SAN JUAN COUNTY COMMISSION MEETING APRIL 23, 2001 The regular meeting of the San Juan County Commission was held a 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the April 16, 2001 as amended was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioner Mark Maryboy was not present at the time the action was taken. Commission Meeting There will be no commission meeting held on April 30, 2001 due to a fifth monday. Central San Juan Recreation District Chip Sharp, San Juan Central Recreation District, requested financial help from the County to purchase a 60" lawn mower from David Lyman at $8,800. He stated Blanding City would pay half if the County would pay half. The request was denied. However, the Commission suggested the Recreation District use the $196,000 baseball field grant money and approach the CIB for matching money. Other cost share ideas were also discussed. Mr. Sharp presented the Commission with a copy of the San Juan Central Recreation District budget. Boiler System/Courthouse Dell Hunter, Grounds and Maintenance Supervisor, reported on the cost of a boiler system for the old part of the courthouse. The engineer estimate is $4500 without labor. Commissioner Bill Redd authorized him to move forward. Commissioner Mark Maryboy seconded. UNANIMOUS. Grounds Keeper Grounds and Maintenance Supervisor Dell Hunter requested to hire a seasonal grounds keeper for the courthouse, jail, and two libraries. The Commission suggested he go to the personnel office to establish criteria for advertizement. Mental Health Contract/San Juan Counseling & San Juan County Dan Rogers, San Juan Counseling, presented the FY 2002 Mental Health Service Plan to the commission for signature. Commissioner Bill Redd made a motion to sign the Mental Health Service Plan. Commissioner Mark Maryboy seconded. UNANIMOUS. San Juan County Substance Abuse/Mental Health Service District/Single Audit Commissioner Bill Redd made a motion that San Juan County Substance Abuse/Mental Health Special Service District be required to obtain a single audit. Commissioner Mark Maryboy seconded. UNANIMOUS. Out-of-State Travel/Mark Maryboy Commissioner Bill Redd made a motion to approve an out-of-state travel request for Commissioner Mark Maryboy to attend the NACo Conference in Philadelphia, PA on July 14-17, 2001. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Copier-Commission Office Administrative Assistant Rick Bailey presented a bid to lease an AR-287 Digital Sharp Copier for the Commission office from the state contract with Les Olsen at .0315 cost per copy with network card at .0395 per copy. The plan includes the machine, all labor, parts, drums, heat rollers, kits, travel, toner, and developer. The plan does not include paper or staples. The machine can be exchanged at any time. Commissioner Bill Redd made a motion to approve the bid. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Independent Auditors Kimball & Roberts, Independent Auditors, will be in the County all week to conduct the annual audit. Schedule Administrative Assistant Rick Bailey stated he has a LEPC meeting on Wednesday and one in Grand County on Thursday. PERSONNEL-LILLIAN BAYLES/WALTER BIRD Payroll Change/Recorder's Office A payroll change request was presented for Mike DesRosiers, Recorders Office, who has completed course work to be a certified cadastral mapper. The request is to move him from Step 119 at $1941 per month to Step 124 at $1990 per month. The request was denied until more justification is received. Payroll Change/Janitor A payroll request was presented for Jim McCarthy to be moved from Step 72 at $1551 per month to Step 84 at $1581 per month due to increased work load. The request was denied until further justification is received. Emergency Hire/Receptionist A request was presented for an emergency hire for a receptionist for the Commission and Emergency Services Department. This will be a temporary position at $6.42 per hour and will last approximately six weeks. There will be no benefits. The Commission gave permission to proceed. BLM/Update Kent Walter and Nick Sandberg, Monticello BLM, presented updates on drought, term permit renewals, oil & gas, and seismic activity. South Cottonwood Abandoned Mine Project Kent Walter, Monticello BLM, reported the South Cottonwood Wash Abandoned Mine Project document should be ready in a couple of weeks. Salt Creek Mesa Project The BLM is conducting a 1600 acre fuel/vegetative treatment program in the Cathedral Peak area. The BLM will be conducting a field trip on April 27, 2001. The County is invited to attend. Back Country Trail Kent Walter would like the County, Forest Service and other entities to collaborate in the management of OHV access roads in the County. The County does not want to do anything to jeopardize ownership of roads until the lawsuit issues are resolved. The County road group will meet next week after which they will meet with the BLM. Butler Wash The BLM will place some enclosures to protect riparian and sensitive resource areas in Butler Wash. Resolution/Blankenagle Lot #2-Division Administrative Assistant Rick Bailey presented a resolution for Dick Sly, owner of Lot #2 Blankenagle Subdivision. It was requested to divide Lot #2 into three lots plus an easement. Adjacent landowner consents have been obtained. Commissioner Bill Redd made a motion to approve the division of the lot by resolution. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. The Resolution is as follows: RESOLUTION 2001-01 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS SAN JUAN COUNTY WHEREAS, Dick Sly and Anastatasis Sly, of LaSal, Utah owners of Lot 2 of the Blankenagle Subdivision have petitioned that they be allowed to re-subdivide this particular lot; and WHEREAS, the petitioners have provided to the County signed documents from those adjacent landowners within 300 feet of Lot 2 in the Blankenagle Subdivision in which each of these owners of adjacent land has agreed with the proposal by the petitioners; and WHEREAS, the letters of approval by the adjacent property owners is in the subdivision file maintained by the County's subdivision administrator; and WHEREAS, there appears to be no reason to deny the application of the petitioners to re-subdivide this particular lot. The ordinance is as follows: ORDINANCE 2001-01 The request having been made by Stephanie DeGeorge, owner of properties known as Lots 1 and 12 of Block 29 of the Cottonwood Addition, Bluff, Utah to vacate 20 feet running east and west through the middle of Lots 1 and 12. Said request having been made to the San Juan County Commission pursuant to Utah Code Annotated, section 10-8-8.1, and consent having been given to such vacation in accordance with Utah Coded Annotated, Section 10-8-8.1, 1953 as amended. A public hearing having been held even though the same may not have been required pursuant to the statute and because of consent of all the abutting property owners. The County Commission have determined that there is good cause for the vacation of said alley, that there exists no utilities, easements, or underlay encumbrances on the property and that the action will not be detrimental. The County Commission being assured by the applicant herein that no other property owners hold an interest in said properties, and the owner requesting that the alleyway between Lots 1 and 12 of Block 29 is no longer be divided by the 20 foot alley running from East to West within said properties. The new property be combined to be described as all of Lot 1 (Lots 1 and 12), Cottonwood Addition, Bluff Townsite. NOW THEREFORE, in consideration of the foregoing, the San Juan County Commission does hereby ordain that the alleyway described as a 20 foot alley separating Lots 1 and 12, Block 29, Cottonwood Addition is hereby vacated and the same is hereby conveyed, transferred, vacated, and set over to Stephanie DeGeorge by the San Juan County Commission. This ordinance shall take effect immediately upon passage. Salt Creek/Scoping Meeting The Park Service will hold a scoping meeting concerning Salt Creek on April 24, 2001 at 4:00-8:00 P.M. in the Commission Room. Times Independent/Photo Study Books Planner Scherick reported the Times Independent Newspaper, Moab, would like to sell the Comparative Study Photo books. Commissioner Bill Redd suggested the County sell them the books for $10 per copy and they can resell them at the price they decide up on. USGS/Water Gauge Agreement Planner Scherick reported that USGS has sent an agreement for the cost of the water gauges. USGS will match 50% of the cost of installation and monitoring. There will be a split of $34,650 between USGS, the County, Soil Conservation Service, and the City. Commissioner Bill Redd made a motion to sign the agreement to participate in the water gauge installation project. Commissioner Mark Maryboy seconded. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits Building permits were presented for Thomas Cartwright for an addition to cabin at Pack Creek Ranch and for Lewis Farms for a shop and storage building south of Monticello. Commissioner Bill Redd made a motion to approve the building permits. Commissioner Ty Lewis seconded. Commissioner Mark Mary boy was not present at the time the action was taken. Grand County Council/Spanish Valley Water Study The County received notice that the water study in Spanish Valley would cost $27,000. Grand County Council would welcome any monetary contribution from San Juan County. Mr.Bailey will write a letter stating the County will consider after certified tax rates established. Dick Shumway/Building Permit Fee & Penalty Administrative Assistant Rick Bailey reported on a letter and money received on two building permits and penalty from Dick Shumway. The total amount of the permits, penalty, and fees is $4252.80. A check was received in the amount of $1853 which is the original building permit fee for both properties. Another letter will be sent from the County indicating that Mr. Shumway has two weeks to pay the remainder of the fees or it will be applied to his property tax. It will also be indicated that building inspections were not conducted according to law and will be recorded on his real property so that future property owners will know that inspections were not performed by law. Mr. Bailey will meet with County Assessor Bruce Bunker to determine the amount of the building permits without the inspection fees. County Contracts Administrative Assistant Rick Bailey recommended that the County implement a policy or procedure that all contracts entered in to by the County be reviewed by Deputy Attorney Walter Bird prior to approval in commission meeting. The commissioners agreed with the idea. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Mark Maryboy reported the Tribal Council was in session last week. A debate was held concerning the fuel excise tax. Their fuel tax resolution was tabled. Commissioner Maryboy stated this is the last week for CIP and CDBG grant proposals from the Chapters. The Chapters will coordinate with the County and submit funding requests to the Navajo Tribe. The Utah Navajo Commission will be meeting this week. Money will be allocated to the Utah Chapters. This week Commissioner Maryboy will be in Albuquerque, NM attending the Agency Wide Road Conference. Commissioner Maryboy will attend the annual NACo Conference in Philadelphia, PA on July 14-17, 2001. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd attended the UAC Management Conference in Cedar City on April 28-20-2001. He attended the open lands meeting and legislative update meeting. Commissioner Redd will be in Price, Utah on April 27, 2001, meeting with other mineral producing counties concerning severance tax legislation. There will be an ATV meeting in Bluff at the Desert Rose Inn on April 24, 2001. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis attended the UAC Management Conference in Cedar City on April 18-20, 2001. Commissioner Lewis will attend the Joint Highway Committee meeting on April 24-25, 2001 in St. George.
