SAN JUAN COUNTY COMMISSION MEETING MAY 6, 2002 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the April 22, 2002 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Ty Lewis. Commissioner Maryboy was not present at the time the action was taken. Commissioners Lewis and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Edge of the Cedars/Debra Stevenson Debra Stevenson, Manager Edge of the Cedars Museum, thanked the County for their support of the museum. The Blanding and Monticello Visitor Centers have done a great job with sending visitors to the museum this year. The new road is also finished. The Edge of the Cedars Management Plan is almost completed. The draft should be available sometime this summer. San Juan Chapter/Sportsman for Fish & Wildlife Lyle Bayles, representing the Sportsman for Fish & Wildlife, is requesting a letter of support from the County regarding a proposal being presented to RAC to extend the mountain lion hunting season to a year long period. Administrative Assistant Rick Bailey will write the letter. Fixed Asset Parameters Norman Johnson, County Clerk and John Fellmeth, ITS, discussed with the commission concerns with County assets. With the implementation of GASB-34 next year a request was made to set the fixed asset threshold at a minimum value of $5000. Commissioner Bill Redd made a motion that the fixed asset threshold be set at $5000. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Drug Task Force Grant/Approval & Payroll Change County Sheriff Mike Lacy presented information concerning the Drug Task Force grant that has been managed by Grand County the last several years. Sheriff Lacy reported that San Juan County will be managing the grant this year. He requested the commission approve that Lyle Bayles be moved to the sergeant slot and his salary be moved from Step 159 at $2432 per month to Step 181 at $2697 per month to administer the Drug Task Force Grant shared with Grand County effective May 6, 2002. Commissioner Bill Redd made a motion to approve the grant and approved the increase in salary for Lyle Bayles for the duration of the management of the grant. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Payroll Change/Sheriff Department A Payroll change was presented for John Laws to be moved from Step 125 at $2071 per month to Step 136 at $2181 per month effective May 6, 2002. Commissioner Bill Redd made a motion to approve the payroll change. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. A payroll change was presented for Jerald Bradford to be moved from Step 126 at $2083 per month to Step 137 at $2191 per month effective May 6, 2002. Commissioner Bill Redd made a motion to approve the payroll change. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Request to Hire/Sheriff Department A request was presented to hire Dominic LaGiglia as a full-time dispatcher in the Sheriff office at Step 63 at $1555 per month effective May 20, 2002. He will replace Ben Crane who resigned. Commissioner Bill Redd made a motion to approve the hire. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. San Juan County Mental Health Area Service Plan Dan Rogers, San Juan Counseling, presented the San Juan County Mental Health Area Service Plan for approval. Commissioner Bill Redd made a motion to approve and sign the plan based on the fact that the County will send a letter along with signature indicating the problems and displeasures of the County concerning distance and population factors that don't allow for extra monies. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Bluff Special Service Area/Storm Water & Transfer Station Patrick McDermott, Lisa Doran, Sarah Martin and Kelly McAndrews, representing Bluff Special Service Area, spoke with the commission concerning storm water problems in Bluff. They requested assistance from the County to conduct a feasibility study for storm water management problems. Commissioner Bill Redd suggested they put out a Request for Proposal for engineering on drainage problems and get an estimate of cost to conduct a plan. The Service Area could then go to the CIB for matching money and also see if the other half of the funding could come from the Community Development Department. Commissioner Maryboy suggested they submit a proposal and budget to the County on anything that is not funded as matching funds. Re-Cycling Project Bluff is interested in re-cycling waste products and sending them to the Canyonlands Recycling Center in Moab. The Bluff Service Area requested permission to park a trailer at the Bluff Transfer Station for specific purposes. The Service Area will be responsible for segregation management & transportation of the re- cycled items. They have people who have agreed to commit their time to this project. The County will draw up a contract indicating parameters and liability issues. Bid/Road Department-Exhaust Fan Bids were presented for a 30" exhaust fan for the Road Department from Grainger at $474; McMaster at $531.50; and from Fairmont Supply at $525 plus freight. Commissioner Bill Redd made a motion to approve the bid from Grainger. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Forest Service/Forest Plan Revision Elaine Zierth, Manti/LaSal Forest Supervisor and Glen Cassamassa, Monticello Ranger District, reported the Forest Service is required to revise their Forest Plan every fifteen years. They have started to work on this revision. They presented the Commissioners with a proposed agreement. It was agreed that the proposed agreement was a good idea. The Forest Service would like to improve on public involvement and working more closely with the counties in a government to government relationship in preparing the plan. This would allow the Forest Service to work up front with the counties on issues before going to the public with the plan. The County has a few changes to incorporate in to the agreement. Planner Edward Scherick and Glen Cassamassa, Forest Service, were assigned to coordinate the changes and report back to the Commissioners with those changes. The plan will take approximately four years to complete. Road Inventory Team The Road Inventory Team had some questions concerning the on going road inventory. Road closures implemented in the Dead Goose Area on Elk Ridge were questioned. The reason for the questions is that the County could not track through the NEPA documentation and decision record the implementation of several road closures in the area. The Forest Service stated that unclassified roads are normally closed out at the time of reclamation of timber sale areas, which in this case, was the method used to close what they deemed as unclassified roads. The Forest Service indicated they would try to keep the County more informed in the future on which roads and trails will be closed using this methodology. Gail Redin/Tax Exemption Gail Redin, Grand Junction, a member of the Coast Guard Auxiliary requested exemption from property tax on a boat she uses for voluntary search and rescue services on Lake Powell. She was denied her request because she couldn't prove her reasons for exemption. The State Code does not exempt taxes on boats based on Coast Guard Auxiliary participation. She was instructed she could appeal to the State is she so desired. PERSONNEL DEPARTMENT REPORT Request to Hire/Weed Dept Deputy County Attorney Walter Bird presented the name of Marshall Martinez to be hired as a temporary full-time weed sprayer at Step 35 at $7.90 per hour effective May 6, 2002. Assessor Office/Hours Extended The Assessors office will be extending their office hours beginning June 3 through August 2002 to meet the need of customers. The hours will be 7:30 A.M. to 6:00 P.M. with the employees taking a half hour lunch. No overtime will be involved. PLANNER EDWARD SCHERICK'S REPORT ATV Plan Planner Edward Scherick reported he has the draft County ATV Plan completed. He is proposing to hold public meetings with Blanding and Monticello Cities along with SULU and an open house meeting at the courthouse. The commissioners agreed on the idea. Drought Meeting Planner Scherick reported that a drought meeting with all entities involved has been set for the afternoon of May 13, 2002. San Juan Forum The San Juan Forum meeting will be held on May 17, 2002 at 11:00 A.M. in the San Juan County Courthouse . ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits Building permits were presented for approval for the following: James Haller for an addition on Boulder Road; Thomas Moreau for a garage in Spanish Valley; Tony Eyman for an addition to home in Spanish Valley; Albert Dyer for a cabin at the Blue Mountain Guest Ranch; Thomas May for a sun room addition in Blanding; and Aubrey Patterson for a new home on Dodge Point. Commissioner Bill Redd made a motion to approve the building permits. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Navajo Revitalization The Navajo Revitalization meeting is scheduled for May 20, 2002 at 1:00 P.M. Mark will not be in attendance. Historical Nomination/St. Christophers Mission The County received a letter from the Utah State Historical Society stating that St. Christophers Episcopal Mission, Bluff, has been nominated to be placed on the national register of historic places. The County will send of letter of support. Fencing Issue The County received a letter concerning a meeting held on the fencing issues on State Highway 163. The County has been asked to consider purchasing six cattleguard and gates on the state highway. The County will abide by the County fencing ordinance which states that the cattle need to be fenced in and therefore the State is responsible for the cattleguard if they don't want the cattle on the highway. Navajo Health Administrative Assistant Rick Bailey and Administrative Services Manager Melissa Banks attended a meeting with Navajo Health in Window Rock last week. They talked about services for the senior citizens on the Reservation. The Navajo Nation agreed to under take a contract to provide those services. It was determined that Native Americans who qualify for medicaid and the services being provided by a Native American organization would be 100% reimbursable. Administrative costs could possibly be provided by that same type of thing. Drought Administrative Assistant Rick Bailey reported on drought issues. The governor has been asked to enlarge the drought declaration beyond agriculture. Blanding City has also issued a drought declaration. Emergency Water Sources Administrative Assistant Rick Bailey requested that the commission allocate $50,000 of emergency funding to be used as leverage in obtaining funding for wells, water storage, and other drought issues. Commissioner Bill Redd made a motion that $50,000 of emergency funding be allocated to be used as a match with Bureau of Reclamation and other funding for drilling of wells and emergency water resources. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Subdivision Plat/Kelling A subdivision plat was presented for approval for Mitch Kelling to subdivide one lot in to two lots in the Kelling Subdivision. Administrative Assistant Rick Bailey recommended it be approved. Commissioner Bill Redd made a motion to approve the addition to the Kelling Subdivision. Commissioner Mark Maryboy seconded. Commissioners Lewis, Maryboy, and Redd voted in favor. None opposed. Commissioner Lewis declared the motion carried. Risk Management Conference Administrative Assistant Rick Bailey will be attending a Risk Management Conference next week and will not be in attendance at commission meeting on May 13, 2002. COMMISSIONER MARK MARYBOY'S REPORT State School Board Commissioner Maryboy reported he was interviewed by the State School Board selection committee. He received a letter stating he was not selected to the position. Trash Pickup Commissioner Maryboy stated that in the Red Mesa and Aneth area people have been picking up trash along the road. The question was raised as to whether or not the County could pick up the bags of trash and take them to the landfill. Commissioner Redd suggested the prisoners could pick up the collected trash. Fuel Excise Tax Two years ago the Navajo Nation passed a fuel excise tax. It generates ten million dollars a year. The money should be in affect by July. They Nation would like to use the money to gravel most of the roads on the Reservation and join forces with the County on the school bus route graveling projects. Health Service The Navajo Nation Council approved the resolution to contract twenty million dollars to Utah Health System. The council amended the resolution adding Winslow and Tuba City health facilities. The resolution was signed last week. Water Rights Commissioner Maryboy reported that the water rights adjudication claim is pending before the council. A committee will be studying that issue. Commission Meeting Commissioner Maryboy will not be in attendance at the May 20, 2002 commission meeting. COMMISSIONER BILL REDD'S REPORT Commissioner Redd attended the CIB meeting in Salt Lake City last week. Commissioner Redd also met with the Road Lawsuit lawyers. Commissioner Redd will be in the courthouse this week. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis met with Senator Bennett's staff concerning water projects on April 17, 2002. Commissioner Lewis was in Washington, D.C. on April 22-26, 2002. He met with the congressional offices and Bureau of Reclamation concerning obtaining money for well drilling and see if a reclamation project would be feasible in the County. Commissioner Bill Redd made a motion to approve paying mileage and meals to Salt Lake for Commissioner Lewis. The remainder of the trip to Washington D.C. was paid by another organization.
