SAN JUAN COUNTY COMMISSION MEETING MAY 12, 2003 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens, Chairman Manuel Morgan, Vice-Chairman Ty Lewis, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk Commissioner Ty Lewis motioned to reserve the right to review the tape of last weeks meeting. Commissioner Stevens tabled the minutes until the review is made. San Juan Health District/Admissions Policy Karen Adams, San Juan Health District Board, presented the Health District's Admission Policy for them to review. Blue Mountain Hospital Dale Slade, Blanding City, introduced the proposed Blue Mountain Hospital project with an artist sketch of the building. The property is located behind Clark's market and is secure. Blanding City is requesting a letter of support from the Commission for the project. Ahmad R. Razaghi, President, of the Blue Mountain Hospital, reported the project is a collaborative effort between Ute Mountain Ute Tribe, Utah Navajo Health Systems, Blanding City residents, and project developers. The Blue Mountain Hospital is a not for profit 501C-3 Corporation. It has been designated as a Four Corners Enterprise Zone Bench Mark Project. Mr. Razaghi reviewed San Juan County population statistics according to the 2000 census, San Juan County Emergency Services statistics, Ambulatory & Inpatient Surgeries, and summary of Health Care Delivery in the County. Blue Mountain Hospital's scope of services will include Ambulatory/Inpatient Surgery, State of the Art Diagnostic Center Physicians Clinic, Pharmacy, Eight Short Term Patient Beds, Laboratory Services, Community Education, Traditional Medicine, Emergency Room, Renal Dialysis, Physical Therapy, and Respiratory Therapy. After the presentation and following questions from the Commissioners, public comment began. Monticello City Mayor Scott Pehrson and City Councilman Doug Allen spoke in opposition to a commission letter of support to Blue Mountain Hospital. San Juan County Hospital Board Chair Karen Adams spoke against a letter of support. Blanding City Councilman Dale Slade spoke in favor of a letter of support. Ute Mountain Ute Tribal Council members, Gwen Cantsee, Elaine Atcitty, and Ernest House spoke in favor. Commissioner Lewis made a motion, "that if the entity can proceed without Commission approval that they proceed without that approval." Motion died for lack of a seconded. Commissioner Manuel Morgan motioned that the Commission provide the Blue Mountain Hospital a letter of support in their application process. Commissioner Stevens passed the Chair to Commissioner Lewis and seconded the motion. Commissioner Lewis stated he would not accept the motion because he feels Commissioner Morgan has a conflict of interest. After legal discussion, Commissioner Ty Lewis stated, "I have a motion and a second of which I think there is a conflict of interest from the motion. I want that stated in the minutes. I think the motion giver has a personal benefit from this motion. With that, all those in favor of the motion say aye." Commissioners Stevens and Morgan voted in favor. Commissioner Lewis voted against. Commissioner Stevens stated that any letter of support will have to be signed by himself. Commissioner Stevens stated he would give the County 30 days to get some kind of decision from the State of Utah as to whether or not he is within his legal right to sign the letter. His current intent is to comply with the majority vote of the commission and sign the letter. The Commission was presented a letter from the City of Monticello which could indicate a conflict of interest for Commissioner Morgan. A copy of the letter is on file in the Clerk's office. County Airplane County Sheriff Mike Lacy reported that the pending sale of the County airplane has fallen through. In order for the plane to be used for commercial flights the engines need to be overhauled. Another proposal has been received from the original bidder in the amount of $175,000. Sheriff Lacy has found another airplane to replace the present airplane that will be sold. Commissioner Ty Lewis made a motion to sell the current plane for $175,000 and purchase another for the same amount or less. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Computer-Sheriff Dept Sheriff Mike Lacy presented a bid for a P- 4 Computer from Dartek at $574 and from Dell Computers for the same at $723.24. The computer will be paid from a grant. Commissioner Ty Lewis made a motion to approve the bid from Dartek. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. White Mesa Mill/Ken Sleight Ken Sleight, Moab, expressed health concerns with a cloud like plume of smoke, dust, and debris blowing around the White Mesa Mill as he was traveling through the area in February 2002. It looked to him like the mill site was not being properly monitored. He requested that the State and Federal Government complete a epidemiology study and complete an emergency EIS. He further requested that tax revenue accounting that comes from International Uranium Corporation be furnished to him. Commissioner Stevens stated the Department of Energy is going through a process of studying, evaluating the relocation of the Atlas Tailings in Moab. This includes everything that is required to study, analyze, and provide information for the safety of the public in their assessment of whether or not White Mesa is the correct place to store the tailings. Herb McHarg, Monticello, expressed his concerns about the economy of San Juan County, nuclear radiation risk in the County, the potential of new businesses in the County, and retaining new people in the area. Bid/Carpet-Community Development Dell Hunter, Building & Grounds Supervisor, presented a bid for new carpet and pad in the Community Development Office from Flooring America at $1380 and from Creative Floors for carpet at $1705. The bid was placed on hold until further evaluation of office space is made. Bid/Dump Body Hydraulics Administrative Assistant Rick Bailey presented a bid from Tesco-Williamson for hydraulics, installation, etc on two trucks for the Road Department in the amount of $24,389. Commissioner Ty Lewis made a motion to approve the bid. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Scarifer System A bid was presented for a Scarifer System from MHL System for the Road Department at $3,365. They are the current supplier of similar equipment. Commissioner Ty Lewis made a motion to approve the bid. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. PLANNER EDWARD SCHERICK'S REPORT Public Lands Council Planner Edward Scherick presented the name of Ben Black to be a member of the Public Lands Council representing commercial recreation. Commissioner Ty Lewis made a motion to approve the appointment. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Personal Watercraft/Lake Powell Planner Scherick reported on a newspaper article concerning the lift of the ban for personal watercraft on Lake Powell. The ban is still in effect up the San Juan River. The Commissioners are concerned as this will still affect San Juan County economically. Equestrian & Bike Trails Planner Scherick spoke with Candi Pearson, Moab, who feels San Juan County's ATV model is working well. She would like to develop some equestrian & bike trails in the northern part of the County. She would like to set up a meeting and talk about those issues. Planner Scherick suggest she speak with SULU first. Forest Service/EIS The County has not met the deadline for the comments on the Forest Service EIS concerning the watershed projects. The comments will be in by the end of the week. Meetings The San Juan Forum meeting will be held on May 29, 2003 in Durango, CO. The Statewide Strategy meeting will be held on May 15, 2003 in Salt Lake City. David Bronson, Survey Dept., will attend. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits Building permits were presented for Jerald Larsen for a new garage and storage in Bluff and for David Swafford for a new garage in LaSal. Commissioner Ty Lewis made a motion to approve the building permits. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Area Agency on Aging/Four-Year Plan Administrative Assistant Rick Bailey presented the Area Agency on Aging Four-Year Plan for FY 2004- 2007 for approval. Commissioner Ty Lewis made a motion to approve the plan. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Chamberlain Architectural Service Administrative Assistant Rick Bailey reported he contacted Chamberlain Architectural Service, Grand Junction concerning a proposal on work for the Monument Valley Fire Station addition, Bluff Fire Station, Blanding EMS addition and Blanding Road Dept. The Commission agreed to have Mr. Bailey proceed. USDA Grant/Weather Radio Administrative Assistant Rick Bailey presented a grant application to the USDA for a Weather Radio on Abajo Peak. The estimated total cost is $28,480 of which USDA will provide 75% of the funding. Local funding will be $7,120. Mr. Bailey is hopeful that some money will be furnished by utility companies. San Juan Central Recreation Special Service District Administrative Assistant Rick Bailey reported on a request from Blanding City to dissolve the San Juan Central Recreation Special Service District. Requirements to dissolve have been completed. Commissioner Stevens reported their is anxiety of residents outside of Blanding City limits if the District is dissolved because of problems that may arise with city programs. Mr. Stevens requested to not act on this request until he speaks to the city council on how they will assure the County that county residents who are funded because of population get representation or board approval. Commissioner Stevens also stated there has been a great deal of anxiety generated between Blanding City and White Mesa over recreation funds. Lisbon Valley Road/Utility Certification Administrative Assistant Rick Bailey presented a Utility Certification for the Lisbon Valley Road project for signature. Commissioner Ty Lewis made a motion to approve the utility certification. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. State Trust Lands Administrative Assistant Rick Bailey reported the State School Trust Lands meeting scheduled in Bluff on May 28, 2003 has been cancelled. The County received a notification of a proposed sale of 640 acres near LaSal Junction to develop a commercial bison operation. Commissioner Lewis has concerns about a county road that goes through that area. Fencing may also be an issue. The County will write a letter to the AOG concerning the road issue in that area. Meeting The County received notice from DOE that the first meeting of the Cooperating Agency concerning the Moab Mill Tailing will be held in Moab, UT on June 5, 2003 from 1-5 p.m. COMMISSIONER LYNN STEVEN'S REPORT Commissioner Lynn Stevens attended the Sonoran Institute meeting on May 6, 2003. He felt it was a very productive meeting. Commissioner Stevens will attend the AOG meeting in Price, Utah on May 15, 2003. On Saturday, May 17, 2003, Commissioner Stevens will hold a meeting concerning ATV roads in the Blue Mountain Road area. COMMISSIONER MANUEL MORGAN'S REPORT The ExxonMobil dinner for law enforcement officers will be held in Window Rock on May 15, 2003. Commissioner Morgan reported that the Johnson Begay recognition will be held at 1:00 P.M. in Bluff on May 17, 2003. Commissioner Morgan reported he is invited to the ATV meeting on May 17, 2003 sponsored by Commissioner Stevens. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attended the Sonoran Institute meeting held in Monticello on May 6, 2003. Commissioner Lewis will be in Salt Lake City to attend the Tax Commission Hearing and also the RS2477 meeting. There will be a Drought meeting on May 19, 2003. The Department Head meeting will be held on May 27, 2003. There will be a Rural Utah Business Technology Conference in St. George on May 28-29, 2003.
