SAN JUAN COUNTY COMMISSION ROOM August 15th, 2005 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission room at Monticello, Utah. Present: Lynn Stevens, Chairman Bruce Adams, Commissioner Manuel Morgan, Vice Chairman Norman L. Johnson, Clerk/Auditor Rick Bailey, San Juan County Administrator Hannah R. Whipple, Deputy Clerk A motion to approve the minutes of August 8th, 2005, as amended, was made by Commissioner Bruce Adams. Commissioner Manuel Morgan seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. San Juan County Sheriff Mike Lacy presented the Court Security Contract for San Juan County Seventh District Court. Commissioner Bruce Adams made a motion to approve the contract. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Commissioner Manuel Morgan was not present for this action. Mr. Jared Shumway discussed with the Commissioners The San Juan Estates. The Commissioners referred him to the County Building Official for further processing. Walter Bird, Personnel Office - New Hires Mr. Bird presented the name of Judy Fulks for the Community Development/Visitors Services Receptionist/Clerk, Grade 6, Step 40. Commissioner Manuel Morgan made a motion to approve the hiring of Judy Fulks. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Walter presented the name of Kirsten Hendry for the Blanding Library Assistant, Grade 1, Step 1. Commissioner Manuel Morgan made a motion to approve the hiring of Kirsten Hendry. Evan Lowry - Planning Department Report Evan reported on the Cost Recovery Letter from the BLM for the ATV Safari. They will be making a refund of $2563.00. Evan presented the Commissioners with a letter in support of the Pine Ridge 3D Seismic Exploration Project. Commissioner Bruce Adams made a motion to approve the support letter. Commissioner Manuel Morgan seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Mr. Lowry requested a signature accepting the Right-of-Way Grant from the BLM in the Canyon Rims area. Evan presented the Commissioners with a letter in support of prescribed burning around Buckeye Reservoir. The letter encourages Timber Sales rather than just burning. Commissioner Manuel Morgan made a motion to approve the letter. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Mr. Lowry presented a letter to the State Director of the BLM in opposition of the deferral of oil and gas leases. Commissioner Manuel Morgan made a motion to approve the letter. Johnson - County Clerk/Auditor Mr. Johnson requested the Commissioners sign a Statement of Confidentiality Pursuant to Utah Code Ann. 59-1-404, government officials involved directly or indirectly in the assessment process are obligated, with certain exceptions, to prevent the disclosure of proprietary financial, business, operating, and strategic information of a commercial enterprise to competitors or entities that might use the information to their advantage. Disclosure of commercial information is not permitted for use by appraisers, in commercial publications, or for other purposes unrelated to the property tax appeal process. Mr. Johnson presented the Commissioners with a bid and Procurement request for a folding machine from Quill for $795.00. Mr. Johnson informed the Commissioners that the Election department has the funding to pay for the machine. Commissioner Manuel Morgan made a motion a approve the folding machine. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Rick Bailey, County Administrator Report Mr. Bailey presented to the Commissioners the following building permits: Dewey Jarrett - El Rancho Estates - Manufactured Home - Spanish Valley Rick & Cindy Hirschfeld - Blue Mountain Estates - Remodel - Blue Mountain Ranch Commissioner Manuel Morgan made a motion to approve the building permits as presented. Commissioner Bruce Adams seconded the motion. None Opposed. Commissioner Lynn Stevens declared the motion carried. Mr. Bailey presented the Commissioners with the Predator Control Contract for 2006. Commissioner Bruce Adams made a motion to approve the contract. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Mr. Bailey informed the Commissioners that he received a letter from the BIA and they will transfer funds in the amount of $930,000 for the Red Mesa Road Project. Commissioner Manuel Morgan made a motion to go into a public hearing for a Zoning Variance. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Public Hearing: At issue is the location of the property boundries and how many feet variance is being requested. Dennis Vitale who owns property to the east of Mrs. Dyers property and shares a property line with the Dyer's spoke in opposition of the variance. He also spoke about the adverse effects to his property. Rick Hirschfeld who owns property at the Blue Mountain Guest Ranch also spoke in opposition of the variance. He believes that the ordinance should be followed as written. Mr. Vitale will pay for a new survey to establish the property boundaries to which Mrs. Dyer agreed for the survey to be conducted on her property. Commissioner Bruce Adams made a motion to go out of the public hearing. Commissioner Manuel Morgan seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried.
