SAN JUAN COUNTY COMMISSION MEETING MINUTES FEBRUARY 12, 1996 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Merna Johnson, Deputy Clerk A motion to approve the amended minutes of the February 5, 1996 meeting was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Commission Meeting The next Commission Meeting will be held Tuesday, February 20, 1996 due to the Presidents Day Holiday. Cal Black Memorial Airport Resolution 1996-02 A resolution restricting aircraft landings and take-offs at the Cal Black Airport to aircraft with a maximum certified takeoff weight of less than 30,000 pounds was presented by Administrative Assistant Rick Bailey for approval. RESOLUTION - 1996-02 Whereas, it has been determined by the Federal Aviation Administration that the airstrip at the Cal Black Memorial Airport located at Halls Crossing, San Juan County, Utah; is safely constructed for aircraft weighing less than 30,000 pounds. Therefore, the San Juan County Commission, by resolution have provided that no aircraft with a certified weight in excess of 30,000 pounds are prohibited from landing and taking off from the Cal Black Memorial Airport. If in the event an aircraft weighing more than 30,000 pounds does utilize the airport and causes damage to the airport runway and/or other facilities at the airport, the owner and/or operator of the aircraft will be responsible for repairs. Approved this 12th day of February, 1996. /s/ Ty Lewis, Chairman San Juan County Commission A motion to approve the resolution was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS Wilbur Capitan, Aneth Chapter Wilbur Capitan of the Aneth Chapter met with the Commission to present a report of the road projects and budget for the past year and the new budget they will be proposing for the Aneth area. Mr. Capitan, on behalf of all the Utah Navajo Chapters, expressed appreciation to the Commission for the assistance the County gives with these projects. Chairman Lewis thanked Mr. Capitan for the excellent report and expressed appreciation for the way Aneth Chapter used the funds and in getting the work done. He stated that if the Chapter could get the right-of-ways on the roads in that area it would be much easier to do the necessary road work. Mr. Capital reported that they are working on that issue as well as gravel permits. Commissioner Maryboy recommended that Mr. Capitan call Gary Moore to follow up on the gravel and the status of the 38 miles of roads that are being worked on. Beer License Renewal/Cottonwood Steak House County Clerk Gail Northern presented the beer license application renewal for the Cottonwood Steak House. A Motion to approve the application was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS Natural Bridges National Monument Steve Chaney, Director of the Natural Bridges National Monument, met with the Commission to review the Draft Environmental Impact Statement; General Management Plan; Development Concept Plan; Interpretive Prospectus; Wilderness Suitability Study; Wild and Scenic River Eligibility/Classification Study for the Natural Bridges National Monument area. The Commission feel that the visual impact should be from the periphery looking in and not from inward looking out. PLANNER-PERSONNEL DIRECTOR ED SCHERICK'S REPORT A motion into convene in an executive session to discuss personnel matters was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS A motion to adjourn the executive session and reconvene the regular session of Commission Meeting was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS Aging Secretary,Cheryl Ewart Personnel Director Edward Scherick indicated that he had met with Aging Director, Frank Morrell, who is in the process of restructuring the Aging program. Mr. Scherick recommended that Aging Secretary, Cheryl Ewart be given a promotion from Grade 5 Step 14 at $1,270 to Grade 6 Step 14 at $1,318 per month for additional duties that will be given her. After discussion, a motion to approve the recommendation was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS Personnel Policy Wording Addition Personnel Director Scherick presented the following addition for page 11, paragraph G, Hiring Procedures, sub paragraph 2 in the Personnel Policy: Upon being given approval to recruit, the personnel officer shall prepare, advertise, and post the opening where all county employees will be made aware of the opportunity. In some instances where a temporary employee is functioning in a similar position, as that being recruited for, the Department Head will have the option of filling the vacancy without formal recruitment or competition so long as the temporary employee qualifies for the position. This qualification procedure will be met when 1) the employee has been in a temporary position for a period of at least three months, and 2) has satisfactorily performed the duties for which they have been assigned. A motion to approve the addition was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS Condor Comment Period Planner Scherick reported that the comment period on the Condor issue has been extended until the end of February. Planning Monies Planner Scherick stated that he has applied to the GOPB for the $12,000 reimbursement grant for the Master Plan. Meeting Schedule Planner Scherick will attend the following meetings: February 12, 3:30 p.m. with Joe Barton on property for U-211 Kiosk February 13, 7:00 p.m. Planning Meeting in Mexican Hat February 13, a meeting on the Bridges Master Plan February 20, 9:30 a.m. meet with Karen Jargen from Canyon Country Partnership February 28, 10:00 a.m. Executive Board of San Juan Forum, at Durango Final plans will be made for an ArcView Training to be held around February 20th in Moab. There will be college credit given to those who complete the training. Table of Organization In order to comply with Auditor requests, Personnel Director Ed Scherick presented the Commission with the San Juan County Table of Organization. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permit/Hadenfeldt A building permit for Vaugn Hadenfeldt for a residence in Bluff was presented to the Commission for approval. It was noted that the San Juan Service Area #1 has given their approval for the construction. Commissioner Redd made a motion to approve the permit with Commissioner Maryboy seconding the motion. UNANIMOUS Utah-Navajo Commission Meeting Administrative Assistant Rick Bailey attended the Utah-Navajo Commission meeting held Thursday, February 8, 1996 in Montezuma Creek. Items discussed were: Recreation, 911 , Roads, Landfill, Montezuma Creek Fire Station, and the Grant Application to the Navajo Nation. While the funding issue for the Montezuma Creek Fire Station was resolved, the location was still a point in question. Red Mesa Chapter officials would like to see the station located at the Old Phillips Camp while the local fire department people want to see it in Montezuma Creek. The cost would be considerably higher at the Old Phillips Camp as a new facility would have to be built as well as a parking lot and roads. San Juan County School Board Meeting The San Juan County School Board has ask Administrative Assistant Rick Bailey to attend the School Board meeting to be held Thursday, February 15, at Montezuma Creek in regards to the old Montezuma Creek Elementary School. The windows have been broken out and kids are climbing in and some transients have been sleeping in there. The County has a lease on the building from the Navajo Nation. Mr. Bailey stated that it was a safety hazard and recommended that Building Maintenance Supervisor, Dell Hunter go down and board up the windows. After discussion the Commission concurred with the recommendation. MillSite Property Administrative Assistant Rick Bailey met with Audrey Berry of the Department of Energy concerning the transfer of the old millsite property back to the City of Monticello. It was felt that it would be more expedient to have the property deeded back to the City of Monticello congressionally as the city could begin some work immediately. Mr. Bailey requested letters from the City of Monticello and the SSAB (Site Specific Advisory Board) to indicate their desires on the issue. San Juan County Landfill Operation A report of the first months operation of the new San Juan County Landfill was presented. There were 53 loads of garbage totaling 232 tons. $9 in cash and $54.75 in checks was collected. $4,717.24 was billed to Baker Sanitation. Landfill Director, Dayne Shumway, asked Mr. Bailey to request clarification of a uniform cost on tires and pickup loads at the landfill as there has been some confusion among users. After some discussion the Commission recommended $3 per pickup load and $1 per tire. Mr. Bailey will put some ads in the papers to notify the public of these fees. Old Library Building - Bluff The San Juan Service Area #1 in Bluff have requested use of the old Library building for administrative purposes for the Service Area. They are willing to pay the utilities and insurance and repair the windows and door. As soon as the underground storage tank issue has been settled the property will be transferred to the Service Area. The Commission granted the request. Subdivision Moratorium The Commission discussed the status of the Subdivision Moratorium as a request had been received from Mitch Kelling for approval to divide 6 acres 1/2 mile west of Velcar in Spanish Valley into two or three lots. He has a water well in connection with his home and would share the water with the other homes. The Commission want to keep the moratorium in place until such time as an agreement can be reached with the Special Service District to bring their sewer line to the County line. The Commission also feel an addendum needs to be added to the Subdivision Ordinance to require wise use of sharing of water. If a residence is within 1/4 mile of the water/sewer line they would be required to hook on to those lines. Any addition to the ordinance would require another public hearing. Bluff Transfer Station Administrative Assistant Rick Bailey and Planner Edward Scherick checked on a potential site for the transfer station in Bluff. Melvin Dalton has 15 acres he has offered to trade for other property in the area. A value needs to be ascertained on that property to complete that proposal. An alternative site would be at the old Bluff dump where a lock could be put across the cattle guard to keep people out when it was closed. Waiver of Fees/School Buildings Administrative Assistant Rick Bailey met with the Superintendent of the San Juan County School District in connection with the waiver of fees for the use of school district buildings for recreation activities. The School District feels that the patrons using the facilities take better care of the building when a fee is charged for the activities as the custodians have to go in and clean up after the activity is over. The Commissioners feel that the interest the School District receives from the monies should cover the activity fees. Senior Citizen Bus Accident Administrative Assistant Rick Bailey reported that repairs to the Senior Citizen Bus that was involved in an accident a couple of weeks ago will cost approximately $650. Blanding Library Fire Cleanup The cleanup and repairs to the Blanding Library after the recent fire have been completed. Southeast Utah Health District Board The term of Edward Tapaha as a member of the Southeast Utah Health District Board expired December 31, 1995. He has expressed a desire to continue serving on that board. A motion to reappoint Edward Tapaha to the Southeast Utah Health District Board was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS Recreation Compliance Agreement Administrative Assistant Rick Bailey presented the Recreation Compliance Agreements between the County and the Utah Navajo Chapters for signature. Previously the money for the administration of the recreation program in the Chapters has gone through the School District. The Chapters have requested that the funds go directly to them to be matched by chapter funds for the programs. The Chapters will be required to make an annual reporting on the revenues, expenditures and programs. A motion to approve the Compliance Agreement was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS Meeting/Activity Schedule Administrative Assistant Rick Bailey will be involved in the following meetings/activities: February 13, Mexican Hat/Bluff - transfer station locations. February 14, Spanish Valley - meet with Dale Pehrson on sewer problem. February 15, 911 addressing at Natural Bridges and to Halls Crossing. to check on the dump. School Board Meeting - Montezuma Creek February 16, Bluff - 911 addressing. February 21, Navajo Public Safety Meeting at Red Mesa Chapter Future Meeting Schedule for Commissioners There will be an Interagency Breakfast meeting on Tuesday, February 20th at 8:00 a.m. The Blue Ribbon Committee meeting is tonight, February 12th at 6:00 p.m. at the San Juan Library. The Mexican Hat Planning meeting will be February 13th at 7:00 p.m. The NACo meetings are coming up at the end of the month and first part of March. The UAC Management Conference is the first part of April. COMMISSIONER BILL REDD'S REPORT Condor Meeting Commissioner Redd attended the Condor meeting on February 7th in Kanab. He reported three areas of concern; 1) the legal requirements of NEPA have not been fulfilled, 2) a scientific thesis on Condor habitation in Southern Utah, 3) a conflict of interest with the Peregrine group having done the study and also contracting to fulfill it. Meetings On February 8th Commissioner Redd attended the UAC Legislative Committee meeting in Salt Lake City and lobbied in the Legislature. On February 9th, Mr. Redd attended a Legislative briefing and the UAC luncheon with the governor and legislature. Commissioner Redd will attend the Blue Ribbon Committee meeting in Blanding. Wednesday and Thursday he will attend the State Comprehensive Planning Meeting. On February 15th Commissioner Redd will represent the Commissioners at the Legislative Committee Meeting at the State Capitol. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy reported that he met with the Navajo-Utah Commission last week. He also met with the New Mexico State Legislature on some of the legislation that the Navajo Nation has sponsored. Mr. Maryboy attended a meeting with various State Senators and State Legislators regarding the working relationships between the various tribes and New Mexico. In Window Rock, Commissioner Maryboy is still working on the 1997 fiscal year budget. He will be in Window Rock Tuesday and Wednesday. Thursday and Friday Mr. Maryboy will be in Salt Lake City attending the BLM Advisory Council, the Resource Advisory Council, and meeting with Bruce Babbitt of the Department of the Interior. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis met at the State Capitol building with Representative Holgren concerning the B & C Road Money. Mr. Holgren felt there were some inequities with the Federal monies that are appropriated for the state highways. Mr. Lewis also attended the Utah Association of Counties Board of Directors Meeting. Commissioner Lewis attended the Legislative Briefing and the luncheon with the governor and legislators and a hearing by the DWR on Hunter Education. Meetings Commissioner Lewis will attend the Blue Ribbon Committee meeting in Blanding on Monday and the Planning meeting in Mexican Hat on Tuesday.
