SAN JUAN COUNTY COMMISSION MEETING AUGUST 19, 2002 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Commissioner Bill Redd, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the August 12, 2002 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. None opposed. Commissioner Ty Lewis declared the motion carried. San Juan County Fair Anna Thayn, County Fair Coordinator, reported on the County Fair. She reported on the overall participation and activities. She stated the rodeo was the best it has been in several years and has received many positive compliments on the physical changes at the fairgrounds. The commission complimented her for a job well done. She asked that the commission consider no longer renting the fair building in the future because of the permanent display in the exhibit building that could be damaged. A discussion was also held concerning insurance coverage, the sound system, rodeo grounds, and dances and receptions. The commission suggested she develop a policy concerning the fairgrounds and buildings. Southern Navajo Fair The Southern Navajo Fair will be held in Bluff on August 28-31, 2002. Southern Navajo Fair Funding Commissioner Maryboy reported he had spoken with Keith Barnett, Utah Navajo Revitalization Board, concerning $20,000 funding needed for the Southern Navajo Fair. There will be a telephone conference call on August 26, 2002 with Keith Barnett. Advancing money from the Road Funds and several other options were discussed. Reimbursement of funds from the Revitalization Board was also discussed. Commissioner Mark Maryboy made a motion to give the Southern Fair $20,000 contingent on Utah Navajo Revitalization approving a refund in a conference call that will be held on August 26, 2002. Commissioner Bill Redd seconded. None opposed. Commissioner Ty Lewis declared the motion carried. BLM Field Office Manager/Patrick Madigan Nick Sandberg, BLM, re- introduced Patrick Madigan, Monticello Field Office Manager, to the commission. He begins his new assignment today. Sheriff Department/County Airplane Sheriff Mike Lacy requested permission to sell the County airplane and purchase a smaller, single engine plane. The Commission authorized him to look for a new airplane. Public Hearing/Variance-Paul Morris At 11:45 A.M. Commissioner Bill Redd made a motion to convene in to a public hearing to hear comments on a variance request for Paul Morris to build two rental cabins on one 4 acre parcel on the LaSal Loop Road. Commissioner Ty Lewis seconded. Comments were heard. Commissioner Bill Redd made a motion to close the public hearing. Commissioner Mark Maryboy seconded. None opposed. Commissioner Lewis declared the motion carried. Commissioner Bill Redd made a motion to approve the variance request. Commissioner Mark Maryboy seconded. None opposed. PLANNER EDWARD SCHERICK'S REPORT LaSal Timber Mill Planner Scherick reported that a meeting will be held at the LaSal Timber Mill on August 21, 2002 to determine the future of the mill. It is one of the largest employers in the County. Attending will be representatives from various levels of State government, federal government and forest service, RDA, bankers, and potential buyers. Cooley Gulch/Easement Planner Scherick presented for approval an easement for Cooley Gulch. The Forest Service can then begin their NEPA process. Commissioner Bill Redd made a motion to sign the Cooley Gulch easement. Commissioner Ty Lewis seconded. None opposed. Commissioner Maryboy was not present at the time the action was taken. Commissioner Lewis declared the motion carried. San Juan Forum Planner Scherick reported that he and Commissioner Lewis attended the San Juan Forum meeting in Shiprock last week. Planner Scherick feels that some good things have come from this forum and that it should continue to function. There have been some leadership changes at Fort Lewis College in Durango, CO and San Juan College in Famington, NM. Planner Scherick stated that a bigger contribution needs to come from participants and board of directors. The Forum is producing a historical document of accomplishments. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Adult Probation & Parole/Contract Administrative Assistant Rick Bailey presented five year lease contract in the amount of $1,617 per year for the Adult Probation and Parole for approval. Commissioner Bill Redd made a motion to approve the contract. Commissioner Mark Maryboy seconded. None opposed. Commissioner Ty Lewis declared the motion carried. Cal Black Airport/FAA Contract Amendment-Weather Monitoring Equipment Administrative Assistant Rick Bailey presented the FAA grant agreement for installation of the Weather Reporting Equipment at the Cal Black Memorial Airport in the amount of $125,907 for approval. Commissioner Bill Redd made a motion to approve the contract agreement. Commissioner Mark Maryboy seconded. None opposed. Commissioner Lewis declared the motion carried. Utah Navajo Revitalization Fund Administrative Assistant Rick Bailey presented the following contracts between the Department of Community & Economic and Navajo Revitalization Fund Board for approval as follows: 1) One third participation in the Monument Valley Fire Truck in the amount of $63,318; 2) Amendment of $10,000 for funding for the Montezuma Creek Fire Station building; 3) Montezuma Creek & Monument Valley Fire Tenders in the amount of $48,200; 4) $150,000 matching County funding to Chapters. Commissioner Bill Redd made a motion to approve the contracts. Commissioner Mark Maryboy seconded. None opposed. Commissioner Lewis declared the motion carried. Bid/Water Storage Tank-Landfill Bids were presented for one 10,000 gallon single wall fibre glass non-potable tank for the landfill from West Tech at $5,642.18; Tanks Direct at $16,480.31; and Darco at $8,804. Commissioner Bill Redd made a motion to approve the West Tech bid. Commissioner Mark Maryboy seconded. None opposed. Commissioner Ty Lewis declared the motion carried. M-4 Subdivision Amendment #4-Pack Creek Administrative Assistant Rick Bailey presented Amendment #4 to the M-4 Subdivision at Pack Creek for approval. The requirements have been met. Commissioner Bill Redd made a motion to approve the amendment to the subdivision. Commissioner Mark Maryboy seconded. None opposed. Commissioner Ty Lewis declared the motion carried. HazMat Administrative Assistant Rick Bailey reported on HazMat responses for an underground storage tank leak and a truck tank spill in Lisbon Valley. Meetings Administrative Assistant Rick Bailey will attend a State Emergency Response meeting on August 20, 2002 and a Pre-Bid Bond meeting on August 21, 2002 in Salt Lake City. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy reported that the BIA school at Aneth is being renovated because of a problem with asbestos. He is working with the BIA to obtain modular units for classrooms. Commissioner Maryboy met with Mexican Water Chapter. State Road 191 that runs from Bluff to Mexican Water needs to be chip sealed. He requested the County help the Chapter with a supporting letter to be sent to UDOT. San Juan Health Service District/Board Appointment Commissioner Maryboy stated he has been approached by some Blanding community members who are concerned about the recent San Juan Health Services Board appointment. The community members would like to know if the motion can be recalled to allow others to be considered for the position. Lynn Stevens stated that concerns have been expressed to him also. Commissioner Redd stated that he is not inclined to recall the motion. Administrative Assistant Rick Bailey will report back with expiration dates of board members. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd attended the UAC Public Lands Committee Leadership meeting. They discussed litigation money that the governor would like to use for the Emery County Monument. Commissioner Redd is not in favor of that proposal. Commissioner Redd will attend the LaSal Timber Mill meeting on August 21, 2002. Commissioner Redd will be in the county offices this week. COMMISSIONER TY LEWIS REPORT Commissioner Lewis attend the Drought meeting on August 12, 2002. He attended the San Juan Mental Health/Substance Abuse Board meeting on August 12, 2002. Commissioner Lewis and Planner Scherick attended the San Juan Forum meeting held in Shiprock on August 13, 2002. Commissioner Lewis attend the opening ceremony for the San Juan County Fair on August 14, 2002. The Board of Equalization Hearing will be held this after from 1:00 - 5:00 P.M. Commissioner Lewis will attend the LaSal Timber Mill meeting on August 21, 2002. There is a State Broad Band Access meeting on August 23, 2002 at 10:00 A.M. here in the courthouse.
