SAN JUAN COUNTY COMMISSION MEETING APRIL 14, 2003 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens, Chairman Manuel Morgan, Vice-Chairman Ty Lewis, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the April 7, 2003 meeting as amended was made by Commissioner Ty Lewis and seconded by Commissioner Manuel Morgan. None opposed. Commissioner Lynn Stevens declared the motion carried. Out-of-State Travel/Steve Bradford Steven Bradford, Communication, requested permission to travel out of state to attend the National Translator meeting and seminar in Denver, CO on May 1-4, 2003. Commissioner Lewis asked questions about the future of television in San Juan County. He suggested that Mr. Bradford develop a plan for the future with analysis and cost and report back to the commission. Commissioner Manuel Morgan motioned to approve the out of state travel. Commissioner Ty Lewis seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Liquor Consumption License Renewal/Line Camp County Clerk Norman Johnson presented a Liquor Consumption License renewal for the Line Camp. Requirements have been met. Commissioner Ty Lewis made a motion to approve the license renewal. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. ATV Trails/Blanding A discussion was held with Blanding City Manager Chris Webb, San Juan County Road Committee, Sheriff Mike Lacy, UHP Rick Eldredge, Joe Lyman, SULU, and others concerning ATV access roads leading out of Blanding in all directions. City Manager Webb requested permission to allow ATV travel on specific paved roads to access public lands until the roadside trails can be built. Safety is a real concern to many. Issues were raised concerning whether or not the trails can be built along side of the roads and whether or not private land owners would allow the trails to be built in the right of ways along their properties. After much discussion Commissioner Ty Lewis made a motion to authorize actions, prioritize, and build road side trails within the transportation corridor along county paved roads. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Utah Navajo Development Council/Land Lease Cleal Bradford, Utah Navajo Development Council Administrator, reported on a request from EMS Coordinator Rick Bailey to lease a portion of the clinic building in Monument Valley for fire and ambulance purposes. He reported that UNDC has authorized the request. Mr. Bradford requested that County Attorney Craig Halls write a lease agreement between San Juan County and Utah Navajo Development Council. The commission agreed. Monument Valley Visitor Center Commissioner Lewis asked about the Monument Valley Visitor Center. Cleal Bradford reported that the funding is still in place even though it will not go to bid by the end of this month. UDOT is the owner of the Welcome Center portion and Utah Navajo Trust is the owner on the Vender Village portion. Trail of the Ancients Cleal Bradford reported there has been legislation introduced by Senator Hatch. The National Park Service opposes further study plus the fact they feel the routes are more scenic than historic. This week Senator Hatch's staff is suggesting that they back a way from establishing the Trail of the Ancients as a National Historic Scenic By-way and proposed it be designated as a National Heritage Area. By doing that it would only designate existing sites along the route that are already existing and administered. The draft Bill will be coming in the future. San Juan Health District Board Cleal Bradford requested the Commission consider whether or not he has a conflict of interest in his position as Administrator of Utah Navajo Development Council and also being a member of the San Juan Health District Board. He doesn't want this to be perceived as a conflict. County Attorney Halls stated that if Mr. Bradford is making decisions concerning payment or non payment of bills, etc. then he feels that would be a conflict. Disclosure needs to take place and excuse himself from voting or decisions. Commissioner Lewis suggested he write a disclosure of his relationship with the two entities as he sees it. The commission will then review it and make a determination. PERSONNEL DEPARTMENT REPORT Request to Hire/Laborer-Road Dept Deputy Attorney Walter Bird presented a request to hire Robert Wynn and Travis Whaley as temporary Road Department Laborers in the South Road Department at Step 29 at $7.91 per hour effective April 21, 2003. Commissioner Ty Lewis made a motion to approve the hires. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Payroll Change/Promotion-Randall Jim Deputy Attorney Walter Bird presented a request to move Randall Jim from a Laborer to a Laborer/Light Equipment Operator moving him from Step 26 at $1408 per month to Step 50 at $1508 per month. Effective April 1, 2003. Commissioner Ty Lewis made a motion to approve the promotion. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. PLANNER EDWARD SCHERICK'S REPORT Public Lands Council Planner Edward Scherick reported that the first Public Lands Council meeting will be held on April 15, 2003 at 7:00 p.m. in the County Courthouse. He requested that Commissioner Stevens give the introductions at the meeting. BLM/Sonoran Institute Planner Scherick reported the Sonoran Institute will be in the County on May 6, 2003 from 9:00 a.m. to 3:00 p.m. to give a presentation on the BLM study they plan to conduct. Planner Scherick requested that the commissioners attend along with the Public Lands Council members. RS2477 Strategy Meeting The RS2477 Strategy meeting will be held in conjunction with the Public Lands Steering Committee meeting on April 16, 2003 in Price. Deputy Attorney Walter Bird will attend. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits Building permits were presented for approval for Edward Williamson for a manufactured home in San Juan Estates, Phase III and for Dale Edwards for a home in the Hang Dog Subdivision. Commissioner Ty Lewis made a motion to approve the building permits. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Cattleguard Concrete Timbers Cattleguard concrete timber bids were presented for the following: Mike Moses for 140 timbers at $11,140; CM Concrete Inc. for 140 timbers at $13,605; Mike Crittenden for 100 timbers at $11,700; and Lehi & David Lacy for 140 timbers at $11,960. Commissioner Ty Lewis made a motion to approve the low bid from Mike Moses. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Contract/Area Agency on Aging-Medicaid Waiver Administrative Assistant Rick Bailey presented for approval a contract from the State of Utah Department of Human Services-Area Agency on Aging for their Medicaid Wavier Reimbursement to the County in the amount of $8,000. May Tax Sale Administrative Assistant Rick Bailey presented a handout of information concerning the up coming Tax Sale that will be held on May 22, 2003. Recognition Award/Harlan Harrison The County received a letter this week from the National Weather Service stating that on April 26, 2003 Harlan Harrison, Mexican Hat, will be honored with the 2002 John Campenares Home Award for volunteering in the cooperative weather observing program for the past 31 years. This service involves reading the daily weather and telephoning the statistics in. Only 25 people nation wide will receive this award. Mr. Bailey has prepared a letter to be placed on a plaque from the County recognizing him for his years of service. Flat Iron Mesa Ranch, Phase II-Subdivision Plat/Approval Administrative Assistant Rick Bailey presented the Flat Iron Mesa Ranch Subdivision Plat, Phase II for approval. They are adding five lots in this phase and have met the requirements. Commissioner Ty Lewis made a motion to approve the subdivision plat. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Hopi 911 Conference Call Administrative Assistant Rick Bailey reported there will be a Hopi 911 conference call on April 15, 2003. Spanish Valley Roundtable Administrative Assistant Rick Bailey reported that the Spanish Valley Roundtable issues concerning the cost to extend the existing water & sewer services across the county line and the cost if completed separately on the San Juan County side are moving forward. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis will attend the BLM/MOU planning meeting this afternoon at 1:00 p.m. The Public Lands Council meeting will be held on April 15, 2003 at 7:00 p.m. The UAC Management Conference will be held on April 16-18, 2003 in Price. Commissioner Lewis will attend a Federal Highway Committee meeting in Salt Lake City on April 22, 2003. COMMISSIONER LYNN STEVEN'S REPORT Commissioner Stevens had a telephone conference call with Planner Scherick, Deputy Attorney Bird, and the road lawsuit attorney concerning a memorandum that will be coming concerning roads. Commissioner Stevens will attend the Public Lands Council meeting on April 15, 2003 in the County Courthouse. Commissioners Stevens and Morgan will meet with Attorney Jesse Trentadue in the evening of April 16, 2003 in Price. Commissioner Stevens will attend the Southeastern Utah League of Counties and Cities board meeting on April 17, 2003. Bill Howell, AOG, has requested that Commissioner Stevens attend a medical coding pre-CIB briefing meeting on April 16, 2003. Commissioner Lynn Stevens will attend the Subcommittee meeting on April 22, 2003 and the Joint Highway Committee meeting on April 23, 2003 in St. George. COMMISSIONER MANUEL MORGAN'S REPORT Commissioner Morgan reported that the Utah Tribal leaders met in Montezuma Creek on April 10, 2003. Commissioner Morgan attended the ground breaking ceremony for the new out patient medical facility at Red Mesa, AZ on April 11, 2003. Commissioner Morgan will be in Price to attend the UAC Management Conference in Price on April 16, 2003.
