SAN JUAN COUNTY COMMISSION MEETING MINUTES JULY 22, 1996 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Gail Northern, Clerk A motion to approve the minutes of the July 15, 1996 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. There were only two Commissioners present at the time the action was taken. Kate Kitchell/Lynn Jackson-SUMO Kate Kitchell, BLM and Lynn Jackson, Project Coordinator on SUMO, updated the Commission on the SUMO Copper Company project. The comment period closed July 15 and they are now reviewing and analyzing the comments received. Mr. Jackson discussed a few of the issues as a result of the comments: a. Post-mining water quality (the pH will be quite high, they will investigate alternative uses for this water) b. Cultural resources impact ("Vision Quest" appears to be the only site of any impact) c. Transportation and traffic impacts and conflicts (Rick Bailey will provide them with information on what is currently being hauled through the communities) d. Air quality (dust) e. Noise impacts (blasting, sirens, truck traffic) The final Environmental Impact Statement should be ready in mid- September. There will be a 30 day comment period and then it is projected that approval will be in mid-November. The Commission is interested in seeing this project proceed and offered their assistance in any meetings with the State, etc. There would be approximately 140 new jobs created. These would include positions for local miners, heavy equipment operators, and blasters. Kane Gulch Visitor Station Commissioner Maryboy indicated that the Navajo Nation may be interested in a cost-share with the BLM regarding a position at Kane Gulch. District Manager Kitchell will prepare a concept paper for Commissioner Maryboy, John Housekeeper, Utah Navajo Trust, and Edward Tapaha, Utah Navajo Commission. Healthy Range Standards and Guidelines Ms. Kitchell reported that on September 10, 1996 there will be an open house from 3:00 to 5:00 and a meeting to hear public comment from 7:00 to 9:00 that same day to address the Healthy Range Standards and Guidelines. Government Accounting Office Ms. Kitchell informed the Commission that representatives from the Government Accounting Office will be in Monticello on Friday. They will be looking at the local federal agencies to see how they are working together and for efficiencies in the management of public lands. Fees/Local Area Management Ms. Kitchell will meet with County Planner, Ed Scherick regarding the possibility for the County to begin assessing fees at local recreation sites. The fees would be retained locally for management of the areas. A likely site would be Recapture Lake. Mr. Scherick will also discuss this further with County Attorney, Craig Halls. USU Extension/County Employee Replacement USU representatives Steve Cox and Dr. Bob Gillaland, Extension Agent, Jim Keyes, and Home Economist, Francis Price came before the Commission to discuss the position vacated by the current Extension secretary. Some of the options discussed were: combining counties, use of graduate students, and the removal of some non-Extension responsibilities from that department. Personnel Director, Ed Scherick will meet again with Mr. Keyes and Ms. Price to discuss changes in the department and then bring a recommendation to the Commission. Wide Area Network Data Processing Manager, John Fellmeth discussed the options available to the County to connect to the State Wide Area Network and the public libraries connection to the Internet. The County Courthouse connection to the State Wide Area Network is nearing completion. The preferred option for the libraries to connect to the Internet is to go through the San Juan School District. Administrative Assistant Rick Bailey will set up a meeting with the School District for Commission Meeting on August 5th to discuss the fees the District is charging for this connection. Public Safety Building/Airway Maintenance Supervisor, Dell Hunter requested permission to contact Lynn Ray and Payson Sheet Metal to find the easiest and least expensive way to improve the heating and air conditioning airway in the courthouse. The Commission gave their approval to get some information on the project. Out of State Travel Economic Development Director, Peggy Humphreys requested permission to travel out of state to visit a Heritage Tourism Site in San Luis, Colorado. A motion to approve the out of state travel was made by Commissioner Redd and seconded by Commissioner Lewis. There were only two Commissioners present at the time the action was taken. CSBG Contract Amendment Aging Director, Frank Morrell presented an amendment to the CSBG contract. The new amount is $23,636. A motion to approve the amendment to the CSBG contract was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Lynn Adams/Doe Clean-up Mr. Lynn Adams requested assistance from the Commission to stop the DOE hauling unfit top soil to his property. Mr. Adams believes that the soil they are planning to use is contaminated with bind weed. He indicated the soil had been tested but that he was not satisfied with the results. Mr. Adams also indicated that he had found some soil at another location that would be acceptable to him. An emergency motion for the health and welfare of the residents of San Juan County to protect the agricultural base of San Juan County, the Department of Energy on the Mill Reclamation Site and consequent transporting of soils from place to place are required to have the soils tested for noxious weeds, pesticide residue, and spray contamination by an independent tester and the Commission suggests that Utah State University be the independent tester was made by Commissioner Redd and seconded by Commissioner Lewis. There were only two Commissioners present at the time the action was taken. Upon further investigation by the Commission, it was found that proper policies and procedures had been followed. A motion to strike the previous motion was made by Commissioner Redd and seconded by Commissioner Lewis. There were only two Commissioners present at the time the action was taken. Nick Sandberg/BLM Nick Sandberg, BLM discussed the problem of overuse of elk on BLM and Forest Service land because of the drought. According to the BLM there is no overuse at this time. The Forest Service is still assessing the situation. Mr. Sandberg agreed on the need to reassess the situation in September so that wildlife reductions can be evaluated in the fall rather than waiting until the spring. Cooperative MOU Mr. Sandberg indicated that the Cooperative MOU is close to being finalized. County Planner, Ed Scherick will set up a meeting with the BLM and the Commission to finalize. COUNTY PLANNER ED SCHERICK'S REPORT Master Plan Planner Scherick presented the Commission a copy of the preliminary Master Plan. The costs for printing are $24.00 per copy for unbound and $22.00 per copy for bound. Mr. Scherick would like to order 50 copies at $24.00 and 150 at $22.00 for a total expenditure of $4,800. The plans could be ready in about a week. A motion to approve the printing of the Master Plan was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Navajo Nation Drought Funding Commissioner Maryboy reported that the Tribal Council had overruled Navajo Nation President, Albert Hale's veto on drought funding. Montezuma Creek Planning Commissioner Maryboy inquired about the process for Montezuma Creek to attain funding for planning. They will need to go through the County Economic Development office and then bring their application to the Commission for signature. Red Mesa Chapter/Road #445 The Red Mesa Chapter has requested that the County install culverts and place gravel on Road #445. South Road Foreman, Lynn Laws will speak to Edward Tapaha regarding this matter. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Cal Black Airport/RFP Mr. Bailey discussed the Request for Proposal for the Fixed Base Operator at the Cal Black Airport. It was the decision of the Commission to exclude the mandatory shuttle from the RFP. Navajo Mountain Grader Jamie Holgate, Navajo Mountain requested a quote from San Juan County to repair their grader. Mr. Bailey will send a quote. Landfill Escrow Account A motion to authorize Commissioner Lewis to sign the escrow agreement with the Utah State Treasurer for the purpose of a Landfill Escrow Account was made by Commissioner Redd and seconded by Commissioner Lewis. There were only two Commissioners present at the time the action was taken. Kenworth Truck Replacement A motion to replace the Kenworth truck transferred to the Blanding Shop to replace the wrecked truck with an Autocar in the amount of $64,601 from Great Basin Trucks, Inc. was made by Commissioner Redd and seconded by Commissioner Lewis. There were only two Commissioners present at the time the action was taken. Transfer Station Employees Administrative Assistant, Rick Bailey reported that he will be interviewing applicants Monday, July 29, 1996 for the Transfer Station workers. Mr. Bailey will come before the Commission on Monday, August 5th with his recommendations for hire. Monument Valley Hospital Mr. Bailey reported that the Monument Valley Hospital closed as of Friday, July 19th at 5:00 PM. The hospital closing also has an effect on fire and ambulance service in that area. The Commission gave their approval for Mr. Bailey to make an offer to the hospital on some of the equipment the County could use for those purposes. Meetings Monday, July 29th, Mr. Bailey will attend a meeting in Bluff regarding the potential incorporation of the community. Tomorrow, July 23rd, Mr. Bailey will travel to St. Johns to meet with other counties on the Navajo Indian Reservation to discuss Native American Indian issues. Mr. Bailey will attend a Management Training Seminar at the University of Arizona next week. The next drought meeting is scheduled for Tuesday, July 30th. COMMISSIONER BILL REDD'S REPORT Meetings July 16th Commissioner Redd and Administrative Assistant, Rick Bailey attended an internet training. July 17th and 18th Commissioner Redd attended a CIB retreat and on the 19th he attended a township meeting in Provo. On July 23rd Commissioner Redd will attend the meeting in St. Johns with Commissioner Lewis and Administrative Assistant, Rick Bailey. Friday, the 26th Commissioner Redd will attend the State Comprehensive Planning meeting and he will also attend a UAC meeting of Commissioners and Sheriff's leadership group. On Tuesday, the 30th of July, Commissioner Redd will travel with Administrative Assistant, Rick Bailey to Tucson, Arizona for a Management Training Seminar at the University of Arizona. COMMISSIONER TY LEWIS' REPORT Solid Waste/Blanding & Monticello Cities Last week, Commissioner Lewis met with Blanding and Monticello cities regarding solid waste issues. Several agreements were reached. These written understandings will be added to these minutes as follows: The County has offered the cities the use of the county equipment and operator to help them in closing their dumps. Each city will be required to obtain the proper permits, land source and soil source to be used in the cover up. The County Road Dept. will then schedule to complete these projects. In order to help the County residents living outside of the city limits the County would be willing to put in a transfer station at county expense on city property and then turn the transfer station over to each city to manage. Meetings Commissioner Lewis was a guest on Utah Public Radio in Blanding on Thursday, July 18th. Commissioner Lewis will be in St. Johns on Tuesday, July 23rd with Commissioner Redd and Administrative Assistant, Rick Bailey. Thursday, July 25th there will be a meeting at Recapture Lake. Friday, July 26th Commissioner Lewis will attend the UAC meeting with Commissioners and the Sheriff's leadership group. Monday, July 29th Commissioner Lewis will attend the meeting in Bluff in regard to the potential incorporation of the community. The next drought meeting is scheduled for Tuesday, July 30th at the Courthouse. Thursday, August 1st Commissioner Lewis will attend a UAC Insurance Mutual meeting. Saturday, August 3rd, Commissioner Lewis plans to attend the Navajo Mountain Pioneer Day celebration.
