SAN JUAN COUNTY COMMISSION MEETING January 23, 2006 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah Present: Lynn Stevens, Chairman Manuel Morgan, Vice Chairman Bruce Adams, Commissioner Rick Bailey, San Juan County Administer Norman Johnson, San Juan County Clerk/Auditor Dianne Neuss, San Juan County Deputy Clerk Commissioner Manuel Morgan made a motion to approve the minutes of January 17, 2005. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried Lynn Laws- Road Issue The W.W. Clyde Company has requested that they be allowed to haul gravel from Lisbon Valley on County Road 313 using trucks with double trailers. These vehicles would exceed the weight limit for the road but the company will post a bond to cover any damage to the road. Lynn Laws, Road Foreman, David Bronson, Surveyors Office and Walter Bird, Attorney expressed their concerns relating to the excessive weight of the vehicles, road damage, time frame for repairs, liability that may be incurred by the county and the location of truck parking. In addition, there was a question related to the repercussions of not allowing the company the use of the road. Walter will explore the various bonds available that would include all issues of concern, especially the liability issue. Walter will work with Lynn to find out additional information regarding the details of their plans. Rowland Francom - Bookmobile Rowland introduced Chad Barlett who is the new manager of the SJC Bookmobile, as Rowland retired from this position in December 2005. He is working with Chad to help him become familiar with his job responsibilities. He also discussed plans for building a facility in Bluff and suggested that we apply for a grant(s) to support the project. He would be willing to help write the grant and asked if there would be any matching money available from the county. As this funding was not addressed in the budget for 2006, it would need to be explored. Rowland offered to draw up a plan for the purposed building. Since there was $15,000 originally allocated for upgrades to the existing shed, which will not be used, Rowland asked about the possibility of using this money for the Bluff project. The Commission felt the money should be turned back to the Library Board for them to allocate, if it is spent at all. In the meantime, the Bookmobile will either be in the Blanding Library parking lot or the road shed building in Blanding. Because of the computer and satellite, it would be better to have inside parking. It has been suggested we take the Bookmobile to Red Mesa. After consideration, Commissioner Morgan suggested that Rowland and Chad plan to attend the Red Mesa Chapter meeting on February 6th at 5:00 P.M. with him. He thought that they should make a proposal to the Chapter for a resolution and then give the proposal to the Elementary School Administration. Brian Cottam - GOPB - County Resource Management Planning Brian Cottam is from the Governor's Office of Planning and Budget. He is working with the various counties introducing them to the County Resource Management Planning Toolkit. The Kit is intended to help counties with information and resources so that they can better work with public land managers. This toolkit is presently meant to be a supplement to the general plan and is comprised of seven sections. Brian distributed material related to the management plan to the Commission for their perusal and expressed that our county has an above average relationship with agencies. Ben Neilson, of the Planning Office, has been working with Brian and has initially identified three issues of concern to our county. He distributed a draft describing the three issues which are: #1. Community & Economic Impacts of Land Management Agency's Decisions, #2. Positive Economic Growth and Community Development in SJC and #3. Multiple Use. The draft followed the seven sections included in the toolkit. It was noted that the $10,000 planning contract will expire at the end of February. Public Hearing - Elected Official Pay Adjustments At 11:15 A.M. Commissioner Manuel Morgan made a motion to go into public hearing to discuss pay adjustments for elected officials. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried. A public hearing was held in order for the community to voice opinions with regard to including elected officials in any county payroll increases. There was a discussion related to present salaries of elected officials and the county's budget constraints. There was only one member of the public present for the hearing. At 11:30 A.M. Commissioner Bruce Adams made a motion to close the Public Hearing. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Larsen & Company - 2004 Audit Presentation Clyde Jones and Russell Olsen of Larsen & Company presented the Commission with the 2004 Audit. It was noted that the audit was delayed because they did not have information from one of the component units. Mr. Jones said that the audit process went very well and that everyone was very cooperative. He then went over the Basic Financial Statements, explaining the various spreadsheets and fielded questions. Mr. Olsen presented the Independent Auditors Report noting only one finding under internal controls. The Commission expressed their appreciation for the work done. Commissioner Bruce Adams made a motion to accept 2004 Audit report. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Cyndi Eldredge - Personnel Office Cyndi presented the names of two proposed employees for the part time Library Assistant positions at the Blanding library for approval. LaRee Sanchez and Erica Shumway at Grade Step- 1 have been selected by the Library Director. Commissioner Manuel Morgan made a motion to approve the new hiring of LaRee Sanchez and Erica Shumway. Commissioner Bruce Adams seconded the motion. Lynn Stevens declared the motion carried. Howard Randall - Assessor's Office - Tax Abatement Issue Howard received a letter from a woman who wants to acquire the tract of property between two plots of land that she already owns. After discussion, it was determined that the legal process should be followed for the release of the property. Howard and Greg Adams addressed the error in the calculation of property tax on three parcels of land owned by Paul Redd. The issue is related to the land being taken out of greenbelt status and designated as vacant land. The correct tax has been calculated and an approval for an abatement was requested for the incorrect tax assessment. Parcel # 28S25E273603, in the amount of $96.69 Parcel # 29S22E36001 in the amount of $77.80 Parcel # 28S25E217800 in the amount of $830.91 Commissioner Bruce Adams made a motion to grant the tax abatement. Commissioner Manual Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Rick Bailey - SJC Administrator Rick presented four building permits for approval: Luis & Linda Neves - Red Canyon Villa, Wilson Arch, Hwy. 191 - Residence M & M Manufactured Homes - Turkey Trot Estates, Spanish Valley - Well House Malaquias Garcia - Spanish Valley - Garage Bo Zufelt - Spanish Valley - Storage Building/Shed Commissioner Manuel Morgan made a motion to approve the four building permits provided all appropriate signatures are in place. Commissioner Bruce Adams seconded the motion and Commissioner Lynn Stevens declared the motion carried. Rick requested approval for Context Energy Company to lease three parcels of land from the county for oil exploration. The lease is for five years, with a payment of $2,575.00. Commissioner Bruce Adams motioned to approve the request, with the provision that the lease meets all legal requirements. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Cost of Living and Merit Increases for SJC Employees A lengthy discussion and debate took place regarding a cost-of-living increase for county employees. The main difference of opinion related to how the raise should be distributed. Some preferred that everyone receive 2 ½ % of their present rate of pay and others preferred that the total cost of a 2 ½ percent increase for all employees be calculated and distributed equally to the employees. Commissioner Manuel Morgan made a motion to give 2 ½% across the board cost-of-living increase to all SJC employees including elected officials. There being no second, Commissioner Lynn Stevens passed the chair to Commissioner Manuel Morgan and seconded the motion. Commissioner Stevens and Morgan voted in favor of the motion and Commissioner Adams opposed the motion. Commissioner Manuel Morgan declared the motion passed and passed the chair back to Commissioner Stevens. The next issue addressed was a merit increase for San Juan County employees. The consensus was that because the county is over budget it would not be prudent to grant merit increases this year. Commissioner Bruce Adams made a motion not to grant merit increases this year. There not being a second, Commissioner Lynn Stevens passed the chair to Commissioner Manuel Morgan and seconded the motion. Commissioners Stevens and Adams voted in favor of the motion and Commissioner Morgan opposed. Commissioner Manuel Morgan declared the motion carried and passed the chair back to Commissioner Lynn Stevens. Sheriff Mike Lacy asked the Commission to approve equity pay increases for Grayson Redd from Step 191 to 204 and James Myers from Step 183 to 192. It was recommended that Sheriff Lacy review these upgrades with Cyndi Eldredge in the Personnel Office. Commissioner Bruce Adams made a motion to approve the equity changes after review. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Open Time: Greg Martin, Assistant City Manager, asked about the future plan for the SJC Community Economic Development Office. Commissioner Bruce Adams said that the Commission is planning to meet with Chambers and City Councils regarding economic development to determine the direction the county wants to take in this area. After this is determined, they plan to advertise for the position statewide. Melissa Slade has been invited to a meeting of Chapter Officials by Tony Dayish. She said she thought this would be a great opportunity to explain the process the county has in place regarding the road and recreation funds provided to the Chapters. She will encourage the need to plan ahead and take advantage of the funds early in the year, so that the money does not revert back to the general fund. Melissa noted that some Chapters have never utilized the funds. Melissa asked if the Capitol Revitalization Fund is to be used only for capitol projects. The answer is yes, the funds can only be used for capitol projects, although with approval, it can be used to pay outside contractors for work on projects, as in the case of Red Mesa. John Harja was given the list of people on the reservation who needed home repairs and said he would take care of getting the work done. It seems that so far some repairs have been completed. Commission Reports Commissioner's Stevens and Adams attended the UDOT Commission Meeting to address the Hwy. 491 road issue and to weigh in on the Hwy. 6 issue. Commissioner Adams said that he was told that the road construction in Moab will not affect our road funding. Commissioner's Stevens, Adams and Morgan will attend the UAC meeting at the State Capitol on Thursday of this week in addition to UAC Legislative day on Friday. They will also meet with Gordon Walker in conference room #4112 at 3:00 P.M. A meeting is planned for Friday at 10:30 A.M. with the Lieutenant Governor. They also plan to meet with Rod Mills at 8:30 A.M. Friday morning. Commissioner Manuel Morgan attended the AOG Meeting and the School Board Impact Hearing last week. Commissioner Morgan said that Carbon County Building Authority wants to use CIB money to build a State Office building but it was not presented to AOG and this money was not intended to be used for this purpose. The Navajo Council is in session staring today. Commissioner Morgan will attend a meeting in Aneth as well as the SLC BLM Rack meeting on Thursday of this week. Commissioner Bruce Adams will attend the Monticello Chamber Banquet on February 1, 2006. Commissioner Adams also plans to help coordinate a coalition of elected officials from all Utah counties impacted by Hwy. 6 issues to lobby congressional people to upgrade the highway. The big problem is that the cost to upgrade the road will be enormous. He plans to develop a proposal for upgrading the road to four lanes as well as other improvements. Commissioner Morgan commented that someone is running a wreaking business out of a home in San Juan Estates. This is a zoning issue and Commissioner Adams will check into it. Commissioner Morgan advised the Commissioners that the people organizing the Rodeo need to upgrade the fairgrounds in order to accommodate their needs. They estimated that the upgrade will cost around $20,000. It was suggested that the county match up to 25% and the rest of the money could come from the revitalization fund or other sources.
