SAN JUAN COUNTY COMMISSION MEETING DECEMBER 18, 2000 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: TY Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the December 11, 2000 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. San Juan Health Care District Cleal Bradford, San Juan Health Care District, reported a CIB request for $75,000 has been authorized. He also reported the San Juan County Hospital electronic billing process since November has been going smoothly. There are some delays in the old and also current clinic billings. Mr. Bradford further stated the District is still using a master plan that was put in place seven years ago and will continue to use it until it is completed. The Blanding portion is not included as part of the plan. He mentioned the Districts current organizational chart establishes links of communications and is used as a legal document showing the District meets requirements. Mr. Bradford indicated the lawsuit against the Health District brought by Dr. Mena was dismissed last week. Bid/Annual Road Department The bid sheets are on file at the Road Department. The bids are as follows: Bid/Batteries Bids were received for batteries from Hensley, Hill's Auto, Motor Parts, M.F.E. West, Inc. as per bid sheet. Commissioner Bill Redd made a motion to approve the bid from Hensley, Durango. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Culverts Bids were received for corrugated pipe UDOT Class A from Amcor, Big R, and Contech; corrugated Class A Riveted pipe from Amcor; Big R, and Contech; and for corrugated Spiral Pipe, Type 2, Class B. from Amcor, Big R, and Contech as per bid sheets. Commissioner Bill Redd made a motion to appr ove the Contech bids on all types of pipe. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Filters Bids were received for filters from Hill's, Motor Parts, M.F.E. West, Inc., as per bid sheets. Commissioner Bill Redd made a motion to approve the Motor Parts, Monticello bid. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Tires Bids were received for tires from Four States Tire and Redburn as per bid sheets. Commissioner Bill Redd made a motion to approve the bid from Four States Tire. Commissioner Mark Maryboy seconded. UNANIMOUS. San Juan Mental Health/Substance Abuse Special Service District/Public Health Fund Dan Rogers, San Juan Mental Health/Substance Abuse, and Norman Johnson, Board Member presented a request for Critical Capitol Expenditures from the Public Health Fund of San Juan County in the amount of $91,500. The Commissioners indicated it would be part of the budget discussion. Nuclear Waste/Ken Sleight Ken Sleight, Moab, expressed his concern about the international waste that is being shipped in to San Juan County. He feels the County does not charge enough fees to cover the health impacts. Mr. Sleight has asked that an environmental statement be conducted by the State and the NRC. He asked the County consider supporting an EIS on this issue. On January 27, 2001 the down winders, Sierra Club, and Dineh care and others are going to attend a memorial for the 50th anniversary of testing beginning at the Nevada test site. A bill will be submitted to the state legislature in honor of those who have died. Beer License Renewal County Clerk Norman Johnson presented the following beer licenses for renewal: K & C Trading Post, LaSal Store, Shirt Tail C-Store. Commissioner Bill Redd made a motion to approve the beer licenses. Commissioner Mark Maryboy seconded. UNANIMOUS. Beer License/New County Clerk Norman Johnson presented an application for a new beer license which is a change over from Damon Orr to Eugene Orr for Sunrise Trading Post. Commissioner Bill Redd made a motion to approve the new beer license. Commissioner Mark Maryboy seconded. UNANIMOUS. Commission Meeting Schedule County Clerk Norman Johnson reported the Commission needs to set their meeting dates for the coming year. Commissioner Bill Redd made a motion to keep the same meeting schedule and authorized advertisement of the meeting schedule public notice. Commissioner Mark Maryboy seconded. UNANIMOUS. BLM/Update Kent Walter, Monticello Field Officer, reported that Bob Turri, Contract Specialist, attended the OHV National Strategy Broadcast. The comment period is open until January 3, 2001. A team will meet and the final decision will be out by January 19, 2001. The Utah Resource Recreation Guidelines comment period will be open until December 31, 2001. Gooseneck State Park Kent Walter, BLM, stated the Bureau has received a proposal from Utah State Parks to expand Gooseneck State Park. Their proposal is to include a campground, fee station, and new trails in the 3,700 acre expansion. Questions were raised concerning patents or leases with State Parks. Indian Creek Management Plan Work is continuing on the Indian Creek Recreation Management Plan from Newspaper Rock to Lockhart Basin. The plan is to have the environment assessment out for public review sometime in February. OHV use is not included in this assessment. Hovenweep Land Exchange The Shumway/Hovenweep exchange has been finalized. Abandoned Mines Watershed Restoration Project Kent Walter, BLM, reported on a proposal to close some of the mine access routes. The BLM will meet with Doug Pehrson, Road Department, to review those routes on January 9, 2001. The Environmental Assessment should be out for public comment sometime in January. The Ute Mountain Tribe has identified that the main Cottonwood Wash road goes through their property. They requested the BLM obtain an access right of way from the Tribe. A meeting will be held in January to facilitate the right-of-way from the Tribe. Oil & Gas Two applications to drill oil & gas wells east of Bluff on McCracken Point will be approved today. Oil & gas lease sales were conducted on November 27, 2000. One parcel was sold in the Montezuma Canyon/Horsehead Canyon area. Seismic Proposal A vibrio seismic proposal has been received by the BLM. There is a 25-30 square mile area identified in the Dry Valley. The EA should be completed soon. Work could start in early spring. Drought The BLM has contacted all the permittees who have winter allotments. A 35% reduction has been recommended. All have been voluntary reductions. Livestock water is still a problem in many areas. McCracken Mesa Extension The BLM is working with Robert Whitehorse and Augustine Norton to address the split estate on the McCracken Extension. The Chapter has not identified individual alottees. The oil companies want to compensate the local alottees for any impacts caused. Commissioner Maryboy requested a draft copy of the BLM resolution so he can complete the resolution for the Chapter. Year 2001 Budget/Adoption County Clerk/Auditor Norman Johnson and ITS Manager John Fellmeth reviewed with the Commissioners the final changes in the 2001 budget bringing the total in the General Fund to $7,031,914. Commissioner Bill Redd made a motion to adopt the budget by resolution. Commissioner Mark Maryboy seconded with the comment that he is concerned with health care money, management plan, and legal opinion. UNANIMOUS. See attached budget at end of minutes. Bid/Work Stations-Assessors Office A bid was presented for two HON work stations from Desks Inc. @$6,190 each and two work stations @$6248 each plus shipping for a total of $12738, and from Midwest Office for two steel case work stations @$4849.63 each and for two work stations @$4467.44 each plus shipping at $1438 for a total of $10755.07. Commissioner Bill Redd made a motion to approve the bids from Midwest Office. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Computer-Assessor's Office County Assessor Bruce Bunker presented a bid request for a 700 MHZ PC computer for the Motor Vehicle office from High Country Computer at $972.14 and from Gateway 2000 for the same at $1369. Commissioner Bill Redd made a motion to approve the bid from High Country Computer. Commissioner Mark Maryboy seconded. UNANIMOUS. Building Permit Building Inspector Bruce Bunker presented a building permit for David Orr for a cabin near Gordon Reservoir. Commissioner Bill Redd made a motion to approve the building permit based on the county receiving documentation showing ownership of the property. Commissioner Mark Maryboy seconded. UNANIMOUS. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Blanding Senior Center Aid/Termination Personnel Director Scherick reported on finalizing a termination for Blanding Senior Center Aid, Betty Stash. Requirements have been meet with warnings, written notices, and hearing opportunities. Commissioner Bill Redd made a motion to approve the termination. Commissioner Mark Maryboy seconded. UNANIMOUS. Comparative Photo Study Planner Scherick reported the comparative photo study has gone to press. The cost is going to be slightly higher than projected. The handout publication through the visitor center and USU web site are almost complete. Salt Creek Road The Park Service will be here this afternoon to discuss issues on the Salt Creek Road. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Aging Contract/Amendment Administrative Assistant Rick Bailey presented Aging Contract Amendment #1 for approval. The amendment would increase the funding to San Juan County in the amount of $25,038.83 bringing the total contract to $332,688.83. Commissioner Bill Redd made a motion to approve the contract and sign the amendment. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Navajo Police Vehicles Administrative Assistant Rick Bailey reported that Leo Manheimer, Navajo Mountain Chapter, is preparing a resolution and was told he could come and pick up one of the Navajo police vehicles being held at the Public Safety Building. The County does not have ownership of those. Utah Navajo Trust and Utah Navajo Commission have control of the vehicles. The Chapter needs to work with those entities in order to obtain one of the vehicles. Montezuma Creek Swimming Pool Administrative Assistant Rick Bailey clarified a discussion held last week concerning the Montezuma Creek Swimming Pool contract. Mr. Bailey reported he received a telephone call from Utah Navajo Health Systems in which they stated the County lease contract sent to them on the Montezuma Creek Swimming pool is in the SAS process in Window Rock. They don't know when it will be through the process. Utah Navajo Health Systems is willing to sign the current County contract until such time that the Navajo Nation ratify or changes the other agreement. Mr. Bailey would not recommend they sign the contract unless the other insurance policies and contracts are in place. Their insurance purchased should be in place sometime this week. Commissioner Redd made a motion to allow Mr. Bailey to sign the contract based on his satisfaction that the insurance policies are in place. Commissioner Mark Maryboy seconded. UNANIMOUS. The County needs to complete some finish up work on the pool then it will be ready to open. There is some concern about humidity in the pool area. Navajo School Bus Route Priority List Administrative Assistant Rick Bailey reported he has not received the road priority list from Aneth and Oljato Chapters. Commissioner Redd feels if the Chapters do not submit their list they will be obligated to go with the School District list. Community Meeting/Monument Valley A community meeting was held at Monument Valley last week. There is concern of removing the ambulance Indian Health Service has there. Leasing an ambulance could be a possibility. Road Department/Accident Administrative Assistant Rick Bailey reported a Road Department employee left his private vehicle engaged while he got out of it. The car ran in to the Commissioners car causing some damage. Telephone/Cell Phone Administrative Assistant Rick Bailey reported on a proposed memo to elected officials and department heads requesting input on telephones and cell phones. Mr. Bailey has pulled the State contracts on long distant telephone service. AT&T does have a lower rate than we are currently paying. He will send out bid proposals to the companies. Aging Advisory Council Administrative Assistant Rick Bailey attended a Aging Advisory Council meeting. Drivers license issues were discussed. Evergreen Highland Subdivision Amendment Administrative Assistant Rick Bailey presented an amendment to the Evergreen Highland Subdivision. R.D. Carroll has sold another lot. He has had a new plat drawn up. Required signatures have been obtained. Mr. Bailey recommended that Lot #8 be added to the Evergreen Highland Subdivision. Commissioner Bill Redd made a motion to approve the amendment to the subdivision. Commissioner Mark Maryboy seconded. UNANIMOUS. Travel Advance Administrative Assistant Rick Bailey reported that James Montella, Fire Warden, will be attending wild land fire training in Fort Morgan, CO in January and is requesting a travel advance on his reimbursement. Commissioner Bill Redd made a motion to approve an advance on the travel reimbursement. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Laptop Computer A bid was presented for a laptop computer for Administrative Assistant Rick Bailey from High Country Computer at $2107, Gateway Computers at $3696 and from PC Laptop at $3799. Commissioner Bill Redd made a motion to approve the bid from High Country Computers. Commissioner Mark Maryboy seconded. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy raised concern about litter along the roads in the southern part of the County. He asked that those selling alcohol encourage the buyers not to litter. County Clerk Norman Johnson will put a note concerning this in each new beer license renewal packet. Commissioner Maryboy reported on the Navajo Nation special session. The Navajo Nation has set aside a trust fund for the Chapters in the three states. Utah received one million dollars. The interest money can be used to match county or state funding for projects. Commissioner Maryboy missed the Shiprock Road Agency meeting because of bad weather. He arrived at the meeting too late. Commissioner Maryboy will be in Window Rock on Tuesday and Wednesday of this week. On Thursday and Friday Commissioner Maryboy will be in the area. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd attended the Community Impact Board meeting last week. He stated San Juan County may be asked to give a road presentation at NACo. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis will attend UAC Insurance Mutual on December 21, 2000. There will be a county Christmas party at noon on December 22, 2000. Next commission meeting will be held on Tuesday, December 26, 2000. The first commission meeting in January will be held on Tuesday, January 2, 2001.
