SAN JUAN COUNTY COMMISSION MEETING JUNE 7, 1999 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Barbara Ford, Secretary A motion to approve the minutes of the May 24, 1999 meeting was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Community Development Susan Taylor, Community Development, reported that funding has been pulled for the placement of a traffic light at the corner of Highway 666 & 191 in Monticello. It was decided that a letter be written to Dale Peterson, UDOT Regional Director, regarding the need for funding because of hazardous conditions created by lack of the signal light. County Clerk/Auditor Norman L. Johnson was sworn is as the new San Juan County Clerk/Auditor. Bookmobile Contract Kay Shumway, San Juan County Library Board President, presented the Bookmobile contract in the amount of $51,388 for fiscal year 2000 for approval. Commissioner Bill Redd made a motion to approve the contract. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. San Juan County Substance Abuse/Mental Health Service District Robert Johnson, Business Manager, presented the State contracts and this years Substance Abuse contract in the amount of $24,905 for signature. The Commission suggested that a letter be written to the State asking to base the participation amount on assessed value as opposed to a percentage of the grant. Building Permits The following building permits were presented for approval: Wilbur Smith, a residence in Velcar Subdivision, Spanish Valley; Alfred & Pearl Phelps a utility and bathroom addition; Ben Black a storage unit; Seely Contracting & Masonry a storage unit; Donald Sphar a storage unit; and Jay Randal a shed in LaSal. Commissioner Bill Redd made a motion to approve the building permits. Commissioner Mark Maryboy seconded. UNANIMOUS. Sign Permit A sign permit was presented for Fry Canyon Lodge/Cafe for approval. Commissioner Bill Redd made a motion to approve the sign permit. Commissioner Mark Maryboy seconded. UNANIMOUS. OHV Ordinance 99-1 A motion to adopt the OHV Ordinance was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. See attached copy of Ordinance 99-1 at end of minutes. Sheila & Toni Parish Tax Sale Property County Treasurer Paul Barr reported on the tax sale of the Sheila & Toni Parish property. Commissioner Mark Maryboy requested that in the future any properties belonging to Native Americans be brought to his attention before they are sold. BLM Monticello BLM Field Office Manager, Kent Walter, invited the Commissioners to go on a field trip on June 8, 1999 with David Terry and other State people from the School & Institutional Trust Lands Administration. Mr. Walter also presented an update on the statewide Wilderness Study Area amendment effort and the meeting with the Oljato Chapter. The Commissioners requested a letter from the WSA committee indicating flexibility in receiving comments after the June 21, 1999 deadline. Out-of-State Travel An out-of-state travel request was presented for Administrative Assistant Rick Bailey and County Landfill Manager Dayne Shumway to travel to Thoreau, NM on July 27, 1999. Commissioner Bill Redd made a motion to approve the out-of-state travel. Commissioner Mark Maryboy seconded. UNANIMOUS. Executive Session A motion was made by Commissioner Bill Redd to convene into an executive session to discuss personnel issues. Commissioner Mark Maryboy seconded. UNANIMOUS. Commissioner Bill Redd made a motion to exit the executive session. Commissioner Mark Maryboy seconded. UNANIMOUS. No decisions were made. Public Hearing: Vacate Alley & Portion of Rabbitbrush Road At 11:45 A.M. Commissioner Ty Lewis opened a public hearing to hear comments on vacating the alleyway portion of Rabbitbrush Road. Administrative Assistant Rick Bailey reported he has received some unfavorable comments on the issue. No other public comments were heard. Commissioner Bill Redd made a motion to vacate the alleyway subject to easements for the extension of utilities. Commissioner Mark Maryboy seconded. UNANIMOUS. The hearing was closed. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Request to Hire/Deputy Treasurer The name of Amber Young was presented to fill the Deputy Treasurer position at Step 25 @$1112 per month effective June 8, 1999. Commissioner Bill Redd made a motion to approve the hire. Commissioner Ty Lewis abstained due to relationship of applicant. Commissioner Mark Maryboy seconded. UNANIMOUS. GRAMA Request Planner Scherick reported that a GRAMA request has been received from SUWA. Commissioner Ty Lewis presented a response letter to UAC . It was decided that payments in advance for research will be requested. A deadline line extension was approved because the County Clerk is the GRAMA official and just started in his position on June 7, 1999. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Navajo Transit Authority A draft resolution from the Navajo Transit Authority to provide services was presented for approval. Commissioner Bill Redd made a motion to approve the resolution. Commissioner Mark Maryboy seconded. UNANIMOUS. San Juan Central Recreation District The Commission requested that a copy of the Blanding Recreation priority list for funding be obtained. Administrative Assistant Rick Bailey reported that the $50,000 of TRT funds allocated for the Four Corners Monument might be used as that funding will not be needed until the year 2000. GPS Grant The County has received notification of a $20,000 state grant allocated for GPS work. Commissioner Bill Redd made a motion to sign the contract. Commissioner Mark Maryboy seconded. UNANIMOUS. Emergency Rescue Equipment Administrative Assistant Rick Bailey reported on a $10,000 allocation for emergency rescue equipment as it pertains to the responsibility of the County. The use of funds for moving the ambulance garage and remodeling of the Montezuma Creek Clinic were discussed, along with possibilities for the Montezuma Creek fire station ambulance area. Administrative Assistant Rick Bailey will advertise for bids. First Security/Zion Bank Merger Administrative Assistant Rick Bailey informed the Commission that First Security Band and Zion National Bank has announced a merger and will become First Security Bank sometime after the first of the year. Bluff City Park/Quit Claim Deed Administrative Assistant Rick Bailey presented a Quit Claim Deed for the Bluff City Park transferring ownership to the San Juan County Service District #1. Commissioner Redd raised questions regarding the residual right of ownership. The County will contact the County Attorney before a decision is made. Canyonlands National Park Expansion Administrative Assistant Rick Bailey presented a letter from Senator Hatch opposing the expansion of Canyonlands National Park. Congressman Cannons's Office Administrative Assistant Rick Bailey will invite Keith Nash, Congressman Cannon's Office, to a commission meeting to discuss county concerns. Commissioner Mark Maryboy suggested that Mr. Bailey invite Navajo Nation President Oscar Begay to a meeting to also discuss county concerns with him. EPA Administrative Assistant Rick Bailey reported that he met with the EPA and the State of Utah in Phoenix last week regarding responses on the Navajo Reservation. He stated that it was agreed to look at the joint power agreement between the State and the Navajo Nation regarding response, authorities, and liabilities. The EPA may have funds available to bolster response capabilities. Monument Valley/San Juan Foundation Utah State University has expressed a desire to put a high education center in the Monument Valley area. A proposal was discussed for the County to transfer some land to the San Juan Foundation. Senior Center Flood Mr. Bailey reported on the flood on Memorial Day at the Monticello Senior Center. Commissioner Lewis asked Mr. Bailey to speak with Grounds and Maintenance Supervisor Dell Hunter regarding a maintenance person to be used at the center in lieu of costs from the flood. Y2K Communication A discussion was held regarding Y2K communication issues if power failure occurs in the County. Mr. Bailey presented information regarding purchasing a satellite telephone system for the County. No decision was made. Meetings Administrative Assistant Rick Bailey and Commissioner Ty Lewis met with personnel from Senator Hatch's office on June 3, 1999. The Navajo American Legislative meeting will be held on June 17, 1999 at 9:00 A.M. in Salt Lake City. The Revitalization meeting will be held on June 21, 1999 in Blanding. There will be a Solid Waste meeting in Thoreau, NM on July 27, 1999. Administrative Assistant Rick Bailey and County Landfill Manager Dayne Shumway will make a presentation. COMMISSIONER MARK MARYBOY'S REPORT San Juan Health Care Services Commissioner Maryboy reported that he would like a relationship developed between the San Juan Health Care Service District and the Chapters. He suggested that Cleal Bradford set up a meeting with the Chapter leaders for this purpose. Concern was expressed over the hiring of a new manager at the Montezuma Creek Health Clinic. Commissioner Lewis stated that the Health District will advertise for the position. Tribal Funds Commissioner Mark Maryboy read a letter from Speaker Marty Stephens regarding Tribal Fund distribution. Commissioner Maryboy stated he would like to meet with Mr. Stephens to further discuss the issues. Teec Nos Pos Chapter Resolution Commissioner Maryboy suggested that a letter be written to the Teec Nos Post Chapter asking the Chapter to identify school bus roads and prioritize road maintenance requests. Montezuma Creek Township Study Commissioner Maryboy will be meeting on June 10, 1999 with the Montezuma Creek Township study group. Chapter Recreation Funds Commissioner Maryboy expressed his concerns regarding the appropriation of county recreation funds to each of the Chapters. He is concerned that the Chapters are not budgeting their funds properly. He asked that a letter be written to each of the Chapters requesting that a budget plan be submitted to the County for next year to help insure that the funds are properly distributed. Meetings Commissioner Maryboy will be in Salt Lake City on Thursday and Friday. He will not be at commission meeting next week. COMMISSIONER BILL REDD'S REPORT AOG Revolving Loan Commissioner Bill Redd made a motion to give $625 to the Revolving Loan fund at the AOG. Commissioner Mark Maryboy seconded. UNANIMOUS. Meetings Commissioner Bill Redd reported that he attended the UAC Road meeting. The County received $20,000 of which some will go to the High School Work Fair. He also attended the Multiple Use Coalition meeting and the Community Impact Board meeting. He requested out-of-state travel permission for two people to go to Washington to give a road presentation on June 15-22, 1999. The Commission gave permission. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the San Juan Health Care Service District meeting last week. Commissioner Lewis met with personnel from Senator Hatch's office on June 3, 1999. Commissioner Lewis met with David L. Burke, Rural Health Financial Services.
