SAN JUAN COUNTY COMMISSION ROOM August 22nd, 2005 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission room at Monticello, Utah. Present: Lynn Stevens, Chairman Bruce Adams, Commissioner Norman L. Johnson, Clerk/Auditor Rick Bailey, San Juan County Administrator Hannah R. Whipple, Deputy Clerk Absent: Manuel Morgan, Vice Chairman A motion to approve the minutes of August 15th, 2005 was made by Commissioner Bruce Adams. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Mrs. Jackie Warren spoke with the Commissioners about human waste flooding onto her property from the septic tank at the Twin Rocks Restaurant in Bluff. She has also filed complaints with Southeast Utah Department of Public Health and the State Division of Water Quality. The county has had the state inspect the septic systems in Bluff, and is waiting for their findings. The Commissioners recommended that she call Dave Cunningham, and request to be on the agenda for the September Southeast Health District Board Meeting. Cyndi Eldredge Personnel Office - New Hires Mrs. Eldredge informed the Commissioners that Kirsten Hendry who was approved for the Blanding Library Assistant position has declined the position. Mrs. Eldredge presented the name of Dianna Nielson for the Blanding Library Assistant, Grade 1, Step 1. Commissioner Bruce Adams made a motion to approve the hiring of Dianna Nielson. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Norman L. Johnson - County Clerk/Auditor Mr. Johnson presented the Commissioners with the Help America Vote Act of 2002 Agreement with the State of Utah for Election Equipment. Norman requested the Commissioners approve the contract, and authorize Commissioner Lynn Stevens to sign the contract while in Salt Lake tomorrow. Commissioner Bruce Adams made a motion to approve the contract. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Evan Lowry - Planning Department Report Mr. Lowry informed the Commissioners about an Open House at the Forest Service Office on August 31st. Mr. Lowry invited the Commissioners to attend an all-day outing on the 8th or 9th of September with the Leadership Team of the Forest Service. Evan requested a signature on the application for the lease of Trust Lands in Indian Creek. Mr. Lowry requested that the refund from last years San Juan Safari be transferred back to the Safari to help with this years events. Commissioner Bruce Adams made a motion for the refund to be transferred back to the Safari. Commissioner Lynn Stevens seconded the motion. None opposed. Rick Bailey, County Administrator Report Mr. Bailey presented to the Commissioners the following building permit: Tom Winder - Family Home - Blanding Commissioner Bruce Adams made a motion to approve the building permit as presented. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Mr. Bailey requested approval and signatures on the contract from BIA for the Red Mesa Road project. Commissioner Bruce Adams made a motion to approve the contract. Mr. Bailey requested signatures on a Quit Claim Deed to U.S. Uranium LTD for San Juan Counties interests in the Mi Vida Mine properties. Mr. Bailey presented the Commissioners with a draft of the State Audit Findings on San Juan County Justice Court for 2004. Mr. Bailey presented the Commissioners with a procurement from the Road Department for a ½ ton high-lift transmission jack for $901.47 from Plateau Equipment. Commissioner Bruce Adams made a motion to approve the procurement. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Mr. Bailey informed the Commissioners that Richard Neff of the Mexican Hat Special Service District has turned in his resignation due to health problems. Mr. Bailey presented the Commissioners with a handout from Mark Walsh on the Severance Tax Legislation for 2006. Open Time: Peggy Humphrey's requested the Commissioners approve the planning grants. Commissioner Bruce Adams made a motion to approve the expenditure. Commissioner Lynn Steven seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Pamela Juliano from Congressman Matheson's office spoke with the Commissioners about the Energy Bill and the effects on San Juan County along with other current issues. Commissioner Lynn Stevens spoke with Pam about the removal of Cedar Mesa from WSA status. Commissioners Report: Commissioner Lynn Stevens will meet with JJ Brown at 8:30A.M. in Senator Hatches office Wednesday morning. Meeting adjourned: 1:00 P.M. Public Hearing: At 6:00 P.M. Commissioner Bruce Adams made a motion to go into a public hearing to receive comments on the proposed County Library Tax Increase. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Lynn Stevens declared the motion carried. Present at the Public Hearing along with Commissioners Bruce Adams and Lynn Stevens was Norman L. Johnson County Clerk/Auditor and seven citizens. Commissioner Lynn Stevens explained to the public the purpose and intent of the hearing was to increase the County Library revenue by $75,000 and asked for those present to speak alternately against and in favor of the proposed Tax. Jarred Rogers: Questioned how the Tax Increase would affect his Tax Bill. Anita Peterson: Expressed opposition to any Tax Increase and expressed her concern over the high percentage of taxes we now pay. She also questioned the equity of Tax burden carried by people in the southern half of the county. She asked about comments made in the December hearing indicating the funds could be taken from other areas within the County Budget. Joella Krall: Stated her support for the Tax Increase and indicated she is an advocate of the libraries and feels the system serves all county residents. She stated she felt the middle class people of the county should be willing to help the less fortunate to have library services. Maryann Lyman: Asked what the new money would be used for as she and many others were on fixed incomes and every dollar counted. She latter stated that she had learned a lot from the hearing and was now in favor of the Tax Increase. Shelly Blake, Library Board Chairman: Told the public what the money would be used for, which included additional books, services, and needed adjustments in staff compensation. Marilyn Lyman: Wondered where we stop in the process of taking from some to give to others, when is enough, and when do we say no more? Norman L. Johnson: Explained the Tax Rate setting process and how the use of reserves figured into County Budget. He pointed out that it has been the historical philosophy of the County to maintain adequate reserves and not go into debt.
