SAN JUAN COUNTY COMMISSION MEETING APRIL 24, 2000 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the April 17, 2000 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. UNANIMOUS. Commissioner Mark Maryboy was not present at the time the action was taken. Jim Hurst/Variance Jim Hurst, Spanish Valley, spoke to the Commission concerning an .82 acre piece of land in Spanish Valley that he would like to place two homes on. The Commission stated that if the health department would approve the septic system then the Commission wouldn't have any problem with it. Sky Ranch/Spanish Valley Bud Tangren, Sky Ranch, discussed with the Commission sanitation requirements for the Sky Ranch Subdivision. Mr. Tangren stated that County Health & Sanitation, Rick Meyers, is requiring that perk tests and soil samples be conducted on each lot. Mr. Tangren feels that because these tests have previously been taken throughout the area that samples in specific areas would be sufficient. The Commission stated that he needed to comply and satisfy the health department. If the health department doesn't sign the subdivision plat then the Commission will not approve it. Central San Juan Recreation Service District Chip Sharp, San Juan Central Recreation Manager, reported to the Commission that Blanding City gave $15,000 to go toward repairs of the Blanding swimming pool. Commissioner Bill Redd made a motion to advance $5,000 from the Interagency Recreation Fund and $5,000 on the anticipated tax revenue increase to go toward the swimming pool repairs. Commissioner Mark Maryboy seconded. UNANIMOUS. Mr. Sharp will send the bills from Aquatech to the County for payment. Bid/Gravel Crushing-Lem's Draw The following bids were received for gravel crushing at Lem's Draw: Crowley Construction for 25,000 CY of 1" Minus @$3.08 CY at $77,250 and 10,000 CY of 3" Minus @$2.89 at $28,900 for a total of $106,150; Jerry Holliday Construction for 25,000 CY of 1" Minus @$4.00 CY at $100,000 and 10,000 CY of 3" Minus @$3.50 CY for $35,000 for a total of $135,000; Paul & Son Construction, Inc. for 25,000 CY of 1" Minus @$7.75 CY for $193,750 and for 10,000 CY of 3" @$6.75 CY for $67,500 for a total of $261,250; LeGrand Johnson Construction for 25,000 CY of 1" Minus @$4.25 CY and 10,000 CY 3" Minus @$3.50; and Sutherland Bros. for 25,000 CY of 1" Minus @$3.49 and 10,000 CY of 3" Minus @3.49 CY. Commissioner Bill Redd made a motion to approve the bids from Crowley Construction. Commissioner Mark Maryboy seconded. UNANIMOUS. Scenic Photos/Evan Lowry Evan Lowry, Survey Department, reported there are 660 scenic photos taken when the road GPS work was conducted. He feels there is a potential opportunity to promote the county through these photos. He suggested the possibility of placing the photos on a computer for display so people could readily access them. They could possibility be used in the Visitor Center and for the State Fair. The Commission requested that he outline some possible ideas to showcase the county. May Tax Sale Properties County Clerk/Auditor Norman Johnson presented the list of May Tax Sale Properties. The sale will be held on May 25, 2000 at 10:00 A.M. at the County Courthouse. Commissioner Bill Redd made a motion that the properties be sold for taxes due or fair market value of the property whichever is greater. Commissioner Mark Maryboy seconded. UNANIMOUS. Grand County Water & Sewer Conservancy District Gray Wilson, Paul Morris, and Dale Pierson, Grand County Water & Sewer Conservancy District, spoke with the Commission concerning the possibility of annexing in to San Juan County in order that water and sewer services could be provided by the District to the residents of Spanish Valley in San Juan County. The District requested a letter from San Juan County to the District requesting service into that area; a letter to Grand County Council requesting annexation. They also requested that the County participate with the District in meetings with Grand County concerning annexation. Tax Exempt Properties County Assessor Bruce Bunker presented a list of tax exempt properties which are based on religious, charitable or educational use. Mr. Bunker feels that some are legitimate and need to be given exemption and others are questionable. Several of the property tax exemption requests and affidavit applications have not been returned to the County. Mr. Bunker will review the properties more closely and come back with a recommendation. Barbara Boot/3rd St. Right-of-Way-Bluff Barbara Boot, Bluff, showed the Commission the survey of their property completed by County Engineer Doug Pehrson. Rick Bailey, Administrative Assistant, reported that Mr. Pehrson had determined that the service station construction extends approximately six feet past the lot boundary line. The Commission requested that the County Attorney review before a decision is made. County Fence Ordinance Jack Redd, Monticello, approached the Commission with his concerns about the County Fence Ordinance. Mr. Redd leases land adjacent to the State Trust Lands that is going to be sold. He is concerned whether or not he will have to fence his livestock in when the sale is complete. The County Subdivision Ordinance states that when property is divided it then becomes a subdivision. The subdivider or the purchaser would then be required to fence the property. Administrative Assistant Rick Bailey will write a letter to State Trust Lands concerning the fencing issue. Bid/Trail Cat A bid was presented for a Sweco 480 Trail Dozer from Sutter Equipment Co. at $50,000. State Parks & Recreation is participating in the purchase. Bid/2-Scurifiers-Road Dept A bid was presented for the Road Department for two roader grader scurifiers from MHL Systems at $3667 each. Commissioner Bill Redd made a motion to approve the bid. Bid/Mobile Radio-Service Truck A bid was presented for a mobile 1225 radio for the Road Department from Motorola at $497. Commissioner Bill Redd made a motion to approve the bid. Bid/Mobile Radio-Fire Truck A bid was presented for a 100 watt radio for the fire truck from Motorola at $1711. Commissioner Bill Redd made a motion to approve the bid. Bid/Radios-Emergency Services A bid was presented for 2 UHF mobile radios for Emergency Services from Motorola at $530 each. A bid for 1 UHF hand held radio at $1060 from Motorola was also presented. Bid/Fire Truck/Body & Attachments A bid was presented for a service body for a fire truck from AG Truck Equipment at $14,105.00. Commissioner Bill Redd made a motion to approve the bid. San Juan County Library Board/Members Linda Boyle, San Juan County Library Board President, presented the following names to be members of the Board. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Request to Hire/Jail Personnel Director Edward Scherick presented a modification to the request to hire for Wendy Schmitz. The position will be permanent part-time with no benefits. Commissioner Bill Redd made a motion to approve the modification. Commissioner Mark Maryboy seconded. UNANIMOUS. Request to Hire/Surveyor A request to hire was presented for Julius Josley to be hired as a part-time Surveyor Aid at Step 29 @$7.03 per hour effective April 25, 2000. Request to Hire/Blanding Library A request to hire was presented for Genevieve Larsen to be hired as a part-time Assistant Librarian at the Blanding Library at Step 1 @$6.17 per hour effective April 24, 2000. Road Department/Part-time Hire Personnel Director Edward Scherick reported that the Road Department is requesting to hire a temporary person to work 5 or 6 months in the North Road Department Office. Vintage Motorcycle Racing Planner Scherick reported that he met with Kim Hoggard concerning the Vintage Motorcycle Racing event proposal. Planner Scherick stated that Mr. Hoggard is requesting a letter from the County supporting the event, help with grant proposal from Community Development/Visitor Services, and a County Commissioner to accompany him to a Monticello city meeting with the proposal. Meetings Planner Scherick reported that Commissioner Redd participated in a debate at CEU on road issues. Planner Scherick will be going with Kent Walter, BLM, to the Collins Canyon area to look at degradation. There will be a safety meeting on April 25, 2000. Planner Scherick and Secretary Lillian Taylor will be attending Road School in St. George on April 26-28, 2000. The San Juan Water Conservancy District would like to hold a water master plan implementation meeting on May 30, 2000. The Chapters are encouraged to attend. Commissioner Maryboy suggested they contact Navajo Utah Commission. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Overweight Trucks Jack Mitchell, Tesco Williamsen, explained lengths, axle lengths and overweight requirement for county trucks. If money for roads are funded by tax dollars then federal laws govern weight requirements. The County will look in to the cost of adding additional axels to the County trucks. Ambulance/EMS Administrative Assistant Rick Bailey reported on the proposal that the County take back the management and responsibility for the Ambulance and EMS services in the County. Licenses given by the state are in the County's name. The take over would require a major change over. Administrative Assistant Rick Bailey presented 25 issues he feels would need to be done before a change over could take place. Commissioner Bill Redd made a motion for Mr. Bailey to continue to look in to the County taking over the Ambulance and EMS services. Commissioner Mark Maryboy seconded. UNANIMOUS. Microfilm Machine/District Court Administrative Assistant Rick Bailey reported that he had has spoken with the District Court Administrator, Tim Simmons, concerning the use of the County microfilm machine. Administrative Assistant Rick Bailey reported that a dollar amount per hour per for use of the machine needs to be identified. School Bus Roads/Aneth Administrative Assistant Rick Bailey reported that the two school bus roads near Aneth are completed. Montezuma Creek Swimming Pool Mr. Bailey reported there have been no further water leak problems at the Montezuma Creek swimming pool. If the water level remains the same the pool could be filled. Sign Permit A request for a sign permit was presented for Paul Morris for a sign to be placed at 5500 So. Highway 191 near Moab. Commissioner Bill Redd made a motion to approve the sign permit. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Variance Request/San Juan Estates Administrative Assistant Rick Bailey reported on a proposed San Juan Estates Subdivision in Spanish Valley. Two areas on the road for access is less than 50 feet. Deeds from property owners have been acquired which would allow the 50 foot easement Commissioner Bill Redd made a motion to approve the variance. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. 911/Paging-Garfield County Administrative Assistant Rick Bailey reported that Garfield County has contacted San Juan County asking that the 911 calls from Ticaboo be received by San Juan County and dispatched to Garfield County. Commissioner Bill Redd made a motion to enter into discussions concerning memorandums and agreements. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Hovenweep Telephone Administrative Assistant Rick Bailey reported that he had spoken with Farmers Telephone who has installed the telephone system at Hovenweep. He indicated that the Hovenweep telephone number will be assigned a Colorado prefix. The 911 calls will go to Montezuma County dispatch. An agreement needs to be made with Montezuma County. Monticello Clinic/Transfer Administrative Assistant Rick Bailey reported on the status of the Monticello Clinic. There is still approximately $40,000 money owed on the clinic. The appraisal cost does not include roof repairs. The current occupant does not have an agreement and is not paying rent. After the building is vacated USU and the jail would like to use part of it for inmate education. USU would like to use the other part of the building for the public to take courses in. Administrative Assistant Rick Bailey will turn the matter over to County Attorney Craig Halls. Meetings There will be a department head meeting every other month on the 2nd Monday at 9:00 A.M. The next meeting will be on May 8, 2000. There will be a Risk Management and Safety meeting on April 25, 2000. On April 26, 2000 there will be an Emergency Management planning meeting. Administrative Assistant Rick Bailey will attend a HazMat refresher course next week. He will not be a Commission meeting next week. There will be a Tri-State meeting in Farmington, NM on April 27, 2000. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Mark Maryboy requested that the County write a letter to the Chapters requesting their recreation plans for the summer. Commissioner Maryboy will be attending the Tri-County meeting in Aztec on April 27, 2000. There will be Utah a Advisory Council Intergovernmental Relations meeting on April 28, 2000. Commissioner Maryboy received an invitation from the Veterans office to meet with them in Denver in the near future. Commissioner Maryboy was in Shiprock, NM while President Clinton was visiting the area. Commissioner Maryboy will be in the area this week. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd attended a class at CEU last week to discuss road issues. The AOG meeting was cancelled. Commissioner Redd will attend Road School in St. George this week. He will be attending the Governors Road Litigation meeting on April 26, 2000. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis reported that Senator Hatch and Congressman Canon were in the County last week in connection with the Republican Convention. Commissioner Redd and Lewis discussed water, roads, and wilderness with them.
