SAN JUAN COUNTY COMMISSION MEETING NOVEMBER 22, 1999 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the November 15, 1999 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Commission Meeting There will be no Commission meeting on November 29, 1999 due to a fifth Monday. Bookmobile Contract Rowland Francom, San Juan County Bookmobile, presented the bookmobile service contract for the year 2000 in the amount of $104,384 with the County match being $52,996 for approval. Commissioner Bill Redd made a motion to approve the contract. Commissioner Mark Maryboy seconded. UNANIMOUS. County Budget The Commissioners will review department budgets with department heads on November 30, 1999 beginning at 8:30 A.M. National Park Service/Jerry Banta Jerry Banta, new Superintendent of the South East Group National Park Service, introduced himself to the commission. Palma Wilson, Hovenweep Supervisor, reported that the money is in the budget for the Hovenweep Visitor Center. The Park Service has a contract with an architectural & engineering firm to complete the final design. The design plans should be ready to go to contract by April 1, 2000 with a possibility of ground breaking next fall. The septic plans should be ready by the end of February. The telephone system is currently being installed. Affordable Housing Plan/Resolution #1999-4 Planner Edward Scherick recommended that the Affordable Housing Plan be adopted. Commissioner Bill Redd made a motion to adopt the Affordable Housing Plan. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. See attached Affordable Housing Plan, Resolution #1999-4 at end of the minutes. Bid/Surveyor David Bronson, Surveyor, presented a bid for a "Profiles Module" for Eagle Point Software from Eagle Point in the amount of $315. Commissioner Bill Redd made a motion to approve the bid. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Copy Machine-Assessor County Assessor Bruce Bunker presented a bid for a Minolta EP-1031R copy machine from Office Outpost in the amount of $1409 and from Copies & Images Plus for an AL-1250 Digital Imager copy machine in the amount of $1094. Commissioner Bill Redd made a motion to approve the bid. Commissioner Mark Maryboy seconded. UNANIMOUS. Out-of-State Travel An out-of-state travel request was presented for Commissioner Maryboy to travel to the NACCo Legislative Conference to be held in Washington, DC on March 3-7, 2000. Commissioner Bill Redd made a motion to approve the out-of-state travel. Commissioner Mark Maryboy seconded. UNANIMOUS. Cindy Smith Road Cindy Smith approached the Commission with copies of letters from Joyce Adair and Larry Weatherford, DSPD Support Coordinators, concerning the private road to the Mack Smith residence in the Dodge Point area. Commissioner Lewis stated that putting in a private road is done when it is to the County's advantage. The County will respond to the two letters from the DSPS workers. Commissioner Lewis stated that CEU has a heavy equipment class if Ms. Smith would like to contact them. Stuart Black Property County Assessor Bruce Bunker reported that a house owned by Stuart Black was placed on an incorrect parcel . The house has been placed on the correct parcel #B36220274875. Mr. Bunker requested that the interest charged on the house for the past two years be abated as it was an error made by the County. The amount is $55.49. Commissioner Bill Redd made a motion to approve the interest wavier. Commissioner Mark Maryboy seconded. UNANIMOUS. Tax Exemptions/Abatement Two abatement applications were presented for approval as follows: A blind persons property tax exemption application for George Lameman in the amount of $217.12 and a circuit breaker application for Joe Archuleta in the amount of $134.73. Commissioner Bill Redd made a motion to approve the abatements. Commissioner Mark Maryboy seconded. UNANIMOUS. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Executive Session Commissioner Bill Redd made a motion to convene into an executive session to discuss a personnel matter. Commissioner Mark Maryboy seconded. UNANIMOUS. Commissioner Bill Redd made a motion to exit the executive session. Commissioner Mark Maryboy seconded. UNANIMOUS. No decisions were made. After exiting the executive session, no decision was made. BLM/Trespass Planner Scherick reported that the BLM has trespassed the County on the Totie Flat Road this past week. The BLM is claiming that the road does not show up on the 1984 road maintenance agreement. The BLM feels that since the County has not signed the Title V permit the County is not in compliance. The BLM feels the County Road Department has gone beyond the disturbance that had been agreed upon. Wilderness Comment Period Planner Scherick reported that the County will send a letter to the BLM requesting an extension of time on the Wilderness comment period closure. The BLM is saying that some of the reports will not be available for some period of time. Trail Cat Agreement The County has received a copy of the trail cat agreement. It has been sent to the county attorney for review. The Road Department will also review it. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits Building permits were presented for approval as follows: T.M. Benedickt for a new home on Lot 40 Bridger Jack Mesa; The Nature Conservancy for a new barn at Dugout Ranch; and Brigette M. Winters for a modular home at 89 E. Coranado St. Spanish Valley. Commissioner Bill Redd made a motion to approve the building permits. Commissioner Mark Maryboy seconded. UNANIMOUS. BLM/Wilderness Letter Administrative Assistant Rick Bailey reported on a letter from the Department of Interior/BLM concerning the Wilderness Study Area (WSA) planning project. The first study will include 616,790 acres located in San Juan County. The draft EIS for this region will be released next March for public comment, with a final decision expected by the end of 2000. UAC Calendar Administrative Assistant Rick Bailey presented a copy of the year 2000 calendar for UAC. He also reported on several points of interest mentioned at the conference. UAC Insurance Mutual Mr. Bailey stated that Commissioner Lewis was re-elected after a two year absence to the UAC Insurance Mutual Board. Presidential Award/Commissioner Redd Administrative Assistant Rick Bailey reported that Commissioner Redd was presented the Utah Association of Counties Presidential Award for the outstanding elected official for 1999. Personnel Commissioner Ty Lewis reported that some one from UAC should come and look at the County personnel department to make sure that everything is working correctly. Each county will probably be looked at. Commissioner Lewis authorized Administrative Assistant Rick Bailey to look at other counties and have someone come to analyze the County system. Automobile Liability Coverage Administrative Assistant Rick reported on changes in the automobile liability coverage. 1) A drivers license check of all employees will be required beginning January 1, 2000. 2)Defensive Drivers course will be required for everyone every two years. 3)Any driver with a DUI in the past three years, any driver with two or more at fault or single vehicle accidents in the past three years or three accidents over all, or any driver with more than 180 points shall not be allowed to drive a county vehicle. San Juan County Insurance Loss Claims Administrative Assistant Rick Bailey gave each of the Commissioners a copy of the San Juan County Insurance Loss Claims report which includes information from 1992-1999 to date. LaSal National Forest/Openhouse The LaSal National Forest will hold an openhouse at the Forest Supervisors Office, and the Monticello Ranger District on December 7, 1999 from 10:00 A.M. to 7:00 P.M. for the purpose of gathering information and begin scoping for public rule making on the roadless area initiative. County Road 120 Administrative Assistant Rick Bailey reported on a letter received from Warren W. Nielson concerning County Road 120 from Highway 191 to the Blue Mountain Road be considered a public access road. There is a locked gate at the end of the county road. The County attorney will be contacted for a legal opinion on access. Walker/Bond Alleyway A vacation of an alleyway was approved for Dale Walker and John Bond in Bluff. A deed has not been issued by the County. The applicants have not paid for the cost of alleyway. A call was received and the Road Department has looked into the situation. What was perceived as an alleyway is actually a platted road within that subdivision. The County received a call from Mr. Bond concerning costs already incurred in placing a permanent foundation under a trailer which is located in the road way. The issue will be given to the County Attorney for review and opinion. The Commission requested that in the future a checklist be required before vacation of an alleyway can be completed. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy reported that he received a letter from Linda Richmond, Bluff Service Area, stating that a public hearing will be held on December 1, 1999 to discuss the fiscal year 2000 budget. Commissioner Maryboy reported on a letter submitted to Charles Johnson, Chairman Utah State Board of Regents, from State Representative Keele Johnson. Representative Johnson is proposing a change in the way that the College of Eastern Utah is run. Commissioner Maryboy attended the Utah Navajo Legislative Liaison Committee meeting. The Navajo Revitalization funds, Navajo Fuel Excise Tax, the Utah Navajo Trust, and the TANF, Temporary Assistance to Needy Families, were discussed. Commissioner Maryboy also stated that Blue Mountain Dineh stated that they have not received any service from the County, Tribe, or UNTF. Aneth Chapter Donation Commissioner Maryboy reported that the Aneth Chapter was awarded some materials from the Bountiful Rotary Club for bathroom and kitchen additions to homes on McCracken Mesa in the amount of $114,000. Montezuma Creek Clinic Commissioner Maryboy reported on the Montezuma Creek Clinic. He stated that Indian Health Service and the group who are trying to break away from San Juan Health District met on November 19, 1999. He stated that apparently Indian Health Service agreed to contract with the Navajo Health System. Schedule Commissioner Maryboy will be in Window Rock on Tuesday and Wednesday. He will be in the area on Thursday and Friday. Meeting There will be a Tri-County meeting on December 8, 1999 in Window Rock. COMMISSIONER BILL REDD'S REPORT Commissioner Redd attended the UAC Fall Convention in St. George last week. Commissioner Redd will attend a Blanding City Council meeting this afternoon. Commissioner Redd will attend the San Juan County Health District Board meeting on November 24, 1999. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the UAC Fall Convention in St. George last week. This will there will be a San Juan County Transportation District meeting on November 23, 1999 at 7:00 P.M. There will be a San Juan County Health District Board meeting on November 24, 1999 in Blanding.
