SAN JUAN COUNTY COMMISSION MEETING OCTOBER 6, 2003 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens, Chairman Manuel Morgan, Vice-Chairman Ty Lewis, Commissioner Rick Bailey, Administrative Assistant Melissa Begay, Administrative Services Manager Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the September 22, 2003 meeting as amended was made by Commissioner Manuel Morgan and seconded by Commissioner Ty Lewis. None opposed. Commissioner Lynn Stevens declared the motion carried. Circuit Breaker, Blind, Veteran/Tax Abatement County Clerk Norman Johnson presented the circuit breaker list recommendations to the commission for approval. Commissioner Ty Lewis made a motion to approve the circuit breaker list and require that the front page of their Federal income tax form be attached to next years application to verify proof of income. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Out-of-State Travel/Frank Morrell ITS Manager John Fellmeth presented an out-of-state travel request for Frank Morrell to attend the Comdex Computer Show/Conference/Training in Las Vegas, NV, on November 16- 20, 2003. The Commission requested that Mr. Morrell provide a written report on what he learned and how it will benefit the County. Commissioner Ty Lewis made a motion to approve the out-of-state travel request. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Board of Equalization/Reconsideration County Assessor Howard Randall presented a greenbelt application and three new renewal applications for approval. Also included are seven parcels in the Deer Haven Park subdivision requiring adjustments. The parcels that are five areas or less should be valued at $45,000. The parcels larger than five acres should be valued at $60,000. Commissioner Ty Lewis made a motion to approve the BOE actions. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. See attached list. County Residential Ordinance Tom Keogh, LaSal, reported he has a piece of rental property in LaSal and feels that because of the quality of the adjacent homes in the area it is becoming a less than desireable neighborhood. He has a hard time keeping renters in his property. He expressed concerns about building codes and enforcement of zoning rules in the County. Commissioner Stevens will go with the Sheriff Department to look at the area. Administrative Assistant Rick Bailey will speak with the Health Department, Building Inspector, and County Attorney and report back to Mr. Keogh. Business Operation on Public Lands/AAA Adventure-Ben Black Ben Black, Black Hawk, reported that under AAA Adventures he applied for a tour business permit with the BLM this spring. The BLM has not acted on the permit application. This years tourist season and revenue has been lost. The Commission stated that permission to travel on county roads is not required. Impact off the county roads would require a permit. Renewing an existing permit should not require any additional paperwork. The County will send the BLM a letter of support requesting they expedite approval or renewal of the permit. PERSONNEL DEPARTMENT REPORT Request to Hire/Monticello Senior Center The name of Tammy Marsh was presented to be hired part time as an aide in the Monticello Senior Center at Step 1 at $6.98 per hour effective October 6, 2003. Commissioner Manuel Morgan made a motion to approve the hire. Commissioner Ty Lewis seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Request to Hire/Blanding Senior Center The names of Penny Wilson, Assistant Cook, and Tonya Chee as an aide in the Blanding Senior were presented to be hired part time at Step 1 at $6.98 per hour effective October 6, 2003. Commissioner Manuel Morgan made a motion to approve the hires. Commissioner Ty Lewis seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. PLANNER EDWARD SCHERICK'S REPORT Resource Management Plan/BLM Planner Edward Scherick reported on the schedule for the BLM public meetings that will be held in several communities. He stated the BLM has requested that Commissioner Lewis make opening remarks at the Monticello meeting on October 21, 2003 at the high school and Commissioner Stevens make opening remarks at the Blanding meeting on October 22, 2003 at the Arts Center. ATV Safari Planner Scherick reported on the close out meeting for the ATV Safari. He stated that there were approximately ninety participants with ninety three volunteers. Ideas for next year were discussed with consideration of adding a few trails. One suggestion was to add a ride on the Reservation. For the most part the Safari went very well. The Executive Director of the Great Old Broads for Wilderness left a note that it was very well planned and carried out. The Safari will be applying for a five year permit. Commissioner Stevens complimented the businesses that were involved. Wild & Scenic Rivers Planner Scherick reported he has compiled most of the comments for the Wild & Scenic Rivers report. The Public Lands Council will review the document before the final submission to the BLM. San Juan Forum Commissioner Lewis stated the San Juan Forum was held last week. He feels the group is not very affective at this point. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits Building permits were presented for Dan Brown for a new home in Blanding; Sheri Pilibotion for a manufactured home in Spanish Valley; Marianne Bawden for a manufactured home in Spanish Valley; and Jim Peterson for a well house and storage in Eastland. Commissioner Manuel Morgan made a motion to approve the building permits. Commissioner Ty Lewis seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. CDBG Project/Blanding City Administrative Assistant Rick Bailey reported the City of Blanding is considering applying for a CDBG project for a skate park and tree planting project at Centennial Park. Due to the lack of Low and Moderate Income designation the City of Blanding has asked the County to sponsor the application with the City to complete all the paperwork. Monticello City Councilman Doug Allen commented that in the past the County has had a gentlemen's agreement for the entities to take turns in applying for the CDBG funds. Last year was the County's turn but did not use it so Blanding applied and received funds. It appears is should be Monticello City's turn to apply. Commissioner Stevens will meet with Doug Allen, Chris Webb, and a Blanding City Council member to decide whose turn it is to apply before a decision is made. Bid/Backhoe A bid was presented to lease a backhoe from Wheeler Machinery at $6,200 per year. Scott Equipment could not match the deal. Commissioner Ty Lewis made a motion to approve the lease. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Three Ton Truck A bid was presented for purchase of a three ton truck from Freightliner of Utah at $49,614 with no bid from Kenworth Sales. Commissioner Manuel Morgan made a motion to approve the bid. Commissioner Ty Lewis seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Ten Ton Trailer Bids were presented for two ten ton trailers from Rasmussen at $9,572 each and from Western Truck & Trailer for the same at $6,964 each. Commissioner Ty Lewis made a motion to approve the low bid from Western Truck & Trailer. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Coyote Bounty Administrative Assistant Rick Bailey reported the County received a contract amendment from the Utah Department of Agriculture and Food. They are allocating an additional $5,000 for the period July 1, 2003 - June 30, 2004 to be used in the coyote bounty program. County Clerk Norman Johnson reported on the proposal to reinstate the San Juan Coyote Bounty program and the procedure to verify the authenticity and location of the kill. The Sportsman for Fish and Wildlife have contributed $2,500. Mr. Johnson has prepared a voucher to use. The Sportsmen for Fish and Wildlife did not specify when the bounty should begin. County Clerk Norman Johnson will contact them to come in and answer questions. Commissioner Ty Lewis made a motion to accept the bounty money from the State. Commissioner Manuel Morgan seconded. Subdivision/Flat Iron Mesa Ranch Phase III Administrative Assistant Rick Bailey presented a change for Flat Iron Mesa Ranch Phase III. This would add Lot #22 to the subdivision. Preliminary approval has been made. Commissioner Ty Lewis made a motion to approve the changes in the Flat Iron Mesa Ranch Phase III plat. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Health Insurance Request Proposals Administrative Services Manager Melissa Begay reported on the proposal for health insurance for the County. Information packets have been sent out to five or six local companies. It was suggested the top 3 or 4 companies give a presentation of their proposal to the commission. If appropriate some managers or employees could attend the presentation to provide input. Utah Counties Insurance Pool Representative Commissioner Ty Lewis made a motion to appoint Administrative Assistant Rick Bailey as the representative for San Juan County at the UAC Insurance Pool meetings with Commissioner Lynn Stevens to be the alternate. The Resolution is as follows: RESOLUTION 2003-01 RESOLUTION OF APPOINTMENT OF A SAN JUAN COUNTY REPRESENTATIVE AND AN ALTERNATE REPRESENTATIVE FOR THE UTAH COUNTIES INSURANCE POOL MEMBERSHIP MEETING WHEREAS, the Board of County Commissioners of San Juan County, Utah is the proper authority to appoint a qualified person to act as the official representative for San Juan County at the Utah Counties Insurance Pool Membership Meeting to be held on November 11, 2003; and WHEREAS, the Board of County Commissioners of San Juan County, Utah, has been informed that the By-laws of the Utah Counties Insurance Pool require that the official representative and an alternate representative for San Juan County be elected or appointed officers or employees of a member county and be appointed by majority vote of the governing body and designated in writing, NOW, THEREFORE, be it resolved by the Board of County Commissioners of San Juan County, Utah, hereby appoint Rick M. Bailey as the official San Juan County representative for the Utah Counties Insurance Pool Membership Meeting to be held on November 11, 2003, with Lynn H. Stevens as an alternate representative. Bird Aging Contract Administrative Services Manager Melissa Begay presented a catering contract between White Mesa Ute Council and San Juan County Area Agency on Aging for signature. Commissioner Ty Lewis made a motion to accept the contract. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. EMS Accounts Receivable Linda Swenson, Ambulance Service, presented a list of IHS claims that have not been paid. She would like to know who has the authority to make payment schedules and write off decisions. The Commission suggested that Ms. Swenson could make collection decisions. The write off decisions should be brought to the commission for a decision. A blanket agreement was written and sent to IHS approximately six months ago. IHS was to identify the service areas covered. This has not been returned to the County so the ambulance service cannot assume that a patient is covered by IHS. Commissioner Manuel Morgan will follow up on the issues in question. COMMISSIONER LYNN STEVENS' REPORT Commissioner Lynn Stevens attended a meeting in Bluff on September 29, 2003 regarding the Amphitheater. Commissioner Stevens spent all day September 30, 2003 with the director of State Parks and Recreation. Commissioner Stevens will attend the AOG meeting on October 8, 2003. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis attended the Wind Conference in Salt Lake City last week. Commissioner Lewis meet with Congressman Cannon last week. Commissioner Lewis also attended the Spanish Valley Round Table meeting and public hearing on September 30, 2003 in Moab. COMMISSIONER MANUEL MORGAN'S REPORT Commissioner Manuel Morgan attended the UAC meeting in Midway, Utah. Commissioner Manuel Morgan attended the San Juan Health Services District Board meeting held in Blanding last week. Commissioner Morgan will to attend the Utah Navajo Revitalization meeting in Blanding this afternoon. OPEN TIME AND OTHER BUSINESS San Juan County Health Services Board Issues Grant Imel, San Juan Health Service Board Member, reported he attended the Health Board meeting in Blanding last week. He expressed his concern and frustration regarding the relationship between the Board and the administration of the hospital and the Board to the community. He presented a letter to each of the commissioners listing his concerns. A copy of the letter is on file in the County Clerk's office. The commission is willing to hold a public working meeting with the Health Board. Under the guidance of the County Clerk comments from public officials should be solicited on things they would like clarified in the meeting.
