SAN JUAN COUNTY COMMISSION MEETING APRIL 28, 1997 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the County Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the April 21, 1997 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. CSBG Grant Aging Director Frank Morrell presented a Community Service Block Grant for approval. Reimbursement to the County under this contract will be $27,000. Commissioner Bill Redd made a motion to approve the contract and Commissioner Mark Maryboy seconded. UNANIMOUS. William Schultz/Public Defender Contract William Schultz, San Juan County Public Defender, spoke with the Commissioners concerning his contract and current investigative expenses. He requested clarification on how to handle extra investigative work that may be required. Commissioner Bill Redd made a motion to pay the current bill but unless required by the Court, prior Commission approval must be obtained before investigative work begins. Commissioner Mark Maryboy seconded. UNANIMOUS. May Tax Sale County Clerk Gail Northern reported that the May Tax Sale would be held on May 15, 1997. At the present time there are four properties going to sale. Commissioner Bill Redd made a motion that the tax sale property be sold with a beginning bid at market value. Commissioner Mark Maryboy seconded. UNANIMOUS. National Park Services Walt Dabney, Canyonlands National Park; Steve Chaney, Bridges National Monument; and Brad Wallis, Director Canyonlands Natural History Association presented the Commissioners with three framed prints of Arches and Natural Bridges Monument as a token of their appreciation for the working relationship between each of them and the County. BLM/SUMMO Moab District Manager Kate Kitchell reported that this week is the last week of the appeal period on the SUMMO project. The BLM final decision has in place a very rigorous requirement for studying, characterizing, monitoring, and annual review of the ground water data. Long Term Ecological Research & Monitoring BLM District Manager Kate Kitchell reported that the Canyon Country Partnership group would like to establish a long term ecological research and monitoring site. A possible site would be the Indian Creek Watershed area. The BLM and Department of Interior will be looking at the site on June 3-5, 1997. ORV Use BLM Area Manager Kent Walter reported that the BLM will be working on the Indian Creek Recreation Corridor plan limiting ORV use to designated roads and trails. Oil & Gas Lease The BLM plans to review all existing oil and gas leases to check on the differences in the GIS and RMP for each of the leases. Native American Coordination Kent Walter, BLM Area Manager, reported that in order to establish more effective communications with the Navajo Nation, the Native American Coordinator with the BLM will be David Redhorse, Farmington BLM office. Bookmobile Grant Money Rowland Francom, San Juan County Bookmobile, reported on expansion of the automated system for the bookmobile. He stated that with the money provided by the Navajo Nation for bookmobile services on the Reservation he has purchased a laser printer, zip drive and copier to expedite services provided by the bookmobile. Building Permits Three building permits were submitted for approval as follows: Toynette K. Hughs, Bluff, a trailer; Jean H. Treece, Bluff, a straw bale home; and Wendy Smith, Bluff, a home. A motion was made by Commissioner Bill Redd to approve the building permits and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Sign Permit A sign permit request was presented for Bob Boot, Turquoise Service, for a sign to be placed on Hwy 191, north of 160, west side of road, on Wild Rivers property, in Cow Canyon. A motion was made by Commissioner Bill Redd to approve the sign permit and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Bids/Emulsified Asphalt One bid was received from Koch Materials Company, Grand Junction for 300/tons Mulch Mixing @$157 per ton; 1000/tons Chip Seal @$157 per ton; 25/tons Prime Oil @$177 per ton; and Tack @$165 per ton. A motion was made by Commissioner Bill Redd to approve the bids for emulsified asphalt and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Bid/Oil Mulch-Lem's Draw Pit A bid was presented for Brasier Asphalt Inc. for mixing 3,000 cubic yards of oil mulch at Lem's Draw @$9.00 per cubic yard and crushing and mixing used asphalt @$13.00 per cubic yard. Crushing by itself is $9.00 per cubic yard. Commissioner Bill Redd made a motion to approve the bid and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Bid/Sandblaster The Road Department submitted a bid for a 110 pound pressure sandblaster w/nozzles, hose and safety valves from Northern Hydraulics @$419.78 and from Graingers @$856 to be used at both the North and South Road Departments. A motion was made by Commissioner Bill Redd to approve the bid from Northern Hydraulics and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT BLM Advisory Board Council Administrative Assistant Rick Bailey reported that the County has received a letter from the BLM regarding the Advisory Council, Native American Board Member position. There is a position for non-elected Native Americans. Applications and letters of recommendation should be sent to the State BLM office by May 8, 1997. UAC/Interlocal Cooperation Agreement Administrative Assistant Rick Bailey presented a UAC Resolution approving and authorizing the execution of an amended Interlocal Cooperation Agreement with other members of Utah Association of Counties Insurance Mutual and an amended UAC Resolution to approve removing the "By Laws" from the operating agreement. Commissioner Bill Redd made a motion to approve the amended UAC Cooperative Agreement. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Bluff Underground Storage Tank Monitoring Administrative Assistant Rick Bailey presented for approval the name of Dames & Moore Company to perform quarterly monitoring sample and analysis for the storage tanks at the Bluff Fire Station site. A motion was made by Commissioner Bill Redd to approve Dames & Moore Company to monitor the storage tank site at Bluff. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. FAA/Cal Black Airport The FAA has allocated $200,000 to complete a supplemental EIS on the Cal Black Airport. The County needs to submit to FAA and the State of Utah a federal application requesting matching funds. The County share would be $9,000. Commissioner Redd made a motion to approve signing the application request. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Meetings Administrative Assistant Rick Bailey and Commissioner Bill Redd will meet with personnel from Congressman Canon's office in Price on April 29, 1997. Mr. Bailey will be in Salt Lake on Wednesday. He will be out of the office all next week to attend Haz Mat training. There will be a Western States Coalition Summit VIII in Spokane, Washington on July 10-12, 1997. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Courthouse Custodian Personnel Director Scherick reported that Kelly Rogers, Custodian, has resigned effective April 26, 1997. Assistant Landfill Operator Personnel Director Scherick submitted the name of Clark Grover, former County employee, to be hired as the Assistant Landfill operator at the White Mesa Landfill at Grade 12 Step 1 @$1477 per month effective April 22, 1997. Commissioner Bill Redd made a motion to hire Clark Grover. Commissioner Mark Maryboy seconded. UNANIMOUS. In regards to continuation of his health insurance premium the Commissioners stated that Mr. Grover would have to begin again with making full payment of his premium. Bluff & Mexican Hat Transfer Station Attendant Personnel Director Edward Scherick presented the name of Gene Bunderson to be hired as part-time attendant at Grade 1 Step 1 @$5.50 per hour, not to exceed 20 hours per week, for the Bluff and Mexican Hat Transfer Stations effective April 2, 1997. A motion was made by Commissioner Bill Redd to approve the hire and seconded by Commissioner Mark Maryboy. UNANIMOUS. Sherry Shupe/Sheriff Department Personnel Director Scherick reported that the effective date for a Grade 12 Step 4 @$1614 per month change for Sherry Shupe should have been February 10, 1997 instead of March 10, 1997 as earlier approved. The Commissioners approved this change. Sage Grouse Planner Scherick reported that a meeting was held last week to discuss the Sage Grouse issue. A group will be organized to determine an implementation plan in order to keep it off the endangered species list. Meeting Planner Scherick will attend the RC&D meeting in Green River on Wednesday, April 30, 1997 at 10:00 A.M. to discuss Americorp projects. COMMISSIONER MARK MARYBOY'S REPORT Earth Day Commissioner Maryboy participated in Earth Day held on April 21, 1997 in the Montezuma Creek and Aneth Area. He requested that the Road Department pick up some bags left by the Red Mesa road and place them at the dumpster in Montezuma Creek. Aneth Subcommittee Commissioner Maryboy reported that he will be meet with the Aneth subcommittee on April 28, 1997 to finalize the agreements with various oil companies. The companies agreed to provide power and water line extensions to various families. The oil companies would like a list of names of students eligible for scholarships. Bond Election The Utah Navajo Commission will be meeting to discuss the school district bond election that will be held next week. Supplemental Funds The Tribe was in session all last week. The Budget & Finance Committee presented 7 million dollars to the Council for supplemental funds with 9 million dollars added on. Meetings Commissioner Maryboy will be in Window Rock tomorrow and in his Aneth office the remainder of the week. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd will be in Salt Lake with Administrative Assistant Rick Bailey on Tuesday and Wednesday.
