, to the Commissioners. Hired effective December 4, 1995. Executive Session Commissioner Redd made a motion to convene in to executive session concerning a personnel matter. Commissioner Mark Maryboy seconded. UNANIMOUS. Commissioner Bill Redd made a motion to exit the executive session. Commissioner Mark Maryboy seconded. UNANIMOUS. Commissioner Bill Redd made a motion to hire a second position on a temporary basis, with light equipment operator skills, for the landfill. Commissioner Mark Maryboy seconded. UNANIMOUS. Sick Leave A County employee is in need of sick leave. The County policy provides that sick leave can be donated to an individual in need. Commissioner Bill Redd made a motion to allow County employees to donate their sick leave if they desire to do so. Commissioner Mark Maryboy seconded. UNANIMOUS. Drug Testing Personnel Director Scherick reported on a drug testing consortium that the County can join. Commissioner Bill Redd made a motion to approve the County joining a consortium for drug testing. Commissioner Mark Maryboy seconded. UNANIMOUS. Monticello Senior Bus Driver Personnel Director Scherick presented the name of David Fisher to be approved as the Monticello Senior bus driver at Grade 1 Step 1 @ $5.39 per hour, to replace Candice Weed who resigned from the position. A motion was made by Commissioner Mark Maryboy to approve the hire and seconded by Commissioner Ty Lewis. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT There will be a Blue Ribbon Committee meeting on December 18, 1995 at 6:00 P.M. in the Bluff Community Center. UAC Mutual will be in the County to talk to employees on December 18, 1995 at 8:00 A.M. Incorporation Feasibility/Bluff Mr. Bailey presented a letter and petition from Steven Simpson, San Juan County Service Area #1, requesting that San Juan County proceed with an incorporation feasibility study. Mr. Bailey asked that the Clerk's office check to see if the names on the petition are registered voters. Bluff Underground Storage Tanks Administrative Assistant Rick Bailey reported on the Bluff underground storage tanks. Commissioner Bill Redd made a motion to approve the contract from Growth Environmental to mitigate the Bluff fuel tanks. Commissioner Mark Maryboy seconded. UNANIMOUS. Eastland Water District Administrative Assistant Rick Bailey requested permission to change the request of 10 acre feet to 25 acre feet of water from the Montezuma County Water Company to the Eastland Community. Commissioner Bill Redd made a motion to approve the letter change of 10 acre feet to 25 acre feet. Commissioner Mark Maryboy seconded. UNANIMOUS. Road Dept/Truck A motion was made by Commissioner Redd giving Administrative Rick Bailey permission to order a 3/4 ton truck @ $19,444 for the road department. Commissioner Mark Maryboy seconded. Landfill Administrative Assistant Rick Bailey reported on the progress of the Landfill as follows: The compactor will be delivered on 12/12/95; the septic tank has been delivered; the fencing material for the transfer stations will be here this week and the generator is wired in to the building. Landfill Truck Commissioner Redd made a motion to purchase a 3/4 ton truck for the landfill from Young Chevrolet, Layton at $20,383. Commissioner Mark Maryboy seconded. UNANIMOUS COMMISSIONER MARK MARYBOY'S REPORT Commissioner Mark Maryboy requested that a public notice be drafted and distributed to the Montezuma Creek residents concerning the closure of the dump. Last week Commissioner Maryboy was in Las Vegas attending and Tribal investment meeting. This week Commissioner Maryboy will be in Phoenix on December 12-13, 1995. He will be in his Aneth office on December 14-15, 1995. COMMISSIONER BILL REDD'S REPORT Last week Commissioner Redd attended a CIB meeting and the Growth Summit meeting. Commissioner Redd will go with Dayne Shumway, Landfill Manager, to look at landfills. Commissioner Redd will attend the RS2477 meeting in St. George on December 15, 1995. COMMISSIONER TY LEWIS' REPORT There will be a RS2477 workshop in St. George on December 15, 1995. The Blue Ribbon Committee meeting will be held on December 18, 1995 at 6:00 P.M. in the Bluff Community Center. There will be an Interagency Breakfast on December 13, 1995 at 8:00 A.M. at Houston's Cafe. The Severance Tax Task Force meeting will be held on December 13, 1995 at 11:30 A.M. in Salt Lake City.
