SAN JUAN COMMISSION MEETING DECEMBER 27, 2004 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens, Chairman Manuel Morgan, Vice Chairman Ty Lewis, Commissioner Rick Bailey, Administration Assistant Norman Johnson, County Clerk Dara Whatcott, Deputy Clerk A motion to approve the minutes for the December 13, 2004 meeting was made by Commissioner Ty Lewis. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared motion carried. Beer License Approvals: Norman Johnson, County Clerk presented the names of businesses that would like to renew their Beer License for 2005. Fry Canyon Lodge, Sunrise Convenience Store, La Sal Store, Aramark Services Halls Crossing Store, Halls Crossing Marina, and Haitt Store. Commissioner Manuel Morgan motioned to approve the renewal Beer License for 2005. Commissioner Ty Lewis seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Selection of Independent County Auditor: Norman Johnson presented the bids for the County Auditors-they are Larson & Company in Spanish Fork, Smuin, Rich & Marshing in Price. Commissioner Ty Lewis motioned to approve the low bid of Larson & Company. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Out of State Travel: Bruce Bunker, Builder Inspector, requested Out of State Travel for an Educational Conference and Seminar in Las Vegas in March for $821, and a World of Concrete Seminar in Las Vegas in January for $921. Commissioner Ty Lewis motioned to approve the Out of State Travel for Bruce Bunker. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Peggy Humphrey, Community Development, requested Out of State Travel to attend a Travel Show, representing the State of Utah, in Cincinnati in January, for $1,259. Commissioner Ty Lewis motioned to approve the Out of State Travel for Peggy Humphrey. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. Public Hearing /Zoning Change-Harris Lane: Commissioner Ty Lewis motioned to go into a Public hearing for a zoning change- Harris Lane. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. The Commission and Mr. Bailey discussed the zoning change, and asked for comments from the public, there were none. Commissioner Lynn Stevens declared the motion carried Commissioner Ty Lewis motioned to change the zoning from agriculture to CDI Controlled Industrial on the total acreage of the Recapture Metals Property on Harris Lane. Commissioner Lynn Stevens declared the motion carried. 2003 Audit Report/ C S&D Company/ Todd Beckstead: Todd Beckstead representing Chadwick, Steinkirchner & Davis discussed the Audit Report for 2003. The County has successfully completed the change required by GASB34. San Juan County is in good financial shape and added $53 million dollars of assets due to GASB34. Four areas of concern are expressed in the management letter: 1. Navajo Bus Route Grant money was not spent within the required time frame. 2. There were two funds over budget, they were the Roads Capital Improvement Fund and the Landfill. 3. The State Form TC693 was not in balance with the counties final adopted budget. 4. The EMS receivable are difficult to follow and the reports are insufficient to rely on. Todd stated he appreciated the staff and the working relationship they had. It is the end of their 3 year contract and he regrets they were not able to bid on the next 3 years, due to various problem, most of which center around their being a Colorado Firm. Public Hearing/ Adjustment 2004 General Fund and Related Budgets: Commissioner Ty Lewis motioned to go into public hearing to discuss adjustments to the 2004 budgets. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. County Clerk Norman Johnson and Deputy Auditor John Fellmeth reviewed the current budget showing projected expenses through December 2004. It was requested that County Clerk/ Auditor Norman Johnson ,as the budget officer, be authorized to make interdepartmental adjustments to the 2004 General fund budget. An adjustment of $145,402 was made to the Landfill Budget, $750,000 was added to the Road Capital Budget and $23,718 to the Library Budget. There were no public comments. Commissioner Manuel Morgan motioned to authorize County Clerk, Norman Johnson to make interdepartmental adjustments necessary to balance the General Fund Budget and make the required adjustments to the Road Capital Budget, Landfill Budget and the Library Budget. Commissioner Ty Lewis seconded. None opposed. Commissioner Lynn Stevens declared the motion carried. See adjusted budget attached at the end of the minutes. Public Hearing/ Adjust Elected Officials Salaries: Commissioner Ty Lewis motioned to go into a Public Hearing to discuss the 2005 elected officials salary. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared motion carried. It was discussed that in general, employees including elected officials, will receive a pay increase of a 3% cost of living adjustment and a 2% departmental and elected officials merit. Specific individual elected official and employees adjustment may be made by the commission. There were no public comments. Commissioner Ty Lewis motioned to go out of the Public Hearing. Public Hearing/Adoption 2005 General Fund and Related Budgets: Commissioner Ty Lewis motioned to go into a Public Hearing for the Adoption 2005 General Fund and Related Budgets. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared motion carried. Deputy Auditor John Fellmeth and County Clerk Norman Johnson discussed the 2005 General Fund and Related Budgets. The discussion centered on increasing the budget to include $5,000 for the Navajo Mountain Pioneer Days, the Street Lighting Project in Montezuma Creek and reducing the budget in Television/Communication to eliminate the requested for a Pickup Truck. The Blanding City budget requests were reviewed and the following conclusion reached: Item #3- Hanger Maintenance was not approved. Item #6-Forgiving Dump Fees was not approved. Item #8-Free use of Gravel was not approved Item #9-Was spread over 2 years with a requirement that the city present a plan of improvements and maintenance for the Walter C. Lyman Park Commissioner Stevens asked for any other comments from the Audience. There were no other comments. Commissioner Ty Lewis motioned to go out of the Public Hearing. Commissioner Ty Lewis motioned to approve the Adoption 2005 General Fund and Related Budgets, using a transfer from the Capital Improvement Fund to balance the budget. Commission Meeting 2005 Schedule: County Clerk Norman Johnson reported that it is required by law that the schedule for Commission meetings be published in the newspaper. At present the Commission meetings are held each Monday except on the 5th Monday no meeting will be held. In the event that a holiday falls on Monday, then the regular meeting will be held the Tuesday following. Commissioner Ty Lewis made a motion to retain the same Commission Meeting schedule for 2005 and Commissioner Manuel Morgan seconded. Commissioner Lynn Stevens declared motion carried. Rick Bailey Administration Assistant Report: Building Permits: Rick presented two building permits, one is for Marc Grossman in Lasal, and the seconded one is for Fidel Martinez out east of Monticello. Commissioner Ty Lewis motioned to approve the building permits. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared motion carried. Intergovernmental Approval- Television Service with Counties: Rick presented a Interlocal agreement with the other Counties for an Eastern Utah Television and Technology Association. Commissioner Ty Lewis motioned to approve the interlocal cooperative agreement with four other counties. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared motion carried. Road Department Procurement: Rick presented a bid for the Road Department for a Dump body for two Dump trucks. Tesco Williamsen bid $27,466.00 each truck. Total is $54,932.00. Commissioner Ty Lewis motioned to approve the bid from Tesco Williamsen. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Stevens declared motion carried. Planner Evan Lowry's Report: Enterprise Zone Designation Resolution: Evan Lowry presented the Enterprise Zone Designation Resolution. Resolution No. 2004-06 Supporting submission of an application for enterprise zone designation. Whereas, San Juan County is currently experiencing significant industrial growth associated with the overall economic prosperity of the State of Utah and its advantageous geographic location. Whereas, this growth creates both challenges and opportunities for a county seeking to promote economic vitality while sustaining its quality of life. Whereas, San Juan County is eligible to submit an application for designation as a Utah Enterprise Zone. Now let it be therefore resolved by the San Juan County Commission that 1. The San Juan County Commission herewith submits this Proposal for Enterprise Zone Application: San Juan County, Utah to the Utah Department of Community and Economic Development. 2 A copy of this application is to remain on file with the San Juan County Clerk. Airport/ Generator: Rick stated that there is not a back-up generator at the Landfill. He presented a bid for a generator for the Airport, the replaced one will go to the landfill. EC Power Systems bid the generator $14,256. Commissioner Ty Lewis motioned to approve the new generator for the Airport and place the old generator at the landfill. Commissioner Manuel Morgan seconded. None opposed. Commissioner Lynn Steven declared motion carried. Commissioner Ty Lewis Retirement: At the conclusion of today Commission Meeting. Commissioner Ty Lewis is retiring after 18 years of faithful service to San Juan County. Expressions of appreciation were voiced to Ty and gifts were presented by ex commissioner Bill Redd and the County staff. A luncheon in his honor was held following commission meeting.
