SAN JUAN COUNTY COMMISSION MEETING AUGUST 11, 2003 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens, Chairman Manuel Morgan, Vice-Chairman Ty Lewis, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the August 4, 2003 meeting as written was made by Commissioner Manuel Morgan and seconded by Commissioner Ty Lewis. None opposed. Commissioner Lynn Stevens declared the motion carried. Board of Equalization Board of Equalization dates have been set for August 18 & 25, 2003 from 1:00 - 5:00 P.M. each day. State Fair Invitation Kisper Ramsay, Miss San Juan County, invited the commissioners to attend a luncheon for the queen contestants at the Utah State Fair on September 5, 2003. Gun Range/Grand County Judy Bane & Jerry McNeeley, Grand County; Frank Darcy, Moab Sportsman; and Mary VonKoch, BLM discussed the proposed gun range in northern San Juan County with the commissioners. Moab Sportmans will be responsible for liability. An over all plan for the range to include a plan of development and a schedule of development will be required The BLM will issue a direct patent after all requirements are met. Planner Scherick will help with the application Commissioner Ty Lewis made a motion to move forward on the application. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Coyote Bounty/Proposed Changes Roy Yoakam, President of Sportsmen for Fish and Wildlife, stated the coyote bounty program was a big success but feels some changes need to be made. He gave the commissioners a letter suggesting specific changes. The Commission suggested the Sportsmen group make the final decision on the proposals and the County will support them in their efforts. The timing and process for the bounty will be controlled by the Sportsmen group. Commissioner Ty Lewis made a motion to allow the Sportsmen Club to develop the voucher system, determine when vouchers will be used. San Juan County will match bounty money with the Sportsmen and the State. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. PLANNER EDWARD SCHERICK'S REPORT Utah Rural Summit Planner Scherick reported on the Utah Rural Summit meeting held in Cedar City last week. He reported that Governor Leavitt stated that now was the time to resolve road issues but not the time to resolve wilderness issues. He and others met in an evening meeting with Ann King, Forest Service, in which they discussed Wild and Scenic River designations. Forest Service Routes Planner Scherick reported the County has found several routes on the Forest that were there prior to the Forest Service withdrawal legislation. One of which is the Wagon Wheel Trail. Hook & Ladder Recreation Plan Planner Scherick reported the draft Hook & Ladder Recreation Area Plan is out. It will change the area to existing roads and trails. There will probably not be any open areas. Water Projects Planner Scherick reported the County has received money from San Juan County Water Conservancy District to help with completion of drought projects begun last year. Planner Scherick will speak with Roger Hansen, Bureau of Reclamation, asking him to help the Navajo Chapters with guidelines in order to utilize money available to them for water projects. Navajo Liaison Edward Tapaha will help the Chapters also. Road Meeting The County Road Committee will hold a meeting today at 3:00 P.M. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Sage Grouse Proposal Administrative Assistant Rick Bailey reported he received a call from the DWR and the BLM concerning a proposal by The Nature Conservancy to apply for grant money to lease conservation easement leases or purchase private land for sage grouse. The Conservancy District is requesting a letter of support from the County. The County is not willing to provide a letter of support for this idea. Building Permits A building permit was presented for Vern Earl for a manufactured home on Dude Ranch Road, Monticello. Commissioner Ty Lewis made a motion to approve the building permit. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Lisbon Valley Road Project/Design Administrative Assistant Rick Bailey presented the design contract from Creamer & Noble for the Lisbon Valley Road Project, Phase II in the amount of $120,524.88 for approval. Commissioner Ty Lewis made a motion to approve the contract. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. UAC Commissioners Workshop The UAC County Commissioners annual workshop will be held in Midway, Utah on September 25-26, 2003. National Park Service Tri-County Meeting The National Park Service Tri-County meeting will be held at Wahweep Lodge on September 10-11, 2003. Commissioner Lynn Stevens will attend. Drought Administrative Assistant Rick Bailey reported the County received a letter from Representative Matheson that stated the Secretary of Interior has announced that because of the exceptional drought, San Juan County is eligible for a livestock assistance program that will begin August 6 - October 24, 2003. Drought Declaration Administrative Assistant Rick Bailey is anticipating the Governor will sign a Drought Declaration today. It states that the entire State of Utah is in the fifth consecutive year of drought. Extreme drought conditions currently exist across the entire state with exceptional drought conditions in San Juan, Rich, Cache, and Washington counties. The situation continues to worsen presenting a serious threat to human health, public safety, private property, culinary and agricultural water infrastructure, livestock, wildlife, the economy, and environment. San Juan County Library Ordinance Administrative Assistant Rick Bailey presented the Library Ordinance to the commission for approval. Commissioner Ty Lewis made a motion to approve the Library Ordinance to become effective September 15, 2003. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. The ordinance is as follows: Ordinance No. 2003-01 ORDINANCE GRANTING CERTAIN RESPONSIBILITIES TO THE SAN JUAN COUNTY LIBRARY BOARD OF DIRECTORS AND ESTABLISHING CERTAIN POLICIES AND PROCEDURES FOR THE EXERCISE THEREOF Purpose: To delegate certain policy responsibilities to the San Juan County Library Board ("Board") and provide basic guidelines and procedures for library operation. The Board of County Commissioners of San Juan County, Utah, ordains as follows: SECTION ONE LIBRARY BOARD OF DIRECTORS 1.1 There is hereby established the San Juan County Library Board of Directors which shall consist of not less than five (5) and not more than nine (9) directors chosen from the residents of San Juan County. 1.2 Only one director of the Board may be a member of the Board of County Commissioners at any one time. 1.3 All directors shall be appointed by the County Executive with the advice and consent of the Board of County Commissioners. Appointments of the Board shall be made before the first day of July of each year in which the appointment is necessary. 1.4 Directors shall be appointed to serve for four (4) year terms, or until their successors are appointed and shall not serve more than two (2) consecutive full terms. 1.5 Terms of Directors shall be staggered so that approximately one- quarter of the Board is appointed each year. 1.6 Vacancies created by resignation, death, removal, or otherwise shall be filled for the duration of the unexpired term in the same manner as the original appointment. 1.7 The County Executive may remove any director for misconduct or neglect of duty. SECTION TWO BY-LAWS AND OFFICERS 2.1 The Board shall adopt by-laws for managing the business and affairs of the Board. 2.2 The County Treasurer shall have legal custody of all library fees/fines and other funds collected or received by the library and taxes and fees collected by the County and shall act as the treasurer of such funds. The County treasurer shall not be a member of the Board. 2.3 The Board shall elect a Chair and such other officers as specified by state law and or the Board's by-laws. The Chair shall arrange staff to take minutes and maintain official records of Board actions. SECTION THREE MEETINGS 3.1 The Board shall schedule regular meetings as it deems necessary and appropriate to conduct its business shall have no fewer than four (4) regular meetings during a calendar year. 3.2 A quorum shall consist of a majority of the Board of Directors. 3.3 Special meetings may be called at any time by the Chair, provided notice thereof is given to the public and all directors at least twenty-four (24) hours in advance. 3.4 Meetings shall comply with all the requirements of state law including, but not limited to, the Utah Open and Public Meetings Act. 3.5 If the Board director who is a member of the Board of County Commissioners is unable to attend any Board meeting, then that director may designate an alternate to act in the director's place, and the alternate's presence shall count as a Board director for purposes of meeting a quorum and voting. 3.6 Records of all Board meetings shall be kept, managed, classified, and disclosed as required by county ordinance and state law, including, but not limited to the Government Records Access and Management Act. SECTION FOUR COMMITTEES 4.1 Ad hoc committees for the study and/or investigation of library issues or other library matters may be appointed by the Board Chair to serve until the completion of the work for which they were established. SECTION FIVE DUTIES AND RESPONSIBILITIES OF LIBRARY BOARD 5.1 Subject to compliance with federal laws, state laws, and County ordinances and policies, the Board is hereby granted responsibility for: a. The expenditure of library funds; b. Establishing and revising policies in cooperation with the Library Director for the use operation, maintenance and care of the library, library facilities, equipment, staff, and other such resources. c. The purchase, lease, exchange, or sale of land; the purchase, lease, exchange, sale, or construction of buildings for the benefit of the library; and the purchase, lease, exchange, or sale of personal property for the benefit of the library. d. Establishing policies for the enforcement of library rules and applicable laws and ordinances. 5.2 Subject to compliance with federal and state laws regarding collections and information resources, the Board shall: a. Establish polices for the selection, acquisition, cataloging, maintenance, and use of the library collections and information resources. b. Submit those policies to the County Attorney for review for compliance with state and federal law. 5.3 Subject to compliance with federal laws, state laws, and County ordinances and policies, the Board shall: a. Recommend to the County Executive a competent person for appointment with those duties specified in a job description approved by the Board and the County Executive; b. Make an annual report to the County Executive and the Board of County Commissioners on the condition and operation of the library, including a financial statement; c. Submit an annual report to the State Library Board; d. Furnish to the County Executive, in writing, and prior to the time required by law to levy county taxes, an estimate of the amount of moneys necessary to establish, equip, and maintain the library, to provide library services during the next ensuing fiscal year and to certify the amount; and e. Perform such other duties related to the library as established in the official job description or as may be assigned by the County Executive; SECTION SIX DUTIES AND RESPONSIBILITIES OF THE LIBRARY DIRECTOR 6.1 The Librarian, as the County Library Director, shall: a. Serve as the executive officer for the Board; b. Serve as the administrative officer and department head of the County library system as a department of San Juan County in accordance with and subject to the requirement of County ordinances, policies, and procedures. c. Perform such other duties related to the library as established in the official job description or as may be assigned by the County Executive; d. Be an employee of the County subject to the personnel policies, procedures, merit system, and compensation plans approved by the County Executive and Board of County Commissioners. SECTION SEVEN EFFECTIVE DATE 7.1 This ordinance shall become effective on 09-15-2003 , or fifteen (15) days after its adoption and publication has been made as required by law, whichever date is later. This ordinance was duly approved and adopted by the Board of County Commissioners of San Juan County, Utah on the 11th day of August , 2003. There were no applicants. Therefore, Mr. Bailey recommended that the Soil Conservation Board members become the Weed Board. They are Bob Barry, Juan Hansen, Keith Ivins, Merlin Grover, and Rigby Wright. Commissioner Manuel Morgan made a motion to approve the Soil Conservation Board become members of the San Juan County Weed Board with Commissioner Ty Lewis to be the County liaison. Commissioner Ty Lewis seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Utah State University Higher Education/Satellite Sites Administrative Assistant Rick Bailey reported Utah State University Higher Education will be hosting a series of open houses throughout the County this week for their higher education centers. The schedule is as follows: Monticello - August 12, 2003 at 7:00 P.M. Montezuma Creek - August 13, 2003 at 7:00 P.M. east of Whitehorse High School. Monument Valley - August 14, 2003. Special Service Districts/Training Administrative Assistant Rick Bailey reported he has contacted the State Association of Special Service Districts to train the County special service districts. The training will be held on October 1, 2003. COMMISSIONER LYNN STEVENS REPORT Commissioner Stevens has been out of the County for the past couple of weeks. Commissioner Stevens will take Commissioner Lewis' place at the opening ceremony of the San Juan County Fair. COMMISSIONER MANUEL MORGAN'S REPORT Commissioner Manuel Morgan reported that he attended the Utah Navajo Revitalization meeting last week. The budget for the coming year was approved. Commissioner Morgan will attend the Utah Navajo Commission meeting on August 13, 2003. COMMISSIONER TY LEWIS'S REPORT Commissioner Lewis will be out of town for part of the week. Commissioner Stevens will take his place at the opening ceremony of the fair on August 13, 2003. There will be a dedication ceremony for the new Youth Center in Blanding on August 14, 2003. Commissioner Lewis attended the Utah Navajo Revitalization meeting on August 4, 2003. Commissioner Lewis attended the San Juan County Mental Health/Substance Abuse Board meeting on August 4, 2003 OPEN TIME AND OTHER BUSINESS Bob Musselman/Comments Bob Musselman, Monticello, commented on the Devils Campground utility issue and wanted to know if anything is happening there. Commissioner Lynn Stevens stated that S.E.A.O.G challenged the Forest Supervisor in Price who indicated that power would not be activated to any of those sites except for the campground host site. Mr. Musselman would like to know if the government can or cannot compete with private enterprise. Mr. Musselman also stated that some tourists don't like the way the community looks and that the City should be looking for ways to improve the area. Mayor Pehrson will be happy to visit with Mr. Musselman about these issues at another time and place. Water issues and a medical helicopter versus another hospital in the County was also mentioned. Blue Mountain Medical Issues Monticello City Mayor Scott Pehrson commented on a Blue Mountain Medical meeting held last week. Mayor Pehrson asked Commissioners Stevens and Morgan if they attended the meeting in the capacity of county commissioners. Commissioner Stevens stated he had. Mayor Pehrson asked questions concerning a letter from the commission in support of the Blue Mountain Hospital. Commissioner Stevens stated that the vote was two to one in support of the project and that that letter had been sent. Executive Session At 1:05 P.M.
