SAN JUAN COUNTY COMMISSION MEETING AUGUST 3, 1998 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the July 27, 1998 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Oscar Begay/Oljato Chapter Oscar Begay, Oljato Chapter, expressed his appreciation for the Halchita road pavement project. He also stated that there are twenty new homes in the Halchita complex that need paving in front of them. Trash Dump/Halchita Oscar Begay reported that he had met with Indian Health Service concerning the open pit dump near Halchita. There is a real need for trash bins. The Commission suggested that he meet with the sanitation company from Kayenta concerning the possibility of placing trash bins at each residence. Oljato Recreation Oscar Begay reported that he needs $1800 to pay four high school students who are helping coach and run the sports program at the Oljato Chapter. It was reported that there was about $1100 that could go toward this. Administrative Assistant Rick Bailey will write a letter to the Oljato Chapter to schedule a meeting with the Commission along with Oscar Begay to resolve the funding problem. General Fund County Clerk Gail Northern and Deputy Auditor John Fellmeth reported that the independent auditors Kimball and Roberts have indicated that the general fund is in excess of 3.6 million and recommend that it be transferred. Mr. Fellmeth recommended that the 3.6 million be transferred from the general fund to the capital improvements fund and hold it in reserve for future capital expenditures. Commissioner Bill Redd made a motion to make the recommended transfer to the capital improvement fund. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Board of Equalization County Clerk Gail Northern reported that the tentative dates for Board of Equalization have been set for September 8 & 14, 1998 from 1-5:00 P.M. BLM/MOU Little Baullies Mesa Road Closure Kent Walter and Nick Sandberg, BLM, presented for approval a MOU between the Bureau of Land Management and San Juan County to close road D0260, Little Baullies Mesa, to conduct a controlled burn for the purpose of reducing hazardous fire fuels and maintaining existing seeding. The closure would be temporary for the execution and rehabilitation of the burn project. Commissioner Bill Redd made a motion to sign the MOU and Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Cedar Mesa Roads Kent Walter, BLM, reported that some of the roads on Cedar Mesa have been washed out. The County has been contacted. Comb Wash Decision Kent Walter, BLM, reported that the Interior Board of Land Appeals has issued their decision on Comb Wash. He stated that the preliminary indication looks like the BLM will have to conduct site specific analysis for each of their grazing permit renewals. Bid/Clutch Handler-Road Dept Bids were presented for the Road Department for a Clutch Handler w/Fly Wheel from Justis Supply @$720.74; Cortez Diesel @$764.88; and from Snap On @$750.20. Commissioner Bill Redd made a motion to approve the bid from Justis Supply. Commissioner Mark Maryboy seconded. UNANIMOUS. Dr. Penn Dr. Penn reported that he had received a letter from the County concerning his proposed office building. He believes there will never be a clinic near the hospital area. He spoke to the Commission concerning rumors that are brought into public meetings. He requested that the rumors be substantiated before reporting them in meetings. Public Hearings At 1:00 P.M. Commissioner Bill Redd opened the public hearing for comments concerning the proposed increase in the general fund budget in the amount of $50,750. There were no public comments and the hearing was closed. A public hearing was held for the proposed establishment of the Wilson Arch Water and Sewer Special Service District. There were no public comments. The hearing was closed. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Dolores County Water Conservancy District Planner Scherick reported that the Dolores County Water Conservancy District is flying over areas to photograph possible water storage sites. There is one site in Utah. They have asked if San Juan County would like to participate. The Commission agreed. Americorp San Juan County received a letter from Castleland RC&D asking if San Juan County would like to continue to participate in the Americorp program next year. The County will send a letter indicating that San Juan County does not wish to participate. Mr. Scherick reported that the State Americorp people were in the area evaluating the Southeastern Utah program. He indicated that the San Juan County group received a good rating. South Eastern Utah/Colorado River Basin Planner Scherick has been asked to serve on the South Eastern Utah/Colorado River Basin Regional Advisory Board. Schedule Planner Scherick will meet with Road Supervisor Doug Pehrson concerning the road photo study. He will meet with Americorp Supervisor Scott Pratt to close out the Americorp project. Mr. Scherick will be in Salt Lake City on Wednesday and Thursday to attend the CIB. He will represent the Eastland Water District funding project. Later that day he will meet with Earl Hindley, Photo Contractor, to review the first proofs of the photo study. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Montezuma Creek Swimming Pool Administrative Assistant Rick Bailey reported on the bid from Tri-Hurst Construction for the renovation of the Montezuma Creek Swimming Pool. Mr. Bailey reviewed the suggestions made by Tri-Hurst Construction to include white liner panels, paint structural steel, install 3" vinyl faced fiberglass between wall and roof panels, and install four additional ridge top vents for a total of $86345. Mr. Bailey requested permission to negotiate on a permanent fence and pool deck. Commissioner Mark Maryboy made a motion to approve the bid from Tri-Hurst with suggested additions and allow Mr. Bailey to negotiate on a permanent fence and pool deck repairs. Commissioner Bill Redd seconded. UNANIMOUS. Road Department/Roller Commissioner Bill Redd made a motion to allow the Road Department to seek bids for a rock breaking roller machine. Commissioner Mark Maryboy seconded. UNANIMOUS. Building Permits A building permit was presented for Joe D. Bierschied to build a cabin on Lot 1, South Mountain Subdivision, LaSal. A motion was made by Commissioner Bill Redd to approve the building permit. Commissioner Mark Maryboy seconded. UNANIMOUS. Solid Waste Renewal Permit Administrative Assistant Rick Bailey presented a proposal to renew the solid waste permit from SRK Consulting Engineers & Scientists, Reno, NV in the amount of $28,820. Commissioner Mark Maryboy made a motion to accept the proposal. Commissioner Ty Lewis seconded. Commissioner Bill Redd voted against. Planning & Zoning Commission Four applications were received from Bluff residents to be a board member on the Planning and Zoning Commission. There is a need for members to be from other areas of the County. Administrative Assistant Rick Bailey will try to find candidates from the other areas. Blanding Golf Course Survey Mr. Bailey reported that the County has received the billing for the survey of the Blanding Golf Course in the amount of $1750. The Commission gave approval to pay the bill. Utah Navajo Trust/Recreation Funds Agreement Administrative Assistant Rick Bailey presented a letter of agreement between Utah Navajo Trust Fund and San Juan County to administer funds distributed to the Utah Chapters of the Navajo Nation. Commissioner Bill Redd made a motion to sign the agreement. Commissioner Mark Maryboy seconded. UNANIMOUS. CDBG Water Quality Contract Administrative Assistant Rick Bailey presented the CDBG Water Quality contract between San Juan County and Southeast AOG & the State of Utah in the amount $41,936 for approval. Commissioner Bill Redd made a motion to sign the contract. Commissioner Mark Maryboy seconded. UNANIMOUS. Emergency Management Work Program Administrative Assistant Rick Bailey presented the annual work plan for the Emergency Management Assistance Program for signature. KJAZZ Television Administrative Assistant Rick Bailey reported that Montrose County Colorado is rebroadcasting a television station out of Grand Junction to the Nucla and Naturita area. It is on the same channel that the County KJAZZ channel is on and is causing a lot of interference. The County will send a letter to Montrose County requesting that they correct the problem. Telephone System/PSB The Commission gave Administrative Assistant Rick Bailey permission to enter into a leasing agreement with the telephone company for the new telephone system at the Public Safety Building. Meetings The date for the Revitalization Board meeting has been changed from September 14, 1998 to September 21, 1998. UDOT will be holding a Partners in Transportation on August 27, 1998 in Moab at 9.00 A.M. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis will welcome the Recorder's to their workshop on August 5, 1998. He will meet with the Forest Service/UDOT personnel on August 6, 1998 at 10:00 A.M. concerning the road on the mountain. COMMISSIONER BILL REDD'S REPORT Commissioner Redd attended the Public Hearings concerning the Economic Development and Travel Council Boards held in Monticello and Bluff on July 28-29, 1998. On July 30-31, 1998, Commissioner Redd attended the UAC Councilman and Commissioners workshop in Cedar City. He will attend the Community Impact Board meeting in Salt Lake City on August 5-6, 1998. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy was in Window Rock on July 28-30, 1998. The Tribal Council was in session all week. The Navajo Nation Public Safety is sending a request for reimbursement to the states of Utah and Colorado for some of the expenditures incurred in the manhunt in the amount of $750,000. This week Commissioner Maryboy will be in Window Rock on August 4-6, 1998 working on the budget for FY1999.
