SAN JUAN COUNTY COMMISSION MEETING NOVEMBER 3, 2003 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens, Chairman Manuel Morgan, Vice-Chairman Ty Lewis, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the October 27, 2003 meeting as amended was made by Commissioner Ty Lewis and seconded by Commissioner Manuel Morgan. None opposed. Commissioner Lynn Stevens declared the motion carried. 2004 Preliminary Budget ITS Manager John Fellmeth and County Clerk Norman Johnson presented the 2004 Preliminary Budget to the commissioners for review. The commissioners will meet with department heads concerning their budgets beginning at 1:00 p.m on November 10, 2003 and again on November 17, 2003. County Clerk Norman Johnson reported that the elected officials would also like to meet with the commissioners during this time. Bid/Office Furniture-Recorder's Office County Recorder Louise Jones presented bids for a front counter, two "L" shaped workstations and 2 "U" shaped workstations from Reed Baier Office Interiors in the amount of $6,477.66; from Midwest Office for two "L" shaped workstations, two "U" shaped workstations plus trip & installation charges for a total of $11,495; and from K-Log for two "L" shaped workstations and two "U" shaped workstations at $5,008. Commissioner Ty Lewis made a motion to accept the bid from Reed Baier Office Interiors which includes a front counter. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Canyonlands National Park Service/Patty Trapp Jerry Banta, Canyonlands National Park Service Superintendent, introduced Patty Trapp as the interim superintendent of Hovenweep and Bridges National Monument. She is replacing Greg Dungeon who has transferred to Alaska. It will be several months before the position is permanently filled. Jerry Banta will be retiring from the Park Service on January 3, 2004. PLANNER EDWARD SCHERICK'S REPORT Public Lands Council Planner Scherick reported that he feels the Public Land Council needs to be more pro-active in things that they see as an economic benefit to the County. There is a real interest in all kinds of recreation such as equestrian use, ATV's, and biking. Healthy Forest Initiative President Bush is pushing the Healthy Forest Initiative on how to deal with forests. A lot of this has come about because of the recent fires in Southern California. Some changes need to take place. Glen Canyon Recreation Area Commissioner Lewis stated he received a flyer concerning expanding Glen Canyon Recreation Area. One concern is the Spotted Owl habitat issue. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Advisory Task Force Administrative Assistant Rick Bailey reported that Governor Leavitt announced he has formed a Recommendation Advisory Task Force to review all wilderness proposals which will be submitted to the new governor. The group will be made up of representatives of the outdoor industry, state government, and rural county commissioners and will be charged with specific duties. This will include developing a marketing plan, promote Utah's outdoor recreation industry, identify state's premiere outdoor recreation destinations and natural assets, assess the land management practices in place, wilderness characteristics and identify several other areas of concern. Gunnison Sage Grouse Habitat Mr. Bailey reported the Nature Conservancy has submitted an application to the State for funds to purchase or lease perpetual right of way easements. Commissioner Lewis stated the habitat is not the issue, the predator is the issue. Health Insurance Proposal Extension Administrative Assistant Rick Bailey stated that Steven Burtenshaw has requested an extension on the proposals for health insurance. The deadline was last friday at 5:00 p.m. Three companies did submit their proposals. There is an issue in which Mr. Burtenshaw has asked for some information on three claimants. There are new HIPPA requirements in place. Mr. Burtenshaw would like prognosis information on these three claimants in order to present a more accurate bid proposal. The Commission would like to have a discussion with the County Attorney before a decision is made. Building Permits Building permits were presented for Teague Eskelsen for a new rental building in Old LaSal and for Richard Cordero for a manufactured home in Spanish Valley. Commissioner Ty Lewis made a motion to approve the building permits. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Building Inspector Department Commissioner Lynn Stevens reported that last year when the Building Inspection Department was created and a person was hired, a decision was made that there would be a one year probation period. Commissioner Stevens feels, at some point soon, an accounting of how that department has done financially should be completed. A decision should be made on the department and position. Mr. Bailey indicated he will conduct a review this month. Bid/Metal Bender-Road Dept Bids were received from Mike-X-Equipment for a 50 ton ram, Air/hyd pump, 10" hyd hose, gauge, and accessory kit for $1,553 plus $60 freight for a total of $1613 and from Gustin Hydraulics for the same at $1,881 plus $50 freight for a total of $1,931. Commissioner Ty Lewis made a motion to approve the low bid. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. CDBG Hearing Administrative Assistant Rick Bailey reported that a CDBG public hearing was held last week. Blanding City has conducted a survey and will sponsor their project. Bid/GPS Crew/Vehicle Administrative Assistant Rick Bailey reported the GPS crew is using an old S10 Blazer that is very un-reliable. He and Road Department Supervisor Doug Pehrson have discussed the issue. Their proposal is to take Mr. Pehrson's Dodge Dakota and give to the GPS crew and purchase a new truck for Mr. Pehrson's use. A state contract bid was presented from West Valley Dodge for a 2004 Dodge Dakota V-8 4X4 crew cab at $19,275. Commissioner Ty Lewis made a motion to approve the bid. Bid/Senior Center Van/Aging Department Administrative Assistant Rick Bailey reported on the status of the handicap seniors in Monticello and Blanding. There are two in Monticello and three in Blanding with two from Blanding going out of the area. Coordination of the current van will be made available to seniors in both areas. A state contract bid was presented for a 2004 Chevrolet S10 4X4 pickup from Young Chevrolet at $17,972 and from Butterfield Ford for a Ford Explorer at $20,562. This vehicle will be used by the Case Manager in the Aging Department. Commissioner Ty Lewis made a motion to approve the bid from Young Chevrolet. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Mill Tailings Meeting There will be an all day DOE Mill Tailings meeting in Moab on November 20, 2003. Bluff Water Well Hearing Administrative Assistant Rick Bailey reported the Bluff water well hearing was held on October 30, 2003 in the commission room. Three state people were in attendance. The person submitting the objection did not present any thing new. The State evaluation people will give a report in 30 day with the appeal process indicated. The well permit was not for a culinary well and could only be drilled in a specific place near the fire station. Utah Division of Emergency Management Administrative Assistant Rick Bailey reported that the Division of Emergency Management provides funds to help the County with some of their operations in the amount of $7,000. Commissioner Ty Lewis made a motion to accept the money. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Navajo Revitalization Money Melissa Begay, Administrative Services Manager, reported to the commission that Mexican Water Chapter is out of road monies that the County provides. They used their money on emergency flood issues. The commission clarified what the money could be used for. Ms. Begay will develop a policy for emergency proposes in order to adjust funds for use in specific situations. Aging Contract Amendment Administrative Assistant Rick Bailey presented an Aging Contract Amendment. The Amendment is to increase the FY2004 Contract budget by $62,891 from FY2003 carryovers, additional Alternatives and Caregiver funds, and a change in the Ombudsman allotment for a total of $396,708. Commissioner Ty Lewis made a motion to approve the amendment with Deputy Attorney Bird to review. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. COMMISSIONER MANUEL MORGAN'S REPORT Commissioner Morgan will attend UAC Conference in St. George next week. Commissioner Morgan will follow up with South Road Foreman Lynn Laws concerning the Shorty Todachennie road issue. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis will attend the San Juan County Mental Health/Substance Abuse board meeting this afternoon at 4:00 P.M. Commissioner Lewis has been invited to attend a tour day on Wind. He is not sure if he will be able to attend. COMMISSIONER LYNN STEVENS REPORT Commissioner Stevens stated he will attend the Library board meeting on November 11, 2003 to talk about their budget. They would like to use the tax revenue for books, etc. rather than for capital projects. Commissioner Stevens reported he took Scott Berkenfield, BLM Recreation Planner, on a horse ride to the top of Texas Flat. They had an enjoyable time. Insurance Benefit/Retirement Commissioner Lynn Stevens reported on the discussion of creating a policy for retirees to convert their sick leave hours in to an insurance premiums The proposal was that eight hours of sick leave would purchase one month of health insurance up to five years or until eligible for medicare if that time period is less than five years. Commissioner Lewis feels there are a lot of unknowns and is hesitant to support the idea. No decision was made. It was suggested that a group meet and look at alternatives and discuss the various issues. Planner Scherick committed to meet with the group. Monticello City Councilman Doug Allen suggested the County really decide what is best for the County. OPEN TIME AND OTHER BUSINESS Coyote Bounty The County received a letter from Sarah Hayduk, Bluff, Ut. concerning the coyote bounty issue. County Clerk Norman Johnson read the letter as follows: This letter is a follow-up to our conversation this morning. I am concerned that individuals setting illegal traps could qualify for the $20 Coyote Bounty unless "inspection and verification" at the County's 4 Coyote Bounty inspection sites includes verifying the trappers identification number, a requirement of the Utah Division of Wildlife Resources. One of our dogs was caught this week in an illegal leg hold trap (no "spacers" on the trap jaw as required by DWR) and with no ID mark or tag with a registered trapper's number. I will be most appreciative if you can present this concern to the County Commissioners at the earliest opportunity. No decision was made. The issue will be referred to the sheriff's office. Executive Session At 1:08 P.M. Commissioner Ty Lewis made a motion to convene in to an executive session to discuss legal implications of extending the health insurance RFP for 30 days. Commissioner Ty Lewis made a motion to extend the RFP process for 30 days until noon on December 1, 2003. All submitted proposals are to be sealed and returned to the agencies if they so desire. The County will attempt to acquire and provide additional claims exposure information to the four companies who expressed an interest in providing an RFP and met the original deadline.
