SAN JUAN COUNTY COMMISSION MEETING MARCH 24, 1997 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the County Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the March 17, 1997 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Commission Meeting There will be no Commission meeting on March 31, 1997 due to a fifth Monday. Public Hearing/Bluff General Plan Commissioner Bill Redd made a motion to convene into a Public Hearing concerning the Bluff General Plan. Commissioner Mark Maryboy seconded. UNANIMOUS. The County received a letter from Calabre Bed & Breakfast, Bluff, requesting that approval of the Bluff General Plan be deferred because there were no minutes taken in the public meeting which reflect any public opinion concerning the plan and notices of the public meetings were not properly posted. Also received was a letter and petition from business owners of the Cottonwood Subdivision stating that the San Juan County Service Area #1 Board of Directors voted to adopt a replacement to page 23 of the Bluff General Plan. This represents a potential resolution of the apprehensions concerning the future of commercial growth and development in the Cottonwood Subdivision of Bluff. Stan Johnson, Bluff, spoke to the Commission concerning the possible concept of creating a planning and zoning district which would place the responsibility on the community of Bluff rather than going through the County Commission to resolve their problems. Mr. Johnson requested that approval of the Master Plan be tabled until the Bluff Community could further pursue the idea of a planning and zoning district along with other options. Commissioner Bill Redd made a motion to exit the Public Hearing concerning the Bluff Master Plan. Commissioner Mark Maryboy seconded. UNANIMOUS. Commissioner Bill Redd made a motion to accept the request that approval of the Bluff Master Plan be tabled until the Bluff Community could further explore other options. Commissioner Mark Maryboy seconded. UNANIMOUS. Bluff Accretion Lands James Bellis, Navajo Nation Assistant Attorney General; Mike Johnson, Hydrologist; and Steven Boos, Navajo Nation Legislative Counsel met with the Commissioners, BLM and interested county residents to discuss the most recent U.S. Departmental Solicitor's Opinion on the lands east and south of Bluff in Sections 28 & 29. The Navajo Nation Attorney wanted the Commissioners to know of their interest in the most recent opinion. The Solicitor's opinion states that the lands have avulsed rather than accreted from the original survey line in 1900. This means that the river channel, in the Solicitors opinion, were somehow forced back to the south. The Tribe claims interest to those lands and considers them property of the Navajo Tribe. The Solicitors opinion was based on historical records, discussion with local residents and scientific studies conducted by qualified Federal Land Management Agency personnel. It should be noted that this is only the most recent opinion which contradicts a 1985 opinion conducted by the same office. The Navajo Nation Attorney stated that the issues have not been resolved and that hopefully negotiated settlements could be reached. He indicated that the Tribe has a strong position on this and if reasonable settlements could not be reached then it would go to litigation. The BLM stated that before a settlement could be reached, and because this study is new to them, there would need to be a government to government meeting between the BLM and the Tribe to gain a better understanding of the issues involved with the opinion. The public and affected parties would be notified and the study would be obtained and placed in the County Planning Office for inspection by those who are interested. Drivers License Service Nels Nelson, Area Drivers License Supervisor and Nolan Mitchell, Drivers License Examiner, reported to the Commissioners about the Drivers License Service available in Monticello and the statistics on the participation in the Monticello area. At the present time, 22% of the licenses issued are in Monticello and 78% are either in Blanding or some other area. They also discussed the possibility of placing an office in different areas and the concept of having a full time office in the Blanding area. Trent Schafer, Monticello City Manager stated the importance of having this service remain in Monticello and that the city would do everything they could to accommodate them in this effort. Out-of-State Travel/Peggy Humphreys An out-of-state travel request was presented for Peggy Humphreys to attend a "Partners in Tourism Leadership Forum" in Denver, CO on April 13-16, 1997. A motion was made by Commissioner Bill Redd to approve the out-of-state travel and seconded by Commissioner Mark Maryboy. UNANIMOUS. Beer License Renewal/Cow Canyon T.P. Commissioner Bill Redd made a motion to approve a beer license renewal for Cow Canyon Trading Post. Commissioner Ty Lewis seconded. Commissioner Maryboy was not present at the time the action was taken. Building Permits The following building permits were submitted for approval: Duke Hayduk, Bed & Breakfast/Residence in Bluff; Sky Ranch Limited a residence in Brown's Hole; Glen Casamassa a residence in Spanish Valley; and Charles Henderson a residence in Spanish Valley. A motion was made by Commissioner Bill Redd to approve the building permits and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Sign Permit A sign permit request was presented for Amer Tumeh, Desert Rose Inn, to place a sign on a County Road right-of-way at the intersection of 6th E. Street and Main Street (U.S. 191) in Bluff. A motion was made by Commissioner Bill Redd to approve the sign permit and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Vacating Lot Lines/Cottonwood Subdivision A motion was made by Commissioner Bill Redd to approve vacating lot lines on lots 7, 8, 9, and 10 in the Cottonwood Subdivision, Bluff for Wendy Smith. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Landfill/Resignation Steve Meyer, San Juan County Landfill has resigned effective April 4, 1997. Mr. Scherick requested permission to advertise for a full time position with a Commercial Drivers License. The Commission gave their approval. Sergeant Position/Sheriff Department Personnel Director Edward Scherick recommended Alan Freestone to fill the Sergeant Position vacated by Mark Ewart for approval at Grade 19 Step 7 @$2361 per month effective April 1, 1997. Commissioner Bill Redd made a motion to approve the promotion and seconded by Commissioner Mark Maryboy. UNANIMOUS. Light Equipment Operator/South Road Dept. The name of Pieter Haller was presented to be hired as a Light Equipment Operator for the South Road Department at Grade 12 Step 1 @$1477 per month. Commissioner Bill Redd made a motion to approve the hiring of Pieter Haller. Commissioner Mark Maryboy seconded. UNANIMOUS. Personnel Policy Personnel Secretary Lillian Taylor spoke with the Commissioners concerning retirement benefits. Ms. Taylor will check in to the state retirement policy and report back to the Commissioners. Meetings There will be a meeting in Dove Creek, CO with the Montezuma County Water District on April 3, 1997 at 1:00 P.M. Brad Palmer, BLM, requested that the County Commissioners attend a meeting concerning the Mill Creek area and the Jeep Safari weekend on March 26, 1997 at 9:00 A.M. in the Moab District BLM office. Steve Urquhart, Thompson and Associates, would like to meet with the Commissioners on April 1, 1997. BLM/Kent Walter Kent Walter, BLM Area Manager reported that a Notice of Intent had been filed for drilling work to be conducted in Horse and Bradford Canyons. The BLM will be conducting a tour with the Hopi Tribe on Cedar Mesa in connection with the Woodland Management Plan. Road #265 Mr Walter stated that the Title V permit has been issued to Petro Drilling Company and work on it is starting today. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT UAC Administrative Assistant Rick Bailey reported that the County has received a Risk Management Program Document. He requested permission from the Commissioners to review the document in a safety committee meeting on April 15, 1997. The Commissioners gave their approval. UAC Mutual Agreement Administrative Assistant Bailey reported that the UAC Mutual will be voting on separating the UAC Mutual By Laws from the Local Cooperative Agreement and would like permission to vote. A motion was made by Commissioner Bill Redd authorizing Administrative Rick Bailey to vote on this issue and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. CDBG Mr. Bailey attended a CDBG Workshop on Friday March 21, 1997 concerning 1997-98 grants. Environmental Certifying Officer A motion was made by Commissioner Bill Redd to approve Administrative Assistant Rick Bailey as the Environmental Certifying Officer for CDBG. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Irrigated Agricultural Lands Utah State University has requested that a UAC representative sit on the Irrigated Agricultural Lands Board. UAC asked that Administrative Assistant Rick Bailey be that person. Montezuma Creek Fire Station Administrative Assistant Rick Bailey reported that the Montezuma Creek Fire Station is in need of some equipment. The Commission gave their approval for Mr. Bailey to purchase a TV-VCR for the building. Fire Trucks Mr. Bailey reported that the Moab Valley Fire Chief had contacted him concerning two fire trucks that they would like to sell. The two trucks combined could be purchased for $11,000. The Commissioners gave Mr. Bailey permission to proceed. Landfill Certified Officer Landfill Operator, Dayne Shumway will be the only certified landfill operator in San Juan County. Administrative Assistant Rick Bailey's certification will lapse. DOE Hiring Statistics Personnel Director Scherick reported that as per request from the County Commissioners he has obtained Local Hiring Statistics from the Department Of Energy for the Monticello projects. Mr. Scherick reported that on August 19, 1995 41.6% were from San Juan County and 57.4% were out of state employees; on August 10, 1996 49.7% were from San Juan County and 47.1% were from out of state; and on October 6, 1996 40.6% were from San Juan County and 57.9% were from out of state. On March 18, 1997 OHM Employment Statistics show that 56.9% are from San Juan County and 33.3% are Native Americans. Aging Secretary Aging Secretary Cheryl Ewart's last day of work will be on March 31, 1997. Meeting The Interagency Breakfast will be held on Wednesday, March 26, 1997 at Houstons at 7:30 A.M. There will be a meeting with Glen Canyon Recreation, Garfield, Kane and San Juan Counties on May 8-9, 1997 at Bullfrog. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Mark Maryboy reported that the Utah Navajo Commission had met with the BLM concerning the Woodland Management Plan. Wood permits are now available for sale through the Chapters. The BLM will conduct a tour on Cedar Mesa with the Hopi Tribe. The Utah Navajo Fair Committee has scheduled a rodeo to be held in Bluff on June 14-15, 1997. The Tri-State County Commissioners meeting will be held on March 25, 1997 at 10:00 A.M. at Northern Arizona University in Flagstaff, AZ. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd attended the Southeastern Utah Health District meeting in Green River on March 18, 1997. COMMISSIONER TY LEWIS' REPORT Meetings On March 13, 1997 Commissioner Lewis attended the UAC Insurance Mutual meeting in Salt Lake City. On March 14, 1997 he met with SUMMO and the BLM concerning the Copper Mine project. On March 20, 1997 Commissioner Lewis attended the Joint Highway Committee meeting in Price. Commissioner Lewis will attend a highway tax meeting with County Road Supervisor Doug Pehrson on March 31, 1997. On March 25, 1997 Commissioner Lewis, Commissioner Redd and Administrative Assistant Rick Bailey will attend the Tri-State County Commissioners meeting in Flagstaff, AZ.
