SAN JUAN COUNTY COMMISSION MEETING MAY 7, 2001 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the April 23, 2001 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. Out-of-State Travel/Steve Bradford An out-of-state travel request was presented for Steve Bradford to attend the National Translator Association Seminar in Denver, CO on June 1-3, 2001. Commissioner Bill Redd made a motion to approve the out-of-state travel request. Commissioner Mark Maryboy seconded. UNANIMOUS. Grocery Store Cost Comparison/Extension Home Economist Heidi LeBlanc reported the Grocery Store Cost Comparisons compared sale prices against regular prices. It was not a fair comparison. Another survey will be conducted at a later time. Heidi LeBlanc did report that Clark's Market in Blanding is offering a one time 20% discount on merchandise to participants that complete the Family Nutrition Program. Navajo Nation Police Department Edward Tapaha, Navajo Liaison, reported that the Navajo Nation Police Department would like to re- schedule the meeting with the Commissioners. Edward Tapaha reported he would like to continue discussion with the Navajo Nation law enforcement department to consider placing the district in Montezuma Creek. Commissioner Mark Maryboy suggested that a meeting be held with each of the Chapters Officials for input on the idea. Bid/Compactor Cutter Crusher A bid was submitted from Mountain West Attachments for an Ateco - Compaction Cutter Crusher at $4250 for the South Road Department. Commissioner Bill Redd made a motion to approve the bid. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Conference Call Telephone System A bid was presented from Communications Plus for a Conference System for the commission room that would be compatible with the County telephone system. Public Safety Building/Remodeling Dell Hunter, Grounds & Maintenance Supervisor; Sheriff Lacy & Lt. Freestone requested to make another restroom in the basement of the public safety building for staff. Commissioner Bill Redd made a motion to approve the project with a bid for the plumbing portion of the project. Commissioner Mark Maryboy seconded. UNANIMOUS. Tax Exempt Properties County Assessor Bruce Bunker presented a list of tax exempt properties based on use and application for religious, charitable, and educational purposes. Included is a list of parcels with no tax exempt affidavits returned for 2000 or 2001. These parcels have values added. Unable to locate owner parcels are also included. Commissioner Bill Redd made a motion to approve tax exemption status for those who have filed. Commissioner Mark Maryboy seconded. UNANIMOUS. PERSONNEL LILLIAN BAYLES' REPORT Request to Hire/Blanding Library Assistant Personnel Secretary Lillian Bayles presented a request to hire Shurrell Meyer to be a part-time Blanding Assistant Librarian at Step 1 at $6.42 per hour effective May 14, 2001. Commissioner Bill Redd made a motion to approve the hire. Commissioner Mark Maryboy seconded. UNANIMOUS. Long Term Disability/Clarification Personnel Secretary Lillian Bayles requested clarification from the commission on the long term disability benefit for the County. The clarification is that after a county employee is placed on leave because of a disability the County will continue insurance coverage for the employee for a four month period provided the employee pays the premium amount. The employee would then be offered COBRA insurance for 18 to 36 months depending on their conditions. This would extend the person to long term disability benefits if the state deems them eligible. Commissioner Bill Redd made a motion to allow continued coverage for an employee for a four month period provided the employee pays the premium. Commissioner Mark Maryboy seconded. UNANIMOUS. PLANNER EDWARD SCHERICK'S REPORT Planner Scherick reported on May 4, 2001 he, Bob Turri, and Commissioner Bill Redd attended a meeting with Utah County Canyonlands Posey interest group in Indian Creek. They discussed with the group the county position on the road lawsuits. Planner Scherick reported the County has received an approval letter from the Forest Service for the stream channel gages for North & Spring Creeks. Installation will take place in the next couple of weeks. Roger Hansen, Bureau of Reclamation, will be here to talk about water projects on May 14, 2001 at 2:00 P.M. The County will be going up Salt Creek on May 9, 2001 to access the area. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Environmental Certifying Officer Administrative Assistant Rick Bailey presented a request from the AOG office that San Juan County designate and appoint Commissioner Bill Redd as the Environmental Certifying Officer for all HUD funded grants operated by the County. RESOLUTION 2001-02 ENVIRONMENTAL CERTIFYING OFFICER (ECO) BE IT HEREBY RESOLVED: That the County of San Juan, a body politic and corporate of the State of Utah and a municipal subdivision of said state of Utah, by and through its governing body, hereby this resolution made and executed this 7th day of May, 2001 does: 1. Designate and appoint for the County of San Juan the Commissioner Bill Redd as the Environmental Certifying Officer for all HUD funded grants operated by the County. 2. The Environmental Certifying Officer shall have full authority, with approval of the County Commission to certify for the County of San Juan any and all documents, materials, activities which may be required by other agencies or individuals, HUD, or units of government, state or federal and particularly, but not limited to, Housing Finance Agencies, Public Housing Agencies, non-Profit Organizations and other entities. 3. This designation and authority shall continue and in full force and effect until revoked or until the designated individual no longer functions in the official capacity as described. Building Permits The following building permits were presented for approval: Curtis Hunt for a modular home in Ucolo; M & M Manufactured Homes for four well houses in San Juan Estates II; McElhaney Construction for a home in Spanish Valley; Kevin Carroll for a modular home in the Entrada Subdivision; Gene Gruette for a home to be moved from Montezuma Creek to Bluff; and for Mark Bradford for alterations on a mobile home on old Devils Canyon Road. Commissioner Bill Redd made a motion to approve the building permits. Commissioner Mark Maryboy seconded. UNANIMOUS Mutual Aid Agreement/San Juan County EMS & Grand County EMS Administrative Assistant Rick Bailey presented modifications to the Mutual Aid Agreement between San Juan County EMS and Grand County EMS for approval. Recreation Funds/TeecNosPos Chapter Administrative Assistant Rick Bailey reported the County has received a Resolution from TeecNosPos Chapter indicating the recreation and road fund issues have been resolved. Commissioner Bill Redd made a motion to release the recreation and road funds to the TeecNosPos Chapter. Commissioner Mark Maryboy seconded. UNANIMOUS Utah Navajo Fair Administrative Assistant Rick Bailey reported the County received a letter from the Utah Navajo Fair Board indicating a meeting was held to elect the new fair board officers. They are Curtis Yanito, Chairman, and Kee Brown, Vice-Chairman. Commissioner Mark Maryboy has a problem with the way the new officers were elected. Commissioner Maryboy and Administrative Assistant Rick Bailey will draft a letter to the Utah Navajo Commission with concerns about representation from each of the Chapters and suggest they organize a fair structure to be funded through their organization. Commissioner Maryboy would also like a letter written to Roger Atcitty indicating his concerns. Commissioner Maryboy made a motion recommending that Utah Navajo Commission organize the Utah Navajo Fair board to include members from each of the seven Chapters with the money to run the fair to go through that board. Commissioner Bill Redd seconded. UNANIMOUS. Revitalization Meeting The Revitalization meeting will be moved to May 21, 2001 at 1:30 P.M. in Blanding, Utah. State Aging Contract Administrative Assistant Rick Bailey presented Amendment #2 of the State Aging Contract which increases the funding amount of $16,030 bringing the total contract to $348,718.83 for approval. Commissioner Bill Redd made a motion to approve the amendment. Commissioner Mark Maryboy seconded. UNANIMOUS. Cal Black Airport/Aeronautical Operations Division Administrative Assistant Rick Bailey presented a Grant Agreement Modification for additional state funding for Airport Development at the Cal Black Airport. The grant is to increase the state share of the project to $11,956 from the originally approved amount of $6,210, to match the FAA's increase of fund to $240,000 from the original $124,580. Commissioner Bill Redd made a motion to approve the grant agreement modification. Commissioner Mark Maryboy seconded. UNANIMOUS. Cal Black Airport/Photo-Voltaic System Administrative Assistant Rick Bailey reported the Utah Transportation Commission approved an application to purchase and install AWAS and battery replacement for the Photo-Voltaic System at the Cal Black Airport. Commissioner Bill Redd made a motion to sign the agreement. Commissioner Mark Maryboy seconded. UNANIMOUS. Forest Service/Revenue Administrative Assistant Rick Bailey reported the Forest Service is proposing a new Rural Schools and Community Self Determination Act 2000 receipt sharing program formula. Each county has the opportunity to select to either remain under the old formula or opting for the new three year average. Commissioner Bill Redd made a motion to select the new option. Montezuma Creek Swimming Pool/Capital Improvement Administrative Assistant Rick Bailey reported on a request for the County to authorize $6,000 capital improvement money allocated for a hot tub at the Montezuma Creek Swimming pool be used for a water slide, basketball hoop, and volleyball net pools. Commissioner Bill Redd made a motion to transfer the money for those items. Commissioner Mark Maryboy seconded. UNANIMOUS. Zoning Change Request/Paul Redd Administrative Assistant Rick Bailey presented a zoning change request from Paul Redd for a 55 acre parcel located approximately 25 miles north of Monticello on Highway 191. This would be to facilitate construction of a residential treatment facility to house, educate, and treat teens with emotional and behavioral abnormalities. Specific requirements will have to be met. A public hearing will be scheduled. Spanish Trail Estates/Jim Hurst Administrative Assistant Rick Bailey reported that Jim Hurst developer of Spanish Trail Estates was issued a building permit to place a modular home on a triangle lot. He cannot meet the setbacks on either the front or the back of the lot because of the shape. He is requesting a variance to allow those setbacks be changed to allow him to meet that. There are differences in the zoning ordinance setback and with what the building department understood the setbacks to be. Mr. Bailey will meet with the building department to determine reasonable setbacks and bring a recommendation to the Commission. A variance hearing will be scheduled. Schedule Administrative Assistant Rick Bailey will travel to Roosevelt, UT on May 8-9, 2001 to attend state aging meetings. On May 9-10, 2001 Mr. Bailey will attend HazMat and fire meetings in Salt Lake City. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy stated he gave a directive to the Road Department to look at the way Apache County Arizona Road Department is structured. They have sub offices in several locations and would like to know the benefits for having those. The Navajo Nation Council will be holding a special session on Monday, May 14, 2001. Commissioner Maryboy is the main sponsor of the fuel excise tax issue to be presented at this session and will not be at commission meeting next week. Last week Commissioner Maryboy met with representatives of Hope Alliance in Salt Lake City. This group is involved with health and eye care programs on the Reservation. Commissioner Maryboy will attend a meeting at Elk Horn today. Some of the people that work there do not have home site leases and are afraid of being forced out of their homes. Commissioner Maryboy attended a conference in Flagstaff, AZ regarding the existing Navajo Nation Government. The Navajo Nation Government is not working under the current structure and is not working the way it should be. There may be a resolution to restructure the Navajo Nation government. COMMISSIONER BILL REDD'S REPORT Last week Commissioner Bill Redd went with Steve Deeter, ASCS, and Corey Perkins, Blanding, to Coal Bed to look at the Corey Perkins proposed dam site. No county commitments were made. Commissioner Redd attended the Road Litigation meeting in Salt Lake City. He also attended a meeting between all the county commissioners and their road foremen. Commissioner Redd went with Planner Scherick, and Bob Turri to Indian Creek to discuss road lawsuit issues with the Utah County Canyonlands Posey group on May 4, 2001. Commissioner Redd will attend the Hart Point Road hearing in Salt Lake on May 8, 2001. Commissioner Redd will attend the AOG meeting in Price on May 9, 2001. He will be in Salt Lake City to attend the CIB meeting on May 10, 2001. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis attended the Joint Highway Committee meeting in St. George on April 24-25, 2001. Commissioner Lewis reported that San Juan County has money for preliminary engineering costs for work on the Lisbon Valley Road going toward the copper mine. When that is completed the project can be funded hopefully by next spring. Commissioner Lewis spoke to fifth graders at Monticello Elementary School concerning road issues. Commissioner Lewis will be in the County this week.
