SAN JUAN COUNTY COMMISSION MEETING FEBRUARY 5, 2002 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present; Ty Lewis, Chairman Bill Redd, Commissioner Melissa Banks, Administrative Services Manager Norman Johnson, County Clerk Absent: Mark Maryboy, Vice-Chairman Rick Bailey, Administrative Assistant A motion to approve the minutes of the January 28, 2002 meeting as amended was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioners Lewis and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Bluff Historical Projects/Corinne Roring Corinne Roring, Historical, updated the commission on the historical restoration projects in the Bluff area. Ms. Roring asked for additional consideration on the building permit for the Old Fort Meeting House. The Commissioners felt they had reduced the permit as low as possible since other non-profit organizations were required to pay for building permits. Hazel Lumes Funds/Corinne Roring Corinne Roring, Historical, advised the commission that there is still approximately $8,000 in the fund and requested the commission consider matching the money for the historical photograph scanning project in connection with the Monticello Library. The commissioners advised her the request would need to go through the next budget process and be worked in to the Library Board budgets. San Juan Water Conservancy District/Ferd Johnson Mr. Ferd Johnson presented a letter of resignation from Gene Stevenson, Bluff, where in he has resigned from the San Juan County Conservancy Board. The commission indicated the vacancy on the board would be advertised. Transient Room Tax/Phil Hall Phil Hall, Kelly McAndrews, and Heather Young, Nizhoni Bridges discussed with the commission the use of Transient Room Tax money by the San Juan County Community Development Council. Mr. Hall read a statement to the commission (attached as a part of the minutes) wherein he felt the council had committed to matching funds for the Midwinter Artists Series "Olympic Festival" in the amount of $3,000 as they have done in the past three years. Mr. Hall indicated that many agreement and contracts have been signed. On January 17, 2002 Mr. Hall was advised by Peggy Humphreys that the San Juan Development Council voted to not fund the Midwinter Artists Series this year. The commission attempted to contact Peggy Humphreys for comment but she was unavailable. Commissioner Redd expressed concern for funding of particular projects in perpetuity. However, if a firm commitment had been made it should be honored. Commissioner Lewis referred to the commission minutes of July 16, 2001 which indicated some community meetings were to be held concerning use of the Transient Room Tax. These meeting have not been held. Commissioner Lewis indicated they would visit with Ms. Humphreys as soon as she returns and get her side of the story. if a commitment had been made on the $3,00 then they would need to abide by that commitment. Utah State Tax Commission/Gidel & Platt Decision County Assessor Bruce Bunker advised the commission that the Tax Commission has denied the county request for reconsideration in the Ann Gidel & Kenneth M. Platt appeal Number 00-1332. The commission requested that Deputy County Attorney walter Bird write a letter to the Tax Commission indicating that, based on their decision, the county should be able to lower the assessment on all vacant property by the same percentage as they lowered the value on the subject property. Their decision would indicated the sales ratio process is flawed as every appeal that goes to them seems to be lowered and therefore their factoring orders must be flawed. Commissioner Redd said, "that there methodology of evaluation for Centrally Assessed, there methodology of evaluation on checking on local properties for factoring is all flawed by the historical concurrence of their own actions over time." The Commissioners requested the letter to the Tax Commission, under the freedom of information act, request a copy of all the appeals that have gone before them that they have agreed to lower and that they have denied both on centrally assess and on locally assessed as the County wants to determine what the trend of that is to see if their methodologies are sound. Tax Refund/Ann L. Gidel & Kenneth Platt Mr. Bunker presented the commission with the figures for the refund of taxes to Gidel & Platt for tax year 2000 in the amount of $385.79 and tax year 2001 in the amount of $373.96 for a total refund of $759.75. A motion to approve the refund was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioners Lewis and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. BLM Update/Nick Sandberg Nick Sandberg, Acting BLM Area Manager, updated the commission concerning on going BLM projects such as Mormon Crickets on Deer Flat, grazing permit renewals, Indian Creek Recreation Plan, Oil & Gas sales around the area. Mr. Sandberg stated the Area Manager selection committee met on January 29, 2002 and forwarded a recommendation to the State office. He hoped they would have an answer soon. The commissioners thanked Mr. Sandberg for his update and expressed appreciation for the job he is doing at the BLM. Water Task Force/Bureau of Reclamation Edward Tapaha, Navajo Liaison, reported to the commission that he attended a meeting on February 1, 2002 in Farmington, New Mexico with he Bureau of Reclamation Water Task Force. Those attending felt there should be more information produced by the Navajo Nation on water sources and projects. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Administrative Services Manager Melissa Banks reported on the following: UAC Legislative Committee The next Legislative Committee meeting will be held on February 7, 2002 in Salt Lake City. Risk Management Program Melissa Banks, Administrative Services Manager, gave the commissioners a copy of the changes in the 2002 Risk Management Program. Spanish Valley Round Table The next meeting of the Spanish Valley Round table will be held on Friday, February 8, 2002, at 10:00 A.M. Commissioner Lewis will be out of town. Commissioner Redd will attend. Federal Surplus Property Application The annual application for federal surplus property purchases was presented. The name of the persons authorized to make purchases in behalf of the county and the chairman signature on the application was requested. A motion to approve the application for the chairman signature was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioners Lewis and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Bid/Plasma Cutter-Road Dept Bids were presented for the North Road Department to purchase a Plasma Cutter from Snap-On Tools at $2895; Four Corners Welding at $2427.04; and US Air Weld Inc. at $2065.88. A motion to approve the bid from Plasma Cutter from US Air Weld Inc. was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioners Lewis and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. San Juan County Community Development/Peggy Humphreys At the request of the commission, Peggy Humphreys came to the meeting to address the questions relating to the $3,000 grant requested by Phil Hall, Bluff. Commissioner Lewis asked Ms. Humphreys if at any time there was a commitment to the Olympic $3,000 match. She answered, "not that I can remember." She indicated the usual process was to send a letter of approval so that it could be used for additional fund raising. Ms. Humhreys reviewed the grant process with the commission and indicated she felt that Mr. Hall may have assumed his project would be funded based on the previous four years of funding. She agreed to look through the grants and the minutes to see if any commitment had been made. Commissioner Lewis reiterated that if there was any kind of commitment, the county would need to uphold their end of the deal. The commissioners felt some type of procedure should be in place to not permanently fund an entity. Ms. Humphreys indicated she could send a letter and offer to advance funds from other Nizhoni Bridges projects if it would help the Olympic project. COMMISSIONER BILL REDD'S REPORT Commissioner Redd was in the Courthouse all last week. Commissioner Redd attended the Olympic Torch Ceremony in Monument Valley on Monday, February 4, 2002. Commissioner Redd will attend the CIB meeting in St. George on February 7, 2002. Commissioner Redd requested that Commissioner Lewis replace him at the AOG meeting on February 21, 2002. COMMISSIONER TY LEWIS' REPORT Last week Commissioner Redd attended the Legislative briefing in SLC and met with various Representatives and Senator Dmitrich on the Devils Canyon Road project. Commissioner Lewis will be out of town all week. He will not be at Commission meeting on monday.
