SAN JUAN COUNTY COMMISSION MEETING JUNE 7, 2004 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens, Chairman Manuel Morgan, Vice-Chairman Ty Lewis, Commissioner Rick Bailey, Administrative Assistant Norman Johnson, County Clerk LaVee Scherick, Deputy Clerk A motion to approve the minutes of the May 24, 2004 meeting as written was made by Commissioner Ty Lewis and seconded by Commissioner Manuel Morgan. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Carpet-Fair Stage Anna Thayn, Fair Director, presented a bid for 106.6 yards commercial grade carpet for the portable fair stage from Economy Contracting at $995 and from Flooring America for the same at $489.29. Commissioner Ty Lewis made a motion to approve the bid from Flooring America. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Risers-Fair Anna Thayn, Fair Director, presented bids for 2 4X8 Risers an 1 3 Step Stair from Monroe Table Company at $862 plus shipping and from Church Furnishings & Accessories for the same at $1,141.34 plus shipping. Commissioner Ty Lewis made a motion to approve the bid from Monroe Table Co. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Computer-Treasurer's Office County Treasurer Paul Barr presented a bid for an AMD Athcon 2800 computer without a monitor from Dartek at $724.93 and from Dell Computers for the same at $1,150. Commissioner Ty Lewis made a motion to approve the bid from Dartek. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Bid/Book Return-Monticello Library Grounds & Maintenance Supervisor Dell Hunter presented a bid for an outside book return for the Monticello Library. The commission asked that Librarian Vee Carroll come and discuss the outside book return before a decision is made. PERSONNEL DEPARTMENT REPORT Request to Hire/Road Laborers Deputy Attorney Walter Bird presented the names of Cody Pehrson and Jason Wareham to be hired as temporary road laborers at Step 33 at $8.90 per hour effective June 1, 2004. Commissioner Ty Lewis made a motion to ratify the hiring of the temporary road laborers. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Request to Hire/Grounds & Maintenance Supervisor Deputy Attorney Walter Bird presented the name of "Monty" Carl L. Perkins to be hired full time as the Grounds & Maintenance Supervisor at Step 192 at $3119 per month effective June 21, 2004. He will replace Dell Hunter who will be retiring at the end of June. Commissioner Manuel Morgan made a motion to approve the hire. Commissioner Ty Lewis seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. RESOLUTION 2004-02/Pre-Disaster Mitigation Plan Administrative Assistant Rick Bailey recommended the commission approve the Pre- Disaster Mitigation Plan with one exception. The Plan it will try to discourage International Uranium Corporation from taking additional waste. The County does not support that idea and will attach a letter indicating such. Commissioner Ty Lewis motioned to approve the plan except the statement dealing with IUC. The County will take responsibility to make plan changes specific to county needs and keep the official document in the County offices. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. The resolution is as follows: RESOLUTION NO. 2004-02 SAN JUAN COUNTY A RESOLUTION ADOPTING THE SOUTHEASTERN UTAH ASSOCIATION OF LOCAL GOVERNMENTS PRE-DISASTER HAZARD MITIGATION PLAN AS REQUIRED BY THE FEDERAL DISASTER MITIGATION AND COST REDUCTION ACT OF 2000. WHEREAS, H.R. 707, the Disaster Mitigation and Cost Reduction Act of 2000, was signed into law on October 30, 2000, and WHEREAS, the Disaster Mitigation Act of 2000 requires all jurisdictions to be covered by a Pre-Disaster Hazard Mitigation Plan to be eligible for Federal Emergency Management Agency post-disaster funds, and WHEREAS, Southeastern Utah Association of Local Governments (SEUALG) has been contracted by the State of Utah to prepare a Pre-Disaster Mitigation Plan covering all of the jurisdictions in the SEUALG Area, and WHEREAS, the SEUALG Executive Council approved SEUALG Staff to write the plan, and WHEREAS, San Juan County is within the SEUALG Area, and WHEREAS, San Juan County is concerned about mitigating potential losses from natural disasters before they occur, and WHEREAS, the plan identifies potential hazards, potential loses and potential mitigation measures to limit losses, and WHEREAS, the San Juan County Commission has determined that it would be in the best interest of the community as a whole to adopt the Pre- Disaster Hazard Mitigation Plan as it pertains to the County, therefore BE IT RESOLVED BY THE SAN JUAN COUNTY COMMISSION THAT: The attached "Southeastern Utah Association of Local Governments Pre- Disaster Mitigation Plan" be adopted to meet the requirements of the Disaster Mitigation and Cost Reduction Act of 2000 with the exception that Goal 2, Part 10, Page 18 be removed from the plan approved by the San Juan County Commission and that the official and authorized plan for San Juan County will be maintained and kept by the Office of the County Fire and Emergency Services Department of the County. Johnson, Clerk San Juan County PLANNER EDWARD SCHERICK'S REPORT Western Slope No Fee Coalition Planner Edward Scherick reported the County has had concerns with fee demo full cost recovery on NEPA, debates on roads, etc. Kitty Benzar, No Fee Coalition, discussed with the commissioners the Recreational Fee Demonstration program. It is a program passed by Congress in 1996. It was supposed to be a two year demonstration program to allow the federal land management agencies to charge a fee for things they had not been allowed to charge for previously. Fees that were already being charged could be increased. The agency collecting could keep that money. It was called the "Pay to Play Theory". It has been extended several times and has never been a honest legislation. It has always been a demo program that keeps being extended. It has hit tremendous opposition from the public. However, the agencies love it because they keep the fees. The agencies are pushing very hard to get this program made permanent. There is legislation right now under HR 3283 that would establish "The America the Beautiful Pass" backed by the current Administration. This pass would be required to enter all federal public lands. Ms. Benzar requested the County support by resolution their position in opposing The America The Beautiful Pass program. Commissioner Ty Lewis suggested the sample resolution be given to Planner Scherick, Sheriff Lacy, and Deputy Attorney Bird to analyze and bring a resolution to the commission for approval. SSBG Grant/Recommendations Planner Scherick presented the recommendations for funding of the Social Service Block Grant as follows: College of Eastern Utah, parenting packets & day care in amount of $2,838.41; Transitions, Transportation & operating costs in amount of $8,000; San Juan County Area Agency on Aging for transportation for the elderly in the amount of $14,000; San Juan County AAA Health, health needs and supplies in the amount of $17,000; and San Juan Counseling for transportation and meals in the amount of $18,000. Arch Canyon/BLM Planner Scherick reported the US Attorney and the Solicitors Office in Washington D.C. met last week to determine if, or who might be cited for the trip up Arch Canyon in May. The potential candidates for citations are: Lynn Stevens in his capacity as Chairman of San Juan County Commission, Mike Lacy, as San Juan County Sheriff, Dale Lemmon, Jeep Jamboree, and Mark A. Smith as the permit agent for the Jeep Jamboree. Salt Creek Canyon Road Planner Scherick reported that he and Commissioner Stevens met with the National Park Service in Moab last week and offered them an opportunity to sign a document wherein the Park Service would acknowledge their ownership of the Salt Creek Road. Local Park officials indicated they did not have authority to sign such a document but agreed to present it to the solicitors office for a decision. Since that time the document has been forwarded to the Washington Office of the National Park service for review. In the interim the Park Service has received their proposed rule from the federal office of management and budget for closure of Salt Creek Canyon Road. The rule will now be published in the federal register and in 30 days can become a final rule. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Homeland Security Administrative Assistant Rick Bailey reported the County has received their allocation from the State for Homeland Security for equipment for 2004. He stated that he and Sheriff Lacy and staff have looked at the requirement, what is eligible and priority needs concerning the communication system in the County. They have determined the communication system in the jail and the Abajo Peak equipment needs to be upgraded to meet the needs that are coming in the future. There are three things they are looking at with the State. One is to put an additional frequency at Bald Mesa, another repeater frequency at Cold Springs, and upgrade Abajo Peak. The State has agreed to provide technicians and people to maintain at an hourly rate. Commissioner Ty Lewis made a motion to support the Homeland Security grant to update the communications system in the County. Commissioner Manuel Morgan seconded. None opposed. San Juan County Mental Health/Substance Abuse Special Services District/County-Wide Services Plan Administrative Assistant Rick Bailey presented the San Juan County Mental Health/Substance Abuse Service Plan to the commission for approval. Commissioner Ty Lewis made a motion to approve the Service Plan. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Building Permits Building permits were presented for John Tangren for a manufactured home in Spanish Valley and for Kent Adair for a new home on Haller Rd east of Monticello. Commissioner Ty Lewis made a motion to approve the building permits. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. LaSal Recreation Special Service District/Board Member The name of Keri Deeter was presented to continue on the LaSal Recreation Special Service District Board. Mosquito Control The County has received a $5,000 grant from the Department of Agriculture for Mosquito control for the Bluff Service Area project. The funding has been sent to them. COMMISSIONER LYNN STEVENS REPORT Commissioner Stevens attended meetings in Salt Lake City, Ogden, Price, Richfield, and Green River last week. This week Commissioner Stevens will attend an RS2477 Executive Committee meeting in Salt Lake City. Commissioner Stevens will not be at Commission meeting on June 14, 2004. He will be meeting with the Lt. Governor and BLM concerning road issues. COMMISSIONER MANUEL MORGAN'S REPORT Bluff Service Area/Community Center Commissioner Morgan stated there is an issue of charging the Navajos a higher rate than anyone else for use of Bluff Community Center. Deputy Attorney Bird will check on the situation. Utah Navajo Revitalization will be held this afternoon at 1:00 P.M. in Blanding. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis attend the WIR Conference in Ogden last week. Commissioner Lewis will attend the Navajo Revitalization meeting this afternoon at 1:00 P.M. in Blanding. Commissioner Lewis will attend the AOG meeting in Price on June 10, 2004. Commissioner Lewis and Administrative Assistant Bailey will attend the hearing in Spanish Valley concerning the Special Service District on June 14, 2004 at 7:00 P.M. OPEN TIME AND OTHER BUSINESS State Environmental Air Quality Jerry Holliday, Holliday Construction, received a letter from the State Environmental Air Quality stating they are authorized to charge $500 for each re-location authorization of equipment. Commissioner Stevens will speak with the Lt. Governor this week concerning this issue. The County will send letters to the State Representatives. Payroll Change/Corporal Position Sheriff Mike Lacy stated he would like to make a fourth corporal position in order to have a corporal cover one of each of the four shifts in the jail and also to be over the grants for the department. He would also like to make a corporal position on the road. Commissioner Ty Lewis made a motion to approve the two corporal positions. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. A payroll change was presented for Preston Palmer to be moved from a jailor to a corporal position. He will be moved from Step 125 at $2301 per month to Step 136 at $2417 per month. Commissioner Ty Lewis made a motion to approve Preston Palmer in the corporal position.
