SAN JUAN COUNTY COMMISSION MEETING MAY 10, 1999 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Barbara Ford, Secretary A motion to approve the minutes of the May 3, 1999 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Bid/Gas Compressor/Road Dept A bid was submitted for a gas compressor from Motor Parts @$776 and from Sears @$599.99. Commissioner Bill Redd made a motion to approve the bid from Sears. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Bid/Wire Feed Welder/Road Dept Bids were presented for a wire feed welder from Four Corners Welding @$1695 and from Motor Parts @$2745. Commissioner Bill Redd made a motion to approve the bid from Four Corners Welding. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Bid/Fax Machine/Attorney A bid from Communications Plus was presented for a Sharp F0-2850 Fax Machine @$749 for the Attorney's Office. It will be purchased with Drug Task Force funds. Commissioner Bill Redd made a motion to approve the bid. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Concrete/PSB Dell Hunter, Grounds and Maintenance, requested to have some concrete work done at the Public Safety Building by Sonderegger's Inc. at the same price as last year. Commissioner Bill Redd made a motion to approve having concrete work done at the Public Safety Building. Commissioner Mark Maryboy seconded. UNANIMOUS. Navajo Transit System Wayne Claw, Navajo Transit, requested that the Commission write a resolution letter supporting funding from UDOT for S311 Program. Administrative Assistant Rick Bailey will write a letter to Doug Mears, UDOT Program Manager. DOE/Supplemental Standards Joel Berwick, DOE Project Manager, discussed with the Commission areas affected by the environmental cleanup with regard to controlling easements. Questions were raised regarding the constitutional legality of controlling the areas. Mr. Berwick indicated they would be de-mobilizing as soon as June 30, 1999. Commissioner Lewis asked if the trailers at the sight could remain in the area and be used for low income housing. A request will be written to Mr. Berwick asking him to pass the request on to proper authority. May Tax Sale Bruce Royer, Blanding, asked the Commission if he could look at the title searches on the properties advertised in the May Tax Sale. The Commission stated that is public information. Out-of-State Travel/Peggy Humphreys Peggy Humphreys, Community Development & Visitor Services, presented an out-of-state travel request to attend a Heritage Conference in Pueblo, CO. She will be traveling with Emery County employees and will be reimbursed for her travel. Commissioner Bill Redd made a motion to approve the travel request. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present when the action was taken. SSBG Contracts Lillian Taylor, Personnel Secretary, presented the revised SSBG contracts for approval in the amount of $60,000 which includes a carry over of $5,685.40. Commissioner Bill Redd made a motion to sign the contracts. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Wilderness Review Process/BLM Kent Walter, Monticello BLM Field Office Manager, reported that the Wilderness Scoping meeting went very well. There were approximately 200 people in attendance. He stated there will be other meetings with the Navajo Commission at various chapters. Commissioner Mark Maryboy suggested that the Oljato and Red Mesa Chapter houses could be used for presenting information. It was also suggested that County Liaison Edward Tapaha could interpret if needed. Comments will be evaluated after June 21, 1999 and a response will be sent. Property Tax Issue A discussion was held concerning the steps to be taken in settling the delinquent property tax issue on the property owned by Mary Jim and Mary Hernandez. Planner Scherick stated that he knew about the boundary on the property when he worked for the federal government. Commissioner Maryboy stated that the Tribe is working with the BLM to try and resolve the issue. There was no action taken by the Commission. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Request to Hire/Aging Personnel Director Edward Scherick presented the name of Genevieve Yazzie to be hired part-time at the Blanding Senior Center at Step 1 @$5.69 per hour effective May 12, 1999. Commissioner Bill Redd made a motion to approve the hire. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. GPS Planner Edward Scherick reported that Lee Gonzales would be working with the fire crew and Phillip Garcia will stay with the GPS crew for three more weeks. Wilderness & Road Closure Signs County Planner Edward Scherick reported on Thompson and Urquhart's suggestion for removal of the wilderness boundary signs. He will notify the BLM concerning the County plans concerning road closure signs. OHV Ordinance Planner Scherick reported that the OHV Ordinance will be advertised in the newspapers. Maps and ordinance will be posted in the various communities for review Mr. Scherick stated there would be about two weeks of advertising on the comments received from the National Park Service and the Forest Service. A Field Managers meeting will be held on May 24, 1999 at 1:00 P.M. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits Building permits were presented for Kurtis Pugh, a shop on Meadow Lane and for John Nicol for a modular home in LaSal. Commissioner Bill Redd made a motion to approve the building permits. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. County Clerk Position Administrative Assistant Rick Bailey reported that someone from the Governors office staff would be in the County on the afternoon of May 13, 1999 to conduct interviews for the County Clerk position. Beer License Renewal An application for renewal of a beer license for the Twin Rocks Cafe & Gift Shop was presented for approval. Commissioner Bill Redd made a motion to approve the beer license renewal. Commissioner Mark Maryboy seconded. UNANIMOUS. A certificate will be issued by the County Clerk's office. Closed Fire Season Commissioner Bill Redd made a motion to close the fire season effective June 1, 1999. Commissioner Mark Maryboy seconded. UNANIMOUS. Bluff Senior Center Administrative Assistant Rick Bailey reported that the remodeling construction on the Bluff Senior Citizen Center will start in about two weeks. Montezuma Creek Swimming Pool Administrative Assistant Rick Bailey went with Tri-Hurst Construction to conduct the closeout on the Montezuma Creek Swimming Pool. Mr. Bailey stated that the County Ground and Maintenance Department will repaint and help with the plumbing work in the restrooms. Tri-Hurst Construction will submit a supplemental bid on repairing the old portion of the building. CIB/Bluff Special Service Area Administrative Assistant Rick Bailey attended the CIB meeting last week. The Bluff Special Service Area remodeling proposal for the community center was moved to the top of the priority list for the next funding cycle. FLPMA 202 Workshop Administrative Assistant Rick Bailey gave each of the Commissioners a copy of a memorandum concerning dates for FLPMA 202 Process Workshops. A workshop will be held in Cedar City, Utah on May 14, 1999 and one in Price, Utah on May 15, 1999. Recreation Fund/Oljato Chapter Oscar Begaye, Recreation Coordinator, requested additional funding for youth programs in the Oljato Chapter. Administrative Assistant Rick Bailey will write a letter suggesting different avenues for budgeting of funds allocated and also suggest possible ideas to obtain additional funds. Calf Canyon/Cleanup Administrative Assistant Rick Bailey reported that the County has received a request with signatures asking that the County burn debris and clean out the drainage ditch from Calf Canyon through the Historical District of Bluff. After a discussion it was decided that because the property is on private land the County could not take responsibility for clearing it out. Mr. Bailey will write a letter to the Bluff citizens stating the County position. Montezuma Creek Airstrip The County has been asked to brush clean the airstrip at Montezuma Creek. After a discussion it was decided that the County does not have the authority to do that. The Aneth Chapter could do it or give the County written authority to do so. Agricultural Tractor/Disc Administrative Assistant Rick Bailey reported that the company receiving the disk bid for the agricultural track does not include demonstrate of the disk. It was decided to seek another bid. Mr. Bailey will also speak with the original bid company. Schedule Administrative Rick Bailey will not be in attendance at the next two commission meetings. He will be attending AAA meeting and then will be in Phoenix attending a workshop. COMMISSIONER BILL REDD'S REPORT Commissioner Redd reported that he attended CEU graduation on May 7, 1999. Commissioner Redd received an honorary Doctorate Degree in Philosophy. Commissioner Redd will go with Phil Brueck, National Park Service, this week. He will travel to Shiprock on Friday to attend a hearing in connection with the San Juan Health Care Service District. On Saturday, May 15 he will attend a FLPMA 202 Process Workshop in Price. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Mark Maryboy requested that changes in the minutes read as follows: "Transcript of discussion is available in the Clerk's office" be added to page 3 of the minutes and delete the last line of the same paragraph. Last week Commissioner Maryboy attended a Senior Citizen Convention in Laughlin, NV where he was a guest speaker. Commissioner Maryboy will only be at Commission meeting until 11:00 A.M. next week. Commissioner Maryboy reported that he has received complaints from Navajo license plate applicants regarding the Assessors office. Commissioner Maryboy has requested that complaints be sent to him in writing. Commissioner Maryboy will meet with Chapter officials and the San Juan County School superintendent regarding the Montezuma Creek school. He will attend the open house and dedication of the San Juan County Substance Abuse/Mental Health Service District building today. Commissioner Maryboy will attend the court hearing in Shiprock on Friday, May 14, 1999. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis will attend the dedication of the San Juan County Substance Abuse/Mental Health Service District building this afternoon at 2:00 P.M.
