SAN JUAN COUNTY COMMISSION MEETING SEPTEMBER 14, 1998 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the September 8, 1998 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Victims Advocacy Sheriff's Deputy Bill Pierce presented a contract between San Juan County and Teague Eskleson to work with the Victims Advocacy Grant. Commissioner Bill Redd made a motion to approve the contract. Commissioner Mark Maryboy seconded. UNANIMOUS. LEDI Proposal Susan Taylor, Economic Development, presented a LEDI proposal for Nizhoni Bridges Foundation for the Arts, Education, and Humanities, requesting funds to study the feasibility of a venue for public programming. Commissioner Bill Redd made a motion to approve the LEDI application. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Truck Cab & Chassis The following bids were presented for a truck cab & chassis: Peterbuilt of Utah @$79858; Lake City International @$76200; and Great Basin Truck @$76710. The Commissioners asked that the Road Department make a recommendation before approving the bid. Bid/Trailer Administrative Assistant Rick Bailey presented a bid for an enclosed trailer to be used in Search and Rescue and would also be available for use by other departments. The bid is from Young Pontiac Cadillac for $4620.40. Commissioner Bill Redd made a motion to approve the bid. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Heating & Air Conditioning-Courthouse A bid was received from Redd Plumbing and Heating for an air conditioning and heating system in the Courthouse @$33620 with option to add a 4-split system @$2368. Commissioner Bill Redd made a motion to approve the base bid of $33620. Commissioner Mark Maryboy seconded. UNANIMOUS. Educators Insurance Jeff Christensen and Eric Falk, marketers for Educators Insurance spoke to the Commission concerning the possibility of their company contracting with the County for medical insurance. The County's present contract is not up for renewal until the end of 1999. The Commission told Educators Mutual to keep in touch with Administrative Assistant Rick Bailey. San Juan Special Service Area #1/Concerned Citizens Amer Tumeh presented the Commission with a letter from the Bluff Water Works Manager along with a letter and a signed petition from 86 concerned Bluff citizens who would like the service area board abolished. Mr. Tumeh feels that the San Juan Special Service Area #1 Board insists on spending money illegally on planning and zoning and has no regard for the citizens of Bluff or the County, runs its own agenda, and does not listen to anyone. He requested that the Commission abolish that Board. The following Bluff citizens voiced their concerns: Amer Tumeh, Jack Powell, Margaret LaBounty, David Bond, Kent Cantrell, Gaylan Hadley, Robert Smith, Linda Moore, Jean Brundage, and Mark Bond. The Commissioners asked several questions and stated some possible alternatives. Administrative Assistant Rick Bailey stated that the County has the power to abolish the Service District. The Commissioners would like to seek the counsel of the County Attorney before any decisions are made. A public meeting will then be held in Bluff with the Service Area Board, the County Commissioners, and Bluff concerned citizens. Commissioner Mark Maryboy will attend the next Service Area Board meeting on October 7, 1998 at 7:00 P.M. BLM/Nick Sandberg Nick Sandberg, BLM, reported that the BLM will be holding a public meeting in Bluff on Wednesday, September 16, 1998 at 7:00 P.M. at the Bluff Elementary School concerning the survey of accretion lands. EMS Radio/Kenneth Maryboy Kenneth Maryboy, White Rocks Area, reported that the radio currently being used for EMS in the White Rocks Area is not working properly. Administrative Assistant Rick Bailey recommended that a new radio be purchased. Commissioner Bill Redd made a motion to purchase a new radio for the White Rocks area EMS. Commissioner Mark Maryboy seconded. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits Building permits were presented for Eddie Barry for an addition to existing home in Eastland and for Jerold Perkins for a storage building on Browns Canyon Road. Commissioner Bill Redd made a motion to approve the building permits. Commissioner Mark Maryboy seconded. UNANIMOUS. Sign Permit/Wilson Arch Development A sign permit was presented for Phil Glaze to place an advertisement sign on the Wilson Arch Development property. Commissioner Bill Redd made a motion to approve the permit and Commissioner Mark Maryboy seconded. UNANIMOUS. Out-of-State Travel An out-of-state travel request was presented for Lyon Hazleton to attend a National Judicial College conference in Reno, NV on October 10, 1998. Commissioner Bill Redd made a motion to approve the out-of-state travel request. Commissioner Mark Maryboy seconded. UNANIMOUS. Payroll Change/Brian Bayles-Road Dept A payroll change was presented for Brian Bayles to be moved from part time Step 48 @$7.09 per hour to full-time Step 48 @$1229 per month. He is replacing Road Department employee Don Lyman who was killed in an accident. Commissioner Bill Redd made a motion to approve the payroll change. Commissioner Mark Maryboy seconded. UNANIMOUS. Montezuma Creek Swimming Pool/Change Order A change order was presented on renovation of the Montezuma Creek Swimming pool to replace the pool deck and install an 8 foot chain link fence with 3 strand barb-wire around the perimeter of the site in the amount of $10,703. Commissioner Bill Redd made a motion to approve the change order. Commissioner Mark Maryboy seconded. UNANIMOUS. ORV ROADS Mr. Bailey indicated that Harold Frost had met with him and would like to meet with the Forest Service, BLM and County Commission the first part of October to draft an agreement on ORV trail upgrades. Commissioner Lewis stated that there will be equipment available to work on the upgrade of the trails. Variance Request Administrative Assistant Rick Bailey reported that Susan Davis is looking to purchase some property outside the Bluff Service Area and is requesting a variance on the property which is .57 acre. The Commission declined her request for a variance. Regional Farmland Protection Area Administrative Assistant Rick Bailey reported that the County has received the official petition from the group that wants to buy the portion of the Jones and Guymon farms and place them in agricultural preservation. The laws states that the Commission is required to appoint an Agriculture Preservation Committee which is the members of the Soil Conservation District Board. The County will write a letter to the Soil Conservation District indicating that a board will need to be set up to handle the request. Commissioner Bill Redd made a motion to establish an Agricultural Preservation committee. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. GIS Equipment With the authorization of the purchase of additional GIS equipment it was decided that the cost of the purchase should come out of the road budget. Meetings Administrative Assistant Rick Bailey will attend the UAC Commissioners Fall Workshop in Cedar City on September 17-18, 1998. The Revitalization meeting will be held on September 21, 1998 at 2:00 P.M. in Blanding. COMMISSIONER BILL REDD'S REPORT Commissioner Redd reported that he had attended the CIB meeting and part of the Governors Economic Rural Summit in Cedar City on September 10-11, 1998. Commissioner Redd stated that he was involved in an automobile accident near Beaver, Utah while returning home from the CIB meeting. He will attend the UAC Commissioners Fall Workshop in Cedar City on September 17-18, 1998. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy stated that the Bluff Fair was held and he would like better advertisement in the Monument Valley area for the fair. Commissioner Maryboy reported that he has been working on the FY99 Tribal Budget and approved over three hundred million dollars. Commissioner Maryboy will attend the Joint Highway Committee meeting in Ogden, Utah on September 24-25, 1998. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the Utah State Fair queens luncheon on Friday, September 11, 1998. Commissioner Lewis will attend the UAC Commissioners Fall Workshop to be held in Cedar City on September 17-18, 1998. He will also attend the Joint Highway Committee meeting in Ogden, Utah on September 24- 25, 1998. Adjournment: The meeting adjourned at 12:20 P.M.
