SAN JUAN COUNTY COMMISSION MEETING OCTOBER 18, 1999 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the October 11, 1999 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Public Hearing: Bluff Maintenance Cemetery District Commissioner Ty Lewis opened a public hearing to hear comments concerning the proposal to establish the Bluff Maintenance Cemetery District. Roger Atcitty, Bluff, objects to the proposed boundary line. He showed a map which includes sections 25, 29, and 30. The river runs through those sections. The land north of the river has been established as Reservation through a resolution from the Navajo Nation Tribal Council. Mr. Atcitty resides on that land. He requested that the boundary line be changed. Hearing no further comments the hearing was closed. Administrative Assistant Rick Bailey stated that he would contact the County Attorney concerning the Reservation land issue included inside the proposed boundary and report back before a decision is made. Board of Equalization/Richard C. Nielson County Assessor Bruce Bunker requested that a removal of a duplication be approved on Parcel #37S22E117200 for Richard C. Nielson. Commissioner Bill Redd made a motion to approve the Board of Equalization change. Commissioner Mark Maryboy seconded. UNANIMOUS. Victims of Domestic Violence Lou Mueller, Victims Advocate, stated that invitations were sent to the County Commissioners inviting them to a Victims of Domestic Violence luncheon, candlelight march and vigil with Lt. Governor Olene Walker on October 21, 1999 in Blanding. San Juan Health Care Donna Singer, spokesperson, along with a group of Blanding citizens including three Blanding City council members, raised issues concerning the allocation of the $50,000 for land purchase at last weeks commission meeting along with an accounting of the 2.3 million dollar trust fund money. They also raised issues concerning whether or not a budget or business plan for the proposed facility was presented and approved, whether guidelines were followed, and how utilization of funds from the sale of the nursing home are decided. Sales tax verses property tax issues were also discussed. Commissioner Lewis explained that San Health Service District is a separate entity with its own budget, tax base and board members. He further stated that the County needs some kind of health care services. If a private health care system comes into place in the county then San Juan Health Service District will be gone because the county does not have the population base to support two facilities. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits A building permit was presented for Brian Backus for a new home in Spanish Valley. Commissioner Bill Redd made a motion to approve the bid. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Western Desert Bill Administrative Assistant Rick Bailey and Commissioner Bill Redd attended a meeting in Nephi concerning the Western Desert Wilderness Bill introduced by Congressman Hansen two weeks ago. This bill is proposing additional acres to wilderness including the 1999 Canyonlands National Park Act and the Glen Canyon Wilderness Act. UAC Insurance Mutual Administrative Assistant Rick Bailey reported that the UAC Insurance Mutual has openings on their board for 4th, 5th, and 6th class counties. The Commissioners discussed possible nomination ideas. Bid/Soil Compactor The following bids were presented for a soil compactor for the Road Department as follows: ACM Equipment for a Superpac 540 @$39650 and for a Superpac 400 @$28400; Century Equipment for a Superpac 400 @$29993 and a Superpac 540 @$42,920 and a Vibromax 40SD @$46914; Scott Machinery for a Dynapac @$32675; Wheeler Machinery for a SC-323C @$52400; and from Cate Equipment for a SD40D @$50990. Administrative Assistant suggested that the bids be sent to the Road Department for their recommendation. Bid/Generator-Navajo Mtn Administrative Assistant Rick Bailey presented a bid from Intermountain Cummins for an Onan generator @$5400 to be used at Navajo Mountain for the Road Department housing units. Commissioner Bill Redd made a motion to approve the bid. Commissioner Mark Maryboy seconded. UNANIMOUS. PERSONNEL-PLANNER EDWARD SCHERICK'S REPORT Request to Hire/Shocap Position Personnel Director Scherick presented the name of Cory Johnson to be hired full-time in the Shocap Position as long as the grant is place at Step 89 @$1530 per month. He will be attending POST beginning October 25, 1999. Commissioner Bill Redd made a motion to approve the hire. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Payroll Change/Barbara Ford Personnel Director Scherick presented the name of Barbara Ford, Secretary, who has completed her probationary period, to be moved from Step 25 at $1112 per month to Step 33 at $1157 per month effective October 15, 1999. Commissioner Bill Redd made a motion to approve the payroll change. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Payroll Change/Harold Keylon Personnel Director Scherick presented the name of Harold Keylon, Landfill, who has completed his probationary period, to be moved from Step 91 at $1546 per month to Step 100 at $1616 per month effective October 15, 1999. Commissioner Bill Redd made a motion to approve the payroll change. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Payroll Change/Valerie Schaechter Personnel Director Edward Scherick presented the name of Valerie Schaechter, Bluff/Mexican Hat Transfer Station, be moved from Step 1 at $5.69 per hour to Step 25 at $6.32 per hour. Commissioner Bill Redd made a motion to approve the payroll change. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Forest Service Trail Maintenance Agreement Planner Scherick reported that the County has received a copy of the proposed Forest Service Trail Maintenance Agreement. The Trail Cat commitment will probably be approved by next week and with that, trail improvements will be expected. The commitment will probably be for two or three work months per year. Planner Scherick and Road Supervisor Doug Pehrson suggested the possibility of hiring a part time qualified person to run the trail cat. The commission agreed with the idea. BLM/Road Maintenance Agreement Planner Scherick reported that there are continuing problems with approving the BLM Road Maintenance Agreement. The BLM is now determining whether or not additional documentation needs to be completed by the BLM before work can be done on the roads. There is a meeting scheduled in Price on October 21, 1999 to talk with the BLM. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT UAC MUTUAL ASSOCIATION Administrative Assistant Rick Bailey stated that UAC is requesting to know who the voting member from our county will be. The Commission agreed that Administrative Assistant Rick Bailey should be the voting member. Navajo Police Vehicles Administrative Assistant Rick Bailey reported that the Navajo Nation police vehicles have been returned to the County. An inventory of the vehicles will be made, Utah Navajo Trust will be contacted, and a decision will then be determined as to what to do with the vehicles. Old Job Service Building/Blanding Administrative Assistant Rick Bailey stated that he has received numerous calls on the status of the old Job Service building in Blanding. He stated that there is a problem with the deed before the title can be transferred. Gravel Crushing A letter was received from Robert Billy Whitehorse concerning the lack of notification on gravel crushing bids. The bids have been in the newspaper for a couple of weeks. LaSal Fire Dept Administrative Assistant Rick Bailey reported that the LaSal Fire Department has been awarded a grant to purchase a computer system of which the State and County would each pay half. One requirement is for them to complete and send their fire reports to the State which would make them eligible for other equipment and training. The LaSal Fire Department is requesting $1063. Meetings The Native American Legislative meeting time has changed to 8:00 A.M. on October 21, 1999. Administrative Assistant Rick Bailey will be in Window Rock on October 19, 1999 attending a State Emergency Management meeting with the Oversite Committee of the Navajo Nation. A yearly grant will be offered for Emergency Service related projects on the Utah portion of the Reservation. Administrative Assistant Rick Bailey and Commissioner Ty Lewis will be traveling to Navajo Mountain on October 27, 1999. COMMISSIONER BILL REDD'S REPORT Wilderness Meeting Commissioner Bill Redd attended the Governors west side conference on Wilderness in Nephi. AOG Assessment Commissioner Redd attended the AOG meeting last week. The Board agreed to base the county assessments to the AOG on county population. San Juan County's assessment is $11,760. Commissioner Bill Redd made a motion to approve the assessment. Commissioner Mark Maryboy seconded. UNANIMOUS. Library Board Meeting Commissioner Bill Redd attended the library board meeting last week. The Internet Policy was submitted to UAC Insurance Mutual some time ago for their review. The County has not received any additional information from UAC. Dr. Warren/Office Space Commissioner Bill Redd inquired about the deed on the medical clinic building previously owned by Dr. Warren. As far as anyone knows the deed is still in Dr. Warrens name. The Commission suggested that Dr. Warren be contacted to get the matter taken care of. Meetings Commissioners Redd and Lewis, Planner Scherick and Road Department Supervisor Pehrson will be meeting with the BLM in Price on October 21, 1999. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy reported that the Aneth Senior Center was vandalized over the weekend. He reported that the stolen items have been recovered. Commissioner Maryboy stated that the Task Force created by the Aneth Chapter to study the possibility of creating an independent clinic in Montezuma Creek has selected a Board of Directors. They will be submitting a bid to Indian Health Service. The Tribal Council is in session all this week. Commissioner Maryboy will be there Tuesday and Wednesday. Commissioner Maryboy will attend the Native American Legislative Committee meeting in Salt Lake City on October 21, 1999. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the Transportation District Board meeting last week. Commissioner Lewis meet with the Sheriff Department to discuss the pilot program in which an inmate can earn a higher education degree within the jail system. This week Commissioner Lewis will go with Commissioner Redd, Planner Scherick, and Road Supervisor Pehrson to Price, Utah to meet with the BLM. Commissioner Lewis will attend the San Juan Health Service District Board meeting on October 26, 1999. He will go with Administrative Assistant Rick Bailey to Navajo Mountain on October 27, 1999 to look at solid waste issues with the Tribe.
