SAN JUAN COUNTY COMMISSION MEETING FEBRUARY 3, 1997 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the County Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner LaVee Scherick, Deputy Clerk Absent: Rick Bailey, Administrative Assistant A motion to approve the minutes of the January 27, 1997 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioner Maryboy was not in attendance when the action was taken. Board of Equalization Issues County Assessor Bruce Bunker reported that Eugene Shumway, has two homes in construction on Parcel #36S22E107201. If construction is in progress on January 1st Assessor Bunker determines what percent is complete and values the construction as of that date. The Shumways feel the value was too high. The Shumways submitted their list of expenditures this week. County Assessor Bruce Bunker requested permission to make the adjustments. The Commissioners agreed to this. Maurice & Delton Pugh properties, Parcel #B36220271267 & B3622071273, were originally one property. When the original property was purchased it was one lot with a structure on it. They divided the property and the structure in half and moved them apart so they would meet all of Blanding City zoning requirements. In the process the same value was left on both pieces. County Assessor Bunker requested permission to split those values and reappraise. The Commission gave their approval. Monticello City Recreation Trent Schafer, Evan Lowry, and Eddie Allred, representing the Monticello City Recreation Board discussed with the Commission the need for improvements at the Monticello City swimming pool. They discussed window and door replacement, roof and electrical system repairs. Their first concern is safety of the roof structure and the electrical system at the pool. The roof has had many additions to it. They would like the existing roof replaced with a metal roof. The beam in the chlorine and dressing rooms need to be replaced. The electrical system is outdated. They requested $53,000 to replace the roof and the electrical system. Commissioner Bill Redd made a motion to approve $53,000 for the roof, beam and electrical system. Commissioner Ty Lewis seconded. UNANIMOUS. Commissioner Maryboy was not present at the time the action was taken. The Commission asked that this group come back in the fall with another proposal for the remainder of the work that needs to be done. Tso Road #492 Mary Tso and Eli Tso came before the Commission to request that road #492 have some materials put on it. When the road is muddy the gravel sinks. They mentioned that the bus turn around area is bad. They also stated that the Road Department has looked at the materials available but that nothing has been done. The Commission stated that they would contact the Road Department concerning this issue. San Juan Counseling/Sliding Scale San Juan Counseling Center Director Dan Rogers and Business Manager Robert Johnson presented a request to increase the Outpatient Sliding Scale by $5 with a cap of $91. Court ordered clients pay a minimum of $25 for individual therapy. Group rates are $23 per hour. Court ordered referrals are charged a $111 assessment fee. The DUI class is $150. Commission Redd made a motion to approve the increase in the Outpatient Sliding Scale effective February 3, 1997 and seconded by Commissioner Mark Maryboy. UNANIMOUS. Mr. Rogers also reported that he had spoken with State Senator Dmitrich and Representative Johnson and they suggested that letters concerning the needs of the Native Americans be sent from the northern Ute Tribe and Navajo Nation President Hale to the Governor. Mr. Rogers also requested that the Commission send letters to the Governor concerning the transition costs in connection with San Juan Counseling Center. UNI Building/Quit-Claim Deed San Juan Counseling Center Director Dan Rogers presented a Quit-Claim Deed for the UNI Building property on south main street in Blanding. Mr. Rogers asked UNI for a Warrantee Deed on the property and stated that UNI is still working on that. County Fair Lillian Taylor, Fair Supervisor, asked for suggestions from the Commission to mesh both the Southern Fair and the County Fair. Suggestions were made concerning Native American booths, rodeo, and dancers and the possibility of involving the city Chambers of Commerce. The County Fair this year will be held on August 13-16, 1997. Building Permit/J.Larsen A building permit was presented for Jerald Larsen to build a new home on Rim Rock Drive in Bluff. Commissioner Bill Redd made a motion to approve the building permit. Commissioner Ty Lewis seconded. UNANIMOUS. Commissioner Maryboy was not present at the time the action was taken. Road Dept/BIA Contracts Wanda Franklin presented the Shiprock Agency Road Maintenance Contract in the amount of $90,000 and the Western Agency Road Maintenance Contract in the amount of $72,000 for approval. These are increases from last year. Commissioner Bill Redd made a motion to approve the contracts and seconded by Commissioner Mark Maryboy. UNANIMOUS. Legislative Issues Fire Warden Frank Morrell discussed with the Commission the Wildland Fire schedule of estimated costs per county on all unincorporated private land in the County. Aging Director Morrell showed the Commission a proposed In Home Provider in Human Services bill. He stated that it is proposed to use a voucher system where money would be given to the individual and they would be responsible for finding their own provider. Mr. Morrell would like to continue in the existing system. Out-of-State Travel/P.Humphreys County Clerk Gail Northern presented an Out-of-State travel request for Peggy Humphreys to attend the Houston Travel Show on February 19-26, 1997. Commissioner Bill Redd made a motion to approve the request with the provision that Ms. Humphreys report back to the Commission on her return. Commissioner Mark Maryboy seconded. UNANIMOUS. Beer License Renewal/Valle's Trading Post County Clerk Gail Northern presented a beer license renewal for Valle's Trading Post in Mexican Hat. A motion was made by Commissioner Bill Redd to approve the beer license renewal and seconded by Commissioner Mark Maryboy. UNANIMOUS. Ted Royer Mr. Royer introduced himself to the Commission and stated that he has a Utah and Colorado Real Estate Brokers license. He is an accountant and insurance agent. He also has a strong inclination for economic development and is on the Chamber Board in Blanding. He offered himself as a resource person and will be attending the Commission meetings on a regular basis to keep informed of County activities. Resolution of Support/Economic Development Commissioner Bill Redd made a motion to sign the Resolution of Support for Southeastern Utah Economic Development District. Commissioner Ty Lewis seconded. UNANIMOUS. Commissioner Mark Maryboy was not present when the action was taken. The resolution is as follows: RESOLUTION OF SUPPORT A RESOLUTION OF THE SAN JUAN COUNTY COMMISSION SUPPORTING SOUTHEASTERN UTAH ECONOMIC DEVELOPMENT DISTRICT CONTINUATION OF ITS OVERALL ECONOMIC DEVELOPMENT PLAN AND WORK PROGRAM FOR 1997-98 BE IT RESOLVED by the Board of Commissioners of San Juan County, Utah as follows: Whereas, an Economic Adjustment Strategy Program undertaken by the Southeastern Utah Economic Development District has been implemented in Southeastern Utah that will stimulate commercial and industrial activity and increase the employment of dislocated workers, minorities and women and provide self-employment opportunities and assistance to disadvantaged small businesses; and Whereas, the Southeastern Utah Economic Development District Overall Economic Development Plan and subsequent Work Program for 1997- 98 proposes actions in support of continued implementation of programs to reverse the adverse economic conditions of the District through relevant development strategies, technical assistance, and appropriate projects following the strategic economic planning process; and Whereas, the Southeastern Utah Economic Development District has the capacity and staff expertise to administer and direct the planning activities on behalf of the communities of Southeastern Utah and the Southeastern Utah Economic Development District being submitted to the U.S. Economic Development Administration Denver Regional Office February 13, 1997. NOW THEREFORE, BE IT RESOLVED that the San Juan County Commission does hereby express support for the continuation of the economic planning activities of the District and urges the acceptance of the District's planning grant application by the U.S. Economic Development Administration. She replaces Fannie Tree who resigned. A motion was made by Commissioner Bill Redd to approve the hire and seconded by Commissioner Mark Maryboy. UNANIMOUS. BLM/Fee Structure Planner Scherick reported that the BLM is considering starting a recreation fee structure for Grand Gulch and Cedar Mesa. The BLM would like to develop an agreement to work with the County. The benefit to the County would be that 10% of all the fees collected would be put in search and rescue. Montezuma County Water District Planner Scherick reported that he had spoken with Montezuma County Water District representatives. They would like to know if the County would be interested in a water project. The Commission asked Mr. Scherick to set up a meeting with them the third week in February. Meetings Planner Scherick attended the Colorado Plateau Forum meeting in Cedar City on January 29-31, 1997. There will be a Public meeting in Bluff on February 3, 1997 at 6:00 P.M. to discuss the Bluff Master Plan. Commissioner Redd and Planner Scherick will be in Salt Lake on February 5-7, 1997 to attend a UAC meeting. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy spoke concerning the severance tax issues and the make up of the board. Commissioner Maryboy would like a letter written to the board stating that an appropriate person be appointed from a non-profit organization to that board. Commissioner Redd will speak to John Harja while in Salt Lake this week. Meetings This week Commissioner Maryboy will be in Window Rock all week dealing with the Hopi land issues. They will be moving the people from the Hopi lands beginning April 1, 1997. He will attend a Chapter planning meeting today and the Bluff Public meeting tonight. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd met with San Juan County School Superintendent R. Gerald Cameron and Finance Officer, Kent Tibbitts. They discussed the recreation agreement between the School District and the County, carrying the liability on activities in the schools, Montezuma Creek swimming pool, and the Ednet hook up with the libraries. Another meeting had been set for February 17, 1997 at 2:00 P.M. Because of a holiday on the 17th LaVee Scherick, Commission Clerk, will contact the School District to set up another meeting time. Meetings Commissioner Redd will attend a CIB meeting. Commissioner Redd and Planner Scherick will be in Salt Lake this week. They are on a committee to help re-write Senator Craigs new changes in the Forest Act and FLPMA. COMMISSIONER TY LEWIS' REPORT Last week Commissioner Lewis met with the Legislature concerning proposed issues. Commissioner Lewis also met with Congressman Jim Hansen concerning the article in the newspaper about his wilderness proposal. He has no proposal at this time. Commissioner Lewis met with the UAC Board of Directors on January 31, 1997. He also met with the litigation board concerning the Wilderness Re-inventory Lawsuit. Meetings Commissioner Lewis will attend the Bluff Public meeting tonight at 6:00 P.M. On Friday, February 7, 1997, he will travel to Farmington, NM to attend the San Juan Forum meeting.
