SAN JUAN COUNTY COMMISSION MEETING JANUARY 5, 1998 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the County Commission Chambers at Monticello, Utah. Present: Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk Absent: Ty Lewis, Chairman A motion to approve the minutes of the December 22, 1997 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Executive Session Commissioner Bill Redd made a motion to convene into Executive Session to discuss a personnel matter. Commissioner Mark Maryboy seconded. UNANIMOUS. Commissioner Bill Redd made a motion to exit the Executive Session. Commissioner Mark Maryboy seconded. UNANIMOUS. 1998 Commission Assignments A motion to retain Commissioner Ty Lewis as Chairman of the Commission and Commissioner Mark Maryboy as Vice- Chairman for the 1998 year was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. Commissioner Bill Redd made a motion to approve the names for check signature. Commissioner Mark Maryboy seconded. UNANIMOUS. Out-of-State Travel Request Economic Development and Tourism Director Peggy Humpreys presented an out-of-state travel request to attend a Consumer Travel Show in Houston, Texas on January 23-27, 1998. Commissioner Bill Redd made a motion to approve the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Navajo Public Safety/Law Enforcement Representatives from the Navajo Public Safety throughout the Reservation met with the Commissioners to discuss law enforcement issues. Mr. Rick Bailey reported that funding has been secured for Navajo police vehicles and equipment to be used for law enforcement on the Utah portion of the Reservation. They discussed estimated costs of the equipment and the possibility of a housing unit in the Montezuma Creek/Aneth area. After much discussion it was decided that the County would proceed with ordering six Tahoe- Chevrolets equipped with radios, lights, etc. The Navajo Tribe would then be responsible for liability insurance and maintenance. With the remaining money it was decided to look at obtaining a residence to be placed in the Montezuma Creek/Aneth area. There is also a need for an additional officer and house replacement in the Navajo Mountain area. Commissioner Maryboy requested that Administrative Assistant Rick Bailey write a press release for the Navajo Times on the proposed project. Mr. Bailey will coordinate with Denise Vicente on the press release. Commissioner Bill Redd made a motion that Administrative Assistant Rick Bailey proceed with the vehicle purchases and also work on housing in the Montezuma Creek/Aneth and Navajo Mountain areas with remaining available money. Commissioner Mark Maryboy seconded. UNANIMOUS. Utah Navajo Trust Larry Rogers, Executive Director Utah Navajo Trust Fund, commented on the Law Enforcement proposal and Memorandum of Agreement between the Navajo Nation and the County. The UNTF is looking forward to coordinating with the County and the Navajo Nation as the law enforcement project proceeds. Navajo Nation Economic Development Sylvia Belin, Program Manager Shiprock Regional Economic Development, discussed the Tribal Economic Development Plan for the Utah side of the Reservation and also the Montezuma Creek Township proposal with the Commissioners. They are also looking at regional planning in the Montezuma Creek area with a feasibility study to include a regional overview, transportation, utility distribution systems, health care and emergency services and training assessments. Commissioner Maryboy requested that Ms. Belin work with him, the County Economic Development office, and County Planner Scherick in connection with the Montezuma Creek Township Proposal. Commissioner Maryboy reported that $10,000 has been designated from the County and he requested that the Tribe match funds for the project. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Evaluation/Merit Pay-Cost of Living Personnel Director Scherick reported that based on evaluations this year there is a need to distinguish between cost of living and merit pay if these are to be included in this years salary adjustments. County Employee Numbers Personnel Director Scherick reported on a mandatory system that has to be implemented if the County full-time employee numbers reach 130. This would require an elected full-time personnel officer, appointed board for personnel hiring, a 3 member career council board, labor relations and negotiations. He feels that the County needs to be thinking about how to deal with this as the County full-time employee numbers are reaching this point. Americorp Project Director The advertisement for the Americorp Project Director position has been completed. Three applications have been received. No decisions have been made. Utah Retirement System Ted Cooley, Utah Retirement, will be in the County in April to discuss the new options available in the Utah Retirement program. BLM/Title V Right-Of-Way Planner Scherick reported that the BLM is continuing to issue Title V right-of-way over County Roads. Planner Scherick and Commissioner Redd have discussed the issue. County Water Study Planner Scherick stated that Wright Engineering firm should be submitting their final figures on the water study. Meetings The Seeking Common Grounds meeting will be held on January 6, 1998. Commissioner Bill Redd, Planner Edward Scherick, and Contract Specialist Bob Turri will meet with Ted Stewart, Department of Natural Resources, on January 8-9, 1998 to organize a group to help review plans proposed by the BLM, Forest Service, and Park Service. On January 15, 1998 there will be a Merit Pay meeting with elected officials and department heads. Commissioner Lewis has been asked to chair this meeting. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Administrative Assistant Rick Bailey reported that there will be a Fire Emergency Services meeting in Monument Valley on January 6, 1998. Mr. Bailey, Fire Warden Morrell and Sheriff Lacy will attend. Chapter Road Funds Mr. Bailey reviewed a list of the Chapter Road fund balances for 1997. The Aneth Chapter has some remaining funds and would like to sell their graders and purchase one newer grader. Mr. Bailey reported that the South Road Department has a 1990 John Deere grader to sell with a trade in value between $65,000 - $72,000 if the Chapter would like to purchase it. The County would then purchase a new grader for the South Road Department. Commissioner Bill Redd made a motion proposing the possibility of selling the South Road Department road grader to Aneth with agreement and approval to purchase a new grader for the South Road Department. Commissioner Mark Maryboy seconded. UNANIMOUS. Navajo Nation Funding Grant Administrative Assistant Rick Bailey requested permission to begin pricing equipment for the Reservation fire departments to be purchased with the Navajo Nation Grant Funding. The commission gave their approval. COMMISSIONER BILL REDD'S REPORT Target Practicing/LaSal Commissioner Bill Redd reported that Robert Sherman, LaSal, stated that shooting is going on too close to homes and that the transfer station is becoming a target area. Commissioner Redd will attend a CIB meeting this week. He will also meet with Ted Stewart, Department of Natural Resources in Salt Lake City on January 8-9, 1998. There will be a meeting with UDOT tomorrow afternoon in the Commission Chambers. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy reported that on December 24, 1997 there was an oil explosion at Elk Horn. Investigation is still continuing. Montezuma Creek Fire Department responded very quickly and contained the fire. Commissioner Maryboy reported that the Red Mesa Chapter has prepared a Resolution concerning the Red Mesa/Montezuma Creek Road. Commissioner Maryboy reported that an area near the oil well on Road #443 has a sharp curve where several accidents have occurred. The Red Mesa Chapter would like to meet with the Road Department to see what can be done to the road. Navajo White Mesa road usually has gravel on both sides. The gravel is worn off and needs to be replaced. Red Mesa Chapter is requesting that the Road Department look at Road #441 Desert Creek wash area and make a recommendation as to how to deal with the problem. A possible solution might be to place a culvert or a bridge. The recommendation will then be presented to the Shiprock Transportation District. Schedule Commissioner Maryboy has a Red Mesa Chapter meeting at 3:00 P.M. and a Planning meeting in Aneth at 5:00 P.M. today. Commissioner Maryboy will be in Window Rock on Tuesday the 6th, in Farmington on Wednesday the 7th, and in Phoenix on Thursday and Friday the 8th & 9th. The Revitalization meeting will be held in Bluff on January 26, 1998 at 2:00 P.M.
