SAN JUAN COUNTY COMMISSION MEETING JANUARY 21, 1997 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the County Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk Absent: Mark Maryboy, Vice-Chairman A motion to approve the minutes of the January 6, 1997 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. UNANIMOUS. Commission Meeting There was no Commission meeting held on January 13, 1997 due to the large amount of snowfall. Resolution to Establish-Substance Abuse/Mental Health Service District Commissioner Bill Redd made a motion to approve Resolution 1997-01 establishing the San Juan Substance Abuse/Mental Health Service District. Commissioner Ty Lewis seconded. UNANIMOUS. The Resolution is as follows: RESOLUTION TO ESTABLISH The Board of County Commissioners of San Juan County, Utah, met in regular session on January 21, 1997, at its regular meeting place in Monticello, Utah at 10:00 A.M., with the following members present: Ty Lewis, Chairman Bill Redd, Commissioner Also Present: Gail Northern, County Clerk/Auditor Rick M. Bailey, Administrative Assistant LaVee Scherick, Commission Clerk Absent: Mark Maryboy, Commissioner After the meeting had been duly called to order and after other matters not pertinent to this resolution had been discussed, the County Clerk presented to the County Commission a Certificate of Compliance with Open Meeting Law with respect to this January 21, 1996 meeting, a copy of which is attached hereto as Exhibit "A". The Clerk then stated that one protest had been received in her office during the fifteen-day protest period following the December 30, 1996 protest hearing, that less than 50% of the qualified voters of the territory proposed to be included within the proposed special service district and the owners of less than 50% of the taxable value of the taxable property included within the proposed special service district have filed written protests against the specified type of service, within said district, proposed to be furnished and that according to the proceeding adopted at the December 30, 1996 meeting, the County Commissioners should not consider a resolution creating the District. The following resolution was then moved for adoption by Commissioner Redd: RESOLUTION 1997-01 A RESOLUTION TO ESTABLISH THE SAN JUAN COUNTY SUBSTANCE ABUSE/MENTAL HEALTH SPECIAL SERVICE DISTRICT, TO ESTABLISH THE PROVISION OF SUBSTANCE ABUSE AND MENTAL HEALTH SERVICES SET FORTH IN THE NOTICE OF INTENTION TO CREATE THE DISTRICT AND TO AUTHORIZE THE ADVERTISEMENT FOR MEMBERS TO THE ADMINISTRATIVE CONTROL BOARD FOR THE DISTRICT. BE IT RESOLVED by the Chairman and the Board of County Commissioners of San Juan County, Utah: Section One. The Board of County Commissioners of San Juan County, Utah (the Board of County Commissioners) believes that the public health, convenience and necessity require the provision of substance abuse and mental health services identified and described in the Notice of Intention concerning the establishment of the San Juan County Substance Abuse/Mental Health Special Service District (the "District"). Section Two. The Board of County Commissioners have heretofore considered each and every protest filed and has heard each and every person who wished to be heard in protest against the creation of the District or the provision of any of the services therein, or on any other matter pertinent to the District. Section Three. The Board of County Commissioners hereby finds that less than 50% of the qualified voters of the territory proposed to be included within the proposed special service district and the owners of less than 50% of the taxable value of taxable property included within the proposed special service district have filed written protests against the establishment of said district or against the specified type of services, within said district, proposed to be furnished. Section Four. The services proposed and described in the Notice of Intention to create the District are hereby authorized and the District are hereby created and will begin to operate as such on May 1, 1997. Section Five. The District shall be administered by an Administrative Control Board which is hereby delegated, without limitation, the power to act as the governing authority of the District and exercise all or any of the powers provided for in Part 13 of the Utah Special Service District act. Said Administrative Control Board shall not, however, have the power to levy a tax on the taxable property of the District, to issue bonds payable from taxes or to call or hold an election for the authorization of the tax or bonds without the approval of the Board of County Commissioners. Section Six. Administrative Control Board members shall be paid at a per diem rate to be set by resolution of the Board of County Commissioners. Section Seven. The membership of the Administrative Control Board of the District shall consist of five (5) members, each of who shall be appointed by the Board of County Commissioners. One board member shall be seated from each Commission District, one Commissioner shall sit on the board, and one health professional. The Board of the County Commissioners shall appoint the initial (2) members to serve a two-year term and the remaining three (3) members to serve a four-year term, the determination of who shall serve in each category to be made by lot. Said terms shall commence on January 1, 1997 which is the next succeeding date that the terms of office commence for the members of the Board of County Commissioners. The initially appointed members of the Administrative Control Board shall serve an additional term commencing on the date of appointment and continuing until the regular commencement of the above-specified terms. Vacancies of the appointed members of the Administrative Control Board, other than by expiration of term, shall be filled by appointment of the Board of County Commissioners, for the unexpired term of the members who vacancy was filled. Section Eight. The Board of County Commissioners shall appoint one of its three to serve on the Administrative Control Board of the District. Section Nine. The Board of County Commissioners authorized the advertisement for membership of the Administrative Control Board for three weeks in a newspaper of general circulation within the County of San Juan and by what other means for the other four (4) positions. The membership of the Administrative Control Board, when seated, shall elect one of its members to serve in the following positions: Chairperson, Vice-Chairperson, and Treasurer. Commissioner Ty Lewis seconded the motion to adopt the foregoing resolution. They are concerned with the progress being made on the renovation of the UNI building. The Commission suggested that County Assessor Bruce Bunker appraise the value of the three buildings involved. Grounds and Maintenance Supervisor Dell Hunter will be responsible for obtaining or finding someone to write the specifications on the UNI building. Aging Director Frank Morrell spoke with the Commission concerning the status of the UNI building and what needs to be done in order to proceed with the renovation of that building. County Assessor Bruce Bunker will appraise the building involved. Grounds and Maintenance Supervisor Dell Hunter will be responsible for getting specifications written. Mr. Morrell and Mr. Hunter will determine remodeling needs. Aging Director Frank Morrell will report back to the Commission on the progress of the project. San Juan County Substance Abuse/Mental Health Special Service District Administrative Assistant Rick Bailey suggested that the date of establishment of the San Juan County Substance Abuse/Mental Health Special Service District be May 1, 1997. Also discussed was the number of board members for the district. It was decided that there be five board members as follows: 1 Commissioner, 1 health person that understands the concept of providing health care services; and 1 from each Commission district in the County. A motion was made by Commissioner Bill Redd to establish the District effective May 1, 1997 and to have a five member board. Commissioner Ty Lewis seconded. UNANIMOUS. Chris Webb/Taxes-Blanding City Blanding City Manager Chris Webb met with the Commission to discuss tax issues on property owned by Blanding City. Commissioner Bill Redd made a motion that Blanding City receive tax exemption from the date of property purchase on Parcel #PRB00000160030A in amount of $110.11, PRB000001504BA in amount of $104.79, PRB0000015004AA in amount of $303.43, and PRB0000040004BA in amount of $56.63. Commissioner Ty Lewis seconded. UNANIMOUS. Central San Juan Recreation District/Capital Purchase Request Gail Northern representing Central San Juan Recreation District presented a capital purchase request for a concrete cap and fence repair for the Blanding City tennis courts in amount of $23,000; a hard cover for the Blanding City swimming pool in amount of $12,000; paint for the Blanding City swimming pool in amount of $3,200; and repair on grounds equipment for the Blanding Golf Course for a total of $41,300. She requested that half be paid from 1996 and half from 1997 Transient Room tax funds. Commissioner Bill Redd made a motion to approve the request with the provision that the Recreation District look at enclosing the entire swimming pool. Commissioner Ty Lewis seconded. UNANIMOUS. Snow Day/January 13, 1997 The Commissioners approved a memo granting a snow day for County employees. Due to weather conditions on January 13, 1997, many employees were unable to travel to work. Those employees who were unable to travel to work on this day will be paid for a full day's pay. Those employees that did make it to work, will receive an additional 8 hours preference day to be used during the upcoming year. County Snow Removal Policy Doug Pehrson, County Road Supervisor discussed with the Commission the current County snow removal policy. After a discussion it was decided that the policy needs to be clarified. Administrative Assistant Rick Bailey will work on the policy clarification and submit it to the Commission for review. Building Permit/Patrick Welch A motion was made by Commissioner Bill Redd to approve a building permit for Patrick Welch, Moab for a new residence on Wray Mesa, Woodlands, Lot #13. Commissioner Ty Lewis seconded. UNANIMOUS. Bids/Passenger Vans-Aging Aging Director Frank Morrell presented a State bid for four passenger vans from Butterfield Ford @$22,390 each for a total of $89,560 for the senior citizens program. A motion was made by Commissioner Bill Redd to approve the bid and seconded by Commissioner Ty Lewis. UNANIMOUS. Leona Nielson Heights The grandchildren of Leona Walton Nielson are requesting that the plot of land in Section 23 T 36S R22E SLM north of Blanding, Utah on Blue Mountain Drive, be designated on the Recorder records as the "Leona Nielson Heights". The following grandchildren signed the request: Preston G. Nielson, Norman F. Nielson, Richard C. Nielson, Donna N. Jensen, Corinne Nielson Roring, Rhoda Jane Nielson Ashley, Barbara Nielson Ballif, Robert J. Nielson , John H. Nielson, Virginia Nielson Black, and Charles K. Kimmerle for Myrna Nielson Kimmerle. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT South Road Dept/Resignation Clark Grover, Heavy Equipment Operator South Road Department has resigned. The department needs to fill that position with a light equipment operator at Grade 12 Step 1. Also a mechanic position is needed in the South Road Department. A motion was made by Commissioner Bill Redd to advertise for these two positions. Commissioner Ty Lewis seconded. UNANIMOUS. Monticello Library Assistant/ Marlene Randolph Marlene Randolph has reconsidered and is not resigning her position at the Monticello Library. Sheriff Department/Payroll Changes Planner Scherick presented a payroll change for Sue Redd from permanent part-time Grade 9 Step 2 @$7.70 per hour to permanent full-time at Grade 9 Step 2 @$1335 per month effective January 1, 1997. A payroll change making Robert Wilcox permanent part-time at Grade 9 Step 1 @$7.48 per hour effective February 1, 1997. Commissioner Redd made a motion approving these payroll changes. Commissioner Ty Lewis seconded. UNANIMOUS. Meetings Planner Scherick attended the Canyon Country Partnership meeting in Moab on January 9, 1997 in which they discussed roads, wilderness, and water issues. Planner Scherick will attend the AOG meeting in Price on January 23, 1997. Bob Turri, contract Minerals Specialist, attended a Mill Creek meeting. The BLM would like to turn the leadership responsibility for that group over to some other person or organization. Mr. Turri also attended the Comb Wash Watershed Planning meeting for ORV use. The BLM would like to designate roads and areas for ORV use in the Comb Wash Watershed area and eventually go countywide. Mr.Turri will work with the BLM and ORV enthusiasts on this project. SUMMO Mr. Turri reported that SUMMO is falling further behind on their projected opening date because of permitting issues. The projected date is now February 1st. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Road Agreements Administrative Assistant Rick Bailey has received and recommended that the Commission sign the Road Maintenance Agreements from Red Mesa, Dennehotso, and Mexican Water Chapters. A motion was made by Commissioner Redd to approve the Road Maintenance Agreements. Commissioner Ty Lewis seconded. UNANIMOUS. Cal Black Airport Lease Cal Black Airport Manager Calvin Blake requested that the Commission consider a ten year lease with Midway Aviation on the operation of the Cal Black Airport. The Commissioners cannot obligate themselves or the next Commission and therefore denied the request. Cellular Phone/Dell Hunter Dell Hunter spoke with Administrative Assistant Rick Bailey concerning obtaining a cellular phone. The Commission sees no problem with him having a cellular phone. Bluff Underground Tank Project Sample testing on the underground storage tanks at Bluff will be conducted. The company will teach the County how to conduct the sampling. The County will conduct the sampling, use the company equipment, then the company will pay for all of the testing and bill the County in the amount of $7048.30. Commissioner Bill Redd made a motion to approve the sampling contract. Commissioner Ty Lewis seconded. UNANIMOUS. Administrative Assistant Rick Bailey reported that there is a problem when water is drawn out of the wells. It has been determined to be hazardous and must be burned. Another company will be deal with this issue and will bill the County in the amount of $1640. A motion was made by Commissioner Bill Redd to approve this contract. Commissioner Ty Lewis seconded. UNANIMOUS. Road Status The County has received several letters concerning the status of various roads. The Blue Mountain Dugway Road is being worked on in segments. The County may consider putting guard rails once the road is widened. County Road Supervisor Doug Pehrson met with Ben Black, Crabtree- Harmon Bus, concerning the bus route on Highway 666. They agreed that the turn around on the county road would be maintained year round. The placement of signs and where the school buses go is not a County responsibility but the County would support them the best they could. A letter was received from the school district concerning the VCA road. No action has been taken. Navajo Reservation/Disaster Area Navajo Nation President Hale declared the Navajo Indian Reservation a disaster area last week due to the snowfall. Navajo Mountain received 16 inches of snow. Mr. Bailey received a call from Mexican Water asking if there was assistance available to provide for coal and other things. Commissioner Lewis reported that the Tribe has approved money to come through the Chapters for emergency purposes. Blue Cross/Blue Shield-Cafeteria Plan Mr. Bailey reported that the County can hold an agenda item on record concerning the 125 Cafeteria Plan, open the County plan and indicate that the County would allow the request of Colonial and Aflac premiums to be pre-taxed. Action will be taken on February 18, 1997. Meetings There will be a public meeting in Bluff concerning their community plan on February 3, 1997 at 6:00 P.M. The San Juan School District Superintendent will meet with the Commission on February 3, 1997 at 2:30 P.M. There will be an Interagency Breakfast on February 19, 1997 at Hoagies Restaurant. COMMISSIONER BILL REDD'S REPORT On January 9, 1997 Commissioner Redd attended the CIB meeting. Commissioner Redd met with Congressmen Chris Cannon and Merrill Cook on January 16, 1997. He also attended the UAC meeting discussing the litigation board for roads, wilderness and monuments. Commissioner Redd will be in the Courthouse this week. COMMISSIONER TY LEWIS' REPORT There will be a Commissioners Legislative Review meeting at 9:00 A.M. on January 23, 1997. Commissioner Lewis will a attend a UAC Insurance Mutual meeting at 1:00 P.M. on January 23, 1997. Meetings On January 30, 1997 there will be a Legislative Briefing at 4:30 P.M. with all elected officials. There will be a UAC Board of Directors meeting on January 31, 1997 from 12:00 - 3:00 P.M. in Midvale. On February 12, 1997 there will be Southeastern Utah AOG legislative meeting at 6:00 P.M. Representatives & Legislators over the AOG areas will be in attendance. February 14, 1997 is the County Elected Officials day with the Legislature at the Salt Palace at noon. The Joint Highway Committee meeting will be held in Price on March 21, 1997. The UAC Board of Directors Management Conference will be held on April 9-11, 1997. A UAC Board of Directors meeting will be held on June 27, 1997. The County Commissioners Day at Utah State Fair is September 5, 1997.
