SAN JUAN COUNTY COMMISSION MEETING MARCH 10, 2003 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah Present: Lynn Stevens, Chairman Manuel Morgan, Vice-Chairman Ty Lewis, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the March 3, 2003 meeting as amended was made by Commissioner Ty Lewis and seconded by Commissioner Manuel Morgan. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Computer Software ITS Manager John Fellmeth presented bids for computer software to scan and archive County documents. Bids are from Microfilm Service Corp for Paper Vision Enterprise software and 3 concurrent licenses for a total of $4,680 and from Archive Index for The Repository software and 5 concurrent licenses at $3,000. ITS Manager John Fellmeth state the Paper Vision Enterprise software better fits what the County would like to have. Commissioner Ty Lewis made a motion to approve the bid for the Paper Vision Enterprise software & licenses. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Computer ITS Manager John Fellmeth presented bids for a computer server for archive imaging. The bids are from New Egg at $1816.95; from Dell Computer at $2921.93 and from Dartek at $2902.55. Commissioner Ty Lewis made a motion to approve the bid from New Egg at $1816.95. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Beer License Renewals County Clerk Norman Johnson presented for approval a beer license renewal for Cow Canyon T.P for a Class D license and a new license for Erik Hansen for Hole In the Rock General Store for a Class A license. The requirements have been met. Commissioner Ty Lewis made a motion to approve the beer license renewal and the new license. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Out of State Travel/Norman Johnson & Edward Tapaha County Clerk Norman Johnson presented an out of state travel request to attend the Tri- State Election meeting in Albuquerque, NM for he and Navajo Liaison Edward Tapaha on March 13-14, 2003. Commissioner Ty Lewis made a motion to approve the out of state travel request. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. BOE Appeal/Gidel & Platt County Clerk Norman Johnson reported that the Gidel & Platt BOE appeal with State Tax Commission was scheduled for April 10th but was moved to April 16, 2003 which is the same day as the UAC Conference in St. George. This is not a good day for the elected officials in San Juan County. Due to legal issues more discussion will be held in a an executive session next week. Blanding Swimming Pool Funding/Chris Webb Chris Webb, Blanding City Manager, reported that Blanding City sent a letter to the commission last fall requesting $50,000 for swimming pool and ball field repairs. He is now requesting the funds be released. The Commission stated that because the TRT fund estimates are lower than anticipated the amount available to divide between Blanding and Monticello Cities is approximately $25,000. A discussion was held concerning whether or not Monticello City was moving forward on their visitor center project. Before any decision is made Commissioner Lewis suggested that the County find out where Monticello City is on their project and conduct an analysis of other budgets to see what can be done. Commissioner Stevens would like to be educated on the capital budget account and asked that Mr. Webb come back to another commission meeting. Utah Department of Transportation Brett Hosler, Blanding City Planner, reported that UDOT will host an informative meeting on March 27, 2003 in the San Juan County Courthouse at 7:00 p.m. The meeting will include Comprehensive Access Management, the proposed revision of the State Highway Access Permit process, and local area State Highway access category assignment and spacing standards. Dan Kartchner/Around the World Road Dan Kartchner expressed his concerns about County Road #206, Around the World Road. He feels it is the narrowest county road on the system, has high traffic use, and is very dangerous. There are between 34 and 40 houses on that road. He would like to see the road improved and paved. The Commission will speak with County Road Supervisor Doug Pehrson and Lynn Laws, South Road Department, about the schedule for that road. Hovenweep Road/Yolanda Mark Yolanda Mark, Aneth Area, is concerned about 418 South Hovenweep road. She requested the County maintain, re- gravel, or pave that road. The snow and rain storms have made the road real muddy. Commissioner Lewis suggested she contact the South Road Department with her concerns. BLM/Patrick Madigan Patrick Madigan, Monticello BLM Field Manger, stated that USGS contacted the BLM last week and wanted to know if the BLM would be interested in having a study done of the Tamarisk in the County. The USGS will make the study available to the different entities for analysis and comments. The project will probably start this summer. PERSONNEL DEPARTMENT REPORT Personnel Secretary Lillian Bayles reported there will be personnel training on March 20, 2003. This will include Sexual Harassment and Drug Policy training. PLANNER EDWARD SCHERICK'S REPORT Public Lands Council Planner Scherick reported on the Public Lands Council advertising. He stated there has not been an over whelming response. A few have offered to participate. Planner Scherick will look at the areas that do not have a participant and then look for people to fill those slots on the board. He stated he will ask both Blanding and Monticello cities to appoint someone to participate on that board. Forest Service Scoping The Forest service will be holding a scoping meeting on March 25, 2003 at 7:00 p.m. in the commission room. A meeting will also be held on March 26, 2003 at 7:00 p.m. in Blanding at the Special Events Center. There will be a meeting with the Forest Supervisor on March 17, 2003 in the Commission Room. The Commissioners are invited to attend. Commissioner Lewis inquired about the status of the Forest Service campsite/concession bids being awarded to local people. The Monticello field office is in favor of looking in to that idea. They still have a couple of years left on the current concessionaire contract. ATV Jamberall Planner Scherick attended the ATV executive committee meeting on March 6, 2003. He felt it was a good meeting and progress is being made. The web site will be up in the near future. The Jamberall will be held on September 25-27, 2003. SULU Planner Scherick attended the SULU meeting on March 5, 2003 in Blanding. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits Administrative Assistant Rick Bailey presented a building permit for Glen Hunter for a secondary residence and garage in San Juan Estates, Phase II. Commissioner Ty Lewis made a motion to approve the building permit. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Cal Black Airport/Engineer of Record Administrative Assistant Rick Bailey reported that the advertising deadline for the Cal Black Airport engineering proposals was on March 7, 2003. One proposal was received and will be forwarded to the FAA. Navajo School Bus Route Funding Mr. Bailey reported that Senator Bingaman, New Mexico, sponsored the Navajo School Bus Route funding bill in the legislature with no co-sponsors. Mr. Bailey called Senator Hatch's and Bennett's offices and by the end of the day Senator Bennett had personally called and asked to be a co-sponsor of the bill. Department of Energy The County received a letter from the Grand Junction office Department of Energy asking San Juan County be a cooperating agency. Mr. Bailey has some concern about that and feels they have not read the previous letters sent to them from the County. Mr. Bailey sent another letter to Joel Burwick, Grand Junction DOE stating the County is interested in being a cooperating agency. Oljato Chapter/Emergency Communications Administrative Assistant Rick Bailey reported a fax was received from the Oljato Chapter approving the County request to use the mesa top near Holiday Mesa for an emergency communications repeater site. Regional Advisory Council The DWR Regional Advisory Council meeting will be held at the John Wesley Powell Museum in Green River on March 18, 2003 at 6:30 p.m. UAC Legislative Meeting The UAC Legislative wrap up meeting will be held on March 13, 2003 at 9:30 a.m. in the UAC offices. Road School The 2003 Road School will be held in St. George on April 23-25, 2003. The Joint Highway Committee meeting will probably be held on April 23, 2003. Defensive Driving Course The Defensive Driving Course will be held on March 13, 2003. Spanish Valley Roundtable Administrative Assistant Rick Bailey reported that Grand County called him concerning the financial participation with the Spanish Valley Roundtable. The Grand County Council does not want to participate in funding any part of the Roundtable planning. Emergency Drought Declaration Administrative Assistant Rick Bailey presented an Emergency Drought Declaration for San Juan County to the commission for approval. Commissioner Ty Lewis made a motion to approve the Emergency Drought Declaration. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. A copy of the declaration is on file in the Clerk's office. Spanish Valley/Parcel Administrative Assistant Rick Bailey reported that Carl Rappe would like to divide a parcel of land in to two pieces. A small portion of each piece is in San Juan County. He is applying for subdivision status through Grand County and requested exemption from the subdivision process in San Juan County. The portions in San Juan County are not big enough to build on. Commissioner Ty Lewis made a motion to exempt the San Juan County portion of those lots from the subdivision process with restrictions that he not place buildings on the County line. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis met last week with Senator Bennett's and Senator Hatch's office concerning money for water issues and asked them to support the school bus route funding bill in legislature. Commissioner Lewis attended the Navajo Revitalization meeting in Blanding on March 3, 2003. He also attended the San Juan County Mental Health/Substance Abuse Board meeting that afternoon in Monticello. Commissioner Lewis reported he met with the legislature on the last day of the session. Many of the bills did not pass. There will be a meeting at the Nation of the Four Corners in Blanding concerning the Monument Valley Visitor Center on March 13, 2003. COMMISSIONER MANUEL MORGAN'S REPORT Commissioner Manuel Morgan attended the Navajo Revitalization meeting in Blanding on March 3, 2003. Mr. Morgan reported that John Harja, Governor's Office, mentioned the Revitalization is under a suit by the oil companies concerning the oil severance tax. Mr. Harja would like the County to provide a letter indicating benefits to the County. On March 4, 2003, Commissioner Manuel Morgan attended the San Juan County Water Conservancy District board meeting in Blanding. Commissioner Morgan gave the other commissioners a copy of a disclosure statement indicating his involvement with the Utah Navajo Health System and health care issues in the County. Commissioner Morgan will attend a Utah Navajo Commission meeting in TeecNosPos on March 12, 2003. He will attend the Defensive Driving Course on March 13, 2003. On Friday, Commissioner Morgan may attend the Tri-State Elections meeting in Albuquerque, NM. Commissioner Morgan will attend the Red Mesa Chapter meeting tonight. Commissioner Morgan recognized community members Yolanda Mark and Shorty Todacheenie and his wife in attendance today. COMMISSIONER LYNN STEVEN'S REPORT Commissioner Lynn Stevens attended the San Juan Water Conservancy District board meeting on March 4, 2003 with Blanding City. A request was made to work out a joint use, funding, and resolve debt issues with Blanding and Monticello Cities. Commissioner Stevens, CEU, and some AOG representatives will be putting together the CIB proposal for education funding for transcribing and medical coding students. Executive Session At 12:20 p.m. Commissioner Ty Lewis made a motion to convene in to an executive session to discuss legal issues concerning the McArthur et.al vs. San Juan County et.al.
