SAN JUAN COUNTY COMMISSION MEETING NOVEMBER 6, 2000 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner LaVee Scherick, Deputy Clerk Absent: Rick Bailey, Administrative Assistant A motion to approve the minutes of the October 23, 2000 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Subdivision Opposition/Frank Darcey Frank Darcey, Moab, expressed opposition to a proposed subdivision behind their property in Spanish Valley. Commissioner Lewis stated the area is not zoned for the proposed trailer park. Water and sewer issues will need to be addressed. A public process would be required before the proposed subdivision would be approved. Domestic Violence/STOP Grant Approval Lou Mueller, Domestic Violence, presented the STOP grant proposal for 2001 in the amount of $32,000 for approval. The 25% County match includes personnel costs for insurance as the county contribution. The Sheriff's office provides a vehicle for the victim advocate and pays mileage. Kelly Bradford is the grant contact person at approximately five hours a week. His contribution is part of the cash match. Lou Mueller stated the grant will not be implemented until it is approved by the Commission. If at any time the approval is withdrawn the grant would cease to be considered. Commissioner Bill Redd made a motion to approve the grant based on review by the Personnel office, County Clerk, and Sheriff office. If the need should arise, the grant could be withdrawn by the County prior to January 1, 2001. Commissioner Mark Maryboy seconded. UNANIMOUS. Tax Abatement/Lyman D. Nielson County Assessor Bruce Bunker reported the taxes on Parcel #B36220270022 in amount of $42.39 & #B36220270023 in amount of $42.39 deeded to Blanding City is still being received by Lyman D. Nielson. Mr. Lyman is refusing to pay the taxes. Apparently Blanding City has not recorded the deed. The Commission asked County Assessor Bruce Bunker to contact Mr. Nielson stating the taxes cannot be abated until the deed is recorded. He can request the city record the deed or record it himself. Mr. Bunker later reported that the deed has been recorded by Blanding City. Commissioner Bill Redd made a motion to abate the taxes for the year 2000. Commissioner Mark Maryboy seconded. UNANIMOUS. Southwest Heritage Foundation Corp/Tax Exemption Martha Sewell and Larry Sanford, Southwest Heritage Foundation, requested to file an affidavit on non-profit property tax exemption. They asked the commission to consider them as a non profit organization. The paper work has been completed. Commissioner Bill Redd made a motion to grant the exemption upon three provisions. 1)That it has had prior exemption status; 2)That the proper tax filings are appropriate to exemption; and 3)That all other reasons under law are met as determined by the County Assessor. Commissioner Mark Maryboy seconded. UNANIMOUS. BLM/Update Kent Walter and Nick Sandberg, Monticello BLM, reported to the Commission on grazing term permit updates; Wilderness study area impact statement and comment period; Cottonwood abandoned mine public review and comment period; and oil & gas activity, sale, and applications. The Utah BLM Resource Advisory Council has drafted recreational guidelines that will be sent out through mailing. The comment period ends February 1, 2001. BLM OHV policy hearing meeting was held in Moab in August. Mr. Walter reported approximately 5000 comments nation wide were received on that policy. A team will now develop a policy for off highway vehicle use on BLM lands. Tom Frei, National BLM Director, has submitted his resignation effective November 24, 2000. Sand Island Road Issue A discussion was held concerning the Sand Island Road Issue. Kent Walter, Monticello BLM, stated the Bureau policy is they don't seek encroachment permits from the County for Bureau roads. The County feels the Sand Island road is a RS2477 road. There is a disagreement as to ownership of the Sand Island Road. On roads the County has interest in the BLM encourages encroachment permits be obtained from the County. The BLM feels the activity at Sand Island is authorized by a withdrawal action in the early 1980's. Mr. Walter stated a request was received from the County for the Sand Island Development plan, right of way reservation for the road withdrawal for the site itself. The information will be provided. Commissioner Redd asked clarification on an issue. He stated that if he understood correctly the BLM regulation does not require the BLM to obtain an encroachment permit from the County for the road they feel is theirs. Mr. Walter stated the BLM could override the County with a Title V even though the County may claim it as a RS2477 road. Mr. Walter indicated the BLM has the responsibility to inform the County when an action is taken on a road the County claims as RS2477. Circuit Breaker/Abatement County Clerk Norman Johnson presented for consideration a late circuit breaker abatement request for John Black, Blanding. Commissioner Bill Redd made a motion to approve the request. Commissioner Mark Maryboy seconded. UNANIMOUS. Out of State Travel An out-of-state travel request was presented for Ty Lewis to travel to Nevada to meet with their legislature concerning road issues on November 13, 2000. Commissioner Bill Redd made a motion to approve the out-of-state travel. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Recorders Office/Computers County Recorder Louise Jones presented bids for two computers for the Recorders office from High Country Computers at $2437 and from Gateway for the same at $3358. Commissioner Bill Redd made a motion to approve the bid from High Country Computers. Commissioner Mark Maryboy seconded. UNANIMOUS. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Payroll Change/Sheriff Office Payroll changes in the Sheriff Office effective November 1, 2000 were presented as follows: Troy Butler to be moved from Corporal to Sergeant from Step 166 at $2342 per month to Step 183 at $2543 per month. Martha Johnson to vacate Corporal position moving her from Step 160 at $2276 per month to Step 155 at $2220 per month. George Rice to be moved to a Corporal position from Step 117 at $1849 per month to Step 142 at $2087. Mike Bradford to a Corporal position moving him from Step 150 at $2168 per month to Step 159 at $2265 per month effective November 1, 2000. Payroll Change/Surveyor A payroll change was presented for Kent Cantrell, to be moved from Step 83 at $1574 per month to Step 100 at $1706 per month effective November 1, 2000. Payroll Change/Road Dept A payroll change was presented for Mike Shupe to be moved from temporary to permanent from Step 29 at $7.03 per hour to Step 48 at $1333 per month effective November 1, 2000. Road Department/Duane Franklin Personnel Director Scherick reported that Duane Franklin, Road Dept., has been placed on family medical leave. Payroll Change/Assessor A payroll change was presented for Kim Lacy, who has completed requirements to be a certified appraiser, to be moved from Step 72 at $1492 per month to Step 149 at $2158 per month as per building inspector and appraiser requirement agreement with the Assessors office effective November 1, 2000. Payroll Change/Treasurer A payroll change was presented for Amber Young to be moved from Step 35 at $1253 per month to Step 42 at $1293 per month effective November 1, 2000. Payroll Change/Recorder A payroll change was presented for Inez Harlan to be moved from Step 60 at $1411 per month to Step 67 at 1451 per month effective November 1, 2000. Request to Hire/Jeff Black A request to hire Jeff Black, as a new full time dispatcher was presented at Step 63 at $1430 per month effective November 1, 2000. Request to Hire/Blanding Library A request to hire Maxcene Spotted Elk as a part time Assistant Librarian at Step 1 at $6.17 per hour. Commissioner Bill Redd made a motion to approve the above payroll changes with the following being tabled for review: Lillian Bayles, Malva Jones, Susan Taylor and Kelly Bradford. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Evergreen Highlands Subdivision/Change Approval Administrative Services Manager Melissa Banks presented a change to R.D. Carroll's Evergreen Highland Subdivision plat. The proposal is to add Lot #9 to the master plan. Commissioner Bill Redd made a motion to approve the change. Commissioner Mark Maryboy seconded. UNANIMOUS. Building Permits A building permit was presented for Paul Blank for a new home in LaSal. Commissioner Bill Redd made a motion to approve the building permit. Commissioner Mark Maryboy seconded. UNANIMOUS. UAC Gift The Commission authorized Administrative Services Manager Melissa Banks to select a gift from the County to be given at the UAC Conference. Grand County Water Conservancy District/Board Member Rex Tanner and Gary Holyoak have expressed interest to serve on the Grand County Water Conservancy District. The Water Conservancy District is recommending Rex Tanner and request San Juan County Commission approval. Commissioner Lewis tabled the approval until more information is received. Leasing Proposals Administrative Services Manager Melissa Banks presented equipment leasing proposal information from Zions and First Security Banks in the amount of $428,000. There are two proposals from Zions and one from First Security. Administrative Assistant Rick Bailey recommended in writing that new quotes be obtained and speak with the County Treasurer concerning treasury notes and bonds. The Commission recommended the decision be tabled until further information is received. Monument Valley Airport Meeting Administrative Services Manager Melissa Banks reported there will be a airport meeting in Oljato on November 10, 2000. Commissioner Lewis will attend. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Mark Maryboy reported that Whitehorse High School is asking the County and County Sheriff Department provide more police protection at school events. He presented a signed petition to the commissioners and a copy to be given to the sheriffs office. Commissioner Maryboy will attend the Red Mesa Chapter planning meeting this afternoon. Tonight Commissioner Maryboy will attend the Shiprock Agency caucus meeting. Commissioner Maryboy attended the school bus route meeting with the Chapters. Commissioner Maryboy inquired about the disqualification of Keele Johnson from the election process. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd was in Window Rock on October 25, 2000 to attend a meeting concerning the Monument Valley airport. NDOT, FAA, and Tribal representatives were there also. On October 30, 2000, Commissioner Redd attended a road meeting with the Navajo Chapters in the Courthouse. Commissioner Redd attended the State Road Litigation Committee meeting in Salt Lake City on November 1, 2000. Commissioner Redd will attend CIB meeting on November 9, 2000. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the UAC Insurance Mutual meeting on October 26, 2000. Commissioner Lewis attended the school bus route meeting with the Chapters on October 30, 2000. He attended the San Juan County Substance Abuse/Mental Health meeting on November 1, 2000. Commissioner Lewis will attend the meeting with Dolores County Water District today at 1:00 P.M. Commissioner Lewis has been invited to attend the Hovenweep Visitor Center ground breaking ceremony on November 8, 2000. Commissioner Lewis will attend the annual Road meeting on November 8, 2000. Commissioner Lewis plans to attend the airport meeting in Oljato on November 10, 2000. Commissioner Lewis will be in Fallon, NV on November 14, 2000. Commissioner Lewis will attend the UAC Conference in St. George next week.
