SAN JUAN COUNTY COMMISSION MEETING NOVEMBER 23, 1998 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the November 16, 1998 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Commission Meeting There will be no Commission meeting on November 30, 1998 due to a fifth monday. Cellular Telephone/Extension Office USU Extension Office secretary, Anna Adair, requested permission to activate a car cellular phone to be used for emergency purposes when she and San Juan County Home Economist, Heidi LeBlanc are out on county business. Commissioner Bill Redd made a motion to approve the request with the provision that Utah State University be asked to reimburse the County for the service. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Lucinda Hardgrave/Delinquent Property Tax County Treasurer Paul Barr reported that he has researched the situation regarding the delinquent property tax on the Lucinda Hardgrave property near Pack Creek Ranch. Mr. Barr stated that he did change an address on a parcel that is state assessed and is classified as metalliferous. Prior to the tax notices being sent out Mr. Barr received the State assessed listing and it had the Denver address on it so he changed it back to the Denver address assuming that this information was more current than his. The Commission has agreed to deal with the penalties and interest on the metalliferous parcel but have some legal concerns with the other parcel even though the tax billing was never received. However, the 1998 tax billings are due and payable through November 30, 1998. The matter will be referred to the San Juan County Attorney for a decision. A letter will be sent to Ms. Hardgrave stating the County's position. Commissioner Bill Redd made a motion to have the County Attorney review and issue a legal opinion before a decision is made. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. 1999 Tentative Budget Chief Deputy Auditor, John Fellmeth, presented the Commissioners with a copy of the proposed 1999 budget. The Commissioners will meet with the department heads on November 30, 1998 to review their budget requests. San Juan County Hospital Interim Hospital Administrator, Reid Wood, met with Commissioner Maryboy this morning and discussed the situation at the Montezuma Creek Clinic. Mr. Wood reported that Commissioner Maryboy pledged his cooperation. Wildland Fire Budget Gary Cornell, State Wildland Fire, reported on the 1999 Wildland Fire Budget in the amount of $44,162 between San Juan County and Utah Division of Forestry, Fire & State Lands. Variance Request Commissioner Bill Redd made a motion to open the public hearing for a variance request for J.D. Lancaster to approve .87 acre to be used as a building lot in Bluff. There were no written or public comments. Commissioner Bill Redd made a motion to close the public hearing. Commissioner Mark Maryboy seconded. UNANIMOUS. BLM/Little Baullies Mesa Nick Sandberg, BLM, reported that on the re- seeding project on Little Baullies Mesa. It has been discovered through the inventory that there are some national register eligible sites on or near the road. Options would be to haul fill-in, excavate, or re-route around them. The Commission suggested that the BLM meet with the Road Department to help determine which action should be taken. The Little Baullies Mesa Road is no longer closed. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Senior Citizen Director Personnel Director Edward Scherick presented a request to advertise for a permanent, full-time Senior Citizens Director for the Monticello Senior Center. Commissioner Bill Redd made a motion to approve advertising for a full-time Monticello Senior Citizen Director. Commissioner Mark Maryboy seconded. UNANIMOUS. Personnel Policy Change/Administrative Leave Personnel Director Edward Scherick requested Commission approval to implement for Kelly Bradford and Mike Bailey, Sheriff Department personnel, Section 9, Paragraph J of the personnel policy entitled "Administrative Leave". Commissioner Bill Redd made a motion to approve the implementation of the Administrative Leave section of the personnel policy. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Emergency Hire Policy Personnel Director reported that the Draft Emergency Hire Policy has been out for comments. Comments were received from the Monticello Senior Center and the County Clerk. Personnel Director Scherick requested approval of the policy to be added to the personnel policy. Commissioner Bill Redd made a motion to approve the Emergency Hire Policy. Commissioner Mark Maryboy second. UNANIMOUS. The policy is as follows: EMERGENCY HIRE POLICY Emergency Hire What is an emergency hire? An emergency hire will normally be considered if an unforeseen occurrence, crisis, dilemma or event that requires immediate attention to either maintain an uninterrupted work schedule, or meet an unexpected deadline, such as a court deadline, or perhaps keep the senior centers running smoothly, or hire flagmen for the Road Department, etc. It may also be invoked when special expertise is needed to complete a short-term project. Basic considerations for an emergency hire to be considered: 1. Is the event critical to the function or mission of the County? 2. What is the time frame for completing the work? 3. Will other options work, i.e., can a current employee, perhaps from another department, fill in for a short time? 4. What expertise is needed, and does that expertise exist within existing county staff, and if so can that person be utilized to complete the project? Procedure: 1. Notify the personnel office at the earliest opportunity. 2. Determine what skills are needed to meet the emergency requirement. 3. If possible, recommend an expected salary schedule, ie, the going rate for heavy equipment operators, etc. 4. The first opportunity will be to try to fill the emergency by advertising for 72 hours in all departments. 5. In concert with this, recruit from Work Force Services, for 72 hours. 6. Note: On board county people will be given preference to filling the position. In other words, road temporaries, fire crews, etc., will be looked at first to determine whether or not they have the skills to do the job, if they don't we will give preference to Work Force Services applicants, and if they have no qualified applications, then the personnel office and the department will go outside to find a qualified candidate, or candidates. 7. The Commissioners will be the final authority on salaries, especially if there is a dispute on salary. Adopted: /s/Ty Lewis Date: 11/23/98 Ty Lewis, Chairman C.C. Telecommunications Planner Scherick reported that Grand County has passed a resolution concerning telecommunications and is asking if San Juan County would be interested in joining the universal fund to develop services in Southeastern Utah. The Governors from the Four Corners area will be meeting next week and Governor Mike Leavitt will be presenting to this group the need for expanding telecommunications for Southeastern Utah and the Four Corners area. Planner Scherick will meet with Dave Epic, Fort Lewis College, and develop a resolution to include the four corners area concerning telecommunications. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits The following building permits were presented for approval: Paul J. Morris/Morris' Last Resort for a cook facility on Loop Rd-Brumley Ridge near Geyser Pass and from Max Palmer for a Storage/Shop in Blanding. Commissioner Bill Redd made a motion to approve the building permits. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. TV Building/Abajo Peak Administrative Assistant Rick Bailey presented the proposal from Pinegar Design Group for the ice shield building on Abajo Peak in the amount of $22,750 plus additional visits if needed for approval. Commissioner Bill Redd made a motion to approve the proposal. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Computer/Commission-Fire-Aging Administrative Assistant Rick Bailey reported that the computer on the Secretary/Receptionist desk will be transferred to the Home Health office for contract services for the county. Mr. Bailey presented bids for replacement of that computer from Gateway 200 for a GP6-350 computer @$1520 and from Micron for a CP350 computer @$1999. Commissioner Bill Redd made a motion to approve the bid from Gateway. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Navajo Police Vehicles Administrative Assistant Rick Bailey reported that the County received a letter from the Navajo Nation Acting Chief of Police, Steven Nelson concerning the use of the Navajo vehicles on the Utah portion of the Reservation. Mr. Nelson attached a listing of calls for service for the Commission to review. Meetings There will be a Navajo Nation Department of Transportation meeting in Aneth on December 14, 1998 at 2:00 P.M. The Utah Navajo Trust meeting will be held in Oljato on December 14, 1998 at 10:00 A.M. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy will be meeting with the Tribe and requested a copy of the road agreement between the BLM and the County to be used as a model in developing an MOA between the Tribe and the County. Commissioner Maryboy met with Donna Singer and discussed the possibility of centralizing the accounting system. They also discussed the future of the Montezuma Creek Clinic. Commissioner Maryboy will attend the Dineh Committee meeting in Oljato at 1:00 this afternoon. He will be in Window Rock on November 23, 1998 and back in the area the remainder of the week. There will be a transportation meeting in Aneth on December 12, 1998. COMMISSIONER BILL REDD'S REPORT Last week Commissioner Redd met with Utah State University and Natural Resource Committee of the Legislature in trying to obtain funding for the road survey projects in the counties. Approval was given to go to the Legislature. He attended the Utah Association of Government meeting in Price. There is still an opening on the UAC board to be selected from the Price AOG. Commissioner Redd will be in the County this week. COMMISSIONER TY LEWIS' REPORT Last week Commissioner Lewis attended the Revitalization meeting. He also attended the county Road Department Supervisor Training meeting. He attended the San Juan Health Care District Board meeting on November 17, 1998. The County received a letter from the Utah State Tax Commission which states that the County was not ordered to factor their 1999 tax assessment rolls.
