SAN JUAN COUNTY COMMISSION MEETING March 27, 2006 The regular meeting of the San Juan County Commission was held on March 27, 2006 at 10:00 A.M. in the Commission Room at Monticello, Utah Present: Lynn Stevens, Chairman Bruce Adams, Commissioner Rick Bailey, SJC Administrator Norman Johnson, SJC Clerk/Auditor Dianne F. Neuss, SJC Deputy Clerk Absent: Manuel Morgan, Vice Chairman Commissioner Bruce Adams made a motion to approve the minutes, with corrections, of March 20, 2006. Commissioner Lynn Stevens seconded the motion. Commissioner Lynn Steven declared the motion carried Nelson Yellowman - Chapter Resolution on Alcohol Sales Nelson Yellowman was accompanied by James Black, who is the Oljato Chapter President. Mr. Yellowman presented a Resolution of the Oljato Chapter in support of the request to deny beer licenses to establishments that are within 50 miles of the reservation. He presented two additional letters, one from the Monument Valley High School's parents organization and one from the Student Body Government supporting the issue. He has visited with other Chapters and will continue to visit all Chapters for their support of on the issue. He advised the Commission that there have been several recent incidents of alcohol related deaths and of his determination to make every effort to reduce the problem. Since Mr. Yellowman's last visit, Commissioner Stevens spoke to the State Attorney General as to the legality of denying beer licenses to businesses near the Reservation. Because it would be discriminatory for the County to deny beer licenses to businesses based on their location, it would not be legal. Although the Commission is sympathetic to the issue of alcohol use by minors, it is unable to prohibit alcohol sales because of the location of the business. Commissioner Stevens will take the Resolution to the Attorney General's office in Salt Lake City and ask for a official response. The subject of cross deputization was discussed at length. Commissioner Bruce Adams explained his understanding of what became of the program stating that the communication between the Navajo law enforcement and the SJC Sheriff's office was a problem and eventually it was discontinued. Commissioner Adams called Sheriff Lacy to the meeting to further discuss the issue with Mr. Yellowman and Mr. Black. He also suggested that the issue of cross deputization should be addressed in a meeting with Council Delegates, Chapters and law enforcement to begin the process again and work together on a plan. Mr. Yellowman expressed the concern of President Shirley and First Lady, Vicki Shirley and the efforts they have made to address the alcohol problems and DUI laws on the Navajo Reservation. Sheriff Lacy arrived at the meeting and addressed the question of the cross deputization agreement and what occurred. He said that he is concerned because the County can be held libel but that the Navajo Nation is exempt from any liability incurred. He expressed his frustration with Navajo Law enforcement siting various situations that took place when they were unwilling to cooperate with the Sheriff's office. After discussion, it was decided that the Sheriff would reinstate random roadblocks at the border of the Reservation to help prevent minors from taking beer onto the Reservation and driving under the influence. Commissioner Bruce Adams noted that the Resolution presented along with the two letters of request for help from Monument Valley High School, would serve as a the request for help from the Sheriff's office and asked Mr. Yellowman and Mr. Black to inform all concerned parties as well, including the high school regarding the plan. Commissioner Bruce Adams will attend the Oljato Chapter Meeting this Sunday and asked that Sheriff Lacy attend if at all possible. It will take place at 10:00 a.m. Greg Martin, Assistant Monticello City Manager Greg reported the results of last Friday's meeting with the other partners who are involved with the Monticello Visitor Center. The BLM agreed to fund an additional $1,000 for staffing the visiting center. It was decided that for the time being, with the help of the additional grant funds from Economic Development, Option #3 will be implemented. The hope is to try and obtain additional money from State agencies and to possibility change the name of the Center to the "Southeast Utah Welcome Center"to encourage additional funding through grants and other sources in the Southeast. The plan is to work toward getting enough funding to go to Option #2. In the meantime, Commissioner Stevens suggested opening on Tuesday, during the busiest times and closing on Tuesday at the beginning and end of the season. Commissioner Stevens will check on additional funds at the State level. Commissioner Bruce Adams made a motion to approve the additional funding from the Economic Development office increasing our contribution by $8,745.40 to meet the Option #3 budget. Commissioner Lynn Stevens seconded the motion. Commissioner Lynn Stevens declared the motion passed. Greg discussed the Memorial Day event plans and has put together a tentative agenda for the celebration. Commissioner Lynn Stevens said that Adjutant General Brian Tarbet will fly into Monticello to participate in the program and will give a speech. Since General Tarbet is over the Air National Guard, Commissioner Stevens will try and coordinate a possible fly-over if it is not too costly. Greg said that he has arranged for the Flag Ceremony and spoke with Sgt. Ben Crane to arrange heavy equipment on site, a 21 gun salute and taps to be played. He will continue to update the Commission and coordinate the event. Evan Lowry - Planning Office Evan will meet with the Monticello BLM tomorrow at 2:00 p.m. to discuss the Recapture Trail and other BLM issues. Evan will meet with the Moab BLM on Friday of next week to discuss the Resource Management Plan and the social economic impact. The Forest Service will hold an open house on April 6th from 3 to 9 p.m. in the Monticello District Office. Another Forest Service open house will take place in Moab on April 7, 2006. Evan reported that the Richfield meeting was productive. He provided the Forest Service/Wilderness information regarding undeveloped roadless areas in the County to Commissioner Stevens who will deliver the information to the State Office. The Bayles Ranch road issue was discussed and Evan presented several possible options to resolve the problem. Rick Bailey - SJC Administrator Rick received two bids for the disassembling of the existing metal fire building and the removal of concrete footings and other building materials at Mexican Hat. Rick was unsure of the time frame for obtaining land for the new facility so that Alternatives one and two may not go forward until a later date. Aces & Eights Construction Co., Blanding and Economy Contracting of Monticello submitted bids. The bid from Economy Contracting was the low bid in all categories. Commissioner Bruce Adams made a motion to approve the low bid from Economy Construction in the amount of $11,400 for disassembly of the building, $20,200 for Alternative Bid One and $7,450 for Alternative Bid Two. Commissioner Lynn Stevens seconded the motion. Commissioner Lynn Stevens declared the motion carried. Rick reported that Bill Howell would like to build a permanent Weatherization Building in Mexican Hat with room for an election area. Lynn Laws would also like to keep the Grader on the property. The proposed property for the facilities will be leased from the BLM, with an option to purchase. Commissioner Stevens suggested that a 10 year lease be pursued. It was noted that the sale would need to be approved at the congressional level. Rick presented an Oil and Gas lease for approval from The Context Energy Company, Denver, CO. The request is to lease 102.025 acres for 5 years at $2,550.63 with a 12 ½% royalty. Commissioner Bruce Adams made motion to approve the Oil and Gas lease. Commissioner Lynn Stevens seconded the motion. Commissioner Lynn Stevens declared the motion carried. Rick presented a agreement for signature for an annual financial stipend of $6,500 from the Utah Division of Comprehensive Emergency Management. Rick asked the Commission if they would like to proceed in providing Scales as planned for the 4H Club. The Commission asked Rick to go forward. The vehicle that was planned to go to Jim Keys from the Monticello Road Department was not available so Rick will investigate getting another vehicle from the Road Department if possible. Rick informed the Commission that the money for the Navajo bus route was appropriated in the amount of $516,580 for 2005 and 2006 with deductions for UDOT administrative handling as well as other deductions. The application to the CIB for the LaSal Senior Center was discussed along with the need to hold a Public Hearing. The Hearing is set for April 24th at noon. Members of the State National Resource Council will visit San Juan County for three days starting on Sunday, April 30th. Mike Dmitrich and Brad King will be invited. Commissioner Lynn Stevens will provide dinner at his home. Sunday evening they will view the "Hole in the Rock" video and Monday morning they will take a bus tour. On Tuesday, lunch will be provided at Dead Horse Point. The Commission will not hold a Commission meeting the week of May 1,2006. Rick discussed the road work being done on Hwy 491. He said that he has spoken to Dal Hawks and that if the County wants the job done right, the length of the project will have to be shortened. Rick will write a letter to Dal letting him know that we want the project completed with 8 foot paved shoulders. The remainder of the job will be done at a later date when it can be funded. SITLA is planning to do a survey and possibly build another road at the bottom of Blue Hill to tie in with the LaSal Loop Road. The Navajo Mountain water system was discussed and it was thought that a supplemental water tank is needed because the spring provides more water than one tank can hold. Rick will attend a meeting on Thursday in Kayenta with all concerned agencies to further discuss the project. Rick gave the Commission a letter disclosing a potential "conflict of interest" if the County builds a reservoir in the Spring Creek and North Creek drainages. His family has private property and receives water from these drainages. Norman Johnson - SJC Clerk/Auditor Norman presented a Beer License renewal for approval from Susan E. Doran - Cow Canyon Trading Post - Bluff, Utah Commissioner Bruce Adams made a motion to approve the beer license renewal. Commissioner Lynn Stevens seconded to motion. Commissioner Lynn Stevens declared the motion carried. Open Time and Other Business Greg Martin asked if the work on 491 within Monticello City limits includes work on lighting and sidewalks. Rick advised Greg that he should write a letter requesting the City's needs and provide Greg with names of contact persons. Greg also asked if the Commission had made any decisions relating to the AGRC's digital imagery presentation made a few weeks ago. After further investigation the Commission decided that it would not be cost effective. Commissioner Lynn Stevens stated that the Hart Point Road lawsuit regarding road ownership was dropped with prejudice on March 21st, 2006 and all charges were dismissed. Commissioner Bruce Adams requested that the advertised Weed Position be run for another week. Commissioner Adams met with John Lewis of Wilderness Quest. They plan to expand their wireless internet and cell phone service and offered to include schools and others in their program. The cost saving would be significant (50%) less than Frontier. Commissioner Adams stated that he delivered a map and grant application to the department of Natural Resources concerning the Spring Creek Dam project. Commissioner's Reports Commissioner Stevens said that he will attend the Independent Petroleum Association of the Mountain States (IPAMS) meeting in Vernal tomorrow hosting a number of companies. The meeting will address exploration and applications for drilling. He will be in Salt Lake City Wednesday, Thursday and possibly Friday of this week. Commissioner Bruce Adams will be in the County all week. He will attend the Health Board Meeting at 5:00 p.m. tomorrow.
