SAN JUAN COUNTY COMMISSION MEETING OCTOBER 6, 1997 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the County Commission Chambers at Monticello, Utah Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the September 22, 1997 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Monticello Community Plan Economic Development Director Peggy Humphreys presented the Monticello Community Plan Extension Contract Amendment #4 for signature. This will allow the contract to be extended until June 1998. A motion was made by Commissioner Bill Redd to sign the contract and seconded by Commissioner Ty Lewis. UNANIMOUS. Commissioner Mark Maryboy was not present at the time the action was taken. Sheriff's Awards/Verle Green & Bob Low Sheriff Mike Lacy presented a plaque to Verle Green, who served as San Juan County Sheriff Deputy, and to Robert Low, who served as a Trooper with the Utah Highway Patrol, in appreciation for valor and professionalism on October 9, 1979 when faced with a life threatening situation which helped preserve his life and the life of his fellow officer. Bids/Sheriff Dept-Guns Bids were presented for approval for 25-Glocks, Model 21, pistols @$440 each with a $265 trade in each of 18 Glocks, Model 17 for a total of $6230 from Professional Armaments and from Interstate Corp for the same @$469.95 each with a trade in of the same amount @$250 each for a total of $7248.75. Commissioner Bill Redd made a motion to approve the bid from Professional Armaments. Commissioner Mark Maryboy seconded. UNANIMOUS. Bids/Computer Upgrade-Adult Education-Sheriff Dept Lt. Bill Christensen presented a bid for computer upgrade for the Adult Education Program at the County jail from Plato Education Services for six computers @$300 each for a total of $1800. A motion was made by Commissioner Bill Redd to approve the bid and seconded by Commissioner Mark Maryboy. UNANIMOUS. Bids/Airplane Tug Bids were presented for an airplane tug, Model EZ 60, Powertow Aircraft Mover, from Northwest Mfg., Inc. @$970 and from Airtug for a Aircraft Tow @$2495. Commissioner Bill Redd made a motion to approve the bid from Northwest Mfg. Commissioner Mark Maryboy seconded. UNANIMOUS. Fire Management Plan Fire Warden Frank Morrell has written a letter to the BLM with concerns about the BLM Fire Management Plan and has asked for the Commission's signature. A motion was made by Commissioner Bill Redd to approve signing the letter and seconded by Commissioner Mark Maryboy. UNANIMOUS. Mike Wilcox-Road Removal Mike Wilcox, Lisbon Valley, has requested that a road in Section 8, Township 31 South, Range 26 East be removed from the "D" Road system. Mr. Wilcox is proposing to build a new road off a rocky rim which is partly on BLM and private ground. Mr. Wilcox also reported that a verbal agreement made with the Road Department which used rock from his land in exchange for upgrading a road in to his property has not been completed. The Commission will meet with the Road Department and report back to Mr. Wilcox. Bids/Underground Storage Tank Removal-Monticello Airport Bids for removal of the underground storage tanks at the Monticello Airport were received as follows: E & G Contractor, Inc. Salt Lake City @$9233. Conrad Miller Mechanical, Salina @$9700. Dames & Moore, Salt Lake City @8900 After a discussion, Commissioner Bill Redd made a motion to allow Administrative Assistant Rick Bailey time to review the differing terms of the bids before making a recommendation. Commissioner Ty Lewis seconded. UNANIMOUS. Commissioner Mark Maryboy was not present at the time the action was taken. Building Permits Three building permits were submitted for approval as follows: Brett Black a new home in Blanding; David Bancroft a new barn south of Monticello on Hwy 191; Nancy Carr & Jeffry Matlock a modular home in Bluff. Commissioner Bill Redd made a motion to approve the building permits. Commissioner Ty Lewis seconded. UNANIMOUS. Commissioner Mark Maryboy was not present at the time the action was taken. Public Hearing At 11:30 A.M. a public hearing was held to hear comments on vacating alleyway in Block 11 and the south and west 1/2 buffer zone around Block 28 of the Cottonwood Addition, Bluff Utah. There were no written or public comments. Commissioner Bill Redd made a motion to vacate Block 11 and the south and west 1/2 of buffer zone around Block 28 of the Cottonwood Addition. Commissioner Mark Maryboy seconded. UNANIMOUS. BLM/Kent Walter Kent Walter, BLM San Juan Area Manager, reported that the public meeting for the BLM Fire Management Plan was held last week. The comment period is open until October 25, 1997. Roads-Snow Flats and Butler Wash Area Manager Kent Walter met with County Road Supervisor Doug Pehrson last week and discussed the flood damage to the Snow Flats and Butler Wash roads. Mr. Walter would like to propose stipulations for minor and major road repairs throughout the County that would be in agreement with the County and then work within those parameters before contacting legal counsel. The Commission agreed to the idea with the stipulation to examine the language of the agreement before a final decision is made. Calvin Blake/Cal Black Airport Calvin Blake, Manager, Cal Black Airport requested that the Commission extend his contract with the County to a 5 or 10 year agreement. The Commission told him that a contract can usually be terminated by either party with a 90 day notice. The County will contact the County Attorney about the possibility of a long term contract. Mr. Blake will then be notified of the decision. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Drought Mitigation Workshop Administrative Assistant Rick Bailey reported that there will be a Drought Planning Workshop in Salt Lake City on November 17-19, 1997. There will be an American Indian Economic Development Summit held in Provo on October 28-30, 1997. Commissioner Bill Redd and Commissioner Mark Maryboy will attend. Emergency Response Meeting Administrative Assistant Rick Bailey attended a Navajo Emergency Response meeting on October 2, 1997. Mr. Bailey reported that there is a possibility of using the County GIS equipment to produce a map of the Reservation to identify residences for emergency response purposes. FY 1998 PILT Increase The County received a memo from Robert Weidner concerning the FY 1998 PILT increase. According to the memo the House and Senate negotiators agreed to increase the FY 1998 PILT payment to counties by $6.5 million. Supplement Grant/Montezuma Creek Swimming Pool A memo was received from the Navajo Nation allowing San Juan County an extension from October 1, 1997 to September 30, 1998 on carry-over funds to complete the engineering and design work for the Montezuma Creek swimming pool. Schedule Mr. Bailey will be in the office on Tuesday. He will be in Grants, NM on Wednesday - Friday to attend the Northern New Mexico Emergency Management Conference. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Litigation Preference A motion was made by Commissioner Bill Redd to sign the litigation preference in the Brandt case. Commissioner Mark Maryboy seconded. UNANIMOUS. Payroll Changes/Sheriff Department Michael Bradford, Corrections Officer, completed P.O.S.T on September 2, 1997. The payroll change will be to move from Grade 12 Step 3 @$1567 per month to Grade 15 Step 3 @$1775 per month. A payroll change was presented for Gerald Bradford, Corrections Officer, who began P.O.S.T on September 8, 1997, to be moved from Grade 9 Step 1 @$1296 per month to Grade 12 Step 1 @$1477 per month. Commissioner Bill Redd made a motion to approve the payroll changes. Commissioner Mark Maryboy seconded. UNANIMOUS. Americorp Project Update Personnel Director Edward Scherick will be working on a Project Manager job description for the Americorp Project. Bluff & Mexican Hat Transfer Station Attendant Eugene Bunderson, Transfer Station attendant has decided to attend school part time. He has found a person to fill in and is currently working. The Commissioners feel that the position should be advertised. Meetings Planner Scherick attended the San Juan Forum meeting held in Pagosa Springs, CO on October 2, 1997. Mr. Scherick stated the need for more county people to become involved in the forum. Planner Scherick attended the Seeking Common Grounds meeting sponsored by the Forest Service. The Sage Grouse meeting was held on October 1, 1997. There were eleven or twelve landowners in attendance. They looked at maps and will be making recommendations. Planner Scherick and Commissioner Redd attended a 14 county Wilderness meeting in Price on October 3, 1997. Mr. Redd and Mr. Scherick were selected to be on a committee to deal with wording of a proposed legislative bill sponsored by Congressman Hansen. Planner Scherick and Secretary Lillian Taylor will be in Provo on Tuesday and Wednesday to attend GIS Training. Planner Scherick will be working with the Bureau of Reclamation on the water project this week. The Colorado Plateau Forum will be held on October 30-31, 1997 in Farmington, NM. COMMISSIONER MARK MARYBOY'S REPORT There will be an American Indian Economic Development Summit in Provo, Utah on October 28-30, 1997. The Navajo Nation Council met last week to consider CIP proposals in the amount of ten million dollars. Thirty two Chapters were not included so the resolution was tabled. Instructions were given to expand the amount to fifteen million dollars and consider all proposals for funding. The twelfth session of the Navajo Nation will be held on October 20-24, 1997. Commissioner Maryboy will not be in attendance at Commission meeting on October 20, 1997. Road Issues Commissioner Maryboy reported that the Montezuma Creek north site housing compound has all of the sand washed away along the highway and requested that some gravel be placed along side of the road. He requested that the County continue to blade the bus route roads and that some culverts have washed out and need to be replaced. COMMISSIONER BILL REDD'S REPORT Commissioner Redd attended the Commissioners Workshop held at Ruby's Inn near Bryce Canyon on September 25-26, 1997. Commissioner Redd attended Board of Equalization that was held on September 29, 1997. He also attended the CIB meeting held in Castle Dale on October 2, 1997. On October 3, 1997 Commissioner Redd and Planner Scherick attended a 14 county Wilderness meeting in Price, Utah. Commissioner Redd was selected to be on a committee to work on wording of proposed Wilderness legislation by Congressman Hansen. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis attended a Transportation District meeting on September 30, 1997. Commissioner Lewis also attended the Commissioners Workshop held at Ruby's Inn near Bryce Canyon on September 25-26, 1997.
