SAN JUAN COUNTY COMMISSION MEETING JUNE 9, 1997 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the County Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk Absent: Bill Redd, Commissioner A motion to approve the minutes of the June 2, 1997 meeting as amended was made by Commissioner Mark Maryboy and seconded by Commissioner Ty Lewis. UNANIMOUS. Farm Service Agency/CRP Doug Christensen, Farm Service Agency, reported that the sign up period for CRP is completed. CRP takes land out of production, the land is planted into grass and the Government pays the land owner a yearly rate on it. Regulations allow 25% of the crop land to be idle. Qualifying idle land in San Juan County would be 27.4%. No more idle land will be placed in CRP for ten years. San Juan County Farm Service Agency is requesting a wavier to increase the percentage of idle crop land from 25% to 27.4%. A motion was made by Commissioner Mark Maryboy to sign the agreement changing the idle crop land from 25% to 27.4%. Commissioner Ty Lewis seconded. UNANIMOUS. International Uranium Corporation/White Mesa Mill Harold Roberts, Executive Vice President of International Uranium Corporation, reported to the Commissioners on recent transactions on the sale of Energy Fuels assets and to discuss additional activities at the White Mesa Mill. The sale of Energy Fuels was completed on May 10, 1997. The mining properties and the White Mesa Mill are now owned and operated by International Uranium Corporation. Their current employment is 30 and will increase to almost 50 by the end of June. IUC has received authorization from the U.S. Nuclear Regulatory Commission to process a material obtained from the U.S. Department of Energy, known as the "Cotter Concentrate" at the White Mesa Mill site. The Nuclear Regulatory Commission has agreed that the material can be processed without posing additional risk or impacts to the environment, the Company's employees, or public health and safety. Library Automation Project Computer Specialist John Fellmeth, and Library Project Coordinator Joyce Martin reported to the Commission on the library automation project. Mr. Fellmeth reported that grants have been received in the amounts of $19,000 & $12,000 with the County contributing $25,000 to automate the libraries. The first step is to obtain hardware for the libraries. Bids were submitted for one server, 6 high end work stations, 2 low end work stations and two laser printers from Tangent Computers @$21,240 and from Future One for the same @$21053.23. Mr. Fellmeth recommended Tangent Computer because of the warranty, state contract, and no shipping charges. Bids were submitted from Winnebago Software for library automation software/training with scanners and printers @$11,111 and from Follett Software for the same without printers @$11,680. Mr. Fellmeth recommended the bid from Winnebago because of bookmobile compatibility and librarians' choice. A motion was made by Commissioner Mark Maryboy to approve the bids from Tangent Computers and Winnebago Software and seconded by Commissioner Ty Lewis. UNANIMOUS. Computer/Treasurer's Office Bids were submitted for a computer for the Treasurer's office from Tangent Computers for a Pentium MMX-166 with 17" display @$1947 and from Future One for the same @$1883 plus shipping. Also submitted was a bid from ECC for two BosaNova Plus kits @$295 each and from System Warehouse for the same @$245 each . The bid from Tangent was recommended because of warranty, state contract and no shipping charges. The bid from System Warehouse for the BosaNova Plus Kit was recommended because of the price. A motion was made by Commissioner Mark Maryboy to approve the bid from Tangent Computers for the computer and from Systems Warehouse for the BosaNova Plus Kit. Commissioner Ty Lewis seconded. UNANIMOUS. Executive Session At 11:00 A.M. a motion was made by Commissioner Mark Maryboy to convene in to executive session. Commissioner Ty Lewis seconded. UNANIMOUS. A motion was made by Commissioner Mark Maryboy to exit executive session. Commissioner Ty Lewis seconded. UNANIMOUS. Commissioner Mark Maryboy made a motion to hold a closed Grievance Hearing next week concerning a personnel matter. Commissioner Ty Lewis seconded. UNANIMOUS. TIC Cal Brown representing TIC, sub contractor, for the SUMMO project, reported that they have received the notice to proceed on the SUMMO project. Commissioner Lewis encouraged them to hire locally and informed them that they would need to contact the County building inspector for building and electrical inspection permits. Mr. Brown indicated that they would be constructing two well pads in June and then vigorous activity would begin in July. SSBG Contracts Lillian Taylor, Administrator for SSBG, presented the 1997-98 SSBG Human Services contract for approval. Commissioner Mark Maryboy made a motion to sign the contract. Commissioner Ty Lewis seconded. UNANIMOUS. Ms. Taylor presented the grant award recommendations from the SSBG Board to the Commission. After a discussion the Commission tabled the recommendations until June 23, 1997. Carnival/Fair San Juan County Fair Director Lillian Taylor presented a contract for the fair carnival from Mattfeldt Family Carnival for approval. Commissioner Mark Maryboy made a motion to approve the contract. Commissioner Ty Lewis seconded. UNANIMOUS. Horseshoe Park Lease Agreement J.J. Steffen, Monticello Horseshoe Park, spoke with the Commission concerning the lease at the Monticello Horseshoe Park. The lease is between San Juan County and the Horseshoe Park and is automatically renewable year by year with a 30 day termination notice required by either party. Gene Lansing/Road Signs Gene and Thelma Lansing, Aneth, reported that the oil company vehicles are traveling very fast and requested that Livestock signs, Children at Play signs, and speed signs be placed on the Aneth to Ismay road near their residence. Commissioner Lewis will have County Road Supervisor Doug Pehrson contact them. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Custodian/Courthouse Personnel Director Scherick presented the name of Rick Reeves to be hired as the custodian for the courthouse and the Monticello library at Grade 9 Step 1 @$1296 per month. A motion was made by Commissioner Mark Maryboy to approve the hire and seconded by Commissioner Ty Lewis. UNANIMOUS. Patch Crew/Road Department Personnel Director Scherick presented the following names for approval to be hired on the patch crew at Grade 4 Step 1 @$6.18 per hour: Carlton Keith; Jeffery Rock; and Terrance Benally. A motion was made by Commissioner Mark Maryboy to approve the names. Commissioner Ty Lewis seconded. UNANIMOUS. A motion was made by Commissioner Mark Maryboy to approve the name of Justin Redd to be an alternate hire in case one of the above approvals does not accept. Commissioner Ty Lewis seconded. UNANIMOUS. CIB Application Planner Scherick reported that he had worked on the CIB application last week. The County needs to set a hearing date, notify the AOG of intent, and notify the State History Department. Indian Creek/Lockhart Basin Meeting Bob Turri, Contract Specialist, attended a BLM meeting concerning the Indian Creek Recreation Plan. He is concerned that it is not a multiple use or partnership plan but rather a recreation plan. The County representative at the meeting was the only person from the public in attendance. Southern Utah Wilderness Alliance Request The County has received a request from Heidi J. McIntosh, Legal Counsel for Southern Utah Wilderness Alliance, as follows: GOVERNMENT RECORDS ACCESS AND MANAGEMENT ACT (GRAMA) REQUEST Pursuant to the Government Records Access and Management Act (GRAMA), Utah Code Ann. 63-2-101 et seq., I request the following documents: 1. I make this GRAMA request on behalf of the Southern Utah Wilderness Alliance ("SUWA"), a nonprofit public interest citizens environmental organization. He is still receiving complaints that the roads are not being graded. Herbert Maryboy Memorial Rodeo Commissioner Maryboy reported that his family is sponsoring the Herbert Maryboy Memorial Rodeo on June 20- 22, 1997. The purpose is to help raise money for the Utah Navajo Fair. Schedule Commissioner Maryboy will be in Window Rock on Tuesday, June 10, 1997. On Wednesday and Friday, he will be in his office in Aneth. There will be a Revitalization meeting at Red Mesa on June 12, 1997 at 10:00 A.M. Dedication of the Montezuma Creek Fire Station will be held on June 14, 1997 at 10:00 A.M. Commissioner Maryboy will not be at Commission meeting next week due to the Tribal Council being in session. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Metal Frame Building/Montezuma Creek Administrative Assistant Rick Bailey reported that he has written a letter to Utah Navajo Trust Fund to inquire about the status of the metal frame building located in Montezuma Creek. Building Permits Two building permits were presented for approval as follows: Kade & Mandy Johnson a new home in Blanding and Doug Christensen, 32 storage units on north Highway 191. A motion was made by Commissioner Mark Maryboy to approve the building permits. Commissioner Ty Lewis seconded. UNANIMOUS. Department of Workforce Services Administrative Assistant Rick Bailey reported that the County has received a letter from the State of Utah Department of Workforce Services concerning the absence of Navajo representation on the South Eastern Utah Workforce Council and are seeking nominations to fill the vacant position. CIB Funding/Bluff Administrative Assistant Rick Bailey reported that the Bluff Special Service District has received a CIB grant to fund a partial sewer system for the Bluff area. San Juan Water Conservancy District The County received a letter from the San Juan Water Conservancy District announcing a tour on June 19- 20, 1997 of Monticello, Blanding and Bluff areas, a cookout at the Four Corners Cultural Center picnic grounds, and a board meeting. Risk Management Mr. Bailey has drafted a Risk Management policy and procedures resolution on claims and litigation management. He gave a copy to each Commissioner to review. It will be approved at a later date. Meetings There will be a law enforcement meeting with Scott Matheson, U.S. Attorney General for Utah, on June 20, 1997 in Salt Lake City.
