SAN JUAN COUNTY COMMISSION MEETING MAY 29, 2001 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the May 21, 2001 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. GASB 34 Training County Clerk Norman Johnson reported that auditors Kimball & Roberts have arranged for GASB 34 Accounting Training by the State to be held in Richfield, Utah on June 20, 2001 beginning at 8:00 A.M. He and ITS Manager John Fellmeth will attend. 2001 Tax Abatement Properties County Clerk Norman Johnson reported there are four properties that will require commission action. Sutherland Oil, Mexican Hat Area, Parcel #SA-4087, has not been in existence since 1996. However taxes in the amount of $236.55 are still on the books. The Commission suggested the County Attorney give an opinion. Commissioner Bill Redd made a motion for the County Attorney to review. If a bid is not needed to clear the record then it can be removed from the tax roles. Commissioner Mark Maryboy seconded. UNANIMOUS. County Recorder Louise Jones feels the Bluff River Ranch property, Cottonwood Subdivision, Parcel #C40210255402, does not exist but is a survey error. She recommends the taxes be cancelled and mark the property as an overlap in the subdivision. Commissioner Redd suggested that if there is property with overlapping situations in which the taxes are not being paid it is not the County's place to decide who should pay. The property should be put up for sale so the two owners will settle the situation. Otherwise the overlap will become the property of the County and the County could then sell the property. Commissioner Bill Redd made a motion to cancel the taxes for 1996 in the amount of $55.97 which will allow it to move forward on next years tax sale. Commissioner Mark Maryboy seconded. UNANIMOUS. BP Amoco Cross Creek/Crystal Energy, Parcel #SA-4019, held a hearing with Utah State Tax Commission and has declared bankruptcy. It appears that this is an oil company. County Clerk Norman Johnson recommended the 1996 taxes, penalty, and interest in the amount of $3358.99 be cancelled. The Commissioners suggested the County Attorney look in to the situation. Commissioner Bill Redd made a motion to cancel the 1996 taxes and turn it over to the County Attorney. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. J & B Home Supply, Parcel #A0000014003E, went to the 2001 May tax sale. There were no bidders. Commissioner Bill Redd made a motion to abate the taxes in the amount of $217.01. The property is struck off to the County. Commissioner Mark Maryboy seconded. UNANIMOUS. The property will return to the County. Tax Exemption/Catholic Church Deputy County Assessor Kim Lacy reported the Catholic Church in LaSal has returned their property tax exemption form and requested they be exempt. Commissioner Bill Redd made a motion to approve the tax exemption. Commissioner Mark Maryboy seconded. UNANIMOUS. San Juan Counseling/San Juan County-Contract Dan Rogers, San Juan Counseling, presented a draft contract between San Juan Counseling and San Juan County for the commissioners to review. After review the commission will give the contract to the County Attorney for corrections. Moab Film Commission Judy Bane and Jerry McNeeley, representing the Moab Film Commission, requested the County contribute $5,000 to go toward the Moab to Monument Valley Film Commission information booklet printing. Administrative Assistant Rick Bailey reported that Peggy Humphreys, San Juan County Travel Council, does not wish to participate because she feels local businesses in San Juan County do not benefit from filming. After a discussion, Commissioner Bill Redd made a motion to give $5,000 to the Moab Film Commission to meet the obligation of the information booklet that has already been produced. Commissioner Mark Maryboy seconded with the suggestion that the commission meet with the Travel Council office to discuss the reasons why they chose not to participate in this project. UNANIMOUS. Blanding City/Planning Issues Brett Hosler, Blanding City Planner, requested that the County be a co-applicant with Blanding City in applying for a $20,000 grant through the Utah Quality Growth Commission to develop a master street plan for Blanding and surrounding area. This plan could then be adopted in to the County Master Plan. The County could help with personnel and time in developing the plan as part of the grant match. The Commission agreed but will seek legal advise from the County Attorney. Commissioner Bill Redd made a motion to write a concept agreement letter. Commissioner Mark Maryboy seconded. UNANIMOUS. Blanding Airport Zoning Philip Palmer is concerned about zoning, regulations, and limits around the Blanding Airport. Commissioner Redd suggested that Mr. Palmer meet with County Planner Edward Scherick and develop a rough plan of the airport, surrounding area, and identify zoning areas and regulations. School Trust Lands/Large Block Management Scott Robertson, School Trust Lands, reported he is writing a large block management plan for the south LaSal area that includes 10,000 acres. Legislation creates trust lands and lays out certain laws. Trust Lands anticipates that these large block management plans will include a significant public process with the County to be included. Public Hearings Commissioner Bill Redd made a motion to convene in to public hearings. Commissioner Mark Maryboy seconded. UNANIMOUS. The following public hearings were conducted: At 12:00 P.M. a variance hearing was held for a request from Monty Perkins to place a second residence on a five acre lot. There were no public comments. At 12:10 P.M. a hearing was held concerning changes in the setback requirements in the zoning ordinance. The proposed setback requires would change the multiple use, agricultural, and residential areas width regulation from 660 to 100, 330 to 100, and remain at 100 feet; frontage regulation from 60 to 25, 60 to 25 and 30 to 25 feet; front yard regulations from 50 to 25, 50 to 25 and 30 to 25 feet; and rear yard regulations from 60 to 25, 60 to 25, and 30 to 25 feet. There were no public comments. At 12:15 P.M. a hearing was held concerning a zoning change from agricultural to commercial for Paul Redd to place a youth treatment facility near the Highway 191 twenty five miles north of Monticello. Comments in favor of the facility were heard by Mr. & Mrs. Phil Glaze, Wilson Arch developers. At 12:20 P.M. a hearing was held concerning a variance request by Jim Hurst to change setbacks and minimum lot size requirements on Tract A property adjacent to Spanish Trail Estates. He plans to place a double wide home on the property. Commissioner Ty Lewis read a letter from Mr. Hurst to be part of the record. Comments opposing the variance were heard from Bill Browder developer of the Entrada Subdivision; R.D. Carroll developer Velcar Subdivision; Leland Junge owner Lot #10 Spanish Trail Estates; Kevin Carroll owner Lot #1 Entrada Subdivision. Commissioner Bill Redd made a motion to exit the public hearings. Commissioner Mark Maryboy seconded. UNANIMOUS. Commissioner Bill Redd made a motion to approve the Monty Perkins variance; approve the setback changes in the zoning ordinance; approve the request for the Paul Redd zoning change, and denied the request for a variance on setbacks and minimum lot size for Jim Hurst. Commissioner Mark Maryboy seconded. UNANIMOUS. PERSONNEL/LILLIAN BAYLES & WALTER BIRD Payroll Change/Sheriff Dept A payroll change was presented for Marcia Shumway who has entered POST. The change is to move her from Step 63 at $1487 per month to Step 89 at $1683 per month effective June 1, 2001. Commissioner Bill Redd made a motion to approve the payroll change. The change is to move him from Step 89 at $1683 per month to Step 114 at $1896 per month effective May 1, 2001. Commissioner Bill Redd made a motion to approve the payroll change. Request to Hire/Monticello Senior Center Aid The name of Allison Hall was presented to be a part-time Monticello Senior Center Aide at Step 1 at $6.42 per hour effective May 29, 2001. Resignation/Duane Franklin Personnel Secretary Lillian Bayles reported that Duane Franklin, Road Department, resigned May 25, 2001. He has been accepted in to long term disability. PLANNER EDWARD SCHERICK'S REPORT BLM/Road Meeting Planner Scherick reported he met with the BLM and the Road committee. The BLM would like to 1)Engage the County in to a negotiation on roads; 2)Wants the County not to take any action within the official WSA's; 3)Inform the BLM on maintenance action on any County D Roads. The County disagrees with the requests. County Planner Edward Scherick feels that signs placed on county roads should be the responsibility of County. The BLM should be required to obtain an encroachment permit if they want to place a sign on the road. South Cottonwood Wash Planner Scherick, Road Supervisor Doug Pehrson, and South Road Foreman Lynn Laws will meet with the BIA and Ute Tribal officials on the South Cottonwood Road to see if they can resolve some of the problems there. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Cal Black Airport/Grant Agreement Administrative Assistant Rick Bailey presented the grant agreement for the Cal Black Airport for approval. The grant is to install weather reporting equipment. Commissioner Bill Redd made a motion to approve the contract. Commissioner Mark Maryboy seconded. UNANIMOUS. Aging Contract Administrative Assistant Rick Bailey presented a contract from the State Division of Aging and Adult Services for an aging contract in the amount of $46,864 to be used to conduct outreach on the Utah side of the Navajo Reservation. The purpose of identify, assist, and enroll eligible Native Americans Elders in a medicare savings program. Commissioner Bill Redd made a motion to approve the contract. Bid/Radios-Ambulances Administrative Assistant Rick Bailey presented bids for two Kenwood 110/100 watt, dual head, dual band VHF/UHF radios for the new ambulances from Dwyer's Communications at $2540.34 each; and from Spectrum Electronics for the same at $3172 each. One half to be paid by EMS grant. Commissioner Bill Redd made a motion to approve the bid from Dwyer's Communications. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Blanding Library-Copier A bid was presented for the Blanding Library for a Canon PC 920 Copier from Reliable Office Supplies at $499.98 with free delivery and from Quill for the same at $499.99 plus shipping. Ute Mountain Tribe/Intergovernmental Agreement-Roads Administrative Assistant Rick Bailey reported the County received a letter from the Ute Mountain Ute Tribe which states the Tribe plans to discontinue the intergovernmental agreement on several roads. Solar Battery Workshop/Cal Black Airport Administrative Assistant Rick Bailey reported the State of Utah is participating with the State of Arizona in a two day workshop on solar batteries to be held in Phoenix, AZ in October. Mr. Bailey is recommending the Cal Black Airport manager attend that workshop. Commissioner Bill Redd made a motion to approve the airport manager attend the workshop. UDOT/Devils Canyon Road Administrative Assistant Rick Bailey reported that UDOT has hired a consultant to review three proposals regarding the Devils Canyon Road realignment. They would like one of the County Commissioners to set on the advisory board. Commissioner Redd agreed to be on that board. Telecommunications Network Sharing There will be a Telecommunications Network Sharing meeting in Farmington, NM on June 27, 2001 at 10:00 A.M. at the Bureau of Land Management office. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy and Commissioner Bill Redd attended the WIR Conference in Hawaii last week. The Navajo Nation presented a resolution to build a 400 kilowatt power line across the Reservation. WIR supported the resolution which will be presented in Philadelphia. This week Commissioner Maryboy will be in Albuquerque, NM to attend the Infrastructure Finance Conference. COMMISSIONER BILL REDD'S REPORT Commissioner Redd and Commissioner Maryboy attended the WIR Conference in Hawaii last week. Commissioner Redd will be in the County most of the week. Commissioner Redd may go to Price on Friday. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the Navajo Revitalization meeting last week. Commissioner Lewis will be in the County the remainder of the week. Road meeting will be at 8:30 A.M. on June 4, 2001.
