SAN JUAN COUNTY COMMISSION MEETING FEBRUARY 24, 2003 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens, Chairman Manuel Morgan, Vice-Chairman Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk Absent: Ty Lewis, Commissioner A motion to approve the minutes of the February 18, 2003 meeting as amended was made by Commissioner Manuel Morgan and seconded by Commissioner Lynn Stevens. None opposed. Commissioner Lynn Stevens declared the motion carried. Open Time Commissioner Lynn Stevens reported to the audience that commission meeting open time will be moved to the end of commission meeting beginning March 3, 2003. This will allow for those with scheduled appointment to meet their commitments. San Juan County Substance Abuse/Mental Health/Contract Amendments Dan Rogers, San Juan Counseling, presented Amendment #2 to the San Juan County Substance Abuse/Mental Health contract for approval. This amendment adds $86,750 in Federal Block Grant funds for a new contract total of $363,637. Commissioner Manuel Morgan made a motion to approve the contract amendment. Commissioner Lynn Stevens seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Out-of-State Travel/Sheriff Department Sheriff Mike Lacy presented a request to attend the National Sheriff's Conference in Nashville, TN in June 2003. Commissioner Manuel Morgan made a motion to approve the out-of-state travel. Commissioner Lynn Stevens seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Inmate Sexual Offender Evaluation Equipment Sheriff Mike Lacy presented a bid for inmate evaluation equipment from Behavior Technology, Inc. in the amount of $8,995 for approval. Commissioner Manuel Morgan made a motion to approve the bid. Commissioner Lynn Stevens seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Beer License Renewals County Clerk Norman Johnson presented two beer license renewals for approval for the Dairy Cafe in Bluff and for Valle's T.P. in Mexican Hat. They have met the requirements and have the Sheriff office approval. Commissioner Manuel Morgan made a motion to approve the beer license renewals. Commissioner Lynn Stevens seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Utah Navajo Health System/Letter of Support Nettie Prack, Montezuma Clinic, presented information concerning an Expanded Medical Capacity grant request. Utah Navajo Health System was awarded Community Health Status in August 2001. Community Health Centers are a program administered under the Health Resource Services Administration of Health and Human Services. It is specifically set up to assist un- served and under served populations who cannot afford to pay. Because Utah Navajo Health System has seen such an increase in the need for services they are applying for Expanded Medical Capacity funding. The request will be between $400,000 and $600,000 for professional and support staff, and equipment for the first year. The application will be submitted March 3, 2003. The Expanded Medical Capacity will allow for increased capacity at the facilities to include adding provider services and extended hours in the present facilities. They are projecting an increase of 3,000 to 3,500 people to serve in the next two years. Ms. Prack requested a letter of support from the County to be attached to the grant application. Commissioner Lynn Stevens motioned to pass the chair to Commissioner Manuel Morgan. Commissioner Manuel Morgan seconded. Commissioner Lynn Stevens made a motion that the County write a letter of support to the Utah Navajo Health System for the grant request. Commissioner Manuel Morgan seconded. None opposed. Commissioner Morgan declared the motion carried. Donna Singer, Montezuma Creek Clinic, reported on a second request for a letter of support. As a Community Health Center they have the opportunity each year to apply for expansion for a new access site. Navajo Mountain, Utah is significantly disadvantaged when it comes to health care delivery. Currently it receives services from Indian Health Services a mid level, half a day, twice a week if they have water in the old clinic. In emergency situations they have to travel to Page, Arizona. Through the Community Health Center process the Utah Navajo Health Systems can apply for a grant to provide health care in that community which would include money for operating expenses and start up equipment. There is a proposal before the Utah Navajo Trust and Navajo Revitalization Fund to match monies to place a modular unit and two staff housing units at Navajo Mountain. Ms. Singer requested a letter of support for Utah Navajo Health Systems to proceed in establishing and operating a medical facility in Navajo Mountain. They have received a letter of commitment from a physician and wife who will move to that community and provide that care. Commissioner Lynn Stevens motioned to move the chair to Commissioner Manuel Morgan. Commissioner Morgan seconded. Commissioner Lynn Stevens motioned to write a letter of support. Commissioner Manuel Morgan seconded. None opposed. Commissioner Morgan declared the motion carried. Navajo Liaison/Edward Tapaha County Clerk Norman Johnson reported on confusion between the Tri-State Commissions meeting and the Tri-State Elections meeting. There will be a Tri-State Elections meeting on March 14, 2003 near Albuquerque, NM which Navajo Liaison Edward Tapaha will attend. There has been some discussion concerning Mr. Tapaha being available to help the commission. This is an off election year and Mr. Tapaha is available. UDOT-Roads/Cleston Laws Cleston Laws, UDOT, reported he was asked to come to commission meeting to discuss some road issues. Bob Turri, Contract Specialist, discussed the possibility of building an ATV trail and two staging areas along Highway U-95 from Fry Canyon to the Blue Notch road. The right of way for construction of U-95 was issued to the Federal Highway Commission and then passed to the Utah Department of Transportation for construction and maintenance in the mid 1970's. The right of way width for the road is 400 feet presumably to be 200 feet each side of the center line of the road. They discussed whether or not UDOT would allow a trail to be built in the right of way and that conditions would have to be met. It was questioned whether the BLM would allow such an action and whether or not NEPA requirements would be involved. It was decided that a follow up meeting be scheduled to include the BLM, UDOT, and the County before any decision could be made. Bob Turri will be responsible to set up the meeting. Mr. Laws also reported on the Devils Canyon Road project, deer crossing possibilities, State Road 162, spot improvement at Blue Mountain Guest Ranch road, Moab Canyon, Arches, Westwater Canyon Road, State Road 666, and the fairground entrance. Commissioner Morgan asked about Highway 262. Mr.Laws stated he met with the Navajo DOT about 18 months ago. Cultural issues have been looked at with mitigation estimated at four million dollars. Mr. Laws has not received any money from Utah State Highway Commission to help the Navajo Nation with this project. Bud Tangren/Spanish Valley Bud Tangren, Spanish Valley, introduced himself to the new commissioners. He inquired about the Spanish Valley Roundtable conference call. Administrative Assistant Rick Bailey stated that the City of Moab, Grand County, Spanish Valley Special Service District, San Juan County, and State Trust Lands has hired a consulting firm to assess the needs of Spanish Valley. Mr. Tangren commented on the roundtable process and a proposed gentleman's agreement that he heard about between Grand and San Juan Counties. Mr. Tangren objects to that agreement if it exists. He feels Grand County's water and sewer systems are inadequate. Commissioner Stevens assured Mr. Tangren that San Juan County would not let Grand County do any favors that the County is not seeking. Red Mesa Senior Center/Travel Funding Request Aging Director Melissa Begay, stated that Sylvia Zhonnie, Red Mesa Senior Center, is appealing a decision by the commission to deny use of County funds to attend a National Aging Conference in Chicago, IL. Ms. Zhonnie reviewed the request for the County to pay the conference fee and lodging. Since submitting the original request it was decided to ask the County to pay for meals and she could share lodging with another person reducing the lodging fee and total amount requested from the County to $704.48. Commissioner Stevens reviewed the facts of how much benefit attending the national conference would be to an individual senior center and if there could be a better use of funds to benefit the Red Mesa senior citizens. Commissioner Morgan expressed his concerns also. Commissioner Stevens reviewed the facts that Ms. Zhonnie may have decided this conference is worth going to at the expense of things that she had planned to buy and now cannot. Commissioner Stevens requested that Ms. Zhonnie report to the commission on the benefits the conference will provide and how she will implement the ideas received at the conference. Commissioner Manuel Morgan made a motion to reverse the decision of last week and allow Ms. Zhonnie to attend the conference. Commissioner Lynn Stevens seconded. None opposed. San Juan Health Service District/Board Appointment Commissioner Lynn Stevens stated that in January the County received a letter of interest from Nettie Prack to serve on the San Juan Health Service District Board which has not been acted upon. Commissioner Manuel Morgan made a motion approving the appointment of Nettie Prack to serve on the Health District Board for a four year term beginning January 1, 2003. She will replace Roger Atcitty. Commissioner Lynn Stevens seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. PERSONNEL DEPARTMENT REPORT Payroll Change/Sheriff Dept Personnel Secretary Lillian Bayles presented a payroll change for Grayson Redd. He has received the necessary training and experience to qualify for Investigator/Detective status. It was requested to move him from Grade 17, Step 173 at $2675 per month to Grade 22, Step 186 at $2844 per month effective February 1, 2003. National Guard Personnel Secretary Lillian Bayles reported that one Road Department employee has been activated with the National Guard. PLANNER EDWARD SCHERICK'S REPORT Water Monitoring Planner Edward Scherick reported that is it time to renew the agreement with U.S. Geological Survey for water monitoring equipment on North & Spring Creek in the amount of $18,300. Monticello City participates in this agreement. Commissioner Manuel Morgan made a motion to renew the contract. Commissioner Lynn Stevens seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Land Use Plan Planner Scherick reported the County would be involved in land use updates with the BLM and Forest Service. Mr. Scherick requested to put together a Public Land Use Council to include representatives from all areas. He has identified areas to be included as follows: Grazing, minerals, oil & gas, wildlife, recreation environment, economic development, and government. Advertisement for interest will take place. Commissioner Manuel Morgan made a motion to approve organizing a public lands council and advertise for board members. Commissioner Lynn Stevens seconded. None opposed. Wilderness Re-inventory Planner Scherick reported that Mark Ward, Attorney Generals Office, will be here tomorrow at 9:00 a.m. to talk about wilderness re-inventory. Forest Service Land Use Plan Planner Scherick reported he has reviewed the Forest Service Land Use Plan. The Forest Service told Mr. Scherick the County had signed an agreement formalizing the cooperating agency status. Planner Scherick had not seen the agreement but has since reviewed it and feels it needs to be revised. Meetings Planner Scherick attended the BLM planning meeting on February 10, 2003. Planner Scherick met with the Forest Service on February 13, 2003. He also attended the ATV meeting held that same evening. Monticello City will take the lead. On February 18, 2003 Planner Scherick with the Road Attorneys to Salt Creek and showed them the issues. On February 20, 2003 Planner Scherick and Deputy Attorney Bird attended the RS2477 Road Strategy meeting. There will be an ATV Safari meeting at Monticello City on February 25, 2003. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits A building permit was presented for James Cowan for a manufactured home in San Juan Estates Phase III in Spanish Valley. Commissioner Manuel Morgan made a motion to approve the building permit. Commissioner Lynn Stevens seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Road Department-Trucks Bids were presented for 3-3/4 4X4 standard cab pickups as follows: GMC Sierra 2500 at $19,437.73; Chevrolet Silverado 2500 at $18,925.07; Dodge D2500 at $19,900; and Ford F250 at $16,320. Bids were presented for a 1 - 1 ton dual wheel 4X4 cab and chassis as follows: GMC 3500 at $24,417.08; Chevrolet 3500 at $24,183.96; Chevrolet 3500 at $22,580.07; Dodge (demo) at $25,757; and Ford F350 at $10,928. A bid was presented for a Ford F450, 1-1.5 ton 4X4 dual cab and chassis, diesel engine at $27,908. No product available from other bidders. Bid/Road Department-Rubber Tire Roller/Compactor Bids were presented for a rubber tire roller/compactor as follows: Atlas Machinery Co for a Bomag at $111,210; Cate Equipment Co for an Ingersol Rand at $90,691; Wheeler Machinery for a Cat at $97,784; and Scott Machinery Co. for a DynaPac at $92,995. The Road Department recommended to purchase the machine from Scott Machinery. Commissioner Manuel Morgan made a motion to approve the purchase from Scott Machinery. Spanish Valley Roundtable There will be a Spanish Valley Roundtable conference call on February 28, 2003. Denehotso Road Meeting The Denehotso Road meeting scheduled for today has been rescheduled for February 25, 2003. County Road Superintendent Doug Pehrson will attend. COMMISSIONER LYNN STEVEN'S REPORT Commissioner Stevens attended the Southeastern Utah AOG meeting held in Price on February 20, 2003. The Board approved a $45,000 request from Blanding City for their city park. Commissioner Stevens and Dr. Bill Olderog, CEU-San Juan, will be in Price at CEU on February 25, 2003 to talk about funding and improving the educational possibilities for medical coders and transcribers. COMMISSIONER MANUEL MORGAN'S REPORT Commissioner Morgan attended the San Juan Health Service District Board meeting last week. A letter was given to the Health District Broad requesting the Board continue to support the operation of the Blanding Birthing Center and provide the necessary services. Commissioner Morgan will attend the meeting in Price at CEU concerning medical coding and transcribing issues. Commissioner Morgan will attend a meeting in Monument Valley on February 27, 2003 with the School District in reference to a safety officer in the school and how emergency services will be provided there. On February 28, 2003 Commissioner Morgan will attend a Dineh Committee meeting.
