SAN JUAN COUNTY COMMISSION MEETING JUNE 5, 2000 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner LaVee Scherick, Deputy Clerk Absent: Rick Bailey, Administrative Assistant A motion to approve the minutes of the May 22, 2000 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Bud Tangren/Water-Spanish Valley Bud Tangren, Spanish Valley, suggested alternative ideas for a water system in Spanish Valley. The Commissioners feel that the County Water Master PLan should include projects in that area. County Planner Edward Scherick will write a letter to the Grand County Water Conservancy District requesting the District be involved in developing a water system in the San Juan County side of Spanish Valley. This system could be included as part of the County Water Master Plan. Bid/Fairground Fence Todd Adair, Fairground Maintenance, presented a bid for 16 sticks of pipe from Young's Machine Company at $840 and from Metal Mart for the same at $378.84 for a fenced area at the fairground concession area. Commissioner Bill Redd made a motion to approve the bid from Metal Mart. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Fairground Fence-Lumber A bid was presented for lumber to be used in the fairground fence project from LaSal Lumber at $1668 and from San Juan Building Supply at $2652.60. Commissioner Bill Redd made a motion to approve the bid from LaSal Lumber. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Headlight-Road Dept. A bid was presented for a headlight aiming kit for the Road Department from Motor Parts at $358.33; Caun-Co at $339.99; and from Snap-on-Tools at $336.05. Commissioner Bill Redd made a motion to approve the bid from Snap-on-Tools. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Bid/Elections-Vehicle County Clerk Norman Johnson requested to purchase an election vehicle. Bids were presented from Youngs Chevrolet for a 2000 S10 extended cab 4X4 Chevrolet pickup with security system in the amount of $20,084.83 and for a 2000 S10 extended cab 4X4 Chevrolet pickup with hitch, lights, radio, and security system in the amount of $18,142.75. Commissioner Bill Redd made a motion to approve the bid for $18,142.75. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Sewer Grinder Bids were presented for a Franklin Miller Taskmaster TM Sewer Grinder from Gobal Sampson in the amount of $13,500 and for a JWC Environmental Muffin Monster Sewer Grinder in the amount of $15,400 for the jail. Commissioner Bill Redd made a motion to approve the bid in the amount of $13,500. Commissioner Mark Maryboy seconded. UNANIMOUS. Public Safety Building/Basement Remodeling Lt. Bill Christensen discussed the idea of remodeling the staff room in the basement of the Public Safety Building for USU school classroom programs. There is the possibility of using the medical clinic building for staff. The Commission requested the Sheriff's office furnish cost estimates on the remodeling project. Montezuma Canyon Farm Project Lt. Bill Christensen reported on the Montezuma Canyon Farm Project in which County inmates are working the farm. Harvest of fruit is about to begin. A request was presented to buy materials to construct a fruit stand to market the produce. Mr. Stone reported that one third of the proceeds from the sale of the produce will go to the jail inmate program. The Commissioners do not want to be in competition with private businesses and will only be involved in the labor portion of the operation. Tax Sale Properties County Clerk Norman L. Johnson reported there were two properties available for purchase at the May Tax sale. One property sold for market value. There was no bid on the other property. Mr. Johnson requested permission to issue a tax deed for the property that was sold. He also requested abatement of taxes in the amount of $19.09; interest in the amount of $14.69; and penalty in the amount of $40.00; for a total of $73.78 on Parcel #SA-3052. This parcel will be returned to the County. Commissioner Bill Redd made a motion to approve the tax deed. Commissioner Mark Maryboy seconded. UNANIMOUS. The Commissioners asked County Clerk Norman Johnson to check on attachment to other real property of the person owing taxes. San Juan County Health Care District Cleal Bradford, San Juan Health Care District, presented the change in scope of CIB grant funds for approval. Commissioner Bill Redd made a motion to approve the re- scoping of grant funds. Commissioner Mark Maryboy seconded. UNANIMOUS. San Juan County Health Care District/Building Leases Cleal Bradford, San Juan Health Care District, reported the District Board has approved the lease agreements for the San Juan Hospital and Blanding Medical Clinic the District leases from the County. He presented the leases for approval. Commissioner Bill Redd made a motion to approve the lease agreements. Commissioner Mark Maryboy seconded. UNANIMOUS. San Juan Hospital/Admitting A discussion was held concerning admittance to the San Juan County Hospital. Cleal Bradford stated that any patient can come to the hospital and be admitted through the emergency room process or be admitted by any physician that has staff privileges. A person seeking medical privileges fills out an application. The application, with necessary attachments, requires proof of training, license, DEA, etc. is presented to the med staff. If the attachments are not in place the application is held. Approval of application is made by the med staff. It then goes to the Health Board with final approval made by that Board. Commissioner Maryboy reported he went to the Blanding Clinic to see a doctor. He signed in, the receptionist left. After a period of time Commissioner Maryboy left without seeing a doctor. Cleal Bradford will following through with this issue to see what happened. San Juan Health Care District/Tax Anticipation Note Request Cleal Bradford, San Juan Health Care District, requested an advance on their Tax Anticipation Note in the amount of $50,000. Commissioner Bill Redd made a motion to approve the advance on the Tax Anticipation Note. Commissioner Mark Maryboy seconded. UNANIMOUS. Clinic Building Cleal Bradford reported on the anticipated clinic building that OHM is donating to the Health District. The building should be available approximately July 15th. Hill Burton Trust Fund Cleal Bradford stated that San Juan Health Care District has received the money from the Hill Burton Trust Fund in the amount of $67,047.61. State Representative Candidate/Dr. Gibbons Dr. Gibbons, State Representative Candidate, proposed to honor people in the county by naming some of the county roads using Native American patriot names. The County will take this in to consideration and make a recommendation to the Road Department. Peggy Mason/Congressman Cannons Office Peggy Mason, Congressman Cannons Office, presented information on the RECA bill presented by Senator Hatch. San Juan County has been added to this bill. She gave the Commission a news release concerning Congressman Cannons work on legislation regarding rural land and water issues. Congressman Cannons office is working toward opening a junior congressional office in Moab with high school students to work there. This will be an office in which the public can come in for information. The Commissioners would like Congressman Cannons help with legislation or district line changes concerning bringing water across state lines. Ms. Mason asked if the Commissioners have made their comments on the Roadless Initiative. The logging industry in Utah will be drastically affected. Commissioner Redd suggested there is a constitutional problem that has not been addressed concerning RS2477 grant issues. He would like Congressman Cannon to encourage the state to research this problem. Out of State Travel/Jim Keyes An out-of-state travel request was presented for Jim Keyes to attend the National Association of County Agricultural Agents Conference in Jackson, Mississippi on August 5- 10, 2000. Commissioner Bill Redd made a motion to approve the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Fairground Property County Attorney Craig Halls reported there is a problem with the fairground property purchased from Joyce Martin. The property that was purchased has a different boundary line than where the fence line is. A survey has been complete showing the discrepancy. Commissioner Lewis will speak with Mr. Gutherie concerning the issues involved. Citizens Communications/Billing Charges Colleen Johnson, Account Executive Citizen Communications, presented the total back billing charges for the County E911.The billing has been changed from $201,993.30 to $53,864.88. She requested the County begin payments now with completion of payments in a two year period. Commissioner Bill Redd made a motion to make three equal payments of $17954.96 beginning on July 1, 2000; July 1, 2001; and July 1, 2002. Commissioner Mark Maryboy seconded. UNANIMOUS. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Payroll Change/Lambert Cly A payroll change was presented for Lambert Cly, Road Department, to be upgraded from Patch Crew Laborer to Light Equipment Operator moving him from Step 31 at $1231 per month to Step 89 at $1619 per month effective June 1, 2000. Commissioner Bill Redd made a motion to approve the payroll change. Commissioner Mark Maryboy seconded. UNANIMOUS. Request to Hire/Fire Crew Personnel Director Edward Scherick presented the name of James Montella to be hired as a temporary Fire Warden at Step 57 at $8.03 per hour effective June 5, 2000. The name of George Schultz was presented to be hired as a temporary Assistant Fire Warden at Step 29 at $7.03 per hour effective June 5, 2000. The name of Lester Lansing was presented to be hired as a temporary fire crew member at Step 29 at $7.03 per hour effective June 5, 2000. Commissioner Bill Redd made a motion to approve the hire. Commissioner Mark Maryboy seconded. UNANIMOUS. Personnel Policy Personnel Director Edward Scherick reported he has re-drafted the personnel policy. It is ready to be sent to UAC for review after which the adoption of the amendments will need to be made. County Attorney Craig Halls reported there is a possibility that the county will be required to adopt the State merit system. Jeep Safari/Environmental Assessment Planner Scherick reported the County has received a copy of the BLM Environmental Assessment on the Moab Jeep Safari. It states that the fees charged are set by the Washington office. The County will send a letter to the BLM requesting claim for fees collected on the County roads to be returned to the Jeep Safari. County Water Master Plan/Meeting The Water Master Plan meeting was held. They reviewed water projects in progress throughout the county. The next meeting will be held on July 17, 2000 at 1:00 P.M. Schedule Personnel Director Scherick; Doug Pehrson, Road Dept; and Bob Turri, Contract Specialist will go to Mill Creek on June 7, 2000. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permit The following building permits were presented for approval: Kay Randall for a new home in Eastland; Robert Nobles a new home in Old LaSal; and Guy Harris a new home south of Blanding. Commissioner Bill Redd made a motion to approve the permits. Commissioner Mark Maryboy seconded. UNANIMOUS. Rock Sample/Mexican Water Chapter Melissa Banks, Administrative Services Manager, reported that a rock sample on County Road #415 near Mexican Water Chapter was taken. She presented a preliminary report of the testing. All of the readings are under the normal except for barium. More details are to come. BLM/Land Exchange The Monticello BLM Field Office is proposing to exchange 180 acres of public land for 580 acres of private land. The purpose of this proposed land exchange is to acquire lands within direct proximity to Hovenweep National Monument. The 560 acre parcel is a desirable acquisition to Hovenweep environment with high recreational, cultural, and wildlife values. Visitor Center/John Black Complaint The County received a letter from John Black complaining that the visitor center is not properly signed and visitors are coming to his new business office wanting visitor center information. The Commissioners requested that Melissa Banks give the letter to the Visitor Center for them to solve. Cal Black Airport/Crack Seal Contract Administrative Services Manager Melissa Banks presented the revised Utah Transportation Commission contract for the seal coating and repainting of all asphalt surfaces for the Cal Black Airport project in the amount of $85,591 for approval. Commissioner Bill Redd made a motion to approve the contract. Commissioner Mark Maryboy seconded. UNANIMOUS. Orrin Hatch Orrin Hatch's staff is coming to the area on Thursday and Friday. They would like to meet with the Commissioners. They are willing to go and do whatever the Commissioners would like them to do and see. It was suggested that Commissioner Maryboy show them the school bus roads. They could possibly meet with Planner Scherick concerning water projects in the County. The Blue Mountain to Hart Draw Road project using Forest Highway money is another option. Variance/Con Holm Administrative Services Manager Melissa Banks reported that a public hearing was held on May 30, 2000 concerning a variance request to build a trailer park in an agricultural zone. There were no public comments. Commissioner Bill Redd made a motion to approve the variance request subject to Rick Bailey's approval. Commissioner Mark Maryboy seconded. UNANIMOUS. San Juan Central Recreation Terry Cook, Central San Juan Recreation, called to request increasing the board from five to seven members. The Commissioners would like Administrative Assistant Rick Bailey to look in to the requirements for board member changes. Kendall Fuller/Lot Division Administrative Services Manager Melissa Banks presented a plat for division of property for Kendall Fuller for approval. The County required a plat. Department of Corrections There will be a Department of Corrections meeting at 1:30 P.M. on June 7, 2000 in Salt Lake City concerning the USU education program at the jail. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Mark Maryboy spoke concerning the San Juan County Area Aging Advisory Board. He is requesting that there be a representative on the Board from three areas of the Reservation. Aging Director Melissa Banks stated that currently the advisory board consists of representatives from the Blanding, Bluff and White Mesa senior centers because of state funding. There is no State or Federal money going to the other centers and therefore it is not required to have a representative on that Board. They are welcome to attend the quarterly board meetings. Melissa will invite the other centers to attend the quarterly meetings. School Bus Routes Commissioner Maryboy reported that Mexican Water and Red Mesa Chapters are wanting work done on the school bus route roads. Commissioner Lewis reported that the Road Department is shutting down grading the roads until some moisture is received. Mobile Oil/Exxon Commissioner Maryboy reported that Mobile Oil and Exxon have merged. He will be meeting with the new management on June 7, 2000 at 1:00 P.M. Todahaidekani to Montezuma Creek Road Commissioner Maryboy reported that the Shiprock Road Agency has agreed to provide matching funding on the Toadhaidekani to Montezuma Creek Road project. Schedule Commissioner Maryboy reported that he will attend the Red Mesa, Mexican Water, and Aneth Chapter planning meeting on June 5, 2000. On June 6, 2000 Commissioner Maryboy will attend the Transportation Community Development meeting in Window Rock, AZ. On June 8-9, 2000 Commissioner Maryboy will attend the Tribal Mental Health Conference in Farmington, NM. Commissioner Maryboy reported he was selected as one of the delegates to attend the National Democratic Convention in August. Commissioner Maryboy will not be at Commission meeting next week. He will be attending the Shiprock Agency Road meeting. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd attended the Department of Environmental Quality meeting on May 24, 2000. On May 25, 2000, Commissioner Bill Redd attended the Multiple Use Coalition meeting. Commissioner Redd met with the Governor and lawyers on road litigation on May 26, 2000 in Richfield, Utah. On May 30, 2000, Commissioner Redd attended the Constitutional Defence Council meeting. Commissioner Redd attended the CIB meeting on June 1, 2000. In the afternoon he attended the GIS meeting concerning the division of money to counties for road mapping. Commissioner Redd met with the Governor on June 3, 2000 at the County Courthouse concerning revamping the drug court. Commissioner Redd will attend the Aging Advisory Council meeting in Salt Lake City on June 6, 2000. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the UAC Insurance Mutual meeting on May 25, 2000. Commissioner Lewis attended a meeting in Richfield, Utah with the Governor concerning the road lawsuit. There will be a San Juan County Substance Abuse/Mental Health meeting on June 6, 2000.
