SAN JUAN COUNTY COMMISSION MEETING MINUTES NOVEMBER 4, 1996 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the October 28, 1996 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Commission Meeting There will be no Commission meeting held on November 12, 1996 due to UAC Conference. Typewriter/Justice Court Lyon Hazleton, Justice Court, presented a procurement for a AE-710 Nakajima typewriter from Communications Plus @$399.00 and from Office Max for an IBM Wheelwriter 2 typewriter @499.00. A motion was made by Commissioner Bill Redd to approve the purchase of the typewriter from Communications Plus and seconded by Commissioner Mark Maryboy. UNANIMOUS. Fair Building/Roof Building and Grounds Supervisor Dell Hunter and Fair Supervisor Lillian Taylor requested permission to re-roof the fair building. The Commission gave their approval to have the fair building re-roofed. Out-of-State Travel Fair Supervisor Lillian Taylor requested permission to travel out-of-state to attend an International Association of Fairs and Expositions in Las Vegas on December 1, 1996. A motion was made by Commissioner Bill Redd to approve the travel request and seconded by Commissioner Mark Maryboy. UNANIMOUS. San Juan Counseling Center Director Dan Rogers and Business Manager Robert Johnson, San Juan Counseling Center, met with the Commissioner to discuss their goals of transition from the State to an independent system and the possibility of setting up a special service district for the Counseling Center. The Commission gave Administrative Assistant Rick Bailey permission to begin the process. Nick Sandberg/BLM Nick Sandberg, BLM, reported that the BLM is purchasing 120 acres east of Hovenweep from Jim Cline. For tax base purposes the County would like equal land exchanged. Fire Wood Tags The BLM is implementing a program requiring that a 3/5" orange fire wood tag with an expiration date and hole punches for date harvested be secured to a load of wood before it is removed from BLM lands. Each tag is for a half chord and is for one time use only. The BLM is looking into having the Chapters sell the firewood tags to make it easier for Native Americans to purchase permits. Bluff Airport Nick Sandberg, BLM, reported that a possibility for hard surfacing of the Bluff airport is to use the material that is in the old Bluff pit or to take it off the airport lease site. Commissioner Lewis suggested that the permit issue be pursued. Mexican Hat Treatment Plant Mr. Sandberg reported that the Mexican Hat Water Treatment Plant proposal is still in the process. White Mesa is also interested in a water treatment plant and line through BLM land. San Juan Health Care District Nancy McMurtry, Interim Director San Juan Health Care, and Kent Alland, Administrator Lutheran Health System met with the Commission and discussed the Monument Valley Clinic and the emergency medical situation in Monument Valley. Ms. McMurtry also stated that IHS has been very cooperative in this joint venture in continuing services in Monument Valley. San Juan Health Care District is negotiating with the LaFonts the possibility of leasing the clinic facility. The LaFonts have met with the Health Care Board and have agreed to a two year lease for $1.00 per year. San Juan Health Care asked the Commission for tax exemption on that portion of the property that will be used for the clinic. The Commission agreed to this as long as LaFonts are not making a profit on the clinic. Commissioner Lewis asked San Juan Health Care to write a letter to the County requesting exemption and indicate the agreement with LaFonts. Catering Contract/White Mesa Aging Director Frank Morrell presented the White Mesa Home Delivered Meals contract for renewal at a cost of $3.50 per meal for the period July 1996-May 1997. A motion was made by Commissioner Bill Redd to approve the contract and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the motion was made. Road Dept/Memo Road Supervisor Doug Pehrson and Road Office Manager Wanda Franklin presented a memorandum concerning Road Department accounts for approval. This will be given to all departments. The memorandum is as follows: Due to problems with invoices not being paid by other departments, the Road Department can no longer allow ordering off of their accounts. Anyone using a Road Department account with out their permission and purchase order will be responsible solely for the purchase. Bids/Radio-Communications Trailer A bid was submitted for a radio for the communications trailer from Midway Aviation for a 720 Icon Aviation Radio @$1439 to be paid with a CDBG grant. A motion was made by Commissioner Bill Redd to approve the bid and seconded by Commissioner Ty Lewis. Commissioner Maryboy was not present at the time the motion was made. Ileen Christensen/ Subdivision Variance Administrative Assistant Rick Bailey reported that he had spoken with County Attorney Craig Halls concerning a subdivision variance for the Ileen Christensen property that is located in the Hole In the Rock area. Mr. Bailey stated that the County Attorney said that there was no need for a variance. They have met the requirements for exemption within the subdivision ordinance. Mr. Bailey will write to the Christensen's informing them that exemption from the subdivision is approved. A motion was made by Commissioner Bill Redd to approve the exemption. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present when the action was taken. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Bluff Plan Planner Scherick reported that he met with the Bluff group at the County Planning meeting held on October 29, 1996. A report on the Bluff Master Plan was presented. It was decided that before a hearing on the plan could be held two issues needed to be resolved. They are 1)whether or not a planning commission could be placed over the Service District and 2)whether or not a tax could be levied to offset the cost of the county to provide services needed in the community. At the present time all zoning and permitting is taxed and monitored on a countywide basis. If zoning regulations go beyond what the county is currently doing, additional costs would have to be passed on to the Service or Planning District. Mr. Bailey and Mr. Scherick were instructed to write a letter to the Bluff Board notifying them of this concern and offer some possible solutions. Bluff/Mexican Hat Transfer Station Personnel Director presented the name of Tracy Reddoor of White Rocks to be the new attendant at the Bluff and Mexican Hat Transfer Stations to be hired at Grade 1 Step 1 @5.50 per hour at not more than 29 hours per week. A motion was made by Commissioner Bill Redd to approve the hire and seconded by Commissioner Mark Maryboy. UNANIMOUS. Staffing Plan Personnel Director Scherick reported that he had met again with the department heads with the exception of the Sheriff's Department to clarify the staffing plan. Mr. Scherick will meet with the Sheriff's office at 11:00 A.M. After a discussion a motion was made by Commissioner Bill Redd to approve the staffing plan and seconded by Commissioner Mark Maryboy. UNANIMOUS. Emergency Hire/Aging Personnel Director Scherick reported that Bessie Spencer, Contract Cater at Bluff, has some health problems. Commissioner Bill Redd made a motion to approve filling her position on an emergency basis unti the position can be properly advertised. Commissioner Mark Maryboy seconded. UNANIMOUS. Canyonlands Strategic Plan Planner Scherick stated that he had reviewed the Canyonlands Strategic Plan for Canyonlands National Park. He does not see a public process in the plan. The County would like to be involved. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Administrative Assistant Rick Bailey attended a meeting in Salt Lake with the Met Johnson group regarding their plans for the Western States Coalition filing suit against the Department of Interior in connection with the Grand Staircase National Monument issue. This week Mr. Bailey will attend a meeting in Salt Lake concerning funding and response of hazardous materials in rural Utah. The Region is looking at combining response teams in geographical areas. He will also be meeting with the Department of Environmental Quality concerning the underground leakage of a storage tank in Bluff. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy met with the Governors office regarding Utah Navajo issues of funding projects through the state and encouraged his support, park designation, and the incident regarding grading of the road. He told the Governor it is very important for Native Americans to access some of those roads as it deals with wood gathering, religious activities, and necessities of life. Commissioner Maryboy attended a special session in which an "Appropriations Act" was tabled until winter session. Commissioner Maryboy had presented a bill which encouraged that counties be the first priority to receive funding. Meetings Commissioner Mark Maryboy will be in Window Rock on November 5, 1996. On Wednesday he will be in the Aneth office. On November 7, 1996 he will attend the Utah Navajo Commission meeting and on Friday he will be in the Aneth Office. COMMISSIONER BILL REDD'S REPORT Commissioner Redd and Commissioner Lewis attended an RS2477 meeting in St. George last week. Commissioner Bill Redd made a motion to accept Ron Thompson & Associates as legal council on the RS2477 road issues. Commissioner Ty Lewis seconded. Commissioner Maryboy was not present when the motion was made. This week Commissioner Redd will attend a CIB meeting on November 7, 1996. COMMISSIONER TY LEWIS' REPORT Last week Commissioner Lewis attended the LaSal Community meeting in which they discussed fire, planning, and solid waste. On Tuesday, October 29, 1996 Commissioner Lewis attended the road litigation meeting in St. George. On October 30, 1996 Commissioner Lewis attended the League of Cities and Towns meeting in Provo. A discussion was held in which the State would like to transfer some roads to the Counties. A subcommittee has been set up to discuss these issues. The subcommittee concluded that if the roads are transferred after the paving cycle is up, the funding will be furnished for maintaining the roads for the next seven years at the level that the State is funding. The roads would not have to be maintained at the state level requirement. On November 6, 1996 Commissioner Lewis will attend the North Creek Water project meeting in Monticello. The UDOT will hold a meeting at the Monticello Park Pavilion on November 12, 1996 at 6:00 P.M. for input on any road projects that the different entities might have. The Utah Association of Counties Convention will be held on November 12-16, 1996 in St. George. There will be no Commission meeting on Tuesday, November 12, 1996 due to UAC Conference in St. George. Commissioner Redd will attend the Western States Coalition and Commissioner Maryboy will be in Window Rock. The Commission will canvass the election on Monday, November 11, 1996 at noon. There will be a Tri-State meeting in McKinley County on November 20, 1996 at 1:00 P.M. The Road Department is holding its yearly meeting on November 21, 1996 from 8-4 P.M.
