SAN JUAN COUNTY COMMISSION MEETING OCTOBER 13, 2003 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens, Chairman Manuel Morgan, Vice-Chairman Ty Lewis, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the October 6, 2003 meeting as amended was made by Commissioner Ty Lewis and seconded by Commissioner Manuel Morgan. None opposed. Commissioner Lynn Stevens declared the motion carried. Deer Haven Plat/Signature Teague Eskleson, Deer Haven Subdivision, reported that she requested to split Lot #15. She has obtained letters from the other homeowners in the subdivision. Signatures have been obtained except for the commission. Commissioner Ty Lewis made a motion to approve it based on staff approval. Commissioner Manuel Morgan seconded. None opposed. After approval it was brought to the commissions attention that the home owner letters were not notarized. These letters are required to be notarized before the plat can be recorded. Tax Exemption/Blue Mountain Apartments, LLC John Housekeeper, Utah Navajo Trust Fund, requested tax abatement for 2003 and tax exemption in the future on a low income housing project in Blanding. There are 20 housing units and a community center situated on two parcels totaling 5 acres. He reported that Blue Mountain Dineh has been managing the project the last few years. Utah Navajo Trust Fund has stepped in to be the general partner. It was suggested the County Attorney check the ownership and use before a decision is made. Annual 2002 Audit Report Todd Beckstead, Chadwick, Steinkerchner, Davis, PC. presented the annual 2002 audit report and management letter to the commissioners. Commissioner Ty Lewis made a motion to accept the audit report. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Bid/Generator-Landfill Bids were presented for a generator for the landfill from Wheeler Power Systems for a 68KW Caterpillar/Olympian D75P1s Diesel Generator set at $17,550; Cummins Power Generation for an 60KW Onan Model 60 DGCB Diesel Generator set at $12,986 plus a Sound Attenuated Enclosure at $783.00; and EC Power Systems for a 60KW Kohler Model 60REOZJB Diesel Generator set at $13,610 to include on site training and installation. Commissioner Ty Lewis made a motion to approve the EC Power Systems bid. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Transient Room Tax Collection Administrative Assistant Rick Bailey reported the transient room tax collection issue was discussed at length at the UAC meeting in Midway, Utah. Several counties have agreed with the UAC position on collecting the tax. San Juan County is opposed. Mr. Bailey stated that Grand County is willing to come and train San Juan County in collecting locally. Accounts Receivable Policy Administrative Assistant Rick Bailey reported he would draft an accounts receivable policy for the landfill. He also discussed the EMS receivables position, the billing system, the need for some to make payments, or for some claims to be written off. Homestead Subdivision Administrative Assistant Rick Bailey presented the Homestead Subdivision Plat for approval. Mr. Bailey has spoken with Rick Meyer, Health Department. He has agreed to sign the plat. Commissioner Ty Lewis made a motion to approve the final plat of the Homestead Subdivision subject to Rick Meyers approval. Commissioner Manuel Morgan seconded. Utah Counties Insurance Pool Administrative Assistant Rick Bailey reported that Utah Counties Insurance pool has two vacancies on their board and is seeking nominations. Vandalism/Road Equipment Administrative Assistant Rick Bailey showed pictures of road equipment that was vandalized over the weekend. Replacement estimates on the windows have not been obtained at this point. Division of Water Rights The Division of Water Rights has set October 30, 2003 at 9:00 A.M. for the Bluff Water well hearing. It will be held in the County Courthouse. County Residential Ordinance Administrative Assistant Rick Bailey reported that things are moving forward on the Tom Keogh issue in LaSal. County Building Inspector Bruce Bunker has sent some letters. Rick Meyer, Health Department, will investigate the situation. Aging Medicaid Waiver Program/Contract Amendment Administrative Assistant Rick Bailey presented the contract amendment between San Juan County Area Agency on Aging and Four Corners Regional Care Center for approval. Commissioner Ty Lewis made a motion to approve the contract amendment. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. National Weather Service Administrative Assistant Rick Bailey presented a cooperating agreement with the National Weather Service for a proposed weather station on Abajo Peak. Total amount of the project is $28,000 with the County match being $6,000. Commissioner Ty Lewis made a motion to approve the proposal. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Wilderness Proposal Administrative Assistant Rick Bailey clarified with the commission the wilderness proposal ideas. He will write a letter to the congressional delegation stating the County has their wilderness proposal ready. It is the County's understanding based on conversation with Congressmen Cannon and Bishop that there will be no wilderness proposal made until after the next election. State Lands The National Conference of Commissioners for Uniform State Lands would like every state to have the same laws on state lands. They are currently working on uniform conservation easements throughout the nation. The County will write letters to Representative King and Senator Demtrich stating the county is opposed to that type of legislation. COMMISSIONER MANUEL MORGAN'S REPORT Accounts Receivable Policy-EMS/Donna Singer Donna Singer, Montezuma Creek Clinic, reported on the EMS accounts receivable for services provided to patients in the Montezuma Creek area. Utah Navajo Health Systems receives contract service funds from IHS to cover the patients liability for health care services outside of the Utah Navajo Health system. That liability is based on two factors. By federal law Indian Health Service is the payer of last resort. All other available resources must be identified first. They are only liable for that portion of the bill that would be the patients responsibility. Ms. Singer stated that IHS is more than willing to share information. She has reviewed the cases the County has questioned and found five cases which will be paid. She has copies of documentation for the list that she will give to Linda Swenson, EMS, to match with her records. Community Health Center Donna Singer, Community Health Center, reported that Utah Navajo Health System received a primary and preventative health grant that is available to all people who are uninsured and under insured. Navajo Mountain Health Donna Singer, UNHS, reported there will be a new clinic and two staff homes in Navajo Mountain in January. A physician and his wife have signed a contract and will live there. Commissioner Manuel Morgan attended an IHS conference which included road issues. Commissioner Morgan attended the Utah Navajo Revitalization meeting on October 6, 2003. San Juan County received $100,000 for road, recreation and senior citizens. COMMISSIONER TY LEWIS' REPORT Commissioner Ty Lewis attended the Utah Navajo Revitalization meeting on October 6, 2003. COMMISSIONER LYNN STEVENS REPORT Commissioner Lynn Stevens attended the AOG meeting on October 9, 2003. Commissioner Stevens spoke with Senator Bingaman's staff, New Mexico, concerning san Juan County support of a senate bill for roads on the Reservation. OPEN TIME AND OTHER BUSINESS Coyote Bounty Commissioner Stevens reported the Sportsmen for Fish and Wildlife contacted him concerning the coyote bounty program. They stated the start up for the bounty can be at any time now. County Clerk Norman Johnson stated he will issue vouchers and they can begin. Commissioner Stevens suggested that public notification should be made with a start up time. The County will place the advertizement in the newspapers. Special Service District Training County Clerk Norman Johnson reported he was asked to contact Jan Furner and San Juan Health Service District. He spoke with John Hart, San Juan Health Service District, and has given him Mr. Furners information in order that he may set up training for the Health Board. Oljato Visitor Center Peggy Humphreys, Community Development, reported she received a letter from UDOT requesting the release of the $100,000 San Juan County funds and the $50,000 from the Utah Travel Council that the County has already received for the Oljato Visitor Center. Commissioner Ty Lewis made a motion to authorize the release of the funds for the Oljato Visitor Center. Commissioner Manuel Morgan seconded. None opposed. Bid/Lawn Mower-Maintenance Dell Hunter, Grounds and Maintenance Supervisor, presented bids for a 17HP lawn tractor and bag from Sears at $1469.87 and from A-1 Saw Mower Co for a 15HP lawn tracker and bagger at $1724. Commissioner Ty Lewis made a motion to approve the low bid. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Road/Shorty Todachennie Commissioner Manuel Morgan reported that an area near the road to Shorty Todachennie home has been washed away. They are requesting the County place some big rocks in that area to keep the water from washing the area away. It was stated that the culvert was not big enough to handle all the water which backed up causing the problem. The Commission suggested he meet with Farm Services to see if they can help him. The Commission will speak with the south Road Department and have them look at the situation and report back to Commissioner Morgan.
