SAN JUAN COUNTY COMMISSION MEETING MARCH 11, 2002 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the March 4, 2002 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Beer License Renewal/Cow Canyon Trading Post County Clerk Norman Johnson presented for approval a beer license renewal for Cow Canyon Trading Post. Commissioner Bill Redd made a motion to approve the beer license renewal. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Glen Canyon National Recreation Katie Roberts and Bill Pierce, Glen Canyon National Recreation Area, reported on Recreation Area activities to the commission. Lead Scroll Katie Roberts stated that a lead scroll has been found in the Lee's Ferry area. It was found in an old building that is being stabilized. It has not been authenticated yet. Personal Watercraft In March 2000 the National Park Service issued a national rule on the prohibition of personal watercraft in most areas of the National Park system, except for 21 units. Glen Canyon was one of those units. A suit was brought against Glen Canyon Recreation Area because of who was allowed to have personal watercraft and who was not. Rainbow Bridge was closed in March of 2000 to personal watercraft use. This year it will be posted and no use enforcement of personal watercraft will be in affect. A draft EIS is in the process and should be out by May or June 2002 and open for comments. Roads A discussion was held concerning roads that are in the National Park area that the County claims. Hole in the Rock Trail, Parleys Canyon, Johns Canyon, Muley Point areas were mentioned. The County is interested in upgrading roads in the Muley Point area. Antelope Point Marina The Navajo Nation is currently concentrating all of its effort on Antelope Point. The developer has been selected but the contracts have not be awarded. There will be a concessions contract for the marina operation and the campground, resort, boat repair area will be a contract with the Navajo Nation. Bluff Election Ruling Kent Cantrell, representing three members of the Bluff Service Area Board of Trustees, read an information letter concerning the summary judgement of the election decision by Judge Manely. Effective today and upon receipt of this letter Sam Cantrell, Kathy Carson, and Gene Gruette resigned from their positions on the Board. The Commission expressed concern of this decision to resign. The Commission stated the board members would have to present this resignation to the Board because they are elected positions and not appointed by the Commission. Mr. Cantrell hopes that upon examination and further review of the summary judgement the Commission would be just as concerned as the board members mentioned are about the decision by the judge. The Commission suggested they appeal the decision. Commissioner Maryboy, Commissioner representing District #3, stated that it is unfortunate in what occurred. He hopes the individuals would re-consider their resignation because Bluff is a town that needs leadership and has projects that need to be worked on. There has been progress made in Bluff. Regardless of what has happened the board members should think about it and talk about it and in the end things will work out. There were a number of people from Bluff present. Jean Brundage, a Bluff resident, stated that Kent, Gene, and Kathy have been outstanding, diligent, hard working members of the board and will be sorry to see them leave. BLM Update Nick Sandberg, Acting Field Office Manager, reported that the person offered the Field Office Manager position had declined. The BLM is re-advertising with a closing date of March 18, 2002. Phil Guzon, Outdoor Recreation Planner, has been transferred to Grand Junction. A new Planner and Environmental Coordinator position is also open. Mormon Cricket Environmental Assessment Mr. Sanberg reported that the comment period on the proposed action for control of Mormon Crickets on Deer Flat closed last friday. One comment from the Division of Wildlife Resources and one from the landowner affected have been received. The decision will be signed this week. Oil & Gas The oil & gas sale that was to take place on March 19, 2002 has been protested by Southern Utah Wilderness Alliance and Natural Resources Defense Council. This sale is state wide and involves the Kanab, Fillmore, Moab, San Juan, and Salt Lake field offices. Wilderness & Inventory Handbook Mr. Sandberg reported that the BLM Wilderness & Inventory Handbook put out in January 2001 allows the BLM to consider new information that may or may not be different from previous inventories that the BLM has conducted. Abandoned Mine Project Survey Nick Sandberg reported on the South Cottonwood Road Survey in connection with the Abandoned Mine Land Project. There are Ute Trust Allotments in that area. The BLM has a cost share agreement with the County to purchase easement right of way on parts of those Trust parcels that the South Cottonwood Road passes through. Because it is not known where the South Cottonwood County B road intersects those Trust lease parcels the BLM will be required to conduct a survey of the South Cottonwood road. The BLM Cadastral Survey out of Colorado will conduct the survey at a cost of approximately $20,000. Mr. Sandberg asked if the County would be willing to participate in the cost of the survey. He stated that the BLM would like the Forest Service to also participate. Commissioner Lewis asked if he would find out if the County could participate in labor or in-kind matches. Commissioner Lewis asked that Planner Scherick and Deputy Attorney Walter Bird look at the proposal before a decision is made. Kenneth Maryboy/Mexican Water Chapter Kenneth Maryboy presented an update for the Mexican Water Chapter. He stated the Chapter has a Resolution passed concerning County Road #445 which is a school bus route. The Commission stated that the Road Department is in the process of putting white shale on Road #414. If they have further problems they should contact the South Road Department. Commissioner Maryboy reported he received a call from Mexican Water Chapter. They are interested in purchasing a grader from the County. Mr. Bailey stated he has sent a letter to Utah Navajo Trust stating the County has three graders they are wanting to replace. The Chapters can contact the Trust for their request. UDOT The Commission discussed with Cleston Laws, UDOT, issues in connection with the Devils Canyon Road project. Also discussed was fencing projects along the roads near Bluff and Mexican Hat, and Montezuma Creek to Aneth. The problem is finding financing for the projects. UDOT does have money designated for these projects. The estimated cost is $1.00 per foot with the County inmates to conduct the installation. Commissioner Lewis suggested that matching money be found to help with the project. Commissioner Maryboy requested that UDOT meet with the Aneth Chapter to discuss an idea of placing a barrier in front of the Chapter House to keep vehicles away from the building. Public Hearing/Abandoned Alleyway-Cottonwood Addition Commissioner Bill Redd made a motion to convene in to a public hearing to hear comments on abandonment of an alleyway in the Cottonwood Addition, Block 32, Bluff. Commissioner Mark Maryboy seconded. There is a written request from Arthur & Linda Moore; Randall Bushore, and Nancy Maryboy to consider abandoning the alleyway. There is proposal to divide the alleyway in half and give half to each property owner. Steve and Mary Lou Kosanke commented on issues concerning their property in Bluff. Bluff Water District is concerned about access because of the possibility of a secondary water system. Commissioner Bill Redd made a motion to close the hearing. Commissioner Maryboy seconded. Commissioners Lewis, Maryboy and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. The Commission will contact the County Attorney for an opinion and see what the alternatives are before a decision is made. PLANNER EDWARD SCHERICK'S REPORT Emergency Drought Declaration Planner Scherick presented the County Emergency Drought Declaration to the commission for review and approval. Commissioner Bill Redd made a motion to approve the declaration. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Forest Roads There will be a meeting on March 18, 2002 at 8:30 A.M. with the county road committee and the Forest Service to discuss forest roads. PERSONNEL DEPARTMENT REPORT UAC Employee Training Personnel Secretary Lillian Bayles stated there will be an UAC Employee training on March 12-13, 2002 for all county employees on Drug & Alcohol and Harassment Training. Personnel Policy Deputy County Attorney Walter Bird reported comments have been received back from the department heads concerning the County Personnel Policy. The Commission suggested the personnel policy be presented to the employees at the employee training and it will be approved next week in Commission meeting. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permit A building permit was presented for Larry Dominy for a new home in Spanish Valley with attached garage. Commissioner Bill Redd made a motion to approve the building permit. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Kiln Administrative Assistant Rick Bailey reported a group of senior citizens in Blanding formed a non-prophet organization a bought a kiln. It was given to the Senior Center but is no longer being used. Sandra Asbury, Transitions, requested the kiln be donated to her group. The Commission asked that Sandra submit a written request. Blue Cross Blue Shield Insurance Administrative Assistant Rick Bailey reported that a representative for Blue Cross Blue Shield Insurance will be here on March 18, 2002 at noon for a work session. Road Department/Graders The Road Department has three graders they would like to surplus and requested permission to seek bids on two graders and one front end loader. The Commissioner agreed they could seek bids. Bid/Ateco A bid to purchase an ATECO attachment for a road grader was presented for the Road Department from Mountain West Equipment at $10,700. Commissioner Bill Redd made a motion to approve the bid. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Surplus Tires Administrative Assistant Rick Bailey suggested that advertisement be made for a surplus tire sale at the fairground. A silent bid will be held. The Commission agreed. UAC Conference The annual UAC Management Conference will be held on April 10, 2002 in Park City. As part of that meeting the by-laws are proposed to be changed. The County is required to have a resolution appointing a representative and alternate as representatives for San Juan County. Commissioner Bill Redd made a motion appointing Administrative Assistant Rick Bailey to be the representative and Commissioner Bill Redd as the alternate. Commissioner Mark Maryboy seconded. Schedule Administrative Assistant Rick Bailey will be in Salt Lake City on March 12, 2002 to attend an Aging funding source committee meeting. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy stated he would take the Drought Resolution to the Navajo Revitalization meeting so they can use it to assist the Chapters in obtaining drought related assistance. Commissioner Maryboy attended the ribbon cutting ceremony for the new Visitor Center in Blanding this morning. He stated that the City of Blanding expressed their appreciation for the $100,000 the County contributed to the project. Commissioner Maryboy was in Washington DC last week. Most of the issues were concerned with home security. It was suggested that local areas concentrate on health, financial & mental health of its citizens. Commissioner Maryboy met with Senator Hatch, Senator Bennett, Congressman Cannon and Congressman Mathison. A discussion was held concerning trash on the Reservation. Hopefully IHS laws can be amended to include funding for solid waste and trash on the Reservation. Commissioner Maryboy stated that Congressman Mathison has agreed to introduce legislation to amend the law. Commissioner Maryboy stated that Mexican Water Chapter is interested in purchasing a used grader if one is available. Commissioner Maryboy will attend the Law Enforcement meeting that will be held at the Courthouse on March 12, 2002 at 10:00 A.M. COMMISSIONER BILL REDD'S REPORT Commissioner Redd attended a Library Board meeting and met with Dr. Cameron, San Juan School District Superintendent. It was decided the people at the school in Monument Valley would contact Administrative Assistant Rick Bailey to look for funding sources. Commissioner Redd gave a lecture on government at CEU-Blanding on March 6, 2002. Commissioner Redd attended the CIB meeting in Moab on March 7, 2002. On Saturday, March 9, 2002, Commissioner Redd attended a meeting in Moab concerning draining of Lake Powell. Commissioner Redd will be out of the County all week. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the San Juan County Mental Health/Substance Abuse Board meeting on March 4, 2002 in the courthouse. Commissioner Lewis attended the sportsman meeting at the National Guard Armory in Blanding on March 8, 2002. Commissioner Lewis will attend the Navajo Revitalization meeting in Blanding today at 1:00 P.M. Commissioner Lewis has been asked to speak at a Farm Bureau meeting on March 14, 2002. He stated the Chapter has a Resolution passed concerning County Road #445 which is a school bus route. The Commission stated that the Road Department is in the process of putting white shale on Road #414. If they have further problems they should contact the South Road Department. Commissioner Maryboy reported he received a call from Mexican Water Chapter. They are interested in purchasing a grader from the County. Mr. Bailey stated he has sent a letter to Utah Navajo Trust stating the County has three graders they are wanting to replace. The Chapters can contact the Trust for their request. UDOT The Commission discussed with Cleston Laws, UDOT, issues in connection with the Devils Canyon Road project. Also discussed was fencing projects along the roads near Bluff and Mexican Hat, and Montezuma Creek to Aneth. The problem is finding financing for the projects. UDOT does have money designated for these projects. The estimated cost is $1.00 per foot with the County inmates to conduct the installation. Commissioner Lewis suggested that matching money be found to help with the project. Commissioner Maryboy requested that UDOT meet with the Aneth Chapter to discuss an idea of placing a barrier in front of the Chapter House to keep vehicles away from the building. Public Hearing/Abandoned Alleyway-Cottonwood Addition Commissioner Bill Redd made a motion to convene in to a public hearing to hear comments on abandonment of an alleyway in the Cottonwood Addition, Block 32, Bluff. Commissioner Mark Maryboy seconded. There is a written request from Arthur & Linda Moore; Randall Bushore, and Nancy Maryboy to consider abandoning the alleyway. There is proposal to divide the alleyway in half and give half to each property owner. Steve and Mary Lou Kosanke commented on issues concerning their property in Bluff. Bluff Water District is concerned about access because of the possibility of a secondary water system. Commissioner Bill Redd made a motion to close the hearing. Commissioner Maryboy seconded. Commissioners Lewis, Maryboy and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. The Commission will contact the County Attorney for an opinion and see what the alternatives are before a decision is made. PLANNER EDWARD SCHERICK'S REPORT Emergency Drought Declaration Planner Scherick presented the County Emergency Drought Declaration to the commission for review and approval. Commissioner Lewis declared the motion carried. Forest Roads There will be a meeting on March 18, 2002 at 8:30 A.M. with the county road committee and the Forest Service to discuss forest roads. PERSONNEL DEPARTMENT REPORT UAC Employee Training Personnel Secretary Lillian Bayles stated there will be an UAC Employee training on March 12-13, 2002 for all county employees on Drug & Alcohol and Harassment Training. Personnel Policy Deputy County Attorney Walter Bird reported comments have been received back from the department heads concerning the County Personnel Policy. The Commission suggested the personnel policy be presented to the employees at the employee training and it will be approved next week in Commission meeting. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permit A building permit was presented for Larry Dominy for a new home in Spanish Valley with attached garage. Commissioner Lewis declared the motion carried. Kiln Administrative Assistant Rick Bailey reported a group of senior citizens in Blanding formed a non-prophet organization a bought a kiln. It was given to the Senior Center but is no longer being used. Sandra Asbury, Transitions, requested the kiln be donated to her group. The Commission asked that Sandra submit a written request. Blue Cross Blue Shield Insurance Administrative Assistant Rick Bailey reported that a representative for Blue Cross Blue Shield Insurance will be here on March 18, 2002 at noon for a work session. Road Department/Graders The Road Department has three graders they would like to surplus and requested permission to seek bids on two graders and one front end loader. The Commissioner agreed they could seek bids. Bid/Ateco A bid to purchase an ATECO attachment for a road grader was presented for the Road Department from Mountain West Equipment at $10,700. Commissioner Lewis declared the motion carried. Surplus Tires Administrative Assistant Rick Bailey suggested that advertisement be made for a surplus tire sale at the fairground. A silent bid will be held. The Commission agreed. UAC Conference The annual UAC Management Conference will be held on April 10, 2002 in Park City. As part of that meeting the by-laws are proposed to be changed. The County is required to have a resolution appointing a representative and alternate as representatives for San Juan County. Schedule Administrative Assistant Rick Bailey will be in Salt Lake City on March 12, 2002 to attend an Aging funding source committee meeting. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy stated he would take the Drought Resolution to the Navajo Revitalization meeting so they can use it to assist the Chapters in obtaining drought related assistance. Commissioner Maryboy attended the ribbon cutting ceremony for the new Visitor Center in Blanding this morning. He stated that the City of Blanding expressed their appreciation for the $100,000 the County contributed to the project. Commissioner Maryboy was in Washington DC last week. Most of the issues were concerned with home security. It was suggested that local areas concentrate on health, financial & mental health of its citizens. Commissioner Maryboy met with Senator Hatch, Senator Bennett, Congressman Cannon and Congressman Mathison. A discussion was held concerning trash on the Reservation. Hopefully IHS laws can be amended to include funding for solid waste and trash on the Reservation. Commissioner Maryboy stated that Congressman Mathison has agreed to introduce legislation to amend the law. Commissioner Maryboy stated that Mexican Water Chapter is interested in purchasing a used grader if one is available. Commissioner Maryboy will attend the Law Enforcement meeting that will be held at the Courthouse on March 12, 2002 at 10:00 A.M. COMMISSIONER BILL REDD'S REPORT Commissioner Redd attended a Library Board meeting and met with Dr. Cameron, San Juan School District Superintendent. It was decided the people at the school in Monument Valley would contact Administrative Assistant Rick Bailey to look for funding sources. Commissioner Redd gave a lecture on government at CEU-Blanding on March 6, 2002. Commissioner Redd attended the CIB meeting in Moab on March 7, 2002. On Saturday, March 9, 2002, Commissioner Redd attended a meeting in Moab concerning draining of Lake Powell. Commissioner Redd will be out of the County all week. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the San Juan County Mental Health/Substance Abuse Board meeting on March 4, 2002 in the courthouse.
